Provides that a lawyer may not simultaneously be an independent contractor and an employee of a district or board of cooperative educational services (BOCES). Provides that a lawyer who is not an employee of a district or BOCES may not seek to be or be considered an employee for purposes of compensation, health insurance, pension and all other employment-related benefits. Provides that any lawyer who violates these provisions is liable for a civil penalty of up to three times the charges and fees for contracted services or salary the lawyer received from the district or BOCES for legal services, and may be enjoined from continuing such violation. Provides that any lawyer who knowingly (1) seeks to be or is considered an employee for purposes of compensation, health insurance, pension and all other employment-related benefits or (2) falsifies or permits to be falsified retirement system records to obtain retirement benefits, is guilty of a class E felony.
Requires every district and BOCES to annually file with the department, comptroller and attorney general a report specifying all lawyers providing legal services to the district or BOCES, whether the district or BOCES hired such lawyers as employees, and all compensation for legal services.
Amends subdivision 3 of section 2601-a of the education law to specify that the administrative component of every district's annual budget must include all compensation, salaries and benefits of all school administrators and supervisors, including business administrators, superintendents, and deputy, assistant, associate or other superintendents under all existing employment contracts or collective bargaining agreements. http://assembly.state.ny.us/leg/?bn=S08699&sh=t
