CASigned into law 09/2004P-12Makes it an infraction to drive a schoolbus or a transit vehicle while using a wireless telephone. Provides that this prohibition does not
apply to a driver who is using the wireless telephone for work-related purposes, or for emergency purposes, including, but not limited to, an emergency call to a law enforcement agency, health care provider, fire department, or other emergency service agency or entity. Specifies that a violation of this new offense does not constitute a serious traffic violation for purposes of the commercial motor vehicle safety program.

DERule Adoption 09/2004P-12Amends regulation by adding a new section that includes the responsibilities of non-public, non- profit schools for the administration of their transportation systems under the rules and regulations of the Department of Education. MOTo governor 05/2004P-12Allows for the adoption of emergency preparedness plans for the use during natural disasters or other community emergencies by school districts.

1. The board of education of each school district in this state is authorized to adopt an emergency preparedness plan to address the use of school resources, including school facilities, commodity foods, school buses, and equipment if a natural disaster or other community emergency occurs.
            2. The emergency preparedness plan may authorize the superintendent or other designated school officials to approve use of school resources to provide relief to the community if an emergency occurs.
            3. Food assistance may be provided using commodities distributed by the United States Department of Agriculture consistent with the standards for emergency congregate feeding under such program.
            4. The use of school resources under this section shall be subject to review by the board of education within thirty days of authorization or as soon as reasonably possible.

SDAdopted, On November 2004 Ballot 02/2004P-12Proposing and submitting to the electors at the next general election amendments to Article VIII of the Constitution of the State of South Dakota to authorize the provision of certain services to all children of school age. The Constitution allows the Legislature to authorize the loan of nonsectarian textbooks to children of school age, including those attending sectarian schools. This amendment would also allow the Legislature to authorize participation in food and transportation services for children of school age, including those attending sectarian schools.
