(1) The program has institutional and governing board approval
(2) The institution has researched and documented current job market need for the program and/or that the program would lead to opportunities for further education
(3) There is recent evidence of both short-term and long-term student demand for the program
(4) Enrollment projections reflect student demand estimates to ensure the financial self-sufficiency of the program
(5) New costs during the first five years of the program would not exceed $2 million.

Defines the "statewide articulated transfer curriculum" as a set of courses that will satisfy the lower-division requirements of a four-year degree in a specific discipline. Requires a statewide articulated transfer curriculum to:
(A) Have the same rigor and content as the equivalent course work in the baccalaureate program offered at a general academic teaching institution
(B) Minimize the time and course work required to complete a baccalaureate degree
(C) Be consistent with the common course numbering system approved by the board and the recommendations and rules of the board
(D) Include only course work directly applicable to the requirements of the baccalaureate degree program(s) with which it is associated.
According to the higher education coordinating board's assistant commissioner for academic affairs and research, as cited in the August 7, 2009 Texas Register, the "establishment of conditions under which the approval of new academic and career technical/workforce associate degree programs, as well as approval of revision of existing academic and career technical/workforce associate degree programs is automatic, would permit public two-year colleges and the five public universities that are authorized to grant the associate degree to implement new degree programs much more quickly than is possible under the provisions of the current version of Chapter 9.

Amendment to Section 9.181 clarifies that rules apply not only to public community colleges, but also Texas State Technical College-Harlingen, and the Lamar State Colleges. Amendment to Section 9.183 adds language to stipulate that each academic associate degree must provide a clearly-articulated curriculum that can be associated with a discipline or field of study leading to a baccalaureate degree, and must be identified as such in the institution's program inventory. Section 9.183 as amended also permits a college to offer a specialized academic associate degree that incorporates a higher education coordinating board-approved statewide articulated transfer curriculum and a portion of the college's approved core curriculum if the coursework for both would total more than 66 SCH.

Community College | Expresses legislative intent to refine higher education reporting requirements to provide for more effective, manageable and transparent reporting by the higher education segments.
Requests that the University of California notify each high school's governing board of (1) the number of graduates who enrolled in the university in the previous year and the number of graduates who were required to take the entry level writing requirement and (2) the comparable numbers of all California high school graduates who enrolled in the university. Requests that the university of California report such information to the department of finance and the joint legislative budget committee. Establishes legislative intent that California State University (CSU) assess and report the entry-level proficiency of all first-time freshmen. Requires the CSU system to annually report to the legislature, by campus:
(1) The total number of regularly admitted and specially admitted first-time freshmen
(2) The proportion of regularly admitted and specially admitted first-time freshmen that are exempt from entry-level proficiency exams
(3) The proportion of regularly admitted and specially admitted first-time freshmen that become exempt through each of the approved alternatives
(4) The entry-level proficiency exam pass rates of regularly admitted and specially admitted first-time freshmen.
Directs the California State University to and requests that the University of California report annually to the legislature on specified components of their institutional financial aid programs for undergraduate, graduate and professional degree students, including the typical financial aid package for a typical dependent undergraduate student with a parent income of $20,000, $40,000, $60,000, $80,000 and $100,000.
Amends Section 66057 by establishing legislative intent that the University of California and the California State University accommodate enrollment growth by maximizing the utilization of existing instructional facilities during the summer term before building new classrooms and teaching laboratories. Also establishes legislative intent that the University of California and the California State University make requests for capital outlay funding for space for classrooms and class laboratories justified using legislatively approved utilization standards and a reasonable assumption of summer-term enrollment. Adds provisions related to five-year capital outlay for UC and CSU systems. Requests that the University of California and requires that California State University report annually to the legislature on summer enrollment counts and on efforts undertaken to increase summer enrollment.
Repeals 66352, "Task force on instruction in business ethics." Eliminates provision in 67312(b) that the California State University must and the University of California system may report on its efforts to serve students with disabilities (requirement that California Community Colleges submit such reports remains in place).
Adds Section 67501, which directs the California State University and California Community Colleges, and permits the University of California, to annually submit to the legislature a comprehensive five-year capital outlay plan that includes specifeid components. Requires five-year plans to be updated annually.
Adds Section 67502, which requests that the the Regents of the University of California provide the joint legislative budget committee and the department of finance with a summary of all instructional and research space in the university system. Specifies elements the summary must address. Requires the California State University to provide the joint legislative budget committee and the department of finance with a summary of all instructional and faculty office space in the university system.
Adds Section 67503, which requests that the Regents of the University of California, and requires California Community Colleges and the California State University, to annually report on the utilization of classrooms and teaching laboratories.
Adds Section 67504, which relates to the Long Range Development Plans (LRDPs) that each University of California campus and medical center periodically develops to guide physical development.
Repeals 71020, requiring the California Community Colleges Board of Governors every three years to develop and submit a diversity paper concerning its own membership.
Adds 92611.9, establishing legislative intent that the University of California carefully monitor the use and effects of the contracting of services at newly developed facilities. Requests that the UC system annually report to the fiscal committees of the legislature on specified provisions related to hiring and contracting.
Adds Chapter 10.5. Community College | The bill implements some of the recommendations of the Florida College System Task Force and the State College Pilot Project. In particular, the bill:
1. Renames the Division of Community Colleges within the Department of Education as the Division of Florida College System;
- Defines the colleges' service areas.
- Authorizes a community college to change its name to include "college" or "state college" if it has been authorized to grant baccalaureate
degrees and has been accredited by the Southern Association of Colleges and Schools (SACS) to do so, or, alternatively, with
board-of-trustees and State Board of Education (SBE) approval.
- Requires the college to seek a statutory name change in the next regular legislative session following the college's name change.
2. Revises the primary mission of the community colleges (now "Florida colleges") to include upper level instruction and awarding
baccalaureate degrees as authorized by law.
- Provides that a separate and secondary mission of Florida colleges includes adult basic education, adult general education, adult
secondary education and General Educational Development test instruction.
- Requires colleges to maintain associate degree programs after receiving approval to offer a baccalaureate degree.
3. Requires Florida colleges that offer one or more baccalaureate degree programs to:
- Maintain its primary mission (i.e., responsibility for responding to community needs for postsecondary academic education and career
degree education and providing associate degrees that provide access to a university);
- Maintain an open-door admission policy for associate-level degree programs and workforce education programs;
- Continue to provide outreach to underserved populations;
- Continue to provide remedial education;
- Comply with all provisions of statewide articulation agreements relating to 2-year and 4-year public degree-granting institutions;
- Not award graduate credit; and
- Not participate in intercollegiate athletics beyond the 2-year level.
4. The Legislature intends that the primary responsibility of a Florida college, including a Florida college that offers baccalaureate degree
programs, continues to be the provision fo associate degrees that provide access to a university.
5. Provides initial approval of a baccalaureate degree by the SBE.
- Provides criteria for the evaluation of a baccalaureate degree proposal.
- Provides for exceptions from the requirement for SBE approval of baccalaureate degree programs.
