CASigned into law 09/2012Postsec.From bill summary: Enacts the Student Athlete Bill of Rights, pursuant to which, commencing with the 2013–14 academic year, intercollegiate athletic programs at 4-year institutions of higher education in the state that receive, as an average, $10,000,000 or more in annual revenue derived from media rights for intercollegiate athletics, are required to comply with prescribed requirements. Among other things, requires the institution of higher education to provide an equivalent scholarship to a student athlete if an athletic program does not renew the athletic scholarship of a student athlete who suffers an incapacitating injury or illness resulting from his/her participation in the athletic program, and the institution's medical staff determines that the student athlete is medically ineligible to participate in intercollegiate athletics, or if a student athlete on an athletic scholarship and in good standing exhausts his/her athletic eligibility, except for specified athletic programs.

Also requires that athletic programs that receive, as an average, $10,000,000 or more in annual revenue derived from media rights for intercollegiate athletics be responsible for paying the premiums of each of its student athletes whose household has an income and asset level that does not exceed the level for Cal Grant A recipients for insurance covering claims resulting from their participation in the athletic program, unless the student athlete declines the payment of premiums. Provides that the athletic program is responsible for paying the insurance deductible amount applicable to the claim of any student athlete who suffers an injury resulting from his/her participation in the athletic program and makes a claim relating to that injury. Requires the athletic program to provide, to a student athlete who suffers an injury resulting from participation in the athletic program and requires ongoing medical treatment, either the necessary medical treatment or health insurance that covers the injury and the resulting deductible amounts. Provides these provisions do not apply to preexisting medical conditions that predated the student athlete's participation in the athletic program.

Requires that the institutions of higher education to which these provisions relating to equivalent scholarships and insurance coverage apply rely exclusively on revenue derived from media rights for intercollegiate athletics to defray any costs accrued under these provisions. MASigned into law 08/2012Postsec.Establishes the afterschool and out-of-school time coordinating council, consisting of 15 members. Outlines members, terms, meeting frequency, and 4 evaluation. Requires the council to consult with and solicit input from various persons and groups, review existing state and local programs and policies on afterschool and out-of-school time programs and make recommendations to the departments of early, elementary and secondary and higher education. Requires the council to prepare and submit an annual progress report concerning the council's activities with appropriate recommendations concerning afterschool and out-of-school time programs.

HISigned into law 07/2012P-12Directs the department of education and the Hawaii High School Athletic Association to develop a concussion educational program that includes (1) educating specified stakeholders, including students, parents, and coaches, about the signs and symptoms of a concussion and procedures to follow in a suspected concussion; (2) annual educational sessions on concussions for coaches and athletic trainers; (3) mandatory removal from athletic activity for student demonstrating signs of a concussion; (4) need for licensed health provider to evaluate student and determine whether student may return to an athletic activity; (5) monitoring of student's return to physical activity by school's certified athletic trainer. Establishes guidelines for a high school concussion awareness program to be implemented in every Hawaii High School Athletic Association member high school (public and private). Directs the department of education to submit to the legislature no later than 20 days prior to the convening of the 2013 regular session on the development and

LASigned into law 06/2012P-12Prohibits an otherwise eligible student from being determined ineligible for participation in an extracurricular interscholastic athletic activity at the student's school if the student's transfer was necessitated by military orders issued to the student's parent or legal guardian, provided that all of specified conditions apply, including that the parent/guardian is a member of the uniformed services as defined in statute. MESigned into law 05/2012P-12The bill directs the Commissioner of Education to propose a model policy for public schools and private schools enrolling more than 60% of their students at public expense in this State on the management of concussive and other head injuries in school activities and athletics. The bill also accomplishes the following.1. It directs the commissioner to invite representatives of educational stakeholders and interested parties to participate in a working group that will meet during the spring and summer of 2012 to develop a model policy that addresses the prevention, diagnosis and treatment of concussive and other head injuries in students and student athletes.2. It provides that the model policy must include the following requirements: A. That athletic directors, coaches and other school personnel involved with school activities and athletics must be provided with training in the identification and management of concussive and other head injuries;B. That a student participating in a school athletic activity and the student's parent or legal guardian must review the school's policy on the management of concussive and other head injuries;C. That schools must use protocols and forms in the implementation of the policy on the management of concussive and other head injuries;D. That a student suspected of having sustained a concussive or other head injury in any activity or athletic practice or game must be removed from participation immediately and evaluated for brain injury prior to returning to the activity or practices and games; andE. That a student suspected of having sustained a concussion after an evaluation must be banned from further participation until the student has received written medical clearance from a licensed health care provider trained in concussion management for the student to begin the gradual resumption of participation in the activity or practices and games.3. It establishes that schools are required to adopt a policy on management of head injuries and begin implementation of the policy by January 1, 2013 and further provides that schools must gradually implement the policy during the 2012-2013 and 2013-2014 school years.4. Requires the Department of Health and the Department of Education to post on their websites guidelines and materials to inform and education student athletes, their coaches and others concerning the warning signs of sudden cardiac arrest. A participating student and the student's parent must sign a form acknowledging they have received and reviewed an informational sheet based on these guidelines. A student athlete who exhibits signs or symptoms of sudden cardia arrest must be removed from play and may not return to play until he or she is cleared to do so, in writing, by a licensed physician, certified registered nurse practitioner, or cardiologist.

FLSigned into law 04/2012P-12Requires independent sanctioning authorities for youth athletic teams and the Florida High School Athletic Association (FHSAA) to (1) adopt guidelines to educate coaches, youth athletes and their parents, and other stakeholders on the nature and risk of concussion and head injury, (2) adopt bylaws or policies requiring parents to sign an informed consent on the nature and risk of concussion and head injury, (3) adopt bylaws or policies requiring immediate removal from play of a student suspected of sustaining a concussion or head injury, and (4) prohibiting return to play until the student submits written medical clearance from an appropriate health care practitioner. Directs the FHSAA to adopt bylaws for the establishment and duties of a sports medicine advisory committee with specified membership.

FLSigned into law 04/2012P-12Authorizes high schools, including charter schools, virtual schools, and home education cooperatives, to become members of the Florida High School Athletic Association (FHSAA). Prohibits FHSAA from denying or discouraging interscholastic competition between FHSAA-member and -nonmember Florida schools, and from taking retributory or discriminatory action against any of its member schools under certain circumstances. Prohibits FHSAA from withholding approval of any other athletic organization that governs athletic competition in the state. Requires FHSAA to adopt bylaws to allow a student who transfers schools to be eligible to participate in athletics if certain conditions are met. Authorizes certain penalties for a recruiting violation. Requiring the FHSAA to adopt bylaws to regulate investigators and sanction coaches who commit major violations. Specifies sanctions and procedures. Requires the FHSAA to adopt bylaws establishing the process and standards by which determinations of eligibility are made. Authorizes the FHSAA, as an alternative to adopting bylaws regarding process and standards for eligibility determinations, to adopt bylaws providing certain procedural safeguards. Prohibits FHSAA bylaws from prospectively limiting the competition of certain student athletes and from unfairly punishing student athletes for violations perpetrated by a teammate, coach, or administrator. Provides parameters for the forfeiture of contests due to eligibility or recruiting violations. Requires an expedited appeals process on determinations of ineligibility. Authorizes a school or student athlete filing an appeal to present certain information and evidence. Provides requirements for de novo decisions on appeal. Provides background screening exceptions for certain FHSAA investigators.

KYSigned into law 04/2012P-12Requires coaches to complete training on recognizing and treating concussions and head injuries. Requires the state board or its agency to develop guidelines or materials to inform student athletes and their parents of the nature and risk of concussions and head injuries. Requires removal from play of a student athlete suspected of having sustained a concussion during athletic practice or competition. Identifies actions required before an athlete with a suspected concussion or head injury may return to play. Directs the state board or its agency to adopt rules governing interscholastic athletics conducted by local boards to require each school participating in interscholastic athletics to develop a venue-specific emergency action plan to deal with serious injuries and acute medical conditions in which the condition of the patient may deteriorate rapidly. Requires each school to submit annual written verification of the existence of a venue-specific emergency action plan to the state board or its agency.

Amends requirement that a student undergo medical exam prior to participating in any athletic activity or sport. Identifies specific areas of investigation. Requires that the task force be appointed by August 1, 2012; identifies task force membership.
