Each CSSP will be (1) coordinated with law enforcement agencies, fire departments and other first responders; (2) compliant with the National Incident Management System, or "NIMS," a framework for governments and agencies to work together to prepare for, respond to, and recover from critical incidents; and (3) specific to the particular needs and requirements of each school and district. Creates a framework for developing CSSPs statewide and centralizing and coordinating state and local officials through DSHS to establish common training protocols between the emergency responders and educators to provide effective, consistent and robust emergency response.

Requires criminal background and child abuse registry checks for charter school board members; prohibits individuals who have felony convictions or convictions for a crime against a child from serving on a charter board. Requires charter school board members to disclose any financial interest they may have in the charter school.

Requires funding for new charter schools to be distributed throughout the year, contingent upon a review by the Department of Education to ensure that the finances of the school are sound. Requires an annual external audit of charter schools and adds charter schools to the Finance Recovery Team portion of the Delaware Code, authorizing the Director of the Office of Management and Budget to appoint a team to assess the financial status of a charter school that is on formal review, to provide information to parents and teachers regarding status, and to make certain decisions regarding payments by the charter school.

Moves up the deadline by which charter renewal decisions must be made so that, if a charter is not going to be renewed, that decision is made prior to the school choice deadline. Creates a mechanism for permitting a high performing charter operator to open a school that would serve students at a charter school that is slated for closure.

Reconstitutes the Delaware Mentoring Council created under former Governor Mike Castle. Establishes the council as the statewide organization responsible for promoting and facilitating mentoring programs for school-aged children. Directs the council, in cooperation with the office of the lieutenant governor and Delaware Department of Education, to support a statewide mentoring network and promote both school-based and community-based mentoring focused on building academic, career, social and life skills. Identifies constituencies to be represented among the 28 council members.

Directs the council to:
(a) Promote the benefits of mentoring and the recruitment of mentors
(b) Identify and promote "The Elements of Effective Practice for Mentoring" of MENTORTM, the National Mentoring Partnership, for safe and effective mentoring programs
(c) Oversee data collection and reporting on the status of mentoring in the state, including the number of mentoring pairs and how many children are in need of a mentor
(d) Work to ensure an adequate level of financial resources to support mentoring programs statewide, including fund raising and funds distribution
(e) Support efforts to provide and improve training, match supervision, technical assistance and evaluation of mentoring programs
(f) Coordinate centralized mentor and mentee training that is both accessible and affordable
(g) Provide technical assistance to organizations interested in starting, strengthening or expanding a quality mentoring program
(h) Coordinate statewide media campaigns, maintain a Web site and serve as the coordinator of National Mentoring Month
(i) Advocate and promote public policies that strengthen mentoring
(j) Provide an annual report of its activities to the governor each July
(g) Conduct a full evaluation of its activities and administrative arrangements within five years of the execution of this order and provide a report to the governor of its evaluation, which must include a recommendation as to the continuation of the council.

Aligns state law with the federal requirements of the reauthorized Individuals With Disabilities Education Act relating to the content of prior written notice, the requirements for the appointment of educational surrogates, and the applicable timelines for an administrative due process hearing. Changes the terminology of "handicapped person" to "child with a disability" to reflect the change in federal law and the preferred "people first" language. In addition, this Act clarifies that a child with a disability who attains the age of 21 during a school year, may continue and complete the school year.

Requires the provosts of the three public institutions of higher education in the state to be members of the council.

Provides that one of the subcommittees of the council must focus on education/work force development, and another must oversee the state's NSF-EPSCoR initiative. Directs each sub-committee to develop a strategic plan for review with the council.

For those students graduating in 2007, requires the department to award either a "State of Delaware High School Diploma" or a "State of Delaware Distinguished Achievement Diploma" utilizing the rules and regulations for issuing diplomas for the 2005-2006 school year.

Requires the department, by January 2008, to establish by regulation the proficiency levels of performance on the state high school assessments, and the use of other academic indicators and their proficiency levels to receive a high school diploma. States that "other academic indicators" must include assessments such as the Preliminary Scholastic Aptitude Test (PSAT), the Scholastic Aptitude Test (SAT), Advanced Placement test scores, American College Test (ACT), local district assessments and indicators used to determine student proficiency relative to the content standards, and other assessments approved at the state level in a content area.

Permits a student receiving a State of Delaware High School Diploma in 2004 or 2005 to seek a re-evaluation and upgrade to a Distinguished Achievement Diploma on the basis of the new standards, once adopted. States that if it is determined the student qualifies for a Distinguished Achievement Diploma under the standards in place at the time of his or her request, the department must retroactively award such diploma.

Expresses the general assembly's intent to continue and encourage the ongoing discussions relating to Delaware high school graduation requirements and to guide the progress of change to ensure the establishment of more effective and appropriate measures of student performance and standards for high school graduation.  Also expresses the assembly's desire to offer a forum for that continued discussion to interested parties who have or will come forward with their concerns and contributions.

Permits a student receiving a State of Delaware High School Diploma in 2004 or 2005 to request that his or her district or charter school reevaluate the diploma determination based on any adjustment or addition of other academic indicators for the determination of the Distinguished Achievement Diploma. Requires the Department of Education and the Department of Safety and Homeland Security to revise and update the state's school safety emergency procedures in light of the increased threat of terrorist attacks. Requires revisions and updates of said procedures to include proactive steps that attempt to prevent specific safety threats, and to investigate and potentially adopt school and district procedures that provide the maximum level of safety. States that one such local procedure that should be considered is one requiring each school building to be "locked down" in a manner that allows building occupants to exit in the event of an emergency, but that prevents entrance into the building from all but a single point of entry with that point of entry being attached to a buzzer or bell that notifies a responsible person of a visitor's need to enter the building. Requires the secretaries of each department to consider all reasonable aspects of implementation prior to final adoption of any revisions or updates of said procedures, including but not limited to cost, practicability, educational effect, etc.

Mandates that by January 10, 2006 the secretary of the department of education provide the Governor and the General Assembly with a report of the status of the aforementioned revisions and updates and outlining such issues as are necessary to ensure that the General Assembly has a thorough understanding of any proposed revisions and updates.

1. The Delaware Department of Education shall convene a panel of three national experts in the areas of assessment, accountability, and/or standard setting. Said experts will be chosen as follows: one by Delaware Department of Education, one by the members of the Delaware Education Consortium (Delaware Chief School Officers Association, Delaware Association of School Administrators, Delaware State Education Association, Delaware School Boards Association, the State Board of Education and the Delaware Charter Schools Network) and one jointly chosen by the President Pro Tempore of the Senate and the Speaker of the House of Representatives.
2. The panel shall be provided with all applicable and related information regarding the development of the assessments, the setting of performance levels, and the design of the student accountability system from the Department of Education and from any other study or paper that has been produced by any other stakeholder groups.
3. The panel may also consider other sources of information from regional or national studies that have been conducted on related matters.
4. The panel shall also examine the levels of incentives and consequences associated with the student accountability system including requirements for student improvement activities such as Individual Improvement Plans, summer school, retention and promotion, and awarding of diplomas and scholarships.
5. The Department of Education shall also contract with three national experts to conduct a full review of the implementation of standards based curriculum in mathematics in both middle and high schools in Delaware. Said experts will be chosen in the same manner as the assessment panel, one by the Department of Education, one by the Education Consortium and one jointly chosen by the President Pro Tempore of the Senate and the Speaker of the House of Representatives.
6. To ensure public participation in the process, a posted public comment period shall be utilized to allow members of the public to submit written public comments to either or both panels.
7. The expert panel on assessment and accountability and the expert panel on curriculum shall present findings and recommendations regarding these issues, including a timeline for proposed implementation, to the Governor and the General Assembly not later than February 15, 2005.

Before enactment of this legislation, this subparagraph banned any 3rd-, 5th- or 8th-grader scoring Well Below the Standard on the state reading assessment from being promoted to the next grade unless the student participated in a summer school program and attained a proficient-level score on the state reading assessment before the start of the new school year. The subparagraph now states that a 3rd-, 5th- or 8th-grader scoring Well Below the Standard on the state reading assessment may not be promoted to the next grade unless he/she attends a summer school program and scores at Below the Standard or above on the state reading assessment before the start of the next school year and, if the student at the end of summer school scores at Below the Standard, the student's parents/guardian and the district agree upon an individual improvement plan. In addition, a separate subparagraph barred any 8th-grader performing Well Below the Standard on the state math assessment from being promoted to the next grade unless he/she attended summer school and attained a proficient score on the state math assessment before the beginning of the new school year. The new legislation changes this such that now no 8th-grader scoring Well Below the Standard on the state math assessment can be promoted unless he/she attends summer school and scores at Below the Standard or above on the state math assessment before the start of the new school year and, if the student performs at Below the Standard, the student's parents/guardian and the district agree on an individual improvement plan. http://www.legis.state.de.us/LIS/LIS141.NSF/vwLegislation/

Requires a sex offender who is also a student attending school to notify the principal that the student is on the sex offender registry; requires that sex offenders include their future place of study as well as employment on sex offender registration forms; adds new methods of community notification such as electronic mail and fax. Requries that schools, districts and licensed day care providers keep a binder of community notifications and ensure that parents and staff are aware of its availability. The section also prohibits the physical posting of notifications in schools and day care providers and requires that schools educate students on personal safety and awareness. Continues the existence of the Community Notification Task Force until January 31, 2003 to oversee implementation of this Act. This section also expands membership on the Task Force and charges the Task Force with overseeing the development of a public awareness campaign of the State's Sex Offender website.

Currently, in order to get a school bus endorsement, drivers can not have been convicted of a felony within the past 5 years. This Act modifies that requirement so that it more closely parallels the rules governing when a convicted felon would be eligible to regain the right to vote. This Act also closes a loophole in the law governing school bus drivers who operate school busses within the State on licenses issued by another state (i.e. out-of-state drivers). Finally, this Act contains a grandfather clause so that persons who are currently school bus drivers will not be adversely effected.

Beginning in 2002, at least 20% of educator's performance evaluation will be tied to student improvement -- teachers and administrators who fail to measure up can be dismissed. Establishes more rigorous system of professional development, teaching standards, licensure and certification requirements; expands the salary system to include compensations for skills and knowledge. Encourages focused, career-long professional development and compensates teachers for additional responsibilities or becoming National Board certified. Ends social promotion - beginning in 2002, students reading below the standard in 3rd, 5th and 8th grades will be required to attend summer school and meet standard to move to next grade. Same provisions apply to 8th graders for math. Students not meeting standards will receive mandatory individual improvement plans (some state funds available for extra time instruction). Future students must demonstrate they meet 10th grade standards in language arts and math to receive academic diploma.
