AZBecame law without governor's signature 06/2002P-12Establishes moratorium from November 30, 2002 until June 30, 2004 on creation of new joint technological education districts unless specified requirements are met. Also bans districts from joining existing joint technological education districts between effective date of this act and June 30, 2004, unless specified criteria are met. Limits average daily membership of new joint technological education districts (meeting specified requirements) to 450 students during first two years of operation. AZBecame law without governor's signature 06/2002P-12Requires that school building inspection carried out by school facilities board every five years ensure compliance wtih routine preventative maintenance guidelines as established in code. Requires school facilities board to randomly select 20 districts every 30 months for inspection. As of August 15, 2004, requires school facilities board to report to the joint committee on capital revenue the amounts required for the building renewal fund and new school facilities fund for the state schools for deaf and the blind for the succeeding two fiscal years, which amounts must be incorporated in any request for building renewal and new school facilities funds. Mandates that by October 15 each year, the school facilities board submit for review to the joint committee on capital review demographic assumptions, projected construction schedule and new school construction cost estimates for coming fiscal year. Requires every district to develop routine preventative maintenance guidelines for its facilities by October 1, 2002, which must be submitted to the school facilities board for analysis and approval by February 1, 2003. If school facilities board deems district facility inadequately maintained pursuant to district's routine preventative maintenance guidelines, district must use building renewal funds to bring facility into compliance with district's routine preventative maintenance guidelines. COSigned into law 06/2002P-12Expands inquiry process at nonpublic schools from applicants to include employees of such schools. If nonpublic school employee is subject of inquiry, he/she must submit a complete set of his/her fingerprints to the governing board of the school. Requires department to forward nonpublic school employee fingerprints to state bureau of investigation for completion of state and national criminal history record check. Department is designated as authorized agency to receive and disseminate information concerning the results of a national criminal background check of nonpublic school employee, and department must inform the governing board whether the background check has confirmed any conviction, plea of no contest, deferred sentence or deferred prosecution. Expands requirement beyond misdemeanor to add that when there is good cause to believe a nonlicensed staff member of a school district has been convicted of a felony or misdemeanor other than a misdemeanor traffic offense or traffic infraction, the district must require such person to provide the district with a complete set of his/her fingerprints within 20 days of receipt of written notification from the district. Eliminates phrase that this requirement shall apply to only those personnel employed by the district since January 1, 1991. FLSigned into law 05/2002P-12According to state legislative summary, "To ensure that educational facilities information used by the legislature is accurate, [section] is amended to provide that the department is to conduct an on-site review of a statistically valid sample of 5% of the facilities reported to the Florida Inventory of School Houses [FISH] by each school district. If the information provided by the district is less than 95% accurate, the district must submit revised and corrected data to the FISH. If the district fails to submit corrected data that is at least 95% accurate within one year from the date of notification by the department, the commissioner of education may exercise discretion of withholding future state fixed capital outlay funds until such time as the district submits corrected information; [section] is amended to provide that the department is to conduct an in-depth analyses [sic] each year of a representative sample of five school districts selected from among the districts with surveys showing the largest need-to-revenue ratio based on the five-year fixed capital outlay revenue projection. If the districts survey does not accurately project its facilities needs it must revise its survey. If a district fails to revise its survey to accurately project its facility needs the commissioner may exercise discretion of withholding future state fixed capital outlay funds until such time as the district corrects its survey." Requires local board to conduct appropriate due diligence including all appropriate inquiry into the use of property before building a K-12 school on the site. If contaminants are found at levels that pose a threat to human health or the environment, the board must undertake appropriate site rehabilitation before beginning construction on the school site. FLSigned into law 05/2002P-12Eliminates date for purgation of certain relocatable classrooms and establishes system by which districts may obtain permission to continue using relocatables as classrooms within the five-year work program. Plan to use existing relocatable facilities must be evaluated and approved by state commissioner by January 1, 2003. According to legislative summary, "Relocatables that do not meet state standards at the end of the work program may no longer be used as classrooms. This does not negate the statutory requirement that relocatable classrooms over 20 years of age that were used as classrooms during the FY 1998-99 must be removed from service by July 1, 2003." To reduce the anonymity of students in large schools, encourages local boards to adopt policies to encourage any school that does not meet the definition of a small school to subdivide into schools-within-a-school. Beginnning July 1, 2003, all plans for new educational facilities to be constructed within a district and reflected in the 5-year school district facilities work plan must be plans for small schools in order to promote increased learning and more effective use of school facilities. Small schools are defined as 500 or under for elementaries; at or under 700 for K-8: 700 or under for middle schools; and 900 or less for high schools. Section 1011.76 creates the Small School District Stabilization Program to assist school districts in rural communities that document economic conditions or other significant community influences that negatively impact the school district. The purpose of the program is to provide technical assistance and financial support to maintain the stability of the educational program in the school district. A rural community means a county with a population of 75,000 or less; or a county with a population of 100,000 or less that is contiguous to a county with a population of 75,000 or less.In order to participate in this program, a school district must be located in a rural area of critical economic concern designated by the Executive Office of the Governor and the district school board must submit a resolution to the Office of Tourism, Trade, and Economic Development requesting participation in the program. http://www.leg.state.fl.us/data/session/2002E/Senate/bills/billtext/pdf/s0020Eer.pdf

KSSigned into law 03/2002P-12Allows any school district to close any of its school buildings at any time the district's board of education finds that the building should be closed to improve the school system of the district. Currently, districts must follow certain procedures, such as adopting a plan, notifying the public, and conducting public hearings. The bill also makes the statutes on this issue uniform for all school districts.

Community College
A learning center district may be established in a school district or community college district upon adoption of a resolution by the local school board or community college board calling for establishment of a district and a showing of need for such a district. A district may also be established to include more than one school district and, in that case, the two or more local school boards shall jointly adopt a resolution and determine the need for a learning center. A district may also be established by a board of county commissioners upon adoption of a resolution by the board of county commissioners calling for establishment of a district and a showing of need for such a district; provided that each community college board or local school board located wholly or partially within the county shall approve of the establishment prior to the adoption of the resolution. The boundaries of the district shall be coterminous with the boundaries of the school district, community college district, combined school districts or county constituting the district. No district shall be established without the written approval of the commission.
