| CA | Signed into law 09/2010 | P-12 | From bill analysis: Includes in the definition of "supplementary instructional materials" instructional materials that use current relevant technology that further engages interactive learning in the classroom and beyond. Requires a local board, when adopting instructional materials for use in schools, to include relevant technology-based materials, as defined, if the materials are both available and comparable to other, equivalent instructional materials. http://www.leginfo.ca.gov/pub/09-10/bill/asm/ab_2651-2700/ab_2694_bill_20100924_chaptered.pdf

| CA | Signed into law 09/2010 | P-12 | States legislative findings regarding work-based learning. Authorizes school districts that maintain high schools to establish work-based learning programs, and to purchase liability insurance for pupils enrolled in
programs of study involving work-based learning, off school grounds. Authorizes partnership academies, regional occupational programs, and local educational agencies to deliver work-based learning opportunities for pupils that may include work experience education, community classrooms, cooperative career technical education programs, and job shadowing experience. Authorizes regional and local business organizations, in conjunction with school districts and community colleges, and any other representatives deemed appropriate, to develop principles and guidelines for the establishment of work-based learning programs.
Provides that for purposes of defining "sufficient textbooks or instructional materials", these may include digital materials, as long as each pupil has the ability to access the digital material at home and, at a minimum, has the same content in class and to take home as all other pupils in the same class or course in the district. http://www.leginfo.ca.gov/pub/09-10/bill/asm/ab_2201-2250/ab_2211_bill_20100924_chaptered.pdf

| CA | Vetoed 09/2010 | P-12 | From bill summary: Requires the state board to inform the chairs of the assembly and senate education committees and the secretary for education of content that it interprets to be the result of certain changes made to the Texas Administrative Code. Repeals this provision on January 1, 2016. Also requires the state board, upon the next adoption of the history-social science curriculum framework, to ensure that the framework is consistent with specified standards governing instructional materials.
From comments in last bill analysis: Seeks to ensure that the revisions of Texas' Essential Knowledge and Skills for Social Studies do not influence the content of California textbooks by requiring the state board of education to ensure that the next revision of the history-social science framework is consistent with existing requirements pertaining to social content and annually report to the legislature if it finds content that it interprets to be a result of Texas' revised social studies standards.

| IL | Signed into law 07/2010 | P-12 | Provides that among other purposes (i.e., purchasing textbooks and software), the School Safety and Educational Improvement Block Grant Program must provide funding for electronic textbooks and the technological equipment necessary to gain access to and use electronic textbooks. Creates new 105 ILCS 5/28-19.5, which permits a district to use funding to purchase electronic textbooks or instructional materials and the technological equipment necessary to gain access to and use electronic textbooks or instructional materials if it can ensure that each pupil will be provided with a copy of the instructional materials to use at school and at home AND it will assist the pupil in comprehending the material. Specifies that this does not require the district to purchase two sets of materials.
Amends provisions in 105 ILCS 5/18-17 (requiring the loaning of textbooks free of charge to K-12 students and students at nonpublic schools) so that all provisions also apply to the loaning of electronic textbooks and equipment needed to access and use such textbooks. Provides that one of the purposes of funds from (1) state board grants to charter schools and (2) Charter Schools Revolving Loan Fund is start-up costs of acquiring electronic textbooks and the technological equipment necessary to access and use electronic textbooks.
Amends the following to indicate that provisions that apply to traditional textbooks also apply to electronic textbooks and the technological equipment necessary to access and use electronic textbooks:
--105 ILCS 5/28-6, "Adoption of books by school boards"
--105 ILCS 5/28-8, "Purchase [of textbooks] by districts for resale [to students] at cost"
--105 ILCS 5/28-9, "Purchase by districts - Designation of agent for sale"
--105 ILCS 5/28-14, "Free textbooks - Referendum - Ballot" (allowing a district to have a referendum on whether to provide free textbooks to students in the district)
--105 ILCS 5/28-15, "Textbooks provided and loaned to pupils-Sale to pupils" (for districts in which a referendum to provide free textbooks to students has passed)
--105 ILCS 5/28-17, "Rules for care and preservation" [of textbooks provided at public expense]
--105 ILCS 5/28-20, "Definitions" (clearly includes electronic textbooks in definition of "textbook" and "instructional materials")
--105 ILCS 5/28-21, Required availability of an accessible electronic file of any textbook on the state board's approved textbooks list, to make the textbook accessible to a student with a print disability
--105 ILCS 5/34-2.3 [applicable to Chicago district only], "Local school councils - Powers and duties" (includes electronic textbooks and technological equipment necessary to gain access to and use electronic textbooks among the "non-compensation items" that must be included in the lump sum amount in the principal's expenditure plan, which must be developed in consultation with and approved by the local school council)
--105 ILCS 5/34-19 [applicable to Chicago district only], "By-laws, rules and regulations; business transacted at regular meetings; voting; records" (Provides that electronic textbooks, just like traditional textbooks, may be adopted or changed only at the regular meetings of the board and by a vote of a majority of the full membership of the board. Adds language that funds appropriated for textbook purchases must be available for electronic textbook purchases and the technological equipment necessary to gain access to and use electronic textbooks at the local school council's discretion.

| TX | Adopted 02/2010 | P-12 | § 66.33: Adds provision to specify that members of state textbook adoption review panels must include educators, parents, business and industry representatives, and employers. Repeals reference to appointment of "academic experts" (teachers and university professors) to textbook adoption review panels. Adds provision barring hardware or software providers (or those holding a professional relationship with hardware or software providers) from making or accepting nominations to state textbook review panels.
§ 66.102: As authorized in Section 31.103(e) of the Education Code, establishes a list of equipment or devices that a district or charter school may purchase using textbook credits, including from the purchase of open-source textbooks (textbook credit = difference between the price paid for a textbook and the cost limit established in Section 31.025(a) of the Education Code for that textbook, multiplied by the number of copies purchased by the district or charter school). Authorizes a district or charter school to receive a textbook credit only in the first year of implementation. Requires the district or charter school to notify the Texas Education Agency (TEA) for the use of funds generated by textbook credits, and submit an itemized expenditure report to the TEA.
§ 66.104: Amends provisions related to selection of instructional materials by school districts. Requires a district or charter school that selects electronic textbooks or instructional materials from the commissioner's list as specified in the TEC, §31.0231, to purchase a classroom set of textbooks adopted by the SBOE under the TEC, §31.023 or §31.035, for each subject and grade level in the foundation and enrichment curriculum. Defines "classroom set" for these purposes. Adds language to clearly establish that the classroom set requirement begins with Proclamation 2010 and is not retroactive.
§ 66.121: Specifies that a requisition for special instructional materials must be based on actual student enrollment to meet individual student need. Requires districts and charter schools to annually conduct an inventory of all currently adopted instructional materials that have been requisitioned by, and delivered to, the district, and for the results of the inventory to be recorded in the district's files. Requires reimbursement for and/or replacement of all braille and large type instructional materials determined to be lost.
