OHSigned into law 12/2009Postsec.During fiscal year 2010, directs the chancellor of the board of regents to designate one construction project at three different state institutions of higher education as a Construction Reform Demonstration Project, which may use alternative methods of construction delivery. Identifies criteria chancellor must consider in selecting projects for designation. Requires a state institution of higher education to demonstrate specified elements for a project to be eligible for consideration, including, among others, that the project will qualify for LEED Certification. Identifies alternative methods of construction delivery that an eligible project must use at least one of (construction manager at risk, design build, general contracting, design assist). Requires state institutions of higher education to conform to specified provisions of law in developing their Construction Demonstration Reform Projects. Requires state institutions of higher education undertaking chancellor-designated Construction Reform Demonstration Projects to maximize EDGE business enterprises (http://www.osfc.state.oh.us/Construction/EDGEOtherContractingRequirements/tabid/96/Default.aspx) contracting on the project. Requires participating state institutions of higher education to provide the chancellor with all requested information, to facilitate the chancellor's study of the cost effectiveness and efficiencies associated with using the alternative construction delivery methods. Directs the chancellor to prepare semi-annual reports and a final report, all of which must be submitted to the governor, the house of representatives and the senate. ILSigned into law 11/2009P-12Requires the establishment of a Chicago Educational Facilities Task Force in order to ensure that school facility-related decisions are made with the input of the parents, teachers and community residents, and reflect educationally sound and fiscally responsible criteria. Establishes membership of the task force, including four members each from the house and senate. Requires the task force to analyze school openings, closings, consolidations, turnarounds, construction and other matters. Requires the task force to consult widely with stakeholders on these issues and examine best practices from other school systems for dealing with these issues systematically and equitably. Directs the task force to issue final recommendations by October 30, 2009 on how the enumerated issues can be addressed effectively based upon educationally sound and fiscally responsible practices. Directs the task force to prepare final proposed policy and legislative recommendations for the general assembly, the governor and the school district. CAVetoed 10/2009P-12Requires the department of general services to distribute information on the use of constructability reviews of plans and specifications used for the construction of school facilities and the potential for cost savings that may be realized by the use of such reviews. States legislative intent that the department of general services incorporate this information into existing venues and schedules of communication that the department has established with school districts as a result of its role in the review and approval of school construction plans. Defines "constructability review" as a cost control technique by which the project plans and specifications are reviewed to identify potential claim or problem areas and deficiencies in the plans and specifications that may occur as a result of errors, ambiguities, omissions, discrepancies and conflicts in the plans and specifications. Provides that one or more professionals, including mechanical, electrical, structural, or construction professionals would be authorized to conduct a review.

Amends existing law which requires that, prior to receiving funding, title to property used for a charter school facilities project shall be held by the school district in which the facility is to be physically located, in trust, for the benefit of the state public school system. Authorizes a local governmental entity or a charter school to hold title to charter school project facilities. Requires applicants, prior to the release of funds for site acquisition or new construction final apportionments, to provide documentary evidence that the school district in which the facility is to be physically located, a local governmental entity, or the charter school holds title to the project facilities, subject to specified conditions. Authorizes a charter school to request a school district to transfer title to project facilities to an entity authorized by the bill if the district entered into an agreement, prior to January 1, 2010, to hold title to the project facilities. Authorizes a school district that receives such a request to transfer the title to the entity designated in the request pursuant to terms

Creates new section authorizing the Capital Development Board to make grants to districts and not-for-profit entities for early childhood construction projects. Requires a district or eligible entity to provide local matching funds. Directs the Capital Development Board, in consultation with the state board of education, to establish standards for the determination of priority needs concerning early childhood projects based on projects located in communities in the state with the greatest underserved population of young children. Requires 20% of grant funds to be awarded to projects in Chicago.

Section 3313.86: Creates new Section 3313.86. Requires school districts, community schools, STEM schools and chartered nonpublic schools to periodically review their policies and procedures to ensure (1) the safety of persons using a school from known hazards that pose an immediate risk to health or safety, and (2) compliance with federal health and safety laws and regulations applicable to schools.

Repeals Section 3313.473, 3314.15 and sections 3701.93 through 3701.936.
Section 3313.473: Directed the principal or chief administrator of public and nonpublic school to provide access to school premises during school operational hours for boards of health to conduct school health and safety network inspections. Also directed local boards of districts and educational service centers, and the chief administrator of each nonpublic school, to develop and submit a plan for abatement of hazardous conditions at the school.
Section 3314.15: Same provision as 3313.473, but applicable to community schools.
Section 3701.93: School safety and health - definitions.
Section 3701.931: Establishes the school health and safety network, under which each board of health was required to inspect each public and nonpublic school building and associated grounds at least once each year during school hours to identify conditions dangerous to public health and safety present in or on the building or grounds.
Section 3701.932: Requires the board of health to report the findings from every school inspection to specified stakeholders.
Section 3701.933: Directs local boards to submit to the board of health a written plan for abatement of the conditions determined to be hazardous to occupants, as identified in the report under Section 3701.932.
Section 3701.934: Directs the director of health to develop information specifying dangerous conditions and dangerous products, including products recalled by the manufacturer, that may be present in school buildings and associated grounds, and to distribute this information every quarter to local boards of health.
Section 3701.935: Directs the director of health to adopt rules establishing minimum standards and procedures for school inspections.
Section 3701.936: Provides that these provisions do not diminish a local board of health's authority to issue orders or take actions under specified sections of code.

Authorizes the board of any state university to enter into financing agreements to finance capital improvements by selling certificates of participation in the installment payments made under such agreements.
