Creates the Idaho Workforce Development Council (the "Council") in accordance with section 111(e) and 117(c)(2)(A) of the Workforce Investment Act (WIA) of 1998.
The Council shall consist of not more than 33 members appointed by the Governor, consistent with federal nomination and composition requirements set forth in section 702 of the Job Training Partnership Act.

The Council will be responsible for advising the Governor and the State Board of Education on the following:
a. Development of a statewide strategy for workforce development programs which encompasses all workforce programs;
b. Development of the WIA State plan;
c. Development and continuous improvement of services offered under the statewide workforce investment system;
d. Development of comments at least once annually on the Carl D. Perkins Vocational and applied Technology Education Act;
e. Development and continuous improvement of comprehensive State performance measures;
f. Preparation of the annual report to the United States Secretary of Labor as required under section 136 of the WIA;
g. Development of a statewide employment statistic program;
h. Development of a plan for comprehensive labor market information; and
i. Development of applications for an incentive grant under section 503 of the WIA.
The Council shall also be responsible for:
a. Approval and oversight of the expenditures from the Employment Security Reserve Fund as
set forth in Section 72-1347A, Idaho Code;
b. Development and oversight of procedures, criteria and performance measures for the
Workforce Development Training fund established under Section 72-1347B, Idaho Code;
and

Health--Child Abuse

Orders the continuance of the Governor's Task Force on Children at Risk (Task Force). The Task Force is responsible for reviewing and developing programs, as well as facilitating local jurisdictions to operate programs designed to improve:
a. The handling of child abuse and neglect cases, particularly cases of child sexual abuse and exploitation;
b. The handling of cases of suspected child abuse or neglect related fatalities;
c. The investigation and prosecution of cases of child abuse and neglect, particularly child sexual abuse and exploitation; and
d. The handling of cases involving children with disabilities or serious health-related problems who are victims of abuse or neglect.

Further, the Task Force shall establish and support a statewide child fatality review team (CFRT) to allow comprehensive and multidisciplinary review of deaths of children younger than 18 years-old, in order to identify what information and education may improve the health and safety of Idaho's children. The recent construction of a new elementary school in the Plummer-Worley School District
represents the first use of the state failsafe provided through HB 743 (2006), ensuring that no
child in Idaho will attend school in an unsafe facility. While the process worked successfully
and smoothly in this instance, it highlighted two issues that could become problems in future
cases. The first issue is that the state panel that is established to review these cases has no access
to funds if additional planning and design work must be completed prior to the panel making a
decision. The second is that there is no provision for dealing with construction cost overruns.
This legislation deals with the first issue by allowing the panel to expend up to $150,000 from a
dedicated funding source to develop additional plans, if necessary. The second issue is dealt with
by clarifying that the panel can request that the Legislature appropriate additional funds from the

Provides for 97% average daily attendance (ADA) funding protection for Idaho school districts. This is important because school districts must make teacher contract offers by
no later than July 1st, before they know how many students will show up for school at the end of summer. The bill would allow school districts that lose more than 3% of their students, year over year, to continue receiving state funding as if the district only lost 3% of its students. The ADA-driven loss of funding would "catch up" the following school year, since this protection feature would reset to 97% of the lower ADA count. Helps separating service members who leave the military with documented training and experience that can prepare them for civilian employment; but this documentation is not always used by state entities to qualify them for licenses required for their occupation or to provide them academic credit. Reported unemployment rates of separating service members that are higher than national averages have brought attention to supporting issues such as expedited licensure and increased academic credit recognition to alleviate this problem. As of June 2011, 1,000,000 veterans were unemployed and the jobless rate for post-9/11 veterans was 13.3%, with young male veterans (ages 18 to 24) unemployment rate at 21.9%. This legislation makes amendments to SB 1184 – the third bill in the Students Come First plan. These changes are as follows:

Additional relief is granted from the state's "use it or lose it" requirement for state instructional staff funding. The relief is expanded from the 6%, 8% and 10% granted by SB 1184 for FY12, FY13 and FY14+ to 7%, 9.5% and 11%. This adjustment allows the amount of relief to better reflect the actual budget that was set for Public Schools after the introduction of SB 1184.

Revises provisions relating to fractional average daily attendance for students attending more than one school district or public charter school, or who are enrolled in online courses.

Revises provisions relating to staff allowances and funded positions and revises provisions relating to the education portion of the experience and education multiplier table.

Revises provisions relating to: certain staff salaries; Idaho digital learning academy funding, and; distribution of state funds for certain math and science courses.

Establishes provisions for dual credits for early completers, making them eligible for up to 36 post-secondary credits of dual credit courses in twelfth grade.

Revises provisions permitting post secondary institutions to operate public charter schools.

Declares an emergency for all sections of this act and SB 1184, and language is added to provide greater time specificity for certain provisions. Creates a new section which will provide provisions in the event of an unanticipated public charter school closure. The provisions require school districts or public charter schools to report students newly enrolled who were enrolled from a public charter that has closed during that school year. The state department of education will use the reported enrollment information to calculate funding that the district or public charter schoolwould have received had the enrollees been enrolled in such districts for the entire school year. Such funding shall be prorated based on the number of days left in the school year and will be included in the next scheduled payment to the district or public charter school.

Students completing all state high school graduation requirements, except the senior project, by no later than the start of the twelfth grade will be eligible for up to 36 postsecondary credits of dual credit courses during their twelfth grade year. Average daily attendance will be counted as normal for such twelth grade students for public school funding purposes. In addition, the state department of education will distribute funds fron the moneys appropriated for the educational support program to defray the per credit cost charged for such dual credit courses by accredited postsecondary institutions. The amount so distributed is not to exceed $75.00 per credit hour.

Oversight moved from the state board of education to the Professional Standards Commission. School districts - employees - Amends and adds to existing law to revise procedures, processes and fees before the Professional Standards Commission; to provide for an applicant for employment at a school district to sign a release that prior personnel files shall be released to the district, to provide immunity from liability and to provide penalties for disclosure of information. Adds language to Section 33-1209 on "Proceedings to Revoke, Suspend, Deny or Place Reasonable Conditions on a Certificate, Letters of Reprimand, Complaint, Subpoena Power, Hearing" stating that, upon receipt of a written and signed allegation of ethical misconduct, the chief certification officer, in conjunction with the attorney general and the professional standards commission investigator conduct a review of the allegation to determine if the complaint should be remanded to the school district to be resolved locally or to open an investigation and forward the case to the Professional Standards Commission. Within fourteen (14) days of the decision, the chief certificiton officer is to notify the complainant and teacher in writing that an investigation will be conducted and the teacher should be afforded an opportunity to respond to the allegation verbally and in writing prior to the issuance of the complaint. The executive committee of the Professional Standards Commission is to review the circumstances of the case at one of the next two regularly scheduled meetings. Timeline is set for processing the complaint. For any person certified in another state and applying for certification in Idaho, the chief certification officer is instructed to deny an application if there are any unsatisfied conditions on such current or previously issues certificate or if there is any form of pending investigation by a state agency concerning the applicant's teaching license or certificate.

Districts will be authorized to keep the positions and funding associated with salary based apportionment if not fully utilized up to 6% in FY 2012, 8% in 2013 and 10% in FY 2014. The bill allocates dollars from the funding formula to other areas within the public school budget. The adjustment ranges from 1.67% to 6.42% over the next five years.

Section 33-515 states that it is the intent of the legislature that after January 31, 2011, no new employment contract between a school district and a certificated employee shall result in the vesting of tenure, continued expectations of employment or property rights in an employment relationship. Therefore, no board of trustees has the authority to enter into any renewable contract with any certificated or other employee hired by such district, except as specifically addressed by section 33-515 and 33-514 (3), Idaho Code. For any certificated employees already holding renewable contract status with a district as of January 31, 2011, the employees have the right to the continued automatic renewal of that employee's employment contract. For those employees not grandfathered in, there are two categories of annual contracts. A category A contract is a limited -year contract for certificated personnel in the first or greater years of continuous employment with the same district. A category B contract is a limited 2-year contract that may be offered at the sole discretion of the board of trustees who may choose to add an additional year to such a contract upon the expiration of the first year, resulting in a new 2-year contract. For employees whose contracts will not -- at the board's discretion -- be renewed, notice must be provided to the employee in writing by July 1. Employees must be given, upon request, the opportunity for an informal review of such a decision by the board of trustees. Provides that districts wishing to have a teen early intervention mental health and substance abuse specialist placed in the district may apply may apply to the department of health and welfare for such placement.

Provides that 750,000 of the $6,040,000 appropriated for programs for limited English proficient students be distributed to schools in which English language learners failed to meet Adequate Yearly Progress (AYP) in math or reading. Requires the department to develop the program elements governing the use of these funds, modeled on the training, intervention and remediation elements of the programs described in Section 7 of the bill (see below). Specifies that these funds are to improve the English language skills of English language learners, to enable such students to better access the educational opportunities offered in public schools. Requires these funds to be distributed on a one-time basis. Requires the superintendent of public instruction to report to the Joint Finance-Appropriations Committee and the House of Representatives and the Senate Education Committees by February 1, 2007, on the program design, uses of funds, and effectiveness of the program.

Establishes the Early Childhood Coordinating Council (as a follow-up to votes by the Interagency Coordinating Council and the Early Care and Learning Cross Systems Task Force to merge) to develop a statewide plan to meet goals related to early care and learning. Directs the council to:

a. Establish an ongoing communication network between state agencies, policymakers, families, stakeholders and communities for the purpose of planning and implementation of a coordinated system of early care and learning in Idaho;
b. Develop multiagency state partnerships among critical stakeholders;
c. Compile resources and identify information on the current best practices in early childhood systems building;
d. Provide a comprehensive statewide mapping of existing early care and learning programs and resources, as well as existing gaps, every three to five years;

g. Align policy and funding systems to develop and support integrated early care and learning system development.


Likewise expands the council's scope from birth to three, to all children from birth through eight and their families. Directs the council to: develop, implement, and sustain a statewide early care and learning strategic plan that maintains the framework of health, social and emotional development, early care and learning, parent education, family support and self sufficiency, and systems development; and recognize language changes to meet federal guidelines for the Individuals with Disabilities Education Act (IDEA) such as service coordination, social and emotional development, adaptive skills and developmental delay.
Expands the council's membership to meet federal requirements for IDEA. Enhances geographical, cultural, political, professional and family diversity in council membership.

Provides that other members may include educators, including representatives from institutions of higher education and local education agencies; experts in the delivery of human, educational, environmental, or public safety services; representatives of Indian tribes; and out-of-school youth or at-risk youth.

a) To develop a three-year comprehensive national and community service plan and establishment of state priorities;

Provides for a $25 million Public School Facilities Cooperative Fund to remediate unsafe school facilities, as a last resort, if the school district has been unable or unwilling to solve the problem. Allows a district to apply to use the fund if they have attempted to pass a bond levy to address the problem and failed. Allows the division of building safety to apply on behalf of a school district, if the district cannot or will not act. State approval of a project, or a modified version of it, automatically refers the approved project to the voters in the district, for one last attempt at bond passage. Failure of the bond then triggers up-front state funding of the project, and directs state supervision of the school district, to last until the project is completed. State funding of a project will also trigger a property tax levy in the school district, the proceeds of which will be deposited back in the Public School Facilities Cooperative Fund. The amount that district taxpayers would pay into the fund would vary, depending on the levy rate, which is recalculated each year, and the district's relative wealth. Wealthier districts with low levy rates would
likely pay 100% of the project cost into the fund, while poorer districts with high levy rates would pay less. The levy could run for no more than 20 years, even if the
