NYSigned into law 10/2008P-12Creates new part III (sections 2050 through 2054) of article 41 of the education code. Provides that a lawyer may not simultaneously be an independent contractor and an employee of a district or board of cooperative educational services (BOCES). Provides that a lawyer who is not an employee of a district or BOCES may not seek to be or be considered an employee for purposes of compensation, health insurance, pension and all other employment-related benefits. Provides that any lawyer who violates these provisions is liable for a civil penalty of up to three times the charges and fees for contracted services or salary the lawyer received from the district or BOCES for legal services, and may be enjoined from continuing such violation. Provides that any lawyer who knowingly (1) seeks to be or is considered an employee for purposes of compensation, health insurance, pension and all other employment-related benefits or (2) falsifies or permits to be falsified retirement system records to obtain retirement benefits, is guilty of a class E felony.

Requires every district and BOCES to annually file with the department, comptroller and attorney general a report specifying all lawyers providing legal services to the district or BOCES, whether the district or BOCES hired such lawyers as employees, and all compensation for legal services.

Amends subdivision 3 of section 2601-a of the education law to specify that the administrative component of every district's annual budget must include all compensation, salaries and benefits of all school administrators and supervisors, including business administrators, superintendents, and deputy, assistant, associate or other superintendents under all existing employment contracts or collective bargaining agreements. http://assembly.state.ny.us/leg/?bn=S08699&sh=t

CAVetoed 09/2008P-12Prohibits a statement or document that is false or unsubstantiated from being placed in the personnel records of a classified employee of a local educational agency. Allows such employee to challenge, and have removed such a statement or document. Requires that the process be governed by the grievance procedure of the agency as established by a collective bargaining agreement or the agency itself. CORule Adoption 09/2008P-12Relates to the development, expansion, implementation, and management of regional service areas. On or before December 1, 2008, the State Board, in consultation with the Department, school districts, and boards of cooperative services, shall divide the state into twelve regional service areas throughout the state. Each regional service area shall consist of at least two school districts and one or more boards of cooperative services. Each plan for a regional service area shall be administered by a locally appointed regional service council.

HIVetoed 07/2008P-12Creates the facilities alignment commission to establish criteria for the selection of public schools to be consolidated or closed, and to recommend to the board of education a list of schools for consolidation or closure. By June 30, 2009, requires the department of education to submit to the commission a school facilities plan based on the department's assessment of the projected student enrollment in specified areas. By December 31, 2009, requires the commission to establish the criteria for selecting schools that will be consolidated or closed. Requires the commission, prior to finalization of the school alignment selection criteria, to hold public hearings to receive public response to the commission's proposed criteria.

By February 28, 2010, based on the department's school facilities plan and the commission's final school alignment selection criteria, requires the commission to develop a preliminary list of schools to be consolidated or closed. Requires the commission to hold public hearings on the proposed closures by August 31, 2010, and to submit to the legislature prior to the convening of the 2011 regular session a report of its findings and conclusions, including a final list of recommendations for schools to be consolidated or closed.

Allows the legislature to disapprove these recommendations only in their entirety. If no legislative disapproval occurs, requires the board of education to comply with these recommendations during the 2012-2013 school year.

Requires the school district to seek out products and supplies containing recycled materials and to ensure that purchased products and supplies are reusable, durable, or made from recycled materials, if economically and practically feasible. Makes changes concerning the requirements for recycled high grade printing and writing paper.

Requires each school district to periodically review its procedures on solid waste management. Provides that those waste reduction procedures must be designed to, when economically and practically feasible, recycle the school district's waste stream, including landscape waste, computer paper, and white office paper. KSSigned into law 05/2008P-12Provides that a student enrolled in a district and attending both a non-virtual school and a virtual school must be counted as that proportion of one pupil (to the nearest one-tenth) that the student's attendance at the non-virtual school bears to full-time attendance. Provides that a student enrolled in a district and attending special education and related services and also attending a virtual school must be counted as that proportion of one pupil (to the nearest one-tenth) that the student's attendance at the non-virtual school bears to full-time attendance.

Repeals and replaces definition of virtual school.

Repeals and replaces K.S.A. 72-6455 regarding each district's high density at-risk pupil weighting. Creates new section for districts with enrollments of at least 40% but less than 50% at-risk students. Provides that each eligible district's medium density at-risk pupil weighting must be determined by the state board by multiplying the number of at-risk pupils by .06. Provides that if a school district becomes ineligible for medium density at-risk pupil weighting because enrollment of at-risk pupils in the district falls below the minimum threshold, the medium density at-risk pupil weighting of the district must be the greater of: (1) The medium density at-risk pupil weighting in the current school year; (2) the medium density at-risk pupil weighting in the prior school year; or (3) the average of the
medium density at-risk pupil weighting in the current school year and the preceding two school years. Provides that the medium density at-risk pupil weighting provisions expire on June 30, 2011.

Establishes the special education funding task force, and requires the first meeting of the task force to be held on or before August 1, 2008. Directs the special education funding task force to:
(1) Study and make recommendations for changes in the existing formula for funding of special education and related services including medicaid replacement state aid
(2) Conduct hearings and receive and consider suggestions from teachers, parents, the department of education, the state board of education, other governmental officers and agencies and the general public concerning funding for special education and related services
(3) Make and submit reports to the legislature on the work of the task force concerning recommendations of the task force. Provides that such reports must also include recommendations for legislative changes and must be submitted to the legislature before the start of each year's legislative session.
Provides that the task force shall cease to exist on June 30, 2011.

Establishes new section regarding medicaid replacement state aid. Directs the state board to designate a portion of the special education services state aid appropriation as medicaid replacement state aid. Provides that the amount so designated may not exceed $9,000,000 in any school year. Provides that each school district is entitled to medicaid replacement state aid. Provides a formula for calculating each district's medicaid replacement state aid.

WASigned into law 03/2008P-12Adds first-class school districts to the provisions of existing law that allow the dissolution of a directors' school district, which requires a signed petition of 20% of eligible voters to pose the question of dissolution to the voters. WASigned into law 03/2008P-12Requires that, instead of being elected, members of regional committees (responsible for approving and disapproving proposals to change school district organization) are to be appointed by the educaitonal service districts (ESD). In cases where school districts are affected by a change in organization in two ESDs, jurisdiction is given to the ESD and regional committee of the district with the largest amount of students.
