Provides technologies to be used would include cable, satellite, over-the-air, or any other type of transmission accessible through a television, and Webcast. Requires the boards to make sure transmission is accessed through the K-12 High-Speed Network. ILSigned into law 08/2009P-12Requires the Advisory Council on the Education of Children with Disabilities and the Advisory Council on the Education of Gifted and Talented Children to research and discuss best practices for addressing the needs of children who are gifted and talented and have a disability. HIVetoed 07/2009P-12Extends repealer from 2009 to 2011 for provision requiring civil service benefits for department of education civil service employees to be the same as those provided to civil service employees of other executive branch agencies. Provides that if the department of education has not established a separate civil service system by June 30, 2010, the department must submit a report to the legislature, no later than 20 days prior to the convening of the regular session of 2011, on its progress on establishing a separate human resources system.

HIVeto overridden: legislature has overridden governor's veto 07/2009P-12Increases the membership on the Hawaii teacher standards board from 13 to 15 with two public members representing the community. Allows the board to employ an executive director for a term of up to four years, who must be appointed by the board of education, and also allows the board to terminate the executive director's contract for cause. Requires the board to submit its annual report to the board of education. Authorizes the board to determine the manner in which licensing fees are collected. Authorizes the board to adopt, amend, repeal or suspend the policies and standards of the board. Authorizes the board to grant additional licensing extensions through June 30, 2010. Makes permanent the board's authority to temporarily suspend its rules in extenuating circumstances. Makes permanent the board's authority to amend licensing-related fees and set or amend other charges related to the performance of its duties. Beginning July 1, 2009, requires the board, department of education and charter school administrative office to implement interim policies and procedures for the mutual sharing of data necessary for licensing and verifying the status of teachers, including criminal background checks; employment status and work sites; license test information; license validity, fields, and levels; and academic transcripts and program completion information.

Provides background on 2008 Senate Concurrent Resolution No. 83, S.D. 1, which requested the auditor to conduct a study on the appropriate accountability structure for the Hawaii teacher standards board, and to report the findings and recommendations to the 2009 legislature, which the auditor did in February 2009. Directs the legislative reference bureau to review the findings of the auditor's report and make recommendations, including proposed legislation, regarding whether there is a need for oversight of the Hawaii teacher standards board, and how oversight is provided for similar boards; and how to strengthen and clarify interagency roles, responsibilities and relationships between the board, department of education and teacher education coordinating committee.
Directs the legislative reference bureau to submit its findings and recommendations, including all proposed legislation and budget requests, to the legislature no later than twenty days prior to the convening of the regular session of 2010.

Directs the dean of the University of Hawaii at Manoa college of education to convene a working group to review and make recommendations to address:
     (1)  Licensing rules and their impact on teacher workforce needs in Hawaii
     (2)  Relicensing and tiered licensing options to ensure effective teachers and continuing development of teachers
     (3)  Streamlining processes for reviewing out-of-state and military applicants for licensure
     (4)  Alignment of licensing standards and requirements with the federal No Child Left Behind Act
     (5)  Teacher preparation program alignment with national standards and the role of national accreditation of teacher preparation programs in Hawaii
     (6)  The role of higher education institutions in assisting teachers in achieving National Board certification.
Specifies the membership of the working group. Provides the working group will cease to exist on June 30, 2010. Directs the dean to submit the findings and recommendations of the working group, including any proposed legislation and budget requests, to the legislature no later than 20 days prior to the convening of the regular session of 2010.

Directs the Hawaii teacher standards board to review the findings of the auditor's report, and to make recommendations for policy and procedural changes needed to refocus and support the purpose of the Hawaii teacher standards board. Directs the board to consider, at a minimum:
     (1)  Procedures to streamline the appeals process, pursuant to section 302A-807, Hawaii Revised Statutes
     (2)  Amendments to the current licensing fees, if required, to meet the operating costs associated with the Hawaii teacher standards board
     (3)  Requirements for training of licensing and administrative personnel to provide increased accessibility and customer service
     (4)  Procedures to improve the coordination of the interim policies and procedures related to the creation of a data interface network consisting of teacher education institutions and the department of education to support the free interchange of information valuable to all of the participating organizations
     (5)  Recommendations as to whether the board may be authorized to request attendance of a deputy attorney general at the meetings of the board.

Prohibits the state board from voting on the local district's resolution until it has been heard at at least two state board meetings. OHSigned into law 07/2009P-12Section 3301.90:Creates the Early Childhood Advisory Council to serve as the federally mandated state advisory council for early childhood education and care, and to advise the state regarding the creation and duties of the Center for Early Childhood Development in the state department of education. Directs the council to promote family-centered programs and services that acknowledge and support the social, emotional, cognitive, intellectual and physical development of children and the vital role of families in ensuring the well-being and success of children.

Section 265.70.20: Directs the Early Childhood Advisory Council (as created by H.B. 1) to establish an Early Childhood Financing Workgroup, to be chaired by the chair of the Early Childhood Advisory Council. Directs the workgroup to develop recommendations exploring the implementation of a single finance system for early care and education programs that includes aligned payment mechanisms and consistent eligibility and co-payment policies. Directs the workgroup to submit its recommendations to the governor by December 31, 2009, upon which time the workgroup shall cease to exist.

Places the Ohio tuition trust authority in the office of the chancellor of the board of regents. Provides that the Ohio tuition trust authority board must solely perform specified duties and responsibilities. Authorizes the Ohio tuition trust authority board, subject to the advice and consent of the chancellor, to remove the authority's executive director at any time. Directs the authority, by December 31, 2009, to conduct a study of guaranteed tuition program plans and submit a report with recommendations for a new guaranteed tuition plan to the speaker of the house, the senate president and the governor. Requires the authority to include in the report consideration of a guaranteed tuition program plan in which the risks of the plan are shared equitably among institutions of higher education, the state, the Ohio tuition trust authority, and program investors.

Authorizes the authority to establish and administer more than one plan for the sale of tuition units within the Ohio tuition trust fund using specified principles or modeled after a plan that was included in the aforementioned study. Provides that if the authority establishes and administers more than one plan for the sale of tuition units, the money received under each plan must be segregated and identified within the Ohio tuition trust fund. Specifies that in the hiring of the executive director, the Ohio tuition trust authority must obtain the advice and consent of the Ohio tuition trust board, provided that the
executive director may not be hired without a majority vote of the board in favor of the hiring. Authorizes the authority to enter into an agreement with any business, entity or governmental agency to perform
the investment duties of the authority, in a manner agreed upon by the authority.

Establishes duties of the council. Authorizes the council to advise and assist the departments of health and education on the provision of appropriate services for children age five and younger, and to advise appropriate agencies on the integration of services for infants and toddlers with disabilities, and at-risk infants and toddlers and their families, regardless of whether at-risk infants and toddlers are eligible for early intervention services. Directs the council to promote family-centered programs and services that acknowledge and support the social, emotional, cognitive, intellectual and physical development of children, and the vital role of families in ensuring the well-being and success of children.

Provides the position may not be filled during the required posting period, except in accordance with state law, and must be filled within a certain number of days after the vacancy occurs, although the position may be filled on an interim basis for up to six months. Adds similar provisions for local boards of education filling appointed county and city superintendent vacancies. OHAdopted 03/2009P-12Authorizes the governing board of any educational service center, or the administrative authority of any chartered nonpublic school to submit an application to the state board for an exemption from specific statutes and/or rules in order to implement a proposed innovative education pilot program (previous rule allowed only school districts to submit a waiver application). Adds provision that an application requesting exemptions in order to provide professional development for educators may be granted for research-based high quality professional development activities as defined by state-board adopted professional development standards, which are available on the department's website, www.ode.state.oh.us. Requires the department to approve or disapprove each application within 45 days of receipt.
