Discipline of Special Education Students

Any disciplinary action regarding a student with disabilities that would constitute a change in placement under federal law may only occur after a manifestation determination review has been conducted by the student's admission, review, and dismissal committee. All disciplinary actions regarding a student with a
disability who receives special education services shall be determined in accordance with federal law and regulations, including the provision of functional behavioral assessments; positive behavioral interventions, strategies, and supports; behavioral intervention plans; and the manifestation determination review. A teacher in a disciplinary alternative education program who has a special education assignment must hold an appropriate certificate or permit for that assignment.
