CASigned into law 10/2009P-12Authorizes the Commission on Teacher Credentialing to issue an education specialist, multiple- or single-subject teaching credential to a teacher prepared in another country who has earned a valid corresponding elementary, secondary or special education teaching credential in another state and who meets specified requirements. Requires a school district, county office of education, or charter school that provides examination prep courses for preparing credential holders to meet certain requirements. OHAdopted 10/2009P-12Adds new paragraph regarding the "teacher leader" endorsement. Provides endorsement is valid for mentoring and coaching teachers, providing staff development and assisting the principal in developing and supporting a shared vision and clear goals for the school. Requires teacher leader endorsement candidates to have a master's degree and at least four years teaching experience. Requires that the preparation program include at least a practicum experience during which the candidate must demonstrate the knowledge, skills and dispositions at the distinguished level, as described in the Ohio standards for the teaching profession.

Also establishes an "urban principal" endorsement, which may be added to any standard principal license or certificate following completion of an approved preparation program for the endorsement. ILSigned into law 08/2009P-12Provides that it is a state attorney's duty to notify the state superintendent of education, the applicable regional superintendent of schools, and the superintendent of the employing school district or the chief school administrator of the employing nonpublic school, upon the conviction of any individual known to possess a certificate issued under the school code of any of certain sex offenses or felony convictions, including the offense of grooming and traveling to meet a minor. Requires teachers institutes to include training on educator ethics and teacher/student conduct. Clarifies 105 ILCS 5/10-21.9(c) to provide that no school board may knowingly employ a person who has been convicted of any offense that would subject him or her to certification suspension or revocation pursuant to Section 21-23a of the School Code. Transfers responsibility for beginning certificate suspension and revocation proceedings from the appropriate regional superintendent of schools to the state superintendent. Requires the superintendent of the employing school board to provide written notification to the regional and state superintendents of any certificate holder whom he or she has reasonable cause to believe has committed an intentional act of abuse or neglect with the result of making a child an abused child or a neglected child, and that act resulted in the certificate holder's dismissal or resignation from the school district.

Requires local boards, at least once every two years, to conduct in-service training on educator ethics, teacher-student conduct, and school employee-student conduct for all personnel. Provides that no one who has been convicted of an offense set forth in Section 21-23a of the School Code may be certified to teach or supervise in the public schools. Adds circumstances under which an applicant with a felony conviction may submit character references or other written
material before such a conviction or other information regarding the applicant's character may be used by the state superintendent of education as a basis for denying the application. Clarifies that the state superintendent of education has the exclusive authority to initiate certificate suspension or revocation, including for child abuse or neglect. Provides that the state superintendent is not under obligation to initiate an investigation of a certificate holder if the Department of Children and Family Services is investigating the same or substantially similar allegations. Provides that if the state superintendent of education does not receive a request for a hearing within 10 days after the individual receives notice, the suspension or revocation must immediately take effect in accordance with the notice. Clarifies that a hearing will act as a stay of proceedings until the state teacher certification board issues a decision. Repeals and replaces certain other existing language regarding hearings and repeals/suspensions of certificates.

ALAdopted 07/2009P-12Adds section creating the Alabama Educator Code of Ethics. Identifies nine areas of standards of conduct, including teacher/student relationships, background checks and confidentiality of the content of student records and standardized tests. Requires educators to report a breach of one or more of the Standards in the Alabama Educator Code of Ethics as soon as possible, but no later than 60 days from the date the educator became aware of the alleged breach. Provides circumstances under which the state superintendent of education may revoke, suspend or refuse to issue a certificate, and establishes grounds that must serve as cause for disciplinary action.

HIVeto overridden: legislature has overridden governor's veto 07/2009P-12Increases the membership on the Hawaii teacher standards board from 13 to 15 with two public members representing the community. Allows the board to employ an executive director for a term of up to four years, who must be appointed by the board of education, and also allows the board to terminate the executive director's contract for cause. Requires the board to submit its annual report to the board of education. Authorizes the board to determine the manner in which licensing fees are collected. Authorizes the board to adopt, amend, repeal or suspend the policies and standards of the board. Authorizes the board to grant additional licensing extensions through June 30, 2010. Makes permanent the board's authority to temporarily suspend its rules in extenuating circumstances. Makes permanent the board's authority to amend licensing-related fees and set or amend other charges related to the performance of its duties. Beginning July 1, 2009, requires the board, department of education and charter school administrative office to implement interim policies and procedures for the mutual sharing of data necessary for licensing and verifying the status of teachers, including criminal background checks; employment status and work sites; license test information; license validity, fields, and levels; and academic transcripts and program completion information.

Provides background on 2008 Senate Concurrent Resolution No. 83, S.D. 1, which requested the auditor to conduct a study on the appropriate accountability structure for the Hawaii teacher standards board, and to report the findings and recommendations to the 2009 legislature, which the auditor did in February 2009. Directs the legislative reference bureau to review the findings of the auditor's report and make recommendations, including proposed legislation, regarding whether there is a need for oversight of the Hawaii teacher standards board, and how oversight is provided for similar boards; and how to strengthen and clarify interagency roles, responsibilities and relationships between the board, department of education and teacher education coordinating committee.
Directs the legislative reference bureau to submit its findings and recommendations, including all proposed legislation and budget requests, to the legislature no later than twenty days prior to the convening of the regular session of 2010.

Directs the dean of the University of Hawaii at Manoa college of education to convene a working group to review and make recommendations to address:
     (1)  Licensing rules and their impact on teacher workforce needs in Hawaii
     (2)  Relicensing and tiered licensing options to ensure effective teachers and continuing development of teachers
     (3)  Streamlining processes for reviewing out-of-state and military applicants for licensure
     (4)  Alignment of licensing standards and requirements with the federal No Child Left Behind Act
     (5)  Teacher preparation program alignment with national standards and the role of national accreditation of teacher preparation programs in Hawaii
     (6)  The role of higher education institutions in assisting teachers in achieving National Board certification.
Specifies the membership of the working group. Provides the working group will cease to exist on June 30, 2010. Directs the dean to submit the findings and recommendations of the working group, including any proposed legislation and budget requests, to the legislature no later than 20 days prior to the convening of the regular session of 2010.

Directs the Hawaii teacher standards board to review the findings of the auditor's report, and to make recommendations for policy and procedural changes needed to refocus and support the purpose of the Hawaii teacher standards board. Directs the board to consider, at a minimum:
     (1)  Procedures to streamline the appeals process, pursuant to section 302A-807, Hawaii Revised Statutes
     (2)  Amendments to the current licensing fees, if required, to meet the operating costs associated with the Hawaii teacher standards board
     (3)  Requirements for training of licensing and administrative personnel to provide increased accessibility and customer service
     (4)  Procedures to improve the coordination of the interim policies and procedures related to the creation of a data interface network consisting of teacher education institutions and the department of education to support the free interchange of information valuable to all of the participating organizations
     (5)  Recommendations as to whether the board may be authorized to request attendance of a deputy attorney general at the meetings of the board.

IAAdopted 07/2009P-12Changes the different classes of licenses issued by the Board. Sets out to make application for licensure more user friendly by combining several classes of licenses. Combines Class B, C, and D licenses into one license, Class B, and rescind separate rules for Class C or D licenses.

Also requires the metrics and educator preparation programs to ensure that educators and other school personnel are adequately prepared to use the value-added progress dimension prescribed by section 3302.021.

Directs the chancellor to approve postsecondary institutions that prepare teachers and other school personnel that maintain satisfactory training procedures and records of performance, as determined by the chancellor. Specifies that if the jointly established metrics require a teacher preparation program to to meet an independent accreditation organization's standards, the chancellor must allow institutions to satisfy the standards of either the National Council for Accreditation of Teacher Education (NCATE) or the Teacher Education Accreditation Council (TEAC). Provides the jointly approved metrics and educator preparation programs may require institutions, as a condition of approval, to to make changes to the curricula of its preparation programs for educators and other school personnel. Requires institutions to allocate funds from existing appropriations to make curricular changes. Directs the chancellor to notify the state board of the metrics and educator preparation programs and approved postsecondary institutions. Directs the state board to publish the metrics, educator preparation programs, and approved institutions with the standards and qualifications for each type of educator license.

Transfers responsibility for reporting on the quality of teacher preparation institutions from the state board of education to the chancellor of the Ohio board of regents, in collaboration with the state board of education.

Also establishes "professional educator license" (applicants must have successfully completed the Ohio teacher residency program), "senior professional educator license" (applicants must hold at least a master's degree, have previously held a professional educator license and meet the criteria for the accomplished or distinguished level of performance, as described in the standards for teachers adopted by the state board under section 3319.61) and "lead professional educator license" (applicants must hold at least a master's degree, have previously held a professional educator license or a senior professional educator license, meet the criteria for the distinguished level of performance and either hold National Board for Professional Teaching Standards certification or meet the criteria for a master teacher or other criteria for a lead teacher adopted by the educator standards board under division (F)(4) or (5) of section 3319.61). Provides that all non-resident-educator licenses are to be valid for five years and renewable. Repeals provision that no license can be required for teaching children age two or younger. Allows state board to adopt any additional educator licenses, and directs the state board to adopt rules establishing the standards and requirements for obtaining each resident educator, professional educator, senior professional educator and lead professional educator license.

Directs the state board to align the standards and qualifications for obtaining a principal license with the standards for principals adopted by the state board under section 3319.61.

Repeals 3319.23, which directed the state board to (1) establish standards and courses of study for the preparation of teachers, (2) provide for the inspection of teacher preparation programs, (3) approve teacher preparation programs, and (4) license the graduates of approved courses and institutions. (New Section 3333.048 directs the chancellor of the Ohio board of regents and the state superintendent to establish metrics for and approve teacher preparation programs.)

(1) Using results from the state writing assessments, including previous results of audits of writing portfolios, the department of education and appropriate partners must identify any major weaknesses that may be attributed to the quality of writing instruction and consider where and how these skills should best be taught to teachers
(2) The education professional standards board must conduct an analysis of the current pre-service writing instruction requirements and determine how writing instruction for prospective teachers can be improved
(3) The education professional standards board must consider the feasibility of requiring a course in teacher preparation programs in the teaching of writing
(4) The department of education must review the availability of professional development opportunities to help teachers learn how to improve writing instruction, and to use available resources, including the continuance of writing academies and writing workshops, to ensure that training for developing and evaluating high-quality writing portfolios and writing persuasive letters and articles, as well as poetry, short stories, memoirs, and personal narratives is available to existing teachers
(5) The department of education must provide training to administrators to help them provide leadership and support for an effective writing program in their schools.
