Community College
Proposes an amendment (amendment C) to the Constitution to authorize the creation of permanent funds for two purposes: First, higher education scholarships, which include the current Hathaway scholarship program; and second, improving the quality of higher education. The principal in the funds, regardless of the source of the funds, cannot be expended. The earnings must be used for the purposes specified and the legislature is authorized to regulate how the earnings are used. Earnings from funds in the current Hathaway student scholarship account are intended to be used for college scholarships. Amends the Federal Student Aid Program regulations to implement the changes to the Higher Education Act of 1965, as amended (HEA), resulting from the Higher Education Reconciliation Act of 2005 (HERA), Public Law No. 109–171, and other recently enacted legislation.
The regulations reflect the provisions of the HERA that affect students, borrowers and program participants in the Federal student aid

Community College
Extends residency for purposes of in-state tuition eligibility at community colleges for immigrants and certain nonimmigrants and their dependents who possess a valid visa from the U.S. Citizenship and Immigration Services with a classification of Temporary Workers or Intracompany Transferee and are eligible for education. Eligibility for consideration will be based on the privileges and limitations of the visa held by the applicant. Also, extends residency for in-state tuition eligibility to active Wyoming National Guard members and U.S. Armed Forces members stationed in Wyoming, and their dependents, as well as members of the U.S. Armed Forces who move to Wyoming within 12 months from the date of honorable discharge from the service. Establishes the Steps for Attaining Higher Education through Academic Development (Illinois Steps AHEAD) program as the state's GEAR UP program, housed in the Department of Human Services to provide educational services and post-secondary educational scholarships for low-income middle and high school students. Requires program components to include increased parent involvement, creative and engaging academic support for students, career exploration programs, college preparation, and increased collaboration with local schools.

Provides that the Department shall implement the program only if federal funding is made available. Creates the Gaining Early Awareness and Readiness for Undergraduate Programs Fund in the state treasury.

Establishes Assets for Independence Program. Provides that purpose of program is to allow eligible low-income Illinois citizens, subject to the availability of state and federal funds and authorization from the department, to open and maintain an Individual Development Account (IDA) at a federally insured financial institution. Provides that deposits into an IDA that are used for subsequent qualified purchases shall be matched dollar-for-dollar by moneys from the Assets for Independence Fund. Includes payment of post-secondary education expenses, if the expenses are paid directly to an eligible educational institution, as one of three possible qualified asset purchases using moneys from an IDA.

Establishes the low-income family postsecondary savings accounts incentive program as a three-year pilot program to encourage qualified individuals and families to establish family postsecondary savings accounts. Defines qualified individuals and families as Kansas residents whose household income is not more than 200% of the federal poverty level at the time of application. Provides that the amount of contributions made to an account by a participant will be matched by the state on a dollar-for-dollar basis, up to $600, if the participant contributes at least $100 in each calendar year in which the account is open. Relates to higher education. Creates a commission to develop the next generation initiative to encourage Vermonters to live and work in Vermont. Proposes the commission consider a broad range of ideas to meet this goal, including:
(1)  Strategies to ensure that postsecondary education is accessible and affordable for all Vermonters through grants, loans, and scholarships, and that funds flow directly to students and their families.
(2)  Options such as loan forgiveness, tax incentives, loan repayments, and leveraging federal resources.
(3)  The integration, where appropriate, of Vermont's secondary and postsecondary workforce training programs with Vermont's postsecondary institutions.   
(4)  The use of strategic investments in Vermont's postsecondary education system to:
(A)  increase the postsecondary aspiration, continuation, retention, and completion rates of Vermonters;
(B)  stimulate specific economic sectors which are particularly appropriate for or unique to Vermont; and
(C)  serve critical marketplace needs.

Requires the plan to include a funding level for implementation, identify a funding source, and include a system for overseeing use of the funds. Makes an appropriation for college scholarships.

This bill attempts to modify and strengthen the Brown v. Board of Education Scholarship Program and Fund to accomplish the purposes of the program more effectively and efficiently. This bill enhances and increases educational opportunities for eligible persons by adding certain
career and technical education postsecondary schools in the Commonwealth and the College-Level Examination Program (CLEP) to the list of approved education programs in which recipients may enroll. This bill also (i) provides that awards may be used to cover the costs of textbooks for approved education programs; (ii) clarifies the duration of awards for career and technical education and training programs, and CLEP; (iii) authorizes the Brown v. Board of Education Scholarship Awards Committee to determine approved education programs to preserve the purpose for which the program was created; (iv) exempts scholastic records, personally identifiable information, scholarship applications, confidential letters and statements, and certain other related information pertaining to applicants and recipients of scholarships awarded by the Brown v. Board of Education Scholarship Awards Committee, and deliberations of the Committee relating to the review and consideration of awards, scholarship renewal, setting the annual maximum scholarship award, and the cancellation, rescindment, or recovery of awards from FOIA; (v) provides definitions; (vi) authorizes the awards committee to cancel, rescind, and recover awards; (vii) allows students to take courses of a religious or theological nature to satisfy undergraduate elective requirements for a liberal arts nonreligious degree; (viii) requires
applicants to sign acceptance forms, affirming the submitted information and agreeing to pursue the education program for which the award was given to its completion; (ix) establishes criteria for the renewal of awards; (x) requires education agencies to credit promptly student accounts after awards have been disbursed; and (xi) makes certain technical amendments. In addition, the second and third enactment clauses of Chapter 753 and Chapter 834 of the 2005 Acts of Assembly are repealed. The second enactment clause of these chapters permitted students enrolled in approved education programs upon the expiration of the program to complete their course of study. The third enactment clauses of these chapters provided that the State Council of Higher Education must review and approve the application for renewal of scholarship awards to students who were enrolled in approved education programs upon the expiration of the program.

Provides that, beginning in 2006, the department shall have the authority to allow up to 50 youth reaching age 18 to continue in foster care or group care as needed to participate in or complete a post-high school academic or vocational program, and to receive necessary support and transition services. Provides that, in 2007 and 2008, the department has the authority to allow up to 50 additional youth per year
reaching age 18 to remain in foster care or group care as provided in this act. Declares that a youth who remains eligible for such placement and services pursuant to department rules may continue in foster care or group care until the youth reaches his or her 21st birthday. Provides that, beginning in July 2008, and subject to the approval of its governing board, the Washington state institute for public policy shall conduct a study measuring the outcomes for foster youth who have received continued support pursuant to RCW 74.13.031(10). The study should include measurements of any savings to the state and local government. The institute shall issue a report containing its preliminary findings to the legislature by December 1, 2008, and a final report by December 1, 2009.

Governor Bush signed Executive Order 06-05 creating the Access and Diversity Commission. The 17-member commission, set to complete their duties on June 30, 2006, will work with the Florida Board of Governors to evaluate the issues surrounding minority enrollment and advocate for the following recommendations: a) need-based financial aid; b) first generation matching grants: c) College Board partnership: d) STARS scholarship program; e) college outreach program; and f) a mentoring partnership program.
