GASigned into law 07/2002Postsec.A BILL to amend Chapters 3 and 4 of Title 20 of the Official Code of Georgia Annotated, relating respectively to postsecondary education and vocational, technical, and adult education, so as to provide that each publisher of a textbook shall provide an electronic format of such textbook; and for other purposes.

States that colleges and universities in this state have made diligent efforts to accommodate the needs of students with disabilities requiring alternative formats for textbooks and other printed instructional materials used in postsecondary courses of study, but that colleges and universities are confronted with many practical problems in obtaining or producing these texts in alternative formats. Practical problems in obtaining these texts in alternative formats include the wide variety of texts used in postsecondary courses of study, a lack of bargaining power with publishers of postsecondary textbooks in comparison with publishers of textbooks for elementary and secondary education, and hesitation among postsecondary institutions to share alternative formats because of concern about copyright law. Practical problems in producing such materials in alternative formats include the labor intensive and technical nature of the work, the frequent need for expertise in the subject matter of the texts, and the expense and time required for production. The General Assembly further finds that students with disabilities, colleges, universities, and publishers would benefit from cooperative development of a system for sharing those texts produced in alternative formats while adequately protecting the intellectual property rights of publishers. IASigned into law 04/2002P-12Adds one nonvoting student member to state board, making total board membership 10, provides for application process and appointment of student member. Also requires school districts and nonpublic schools to report number of ninth graders who do not graduate from the school or school district, as well as the number of students who are tested on multiple assessment measures to determine student achievement levels, and the percentage of students who are so tested annually. Requires the board to develop and adopt uniform definitions consistent with the federal No Child Left Behind Act of 2001 and any federal regulations adopted pursuant to the federal Act. Permits department to conduct school site visits of accredited schools and districts on as-needed basis. Addresses conditions of employment of Superintendent staff. Addresses procedures in open enrollment law. Renders provision of school breakfast programs optional rather than mandatory. Modifies section addressing parental reimbursement for nonpublic school pupil transportation. Regulates the provision of textbooks to students in accredited nonpublic schools. Modifies requirements for school bus drivers' licenses. NESigned into law 04/2002P-12The bill, as amended, includes the contents of LB 1250. LB 1250 requires a publisher or manufacturer to provide a computer file or
electronic versions of each textbook that is purchased from the vendor. The vendor must also allow the school or ESU the right to
transcribe, reproduce, modify and distribute each textbook purchased in Braille or large-print if other specialized materials are not
provided by the vendor for use by students who are blind or visually impaired. Vendors are required to reimburse a school or ESU for
the cost of creating computer files or electronic versions, if they are not furnished upon request.
