PASigned into law 11/2011P-12 Establishes standards for managing concussions and traumatic brain injuries to student athletes. Requires the Departments of Education and Health to develop and post on their websites guidelines and relevant materials to inform mand educate students concerning head injuries. The Departments are to inlcude information provided by the Centers fo rDisease Control and Prevention. A student participating in interscholastic athletics and the student's parent/guardian must sign a form acknowledging they have receive and reviewed these guidelines. A student athlete who exhibits signs or symptoms of a concussion must be removed from plan and may not return to play until her or she is cleared to do so, in writing, by an appropriate medical professional. Imposes penalties. Defines "Appropriate medical professional" as all of the following: (1) A licensed physician who is trained in the evaluation and management of concussions or a licensed or certified health care professional trained in the evaluation and management of concussions and designated by such licensed physician.

ILSigned into law 07/2011P-12Directs each school board to adopt a policy on student athlete concussions and head injuries that is in compliance with the protocols, policies and bylaws of the Illinois High School Association. Requires that information on the local concussion and head injury policy must be included in any agreement, contract, code or other written instrument a district requires student athletes and parents to sign before participating in practice or interscholastic competition. Directs the Illinois High School Association to make available to all districts, including elementary school districts, educational materials describing the nature and risk of concussions and head injuries. Requires that districts use such educational materials to educate coaches, student athletes and parents about the nature and risk of concussions and head injuries, including continuing play after a concussion or head injury.

Authorizes and encourages any park district to make available to residents and users of park district facilities, including youth athletic programs, educational materials that describe the nature and risk of concussion and head injuries. RISigned into law 07/2011P-12Adds an annual refresher course to the initial course requirement for coaches and volunteers, and encourages districts to have
school nurses complete a training course in concussions and traumatic brain injuries. Encourages districts to get student neuropsychological testing, computerized or otherwise. A youth athlete, who has been removed from play, may not return to play until the athlete is evaluated by a licensed physician who may consult with an athletic trainer, all of whom must be trained in the evaluation and management of concussions. The athlete must receive written clearance to play from the physician.

NCSigned into law 06/2011P-12Provides that the required rules governing interscholastic athletic activities adopted by the State Board of Education must provide:

1. That all coaches, school nurses, athletic directors, first responders, volunteers, students who participate in interscholastic athletic activities, and the parents of those students will annually receive a concussion and head injury information sheet. School employees, first responders, volunteers, and students must sign the sheet and return it to the coach before they can participate in interscholastic athletic activities, including tryouts, practices, or competition. Parents must sign the sheet and return it to the coach before their children can participate in any such interscholastic athletic activities.

2. If a student participating in an interscholastic athletic activity exhibits signs or symptoms consistent with concussion, the student must be removed from the activity at that time and not be allowed to return to play or practice that day. The student must not return to play or practice on a subsequent day until the student is evaluated by and receives written clearance for such participation.

3. That each school must develop a venue specific emergency action plan to deal with serious injuries and acute medical conditions in which the condition of the patient may deteriorate rapidly. The plan shall include a delineation of roles, methods of communication, available emergency equipment, and access to and plan for emergency transport.

AKSigned into law 05/2011P-12Relating to prevention and evaluation of and liability for concussions in student athletes. Sec. 14.30.142 is amended to read: The governing body of a school district shall consult with the state school activities association to develop and publish guidelines and other information to educate coaches, student athletes and parents of student athletes regarding the nature and risks of concussions. Guidelines developed under this section must include a description of the risks of return to play and standards for return to play. A student who is expected of having sustained a concussion during a practice or game is to be immediately removed from the practice or game and the student may not return to plan until having been evaluated and cleared for participation in writing by a qualifed person who has received training and is currently certified, as verified in writing or electronically by the qualified person, in the evaluation and management of concussions. "Qualified person" means either a licensed health care provider or a person acting at the direction and under the supervision of a licensed physician. Effective date 08/25/11.

INSigned into law 05/2011P-12Requires the department of education, in consultation with specified persons, to disseminate guidelines, information sheets, and forms to school corporations for distribution to schools to inform and educate coaches, student athletes, and parents of student athletes of the nature and risk of concussions and head injuries. Requires that a high school student athlete and the student athlete's parent be given information concerning head injuries and concussions and return a form acknowledging receipt of the information to the student athlete's coach each year before beginning practice for a sport. Requires that a high school student athlete who is suspected of sustaining a head injury or concussion be removed from play at the time of the injury. Provides that the student athlete may not return to play until the student athlete has been evaluated and received written clearance from a licensed health care provider trained in evaluating head injuries. Provides that a health care provider who, as a volunteer in good faith and gratuitously, provides head injury evaluations to student athletes has immunity from civil liability for acts or omissions arising from the evaluations, except for gross negligence or willful or wanton misconduct. NVSigned into law 05/2011P-12Requires the Nevada Interscholastic Activities Association and the board of trustees of each school district to adopt policies concerning the prevention and treatment of injuries to the head sustained by pupils while participating in sports and other athletic activities and events. The policy must require that a pupil who sustains or is suspected of sustaining an injury to the head while participating in such activity or event: (1) be immediately removed from the activity or event; and (2) may not return to the the activity or event unless the parent or legal guardian of the pupil provides a written statement from a health care provider medically clearing the pupil to participate and the date on which the pupil may return to the activity. Annually, a pupil participating in interscholastic activites and his parent or legal guardian must sign a form acknowledging they have received a copy of the policy and understand its terms and conditions before the pupil may participate. The board of trustees of each school district is required to adopt a similar policy for participation in the Nevada Interscholastic Activities Association. Certain organizations for youth sports in this State is required to adopt a similar policy.

VTSigned into law 05/2011P-12This section defines and establishes the importance of avoiding and treating student concussions. Requires the development of statewide guidelines, forms and other materials (to be updated as needed) that are designed to educate coaches, youth athletes, and the parents and guardians of youth athletes regarding concussions. Requires school administrators to ensure that such information developed is provided to each youth athlete and family. Requires each youth athlete and a parent or guardian to annually sign a form acknowledging receipt of such information. Requires each coach to receive training no less than every two years. Prohibits coaches from permitting a youth athlete to train or compete if the athlete has been removed or prohibited from participating because of symptoms of a concussion until a licensed health care provider has provided written permission.

Creates a Public School Athletic Trainer Pilot Program. Directs the Department of Education to provide grants for providing a access to one or more athletic trainers to public schools in Arkansas through the two-year Public School Athletic Trainer Pilot Program. Defines scope of pilot program and requires reporting upon its completion.

Directs the Arkansas Legislative Task Force on Athletic Training in Public Schools to develop a web-based survey to be completed by each public school in Arkansas through the Department of Education website. The survey must include questions concerning: (1) The recruitment, hiring, and retention of athletic trainers; (2) Professional development and certification or licensure of athletic training personnel; and (3) Procedures and training on the recognition and management of the following events or conditions that may be encountered by a student during athletic training and activities: (A) A concussion, dehydration, or other health emergency; (B) An environmental issue that threatens the health or safety of students; and (C) A communicable disease.

The program must require that students be removed from competition and practice or training if they report or exhibit any sign or symptom of a concussion. Also requires that any student who is removed must be examined as soon as possible by a licensed, registered or certified health care provider and that the student does not return to competition or training until written permission is obtained by an authorized health care provider. Authorizes legislative management to study concussion management, including the nature, scope and applicability of programs designed to prevent or eliminate concussions.

The intercollegiate athletic teams sponsored by the university of North Dakota shall be known as
the university of North Dakota fighting Sioux. Neither the university of North Dakota nor the state board
of higher education may take any action to discontinue the use of the fighting Sioux nickname or the
fighting Sioux logo in use on January 1, 2011. Any actions taken by the state board of higher education
and the university of North Dakota before the effective date of this Act to discontinue the use of the
fighting Sioux nickname and logo are preempted by this Act. If the national collegiate athletic
association takes any action to penalize the university of North Dakota for using the fighting Sioux
nickname or logo, the attorney general shall consider filing a federal antitrust claim against that
association.
