CAVetoed 09/2004P-12Requires the principal of a school to take immediate steps to seek the consent of the parent or guardian of an elementary school pupil prior to making the pupil available to a peace officer for questioning. Prohibits making the pupil available for questioning if the parent or guardian requests that the pupil not be questioned until he or she can be present. Permits a member of administration, school counselor or teacher selected by the pupil to be present. Provides exceptions. Also requires the principal, prior to making a minor high school pupil available for questioning by a peace officer, to inform the pupil of the pupil's right to have a person, as prescribed, present during the questioning. CAVetoed 09/2004P-12Prohibits a school district governing board from denying a charter school petition, unless it makes findings that the petition lacks a description of the procedures by which a pupil may be subject to discipline and the procedure employed by the school to safeguard the due process rights of pupils and unless it makes findings showing a lack of compliance with the Ralph M. Brown Act. Provides that charter schools are subject to the open meeting requirement of the Ralph M. Brown Act. Prohibits a charter school from expelling a pupil based solely on his or her academic performance. Requires a charter school to notify the governing board of the school district of residence and the county superintendent of schools within 14 days if a pupil is expelled and to notify the governing board of the school district of residence within 14 days of the last day the pupil attended school if a pupil leaves the charter school without graduating or completing the school year for any reason. CASigned into law 08/2004P-12Extends the repeal date of the Leroy Greene California Assessment of Academic Achievement Act to January 1, 2011. Excludes testing students in grade 2 effective July 1, 2007. Permits the release of a pupils record of accomplishment and the results of achievement tests to postsecondary education institutions, upon the request of a pupil or his or her parent or guardian. Expands the law that prohibits any program for of specific preparation of pupils for that statewide assessment program or a particular test to include charter schools; exempts instructional materials provided by the state department of education if the materials are embedded in an instructional program to improve student learning. Requires the department of education to develop and implement primary language assessments aligned with state academic content standards. Provides that the achievement test to be administered to pupils in grades 3 and 8, instead, be administered in grades 3 and 7. KYSigned into law 04/2004P-12Eliminates the requirement that the principal of a public school be notified when a child is found guilty of an offense that classifies the child as a youthful offender (maintains existing notification requirement for private school principals). Adds that local superintendent be notified when child enrolled in district is identified as youthful offender or violent offender; requires the local superintendent to notify the child's principal of such identification. Requires local superintendent to be identified within 24 hours when a petition is filed against a child enrolled in district or an enrolled child has been found guilty of an offense that would be a felony or misdemeanor if committed by an adult. Specifies that if the petition is dismissed, all school or district records of the incident or notification must be destroyed, and may not be included in the child's school records. Adds that a child's counselor must be notified by the school principal when the child has been found guilty of offenses identifying him or her as youthful offender, violent offender or an offense that would be a felony or misdemeanor if committed by an adult. Principal of student found guilty or expelled for such an offense must provide, prior to student's admission to any school, a sworn statement that the child has been found guilty of such an offense within 5 working days of student's request for enrollment in new school.

VASigned into law 04/2004P-12Reporting of certain acts by school authorities to law enforcement. Expands the enumerated activities that school principals must report to local law enforcement by providing that reportable offenses involving "firearms" on school property address any weapon prohibited on school property or at a school-sponsored activity pursuant to § 18.2-308.1, as well as (i) any weapon, including a starter gun, that will, or is designed or may readily be converted to, expel single or multiple projectiles by the action of an explosion of a combustible material; (ii) the frame or receiver of any such weapon; (iii) any firearm muffler or firearm silencer; or (iv) any destructive device. "Firearm" shall not include any weapon in which ammunition may be discharged by pneumatic pressure. VASigned into law 04/2004P-12Directs local school boards to notify parents of the educational rights of students who fail to graduate or who have failed to achieve the number of verified units of credit required for graduation as provided in the standards of accreditation or who have been identified as having limited English proficiency or who have been identified as disabled and receive special education of their right to a free public education through age 21. Pursuant to §§ 22.1-1 and 22.1-5, public schools are free to "persons of school age" (at least age five on or before September 30 of the school year and under 20 years of age on or before August 1). In addition, subsection D of § 22.1-5 sets forth for students for whom English is a second language the opportunity for a free public education through the age of 21.
