Recognizes full-time secondary and/or postsecondary teaching experience in a prescribed program area as acceptable full-time work experience. Establishes legislative findings. Directs the state superintendent of education to develop a school grading system for schools and districts, using an A, B, C, D, F framework. In developing the system, directs the superintendent to seek input from specified stakeholders on how the system can reflect each school's overall academic proficiency as well as academic progress, along with other key performance indicators. Directs the state superintendent to prescribe the design and content of the school grading system by December 31, 2012, and provides legislative intent that the system be in place by the 2013-14 school year. Permits the state superintendent to assign grades to school feeder patterns or grades that reflect the fiscal health and fiscal efficiency of a school or school system. Provides relative to making grades available to the public and to parents of public school students. Requires that a school's grade, at a minimum, be based on a combination of student achievement scores, achievement gap, college and career readiness, learning gains, and other indicators as determined by the state superintendent.

Establishes the Legislative School Performance Recognition Program to recognize high performance and exemplary progress in school rankings, to be implemented no earlier than the school grading system's 2nd academic year of implementation, provided rules governing the program's administration and implementation have been promulgated by the state department of education. Provides for the awarding of financial awards to selected schools, subject to the availability of appropriated funds. Requires that funds be awarded on a competitive basis. Provides relative to awarding of funds to schools. Provides that a school eligible for an award is exempt from any statute or regulation related to the prescribed use of funds at the school level, or any categorical spending requirements imposed through the appropriation of funds from the state, except those requirements associated with the receipt of federal funds. Requires that a list of schools eligible for an award be posted annually on the department of education website. Provides that a school eligible for an award is eligible for this flexibility regardless of whether the school receives a financial award.

Changes the baseline date for the Base Realignment and Closure (BRAC) Distributions provisions in the education code from January 1, 2010 to January 1, 2006. Increases the amount the Alabama Public School and College Authority is authorized to issue bonds for (for renovation or construction of school faciliities in BRAC-impacted areas) from $175 million to $208 million; extends purpose of such bonds to include school bus fleet renewal. Amends qualifications for recipient school districts. By January 2013, requires the authority to allocate, and the department to distribute such allocation of $33 million of bond principal for local boards to renew school bus fleets. Provides that local procedures for administering such school bus fleet funds are different from existing procedures for administration of BRAC school facility construction and renovation funds. Repeals a provision that in order to qualify for bond proceeds, a local school system may redirect an existing tax not currently dedicated to schools to qualify for bonds.

Permits the 180-day minimum school term requirement to be met through the hourly equivalent thereof, beginning with the 2012-13 school year and ending with the last day of the 3rd month of the 2013-14 school year. Requires the local school calendar to be annually established by the local board of education. Establishes limits on earliest by which the school year may start and the latest that the last day of instruction may be. Prohibits a local board from reducing the amount in any cell of any employee salary schedule based on these provisions or a future modification to its calendar or schedule. Requires salary allocations in all future Education Trust fund budgets to be based on the number of contact days allocated by the legislature, or the hourly equivalent thereof. Directs the legislative fiscal office to report, by the 10th legislative day of the 2014 session, on the impact of these provisions on state tax revenues, including state sales, use, and lodging tax revenues.

Establishes the Lieutenant Dexter Holcomb Act. Prohibits a local board from hiring or entering into any agreement with any person for the purposes of operating a school bus transporting students unless the person is physically qualified to drive a school bus. Establishes requirements an individual must meet to be physically qualified to drive a school bus. Requires all new and currently employed school bus drivers to pass a physical examination, performed by a duly licensed physician, within three months after the effective date of this act, and at least once every two years thereafter. Requires local boards to document results of physical exams. Permits a driver holiding a valid Alabama school bus driver certificate to be grandfathered in under specified circumstances. Provides that failure to comply with these provisions will result in the driver losing his/her Alabama School Bus Driver Certificate issued by the state department of education.

Where feasible, provides each 9th grade student and teacher a pen-enabled tablet, mobile computer, or other similar wireless electronic device. Provides for certain sanctions to be imposed upon board members upon a finding that the action or inaction of a board member constitutes neglect of duty or willful misconduct. Requires the state board of education to adopt a model code of conduct for board members, and for local boards of education to adopt a code of conduct that includes, at a minimum, the model code of conduct adopted by the state board. Appropriates specified amounts from the Education Trust Fund to the PACT Trust Fund for the fiscal years ending in 2016, 2017, 2018, and 2019. Removes provision that specified appropriations will make the PACT Fund fully funded, according to the actuarial professional retained by the PACT board, and makes such changes retroactive to April 30, 2010. Authorizes the PACT Board to negotiate, accept, and implement a legally binding resolution with PACT purchasers and beneficiaries to address any actuarial deficit in the PACT Trust Fund. Repeals 16-33C-17, which prohibited a public institution of higher education from charging the PACT plan or a PACT plan contract owner mandatory fees or tuition per credit hour in an amount exceeding the cost of mandatory fees or tuition per credit hour, with exceptions. Makes such repeal retroactive to April 30, 2010. Repeals 16-33C-19, which strongly encouraged the PACT board to make any financially beneficial changes to PACT rules, procedures, or policies.

Clarifies which employees of the department of human resources are required to undergo criminal history background checks. Eliminates certain requirements that the department of human resources request certain criminal background information from the department of education for individuals who have had a criminal background check through the department of education.Provides for: (1) The transmission of criminal history reports from the department of public safety to the department of human resources via a FBI-certified channeler; (2) the transmission of criminal history reports to applicants that have disqualifying crimes; and (3) further clarification of the department of public safety's duties regarding the transmission of arrests or convictions or subsequent arrests or convictions for applicants. However, requires public schools to determine the citizenship and immigration status of their students, to compile data on students who are legally and illegally in the U.S. and submit such data to the state board of education. Requires the state board of education to submit an annual report to the legislature, providing data, aggregated by public school, regarding the numbers of U.S. citizens, lawfully present aliens, and of aliens believed to be unlawfully present in the U.S. enrolled at all K-12 public schools in this state. Requires that the report also:
--Provide the number of students in each category participating in English as a Second Language (ESL) programs enrolled at such schools.
--Analyze and identify the effects upon the quality of education provided to students who are U.S. citizens residing in Alabama that may have occurred, or are expected to occur, as a consequence of the enrollment of students who are illegal aliens.
--Analyze and itemize the fiscal costs to the state and political subdivisions thereof of providing instruction, computers, textbooks and other supplies, free or discounted school meals, and extracurricular activities to students who are illegal aliens.

Requires the state board to prepare and issue objective baseline criteria for identifying and assessing the other educational impacts on the quality of education provided to students who are U.S. citizens due to the enrollment of illegal aliens, in addition to the statistical data on citizenship and immigration status and ESL enrollment required by this act.

Prohibits an illegal alien from enrolling in any postsecondary institution in the state. Requires an alien enrolled in a postsecondary institution to possess either lawful permanent residence or an appropriate nonimmigrant visa. Provides an illegal alien is ineligible for any education benefit, including scholarships, grants, or financial aid. Permits a public postsecondary education institution officer to seek federal verification of an alien's immigration status with the federal government.

Requires each sports or recreational organization governing body to ensure that coaches receive annual training on recognizing the symptoms of a concussion and seeking proper medical treatment for a person suspected of having a concussion. Requires each sports or recreational organization to establish by rule the requirements of the training and timelines. Requires a youth athlete suspected of having a concussion to be immediately removed from participation and may not return to play until the athlete receives written clearance to return to play from a licensed physician.

Relates to the posting of notices of vacancies in the positions of appointed county superintendent of education and appointed city superintendent of education. Extends the deadline for the local board of education to fill the position of superintendent from 120 to 180 days. Provides that within 90 days after a vacancy occurs, a county or city board of education must announce a proposed process and timeline for posting and selecting a superintendent. Repeals language directing the state superintendent to fill a vacancy that is not filled by the statutory deadline; replaces with language directing the state superintendent to withhold state warrants until the vacancy is filled unless the board, to the state superintendent's satisfaction, exhibits good faith and reasonable effort in progress toward selecting a superintendent. Permits a county or city board of education to appoint an interim superintendent to serve for up to 180 days. Requires that the interim superintendent satisfy the minimum qualifications required for service as a county or city superintendent of education. Provides the county or city board of education is not required to post the interim superintendent position.

Subjects employees or retirees who knowingly and willfully submit false or misleading information to the board or engage in fraudulent activity to disqualification from coverage in the plan. Provides that all employees retiring after December 31, 2011, with certain exceptions, be subject to a new sliding scale premium calculation based on years of service. Provides that all employees retiring after December 31, 2011, be subject to a sliding scale premium calculation based on the difference between the age of the employee at retirement and the Medicare entitlement age. Provides that for all employees retiring after December 31, 2011, the employer contribution for a Page non-Medicare retiree may not exceed the employer contribution for an active employee no later than October 1, 2016. Provides that assistance be given to low-income employees and retirees who fall within 300% of the federal poverty level. Provides further for percentages of federal poverty level with regard to assistance to low-income families. Provides that a two-thirds vote of the Public Education Employees' Health Insurance Board is no longer required to change the employee or retiree contribution to the health insurance premium or other out-of-pocket expenses.

Provides no action may be proposed or approved based upon the personal or political reasons of the employer, chief executive officer or governing board. Establishes processes and conditions for teachers to obtain and retain tenure, and for probationary classified employees to obtain and retain nonprobationary status. Provides that neither tenure nor nonprobationary status creates or confers any enforceable right or protected interest in or to a specific position, rank, work site or location, assignment, title, or rate of compensation within those categories of employment. Provides that neither tenured status or time in probationary service are transferable from one employer to another. Provides conditions and processes for the termination of probationary classified employees and probationary teachers. Provides conditions under which tenured teachers and nonprobationary classified employees may be terminated, and procedures for such termination. Provides for a hearing upon employee request. Provides procedures for an employee terminated following a hearing to obtain a review of an adverse decision.

Provides layoffs or other personnel actions that are unavoidable reductions in the workforce beyond normal attrition due to decreased student enrollment or shortage of revenues are not subject to challenge or review under this act. Provides conditions and processes for an employee's suspension for cause with or without pay. Provides employees may be transferred or reassigned at any time as the needs of the employer require to any position for which they are qualified. Permits a chief executive officer to reassign a teacher to any grade, position, or work location within the same school, or, for two-year institutions operated under the authority and control of the department of postsecondary education, to any teaching position or work location that is under the control and jurisdiction of the institution, as the needs of the employer require. Permits tenured teachers to be transferred within an agency or system to any grade or position outside of the school to which the teacher is assigned, subject to specified terms and conditions; establishes similar conditions for nonprobationary classified employees, including employees of two-year institutions operated by the department of postsecondary education. Establishes conditions under which probationary and tenured teachers and probationary and nonprobationary classified employees may be transferred to another position with lower compensation or a shorter term of employment. Provides that the employment of a teacher whose certificate is revoked by the state superintendent of education is summarily terminated. Provides that if a conviction resulting in the revocation of the certificate is overturned, the certificate must be immediately reinstated, and the employer must either place the employee in a position for which the employee holds appropriate certification or place the employee on paid administrative leave.

Prohibits a teacher from terminating his/her employment within 30 days of first day of the next school term, or for employees of two-year institutions operated by the department of postsecondary education, within 30 days of the fall semester. Provides for relief for an employee who has been denied a hearing before an employer. Permits an employer to grant an employee a one-year leave of absence for good cause without impairing the employee's tenured or nonprobationary status. Requires that leaves of absences for military service be as provided in Section 31-2-13.

Provides that all laws or parts of laws that conflict with this act are repealed, specifically portions of the Teacher Tenure Law, commencing with Section 16-24-1; the Fair Dismissal Act, commencing with Section 36-26-100; and Section 16-24B-7, Code of Alabama 1975, relating to teacher transfers.

Adds provision that chancellor's position must be filled within 180 days after vacancy occurs .

Amends Sections 16-9-11 and Section 16-12-1. Requires local (county or city) board of education to fill a superintendent position in 120 days. Adds provision requiring notice of a local superintendent vacancy to be posted at each school campus and worksite at least 30 calendar days before the position is to be filled, and to remain posted until the position is filled. Requires notice to include specified information. Prohibits the local board from filling the position during the required posting period. Adds provision that violation of the notice requirements in this section will void any related employment action taken by the board.

Amends Section 16-60-111.9 relating to chief executive officer of any two-year school or college and CEOs of specified specialty schools in the state. Requires vacancy notice for such CEO position to be posted on the Internet. Clarifies that a vacancy in the position of executive officer may be filled by the board within more than 120 days after such vacancy occurs in the case of a financial emergency.

Requires the department to incorporate specific dropout prevention strategies, target resources, and gather data that will improve graduation rates and educational outcomes in all grades in all public schools. Directs the department to develop specific methods of intervention or identify appropriate existing methods for districts with 4-year graduation rates below a state board-determined percentage. Specifies 8 interventions that may be included. Directs the department to compile specified data on truancy, 9th grade success, alternative education placements and other indicators to ensure that dropout prevention programs are based upon evidence-based research, are data-driven and show continuous improvement. Directs the department to annually report to the legislature on outcomes of the dropout prevention program and any planned modifications based on compiled data.

Directs the state superintendent, chancellor of the department of higher education and the Alabama Commission on Higher Education to develop a plan for a high school fast track to college program offering individuals the opportunity to simultaneously earn a high school diploma as well as credits for a certificate program or associate's degree. Targets program to individuals either age 18 not enrolled in school, or age 16-18, with consent from an administrator in which the student is enrolled. Directs the department to report to the legislature on the feasibility of establishing the fast track to college program.

Limits harassment to behavior that takes place on school property or school buses, or at school-sponsored events. Provides no student should be subject to harassment or intimidation. Allows any student who is the object of harassment (or student's parent) to file a written complaint. Requires all schools to develop plans or programs, including peer mediation teams, to encourage students to report and address incidents of harassment, violence or threats of violence. Directs the department to develop a model policy prohibiting harassment, violence and threats of violence that contains specified components, including procedures to report acts of intimidation or harassment, suicide threats, violence and threats of violence.

Requires schools to:
--Implement proven practices to promote safe and harassment-free school environments
--Implement proven practices to prevent harassment, intimidation, violence and threats of violence, and to intervene when such incidents occur
--Incorporate awareness of harassment and intimidation prohibitions into character education curricula
--Report statistics on harassment, violence and threats of violence to the local board, which must provide statistics by school and for the district as a whole to the department of education for posting on the department Web site.

Provides that, to the extent that legislative or local funds are available, all school systems must implement 12 specified suicide prevention standards and policies, including educating students in recognizing signs of suicidal tendencies, informing students of available community suicide prevention services, and promoting cooperation between school staff and community suicide prevention program staff. Permits local boards of education to voluntarily implement this endorsement as the first-choice diploma option for the 2008-2009 school year. Provides that effective with 9th grade students during the 2008-2009 school year, students will be required to complete one distance-learning course prior to graduation. Allows exceptions through Individualized Education Plans.

Eliminates the Alternate Adult High School Diploma, which allowed students who did not pas all sections of the graduation exam to earn a high school diploma by completing all course requirements and passing the GED.

Establishes the Alabama High School Diploma with Credit-Based Endorsement for students who have taken the Alabama High School Graduation Exam through the 12th grade and have passed the reading, mathematics, and one of the science, language, or social studies subject-area tests of the exam. Provides that effective for students in the 12th grade during 2007-2008 school year, to earn an Alabama High School Diploma with Credit-Based Endorsement, eligible general education students and students with disabilities must complete the required credits in the core curriculum for an Alabama diploma and earn one additional Career/Technical Education (CTE) or academic credit related to the student's career objective consistent with any guidelines established by the State Department of Education and local boards of education.

Authorizes local boards to establish Credit Recovery programs allowing certain students learning opportunities to master concepts and skills in one or more failed courses. Requires course content for credit recovery courses to be composed of standards in which students proved deficient rather than all standards of the original course. Provides schools may offer these courses using computer software, online instruction, or teacher-directed instruction. Requires the curriculum to align with state board courses of study content standards in which students are deficient.

Eliminates provision that a secondary school student may earn no more than ten credits during a school year.
