MSSigned into law 05/2004P-12Clarifies that assistant teachers will receive the same number of sick days as licensed teachers. In addition, under the donation of leave provision for school employees, the definition of catastrophic illness was amended to conform to the same definition as is provided in law for state employees in order to provide a uniform definition of catastrophic illness. Also, the bill clarifies several important points as it relates to PERS administration of school leave provisions and the way they impact the retirement allowance. First, the bill clarifies that that payment for up to 30 days of unused leave may only be made upon retirement. Second, it clarifies that "vacation" leave is the same as "personal" leave. And third, it clarifies that unused vacation or personal leave accumulated by licensed employees in excess of the maximum five (5) days which may be carried over from one (1) year to the next may be converted to sick leave not to exceed the conversion of ten (10) days of personal or vacation leave days to sick days per year. In the case of unused vacation or personal leave accumulated by nonlicensed employees, no more than ten (10) days of unused personal or vacation leave may be converted to sick leave per year. Any personal or vacation leave previously converted to sick leave under a lawfully adopted policy before the effective date of Senate Bill No. 2297, 2004 Regular Session, shall be recognized as accrued leave by the local school district and available for use by the employee. The leave converted under a lawfully adopted policy may be certified to the Public Employees' Retirement System upon termination of employment and any such leave previously converted and certified to the Public Employees' Retirement System shall be recognized.
