Establishes $200 million per fiscal year as the maximum amount for which school facilities board may enter into lease-to-own transactions. Requires that school facilities board ensure that deficiencies in the facilities for these schools are assessed by December 31, 2002. See Section 52: http://www.azleg.state.az.us/legtext/45leg/2r/bills/hb2710c.htm Title: Omnibus--H.B. 2710 Source: http://www.azleg.state.az.us AZ Became law without governor's signature 06/2002 P-12 Requires that school building inspection carried out by school facilities board every five years ensure compliance wtih routine preventative maintenance guidelines as established in code. Requires school facilities board to randomly select 20 districts every 30 months for inspection. As of August 15, 2004, requires school facilities board to report to the joint committee on capital revenue the amounts required for the building renewal fund and new school facilities fund for the state schools for deaf and the blind for the succeeding two fiscal years, which amounts must be incorporated in any request for building renewal and new school facilities funds. Mandates that by October 15 each year, the school facilities board submit for review to the joint committee on capital review demographic assumptions, projected construction schedule and new school construction cost estimates for coming fiscal year. Requires every district to develop routine preventative maintenance guidelines for its facilities by October 1, 2002, which must be submitted to the school facilities board for analysis and approval by February 1, 2003. If school facilities board deems district facility inadequately maintained pursuant to district's routine preventative maintenance guidelines, district must use building renewal funds to bring facility into compliance with district's routine preventative maintenance guidelines. Allows school facilities board to transfer monies between specified facilities funds under enumerated circumstances. http://www.azleg.state.az.us/legtext/45leg/2r/bills/hb2710c.htm Title: Omnibus--H.B. 2710 Source: http://www.azleg.state.az.us AZ Became law without governor's signature 06/2002 P-12 Makes addition to subsection forbidding local board to reduce pupil square footage when such action would cause the district to fall below minimum adequate gross square footage requirements without written permission of school facilities board. Addition specifies that reduction includes a reconfiguration of grades resulting in reduction of pupil square footage of any grade level, but that this subsection does not apply to a maximum of one-year reconfiguration of grades to accommodate new school construction. http://www.azleg.state.az.us/legtext/45leg/2r/bills/hb2710c.htm Title: Omnibus--H.B. 2710 Source: www.azleg.state.az.us AZ Became law without governor's signature 06/2002 P-12 Estabishes specific circumstances under which excess square footage in new construction may not be included in the gross square footage. Also mandates that school facilities board, in measuring square footage per pupil requirements, demand that excess square footage constructed after July 1, 2002 and that is not excluded under above circumstances meet minimum school facility adequacy guidelines to be eligible to receive building renewal funds. Fire officials are to provide written notice to schedule times for fire safety checks. No more than 2 routine inspections may be made in a calendar year. Nothing in this section should be construed to prohibit a local fire department, fire protection district, or the Office of the State Fire Marshal from conducting a fire safety check in a public school. Upon being notified by a fire official that corrective action must be taken to resolve a violation, the school board must take corrective action within one year. However, violations that present imminent danger must be addressed immediately. The notice must include the reasons for the proposed closure, and must be held at least thirty days before voting in a public meeting to close the school. This paragraph does not apply if the facility is being closed because it endangers student or employee health or safety. http://www.azleg.state.az.us/legtext/45leg/2r/laws/0316.htm Title: S.B. 1180 Source: www.azleg.state.az.us FL Signed into law 05/2002 P-12 According to state legislative summary, "To ensure that educational facilities information used by the legislature is accurate, [section] is amended to provide that the department is to conduct an on-site review of a statistically valid sample of 5% of the facilities reported to the Florida Inventory of School Houses [FISH] by each school district. If the information provided by the district is less than 95% accurate, the district must submit revised and corrected data to the FISH. If the district fails to submit corrected data that is at least 95% accurate within one year from the date of notification by the department, the commissioner of education may exercise discretion of withholding future state fixed capital outlay funds until such time as the district submits corrected information; [section] is amended to provide that the department is to conduct an in-depth analyses [sic] each year of a representative sample of five school districts selected from among the districts with surveys showing the largest need-to-revenue ratio based on the five-year fixed capital outlay revenue projection. If the districts survey does not accurately project its facilities needs it must revise its survey. If a district fails to revise its survey to accurately project its facility needs the commissioner may exercise discretion of withholding future state fixed capital outlay funds until such time as the district corrects its survey." Community College According to state legislative summary, "Clarifies that school district, community college and university facilities are to comply with the 'appropriate' sections of the Florida Building Code. See bill section 837, page 1550, line 22 ff. Also according to state legislative summary, "Exempts charter schools from building permit fees, etc." See bill section 859, page 1577, line 10 ff: http://www.leg.state.fl.us/data/session/2002E/Senate/bills/billtext/pdf/s0020Eer.pdf Title: S.B. 20E Source: http://www.leg.state.fl.us FL Signed into law 05/2002 P-12 New section forbids building of K-12 school on or adjacent to known contaminated site unless action has been taken to ascertain that students will not have contact with air, water or soil contaminants at a level that poses a threat to human health or the environment. Requires local board to conduct appropriate due diligence including all appropriate inquiry into the use of property before building a K-12 school on the site. If contaminants are found at levels that pose a threat to human health or the environment, the board must undertake appropriate site rehabilitation before beginning construction on the school site. Plan to use existing relocatable facilities must be evaluated and approved by state commissioner by January 1, 2003. According to legislative summary, "Relocatables that do not meet state standards at the end of the work program may no longer be used as classrooms. This does not negate the statutory requirement that relocatable classrooms over 20 years of age that were used as classrooms during the FY 1998-99 must be removed from service by July 1, 2003."
