Provides that a school corporation that enrolls a student who has legal settlement in another school corporation for the student to receive services from a nonpublic alternative high school receives state tuition support for the student. Requires an accredited nonpublic school to provide sufficient verbal information to permit a requesting school to which a child transfers to make an appropriate placement decision when the parent of the child is in breach of a contract that conditions release of student records on the payment of outstanding tuition and other fees.

Requires the state board of education to conduct a second count of students enrolled in school corporations and charter schools in February of each school year, with the first count being in September. Expires the school funding formula on July 1, 2013.

Transfers the appropriation and funding for charter school start-up grants to the appropriation for state tuition support. Increases the amount of the charter school start-up grant for charter schools that begin operation in calendar year 2012 and provides that the grant is to be paid in six installments with one installment in each of the last six months of calendar year 2012.

Abolishes the state student assistance commission (SSAC). Abolishes the commission on proprietary education (COPE). Requires the commission for higher education (CHE) to administer the functions formerly administered by SSAC. Establishes the board for proprietary education (BPE). Permits the BPE to adopt reasonable rules. Specifies that the BPE must meet at least four times each year. Provides that the BPE is responsible for accrediting a postsecondary credit bearing proprietary educational institution. Provides that the CHE is responsible for providing staff and office space for the BPE. Specifies that the CHE is to determine the maximum higher education award and freedom of choice award, subject to approval by the budget agency with review of the budget committee. Requires the CHE to submit annual higher education award reports to the budget committee. Provides that the state workforce innovation council is responsible for accrediting postsecondary proprietary educational institutions that are non credit bearing. Establishes the office for career and technical schools within the state workforce innovation council. Provides that the market research of a postsecondary credit bearing proprietary educational institution may not be considered or required by the BPE as a condition for accrediting or renewing the accreditation of or for approval of the programs of a postsecondary credit bearing proprietary educational institution. Transfers proceedings pending before the Indiana commission on proprietary education on July 1, 2012, to the BPE for a proceeding pertaining to a postsecondary credit bearing proprietary educational institution or to the state workforce innovation council if the proceeding pertains to a postsecondary proprietary educational institution. Requires the auditor of state to transfer $300,000 of the balance of the career college student assurance fund to the career college student assurance fund administered by the BPE. Requires the state auditor to transfer the balance of the current career college student assurance fund to the student assurance fund administered by the state workforce innovation council. Requests the legislative council to assign issues relating to the accreditation of proprietary institutions to an appropriate study committee. Repeals: (1) provisions relating to establishment and administration of SSAC; (2) provisions relating to establishment and administration of COPE; (3) certain provisions requiring the CHE to provide SSAC information to implement the minority teacher or nursing scholarship program; and (4) definitions relating to SSAC or COPE. Provides that the public meeting must occur at least seven days before a contract for employment is entered. Provides that the governing body is not required to disclose the identity of the candidate for superintendent at the public meeting. Requires that the governing body shall post the provisions of a superintendent's employment contract on the school corporation's Internet web site. Requires a school corporation to post the provisions of an employment contract with a certificated employee that is not represented by an exclusive representative on the school corporation's Internet web site. Provides that after a governing body and the certified employees' exclusive representative have reached an agreement on a contract, the governing body shall post the contract on the school corporation's Internet web site. Establishes the center for deaf and hard of hearing education (center) to ensure that children who are deaf or hard of hearing acquire optimal communication and academic abilities. Specifies the duties of the center. Provides that before July 1, 2013, the office of management and budget (OMB) shall, in consultation with the Indiana School for the Deaf, the department of education, the state department of health, and the office of the secretary of family and social services, recommend to the general assembly through the budget process an appropriate agency to provide support for the center. Specifies that until the center is established and operating, the Indiana School for the Deaf shall continue to provide those services that will be transferred at the time the center is established and operating. Provides that the state board of finance and the state budget agency may not transfer for use by or for the center any appropriation made to the Indiana School for the Deaf by the 2011 budget act. Transfers the outreach services and consultative services to local education agencies to assist in meeting the needs of locally enrolled students with hearing disabilities of the Indiana School for the Deaf to the center. Provides that, before October 1, 2012, the OMB (in consultation with the Indiana School for the Deaf, the department of education, the state department of health, and the office of the secretary of family and social services) must submit a transition report to the state budget committee. Requires the OMB in developing the transition report to also consult with other specified entities, and to conduct two public meetings prior to submitting its transition report. Requires the OMB to post the final transition report on its Internet web site. Requires the state budget committee to consider the transition report in the state budget report and budget bill. Changes references throughout the Indiana Code from "hearing impaired" to "hard of hearing". A new section (20-28-9-1) requires increases or increments in a local salary scale based on the following factors: 1) Combination of the following factors can account for no more than 33% of the calculation used to determine a teacher's increase or increment (number of years of experience and the attainment of either additional content area degrees or additional content area degrees and credit hours); 2) Results of evaluation; 3) assignment of instructional leadership roles, including the responsibility of conducting evaluations; 4) academic needs of students in the school corporation. Teachers rated ineffective or improvement necessary may not receive any raise or increment for the following year if the teacher's contract is continued. Teachers may appeal. By January 31, 2012, requires the department of education to publish a model salary schedule that a school corporation may adopt, and each school corporation is required to submit its local salary schedule to the department, where they will be published to the department's web site. Modifies language concerning supplemental services contracts to allow administrators to select and pay summer school teachers. Clarifies that current teacher salaries cannot be reduced due to a new salary scale adopted to meet requirements of S.B. 1.

Defines "attend" for purposes of the compulsory school attendance law. Requires school corporations to have a policy outlining both excused and unexcused absences. Bill indicates that attendance is excused only if it is in accordance with the governing body's excused absence policy. It specifies that to hold a parent accountable for an attendance violation, notice must be delivered personally to the parent. The bill also requires a superintendent or attendance officer to report a habitually absent child to the juvenile court or the Department of Child Services.

Beginning in 2012, school board members selected by election must be elected at general elections and take office the following January 1. Provides that a school board plan may be amended to allow for both election and appointment of the members of the school board. Allows a change in a school board plan to be initiated by the filing of a petition signed by at least 10% of the voters of the school corpation with the clerk of the circuit court. Provides for a public question to be placed on the ballot of the 2011 municipal election in Mishawaka asking the voters whether the method of choosing members of the governing body of the Mishawaka school corporation shuld be changed. Establihes, ifthe voters of Mishawaka approve the public question, a governing body of the members, three of whom are elected at large by the voters of the city, one of whom is appointed by the city executive, and one of whom is appointed by the city legislative body. Provides other details of the organization of the governing body. Provides for the election rather than the appointment of the members of the school board for the city of East Chicgo and adds certain other provisions concerning the composition and organization of the school board. Repeals provisions related to the election of school board members at the primary election position and organization of the school board. To be licensed as an elementary teacher, individuals must be able to demonstrate comprehensive scientifically based reading instruction skills, including: (a) phonemic awareness; (b) phonics instruction; (c) fluency; (d) vocabulary; and (e) comprehension (the last three are new). These are in addition to other prior requirements that included (1) basic reading, writing and math; (2) pedagogy; (3) knowledge of the areas in which the individual is required to have a license to teach.

Teaching Quality--Certification and Licensure

Establishes an annual staff performance evaluation that categorizes teachers as highly effective, effective, improvement necessary, or ineffective. Allows school corporations to meet requirements for evaluation plans by using any of the following models: A plan using master teachers or contracting with an outside vendor for master teachers; the System for Teacher and Student Achievement (TAP); or the Peer Assistance and Review Teacher Evaluation System (PAR). Specifies components that plans must include, such as annual evaluations for all certificated employees; objective measures of student achievement and growth to significantly inform the evaluation; rigorous measures of effectiveness, including observations and other performance indicators, and an annual designation of highly effective, effective, improvement necessary or ineffective; an explanation of the recommendations for improvement and the time in which improvement is expected; and a provision that a teacher who negatively affects student achievement and growth cannot receive a rating of highly effective or effective. Specifies that a teacher rated ineffective or improvement necessary may not receive a raise or increment for the following year. Provides that a student may not be instructed two years in a row by two different teachers who have been rated as ineffective in the year preceding the student's placement in that class if avoidable. Changes the process concerning how teacher contracts are canceled (affects tenure). For any teachers hired after 7/2012, teachers with a rating of ineffective are considered probationary. Probationary status for teachers hired after 7/2012 is for one year, plus a new contract. Teachers hired after 7/2012 may be dismissed for incompetence, and incompetence is defined as an "ineffective" rating on 2 consecutive evaluations or 2 consecutive "improvement necessary" ratings or "ineffective" or "improvement necessary" ratings in 3 out of 5 years. Requires notice of cancellation of a teacher's contract not earlier than May 1 and not later than July 1. Eliminates the Advisory Board of the Division of Professional Standards of the Indiana Department of Education (IDOE). Repeals references to the advisory board and the existing staff performance evaluation provisions, and makes corresponding changes to related sections. Requires the IDOE to revoke the license of a licensed school employee if the employee is convicted in another state or under federal statutes of an offense that is comparable to the felonies for which the employee's license would be revoked if committed in Indiana.

Adds new sections of law (20-28-6-7.5 and 20-28-7.5). PROBATIONARY STATUS: For teachers not under contract prior to 7/2012, a teacher is considered probationary if he/she was under contract after 7/2011, has not yet received a rating or receives a rating of ineffective, has not entered into a contract for further service, and has not received 3 ratings in a 5 year period of effective or highly effective. After June 30, 2011, a teacher who receives a rating of effective, highly effective or a combination for at least 3 years in a 5 year period becomes a professional teacher by entering into a contract. A professional teacher who receives a rating of ineffective will be considered probationary but is not subject to cancellation of the teacher's contract unless at least one of the following criteria applies: 1) receives a rating of ineffective in the year immediately following the initial rating of ineffective; 2) cancellation is due to a justifiable decrease in the number of teaching positions; 3) contract cancellation is due to conduct set forth in IC 20-28.7.5-1(b). CANCELLATION of CONTRACT: After June 30, 2012, contracts cancelled due to a justifiable decrease in the number of teaching positions must be determined on the basis of performance, not seniority. For teachers under contract prior to 7/2011, 2 years probationary for semi permanent teachers and 5 years probationary for permanent teachers. Lists reasons that allow for immediate cancellation of a contract: 1) immorality; 2) insubordination, which means a willful refusal to obey the state school laws or reasonable rules; 3) justifiable decrease in the number of teaching positions; 4) incompetence, including receiving an ineffective designation on 2 consecutive evaluation or an ineffective designation or improvement necessary rating in 3 years or any 5 year period; 5) neglect of duty; 6) conviction for an offense list in law; 7) other good or just cause. Notice for any reason other than reduction in force must inform the teacher that, no later than 5 days after teacher's receipt of the notice, the teacher may request a private conference with the superintendent, and the superintendent must set the meeting not later than 10 days after.Teachers may also request a conference with the governing body.

Indiana has recently enacted comprehensive collective bargaining reform for public education employees under Public Law 48-2011; and the legislation has substantially limited the nature and relationship of collective bargainin contracts to wages and wage-related benefits. Indiana school corporation contracts shall not exceed two years in duration and cannot force a school corporation to deficit spend. The Indiana Education Employment Relations Board is charged with the regulatory authority over the implementation of this new law. The Indiana Education Employment Relations Board consists of a chairperson, two board members and limited staff to implement this comprehensive reform effort. The Indiana Department of Education has extensive legal, regulatory and policy staff available to directly support Indiana Education Employment Relations Board in the implementation of this landmark legislation. The State Superintendent of Public Instruction is charged with the general supervision of public education and is the designated director of the Indiana Department of Education. The Indiana Department of Education has extensive legal and fiscal responsibilities related to the proper implementation of collect bargaining reform that can be more effectively and efficiently utilized with the direct oversight and leadership of the Indiana Education Employment Relations Board by the State Superintendent of Public Instruction.

Allows charter schools to opt in to the state health insurance plans. Establishes the charter school board as a statewide sponsor of charter schools. Provides that the department of education shall provide staff to the charter school board until the board begins receiving administrative fees from schools chartered by the board. Adds certain nonprofit private colleges and universities as eligible charter school sponsors. Establishes certain accountability criteria for charter school sponsors, and places charter schools under accountability standards for public schools. Adds: (1) student academic growth; (2) financial performance and stability; and (3) board performance and stewardship; to the list of items to be included in a charter school's charter. Requires uniform and consistent transfer of credits for students who transfer from a charter school to another public school. Stipulates that a teacher in a conversion charter school may be an employee of the charter school or the school corporation as determined in a charter school's charter. Provides that at least 90% of the full time teachers in a charter school must be licensed or in the process of obtaining a license. Ends the virtual charter school pilot program, and allows existing virtual charter schools to seek sponsors. Provides that a virtual charter school's funding is equal to the sum of: (1) the virtual charter school's ADM multiplied by 85% of the school's foundation amount (rather than 80% of the statewide average basic tuition support, under current law); plus (2) the total of any special education grants to which the virtual charter school is entitled. Provides that each school year, at least 60% of the students who are enrolled in virtual charter schools for the first time must have been included in the state's ADM count for the previous school year. Sets out the conditions, accounting process, and reporting procedures for a charter school sponsor concerning the collection of fees from its sponsored charter schools. Requires the department of education to establish a charter school page on the department's Internet web site. Establishes the charter school facilities assistance program and fund. Specifies the purposes for which grants and loans of money in the fund may be used. Provides that money in the fund may be used to match federal grants from the United States Department of Education for charter school facilities, and deletes current law that allows common school fund interest to provide these state matching funds. Changes the procedure for converting a public school into a charter school. Establishes a "trigger" for conversion of a school to a charter school with both parents and the school board signing off on the conversion. Establishes a process by which charter schools may lease or purchase unused, closed, or unoccupied school buildings that are maintained by school corporations and are not being used for classroom instruction. Permits the state board of education to close a charter school, transfer sponsorship of a charter school, or reduce the administrative fees collected by the sponsor of the charter.

Creates a nine member board of trustees (board) for the system appointed by the governor as follows: (1) at least one member with experience in economics, finance, or investments; (2) at least one member with experience in executive management or benefits administration; (3) the director of the budget agency (or designee) serving as an ex officio voting member; (4) two members nominated by the speaker of the house of representatives: one an active or retired police officer or firefighter who is a member of the 1977 Fund and one TRF member; (5) two members nominated by the president pro tempore of the senate: one PERF member and one TRF member; (6) one member nominated by the auditor of state: the auditor of state or an individual with experience in professional financial accounting or actuarial science; and (7) one member nominated by the treasurer of state: the treasurer of state or an individual with experience in economics, finance, or investments. Requires that initial appointments to the board give a preference for those individuals who, on June 30, 2011, are serving as trustees of PERF and TRF, and provides that a PERF or TRF trustee appointed to the board serves until the trustee's term would have expired under prior law. Provides for a four year term for trustees. Provides that a trustee is strongly encouraged to complete annually at least 12 hours of trustee education. Provides that five trustees constitute a quorum and requires a majority vote of the trustees present in order for the board to adopt a resolution or take other action at a regular or special meeting. Requires the system's chief investment officer and the officer's staff to file annual financial disclosure statements with the inspector general. Provides that the board's powers and duties are the combined powers and duties of the PERF and TRF boards. Provides that each retirement fund continues as a separate fund managed by the board. Provides for a director of the system who is appointed by and serves at the pleasure of the board. Provides that employees of PERF and TRF remain members of those funds. Provides that new hires of the system become PERF members, unless the director expressly determines otherwise. Allows the board to establish contribution rate groups for PERF, and removes the requirement that each employer have a separate account within the retirement allowance account.

Provides that if a complaint that is filed alleging an unfair practice concerning a subject of discussion is found to be frivolous, the complaining party is liable for costs and attorney's fees. Modifies the meditation process. Establishes a process for factfinding. Expands the purposes for which money in the capital projects fund may be used. Repeals provisions concerning minimum salary and salary increments for teachers, the definition of ''submission date", and a provision allowing the statutory procedures for refusing to continue or canceling a teacher contract to be modified by an agreement, certain provisions concerning mediation and factfinding, and makes conforming changes to related sections.

In addition to appropriate consultation with parents or guardians, the plan must include the following: (1) Reading skills standards for grade 1 through grade 3; (2) emphasis on the method for making determinant evaluations by grade 3 that might require remedial action for the student, including retention as a last resort, after other methods of remediation have been evaluated or used, or both, if reading skills are below the standard; (3) fiscal impact of each component of the plan must be taken into account. For any component of the plan that has a fiscal impact, the state superintendent must present those components of the plan to the general assembly. Adds a new chapter to the code, Chapter 16—School Fund Transfers.
Allows the governing board of a school corporation to adopt a resolution to transfer money during the 2010-2011 school year from its capital projects fund if no employees of the school corporation will receive a compensation increase for the 2010-2011 school year, excluding certain incidental or automatic increases, certain reimbursement to teachers for completion of professional education development courses, and a compensation increase paid to a teacher as a result of the teacher receiving an advanced higher education degree. Provides that the maximum amount that may be transferred from a school corporation's capital projects fund is equal to 10% of the sum of: (1) the balance in the school corporation's capital projects fund on December 31, 2009; plus (2) the amount of the school corporation's property tax levy for its capital projects fund for taxes first due and payable in 2010. Provides that the governing body of a school corporation and an exclusive representative may mutually agree to forego any salary or compensation increases that would otherwise be required for the 2010-2011 school year under the statutes concerning minimum teacher pay. Testing and Remediation monies were increased by $10 million to a total of $41 million/year, while GQE Remediation funds remained level at $4.9 million/year. Creates funding of up to $100,000/year for school consolidation studies that school corporations can apply directly to the IDOE to use in order to assess the feasibility of consolidation or merging services with another corporation. Funds the school finance studies conducted by the Center for Evaluation and Education Policy at Indiana University at $140,000/year. Requires a comprehensive study of the efficiency and effectiveness of charter schools in Indiana and commissions the Center for Evaluation and Education Policy to complete the study. Keeps funding for summer school constant at $18.36 million/year. Funds education service centers at $2.32 million/year. Funds the Principals' Leadership Academy at $462,832/year. Authorizes the board of trustees of Ball State University, Indiana State University, Indiana University or Purdue University to establish a university-administered school in any county in Indiana in which the institution is situated. Allows a district board to enter into a contract with the board of trustees of one of the authorized institutions to educate students in a university-administered school.

Authorizes the board of trustees of Ball State University, Indiana State University, Indiana University or Purdue University to establish at the institution's main campus laboratory schools for:
        (1) developing, testing, and evaluating new methods of instruction and materials;
        (2) comparing new methods with conventional methods in use; and
        (3) training teachers in new methods of instruction and materials, as is found acceptable.
Directs an institution operating a laboratory school to prepare an annual report containing:
        (1) a comparison of the results obtained by the new methods of instruction with the conventional methods of instruction; and
        (2) the new methods of instruction recommended for general use in public schools.

Authorizes Ball State University to establish the Indiana Academy for Science, Mathematics, and Humanities as a laboratory school. Provides the academy must serve as both a public, residential high school and a program for public school educators. Authorizes Indiana University to establish the Indiana School for the Arts as a laboratory school. Provides the school must serve as both a public, residential high school and a program for public and nonpublic school educators. Directs both the academy for science, mathematics and humanities and the school for the arts to:
(1) establish an advisory committee that represents the education and business communities in Indiana (in the case of the academy) and the education and the arts communities in Indiana (in the case of the school for the arts);
(2) determine the standards for admissions and the curricula and courses of study to be offered;
(3) develop curriculum material for distribution and use throughout the public school system;
(4) develop programs to encourage interaction with public school educators (and nonpublic school educators, in the case of the school for the arts);
(5) make curriculum material available to students in public schools throughout Indiana by the use of telecommunications technology; and
(6) establish cooperative arrangements with private and public entities in order to effectively operate the program.

Authorizes the board of trustees of Vincennes University to establish a grammar school to teach foreign languages.

Chapter 1. Purposes and General Provisions

Chapter 2. Authority to Allocate Expenditures to Student Instruction and Learning
Authorizes school corporations to take specific actions to reduce noninstructional expenditures and allocate the resulting savings to student instruction and learning. Authorized actions include:
(1) Creating insurance pools with other school corporations.
(2) Aggregating purchases of natural gas commodity supply.
(3) Consolidating specified purchases with other school corporations or units of government.

Authorizes school corporations to use shared services arrangements with other school corporations and units of government to provide instructional and noninstructional services.

Authorizes school corporations to collaborate with contiguous school corporations to explore the use of cooperatives among school corporations, commonly managed school corporations, or the consolidation of school corporations to provide effective and efficient management of the school corporations or functions within.

Directs educational service centers to support and facilitate actions by school corporations to pool resources, including by the use of an educational service center's existing cooperative agreements. Directs educational service centers to annually report to the state board the results of the efforts of the educational service centers during the preceding school year to help school corporations pool resources.

Chapter 3. State Board Action
Directs the state board to explore methods to reduce the expense to school corporations for the purchase of textbooks, technology, school buses and other vehicles, and other areas of expenses as determined by the state board. Directs the state board to annually survey school corporations to determine actions taken to allocate resources to student instruction and learning. Directs the state board to issue an annual report of actions taken to each school corporation, the public and the general assembly. Additionally requires the state board to report annually to the state superintendent, the governor, and the general assembly on:
 (1) Consolidated purchasing arrangements used by multiple school corporations, through educational service centers, and throughout Indiana.
 (2) Shared services arrangements used by multiple school corporations, through educational service centers, and in Indiana as a whole.
 (3) The efforts of school corporations to explore cooperatives, common management, or consolidations.

Directs the state board to analyze each school corporation's expenses for the 2004-2005 and 2005-2006 school years to determine how much each school corporation spent on student academic achievement expenditures, student instructional support expenditures, overhead and operational expenditures, and nonoperational expenditures. By June 30, 2007, requires the state board to report the results of the analysis to the state superintendent, the governor, and the general assembly.

Provides that, for each school year using the 2005-2006 school year as a baseline:
        (1) the office of management and budget must report to the state board, the governor, and the general assembly on the progress or lack thereof of each school corporation, of all school corporations in each educational service center's area, and in Indiana as a whole in improving the ratio of student instructional expenditures to all other expenditures for the previous school year;
        (2) the state board must publicly recognize each school corporation and educational service center that has an improved ratio of student instructional expenditures to all other expenditures during the previous school year;
        (3) the office of management and budget and the division of finance of the department must be available to consult with and provide technical assistance to each school corporation that did not have an improved ratio of student instructional expenditures to all other expenditures during the previous school year; and
        (4) each school corporation must report to the public in its annual performance report and to the members of the general assembly whose districts include the school corporation on specified expenditures.

Requires, beginning with the 2007-2008 school year, each governing body to establish goals for academic, instructional support, overhead/operational and nonoperational expenditures that will increase the school corporation's allocation of taxpayer resources directly to student instruction and learning. Requires an individual to have training in cardiopulmonary resuscitation, removing obstructions to a person's airway and the Heimlich maneuver before obtaining an initial license as a teacher.

Creates a new chapter on care of students with diabetes. Requires that a diabetes management and treatment plan as well as an individualized health plan be prepared and implemented for each student with diabetes for use during school hours or at a school related activity. Requires that the diabetes management and treatment plan be submitted to the school nurse, and that the school nurse be involved in the development of the individualized health plan. Requires the school principal at each school serving a student with diabetes to seek school employees to serve as volunteer health aides, and work to ensure that the school has an adequate number of volunteer health aides to care for students.

Authorizes the department to cooperate with the state department of health to develop a diabetes training program for school nurses and for volunteer health aides. Directs the department to provide annual diabetes training programs to school nurses and volunteer health aides that includes technological advances, current standards of practice for diabetes management and training, and instruction in specific topics.

Directs a school nurse, or under specified circumstances, a volunteer health aide, to perform the tasks necessary to assist a student in carrying out the student's individualized health plan. Requires schools to allow students to engage in specific activities, such as administering insulin, if the student has been evaluated and determined to be capable of doing so as reflected in the student's individual health plan and the student's diabetes management and treatment plan. Requires school transportation staff or staff supervising a student with diabetes in an off-campus activity to be provided with an information sheet identifying the student, the potential emergencies that may occur as a result of the diabetes and appropriate responses to an emergency, and emergency contact information.

Adds that a school or school board may not require a teacher or other school employee who is not employed as a school nurse or physician to administer health care services, basic life support, or other services that require the teacher or employee to place the teacher's or employee's hands on a pupil for therapeutic or
sanitary purposes. Also provides a school or school board may not discipline a teacher or other school employee who refuses to administer health care services, basic life support, or other services that require the teacher or employee to place the teacher's or employee's hands on a pupil for therapeutic or sanitary purposes. Establishes immunity for acts or omissions by a teacher who has been trained in CPR, the Heimlich maneuver or removing obstructions to a person's airway.

Requires a school corporation, in reporting average daily membership (ADM) for the 2007-2008 school year, to also report the number of school nurses and the number of students, by disease category, who have a chronic disease, including asthma, diabetes, and any other disease the department of education determines is significant for the school corporation to report.

(2) Provide administrators, including principals and counselors, with professional development to create strong and effective AP programs.
(3) Provide middle school, junior high school, and high school teachers with AP vertical team training and other pre-AP professional development that
prepares students for success in AP.
(4) Support the implementation of an instructional program for students in grades 6-12 that provides an integrated set of instructional materials, diagnostic assessments, and teacher professional development in reading, writing, and mathematics that prepares all students for enrollment and success in AP courses and in college.

Authorizes the state department of education to seek federal funding through the Advanced Placement Incentive Program and the Math-Science Partnership Program.

Requires the state department of education to develop middle and junior high school curriculum guidelines that include a plan to increase the availability of the AP program in schools with a high concentration of low-income students, as well as the participation of low-income students in AP programs. Requires the plan to work toward these participation goals via information dissemination through various media that informs parents and students of the importance of AP and pre-AP courses to a student's ability to gain access to and to succeed in postsecondary education.

Directs the state department of health to provide a school that enrolls grade 6 female students with information on cervical cancer and the human papillomavirus (HPV) infection. The information must include:
(1) The latest scientific information on the immunization against the HPV infection and the immunization's effectiveness against causes of cervical cancer.
(2) That a pap smear is still critical for the detection of precancerous changes in the cervix to allow for treatment before cervical cancer develops.
(3) Information concerning the means in which the HPV infection is contracted.
(4) A statement that any questions or concerns concerning immunizing the child against HPV could be answered by contacting a health care provider.

Requires schools to provide the parents of female students entering grade 6 to be provided with information on the link between cervical cancer and the HPV infection and that an immunization against the HPV infection is available. Requires such parents to provide the school with a written statement within 20 days of the first day of school, indicating that the parent had received the information concerning the link between cervical cancer and the HPV infection and on the availability of an immunization against the HPV infection; and also indicating whether the student is or will be immunized or that the parent chooses not to inform the school whether the student was immunized. Provides that a student may not be prevented from enrolling in a school for the sole reason that the student has not provided the school with the written statement. Requires each school, beginning in the 2008-2009 school year, to report to the state department of health and the local health department having jurisdiction the number of female students in grade 6 have (or plan to have) and have not been immunized against HPV infection, and the number of female students in grade 6 whose parent chose not to provide the information to the school concerning whether the student was immunized.

(D) explores all options for timing and use of summative tests, including giving a summative test in the fall or the spring;

(H) assesses student proficiency in written communication.
(4) To move to the use of online assessments for Core 40 subjects.

In developing the plan for the testing program, requires the state board and the department to:
(1) solicit information from educators, administrators, parents, and the public concerning the program;
(2) look at tests and testing practices in use by or in development by other states;
(3) solicit information from testing companies concerning:
(A) parameters and costs of tests;
(B) steps to be taken to ensure the validity and reliability of the tests;
(C) steps to move the longitudinal data from the current testing program to the new testing program; and
(D) any other information the department or the state board considers useful in developing the testing program;
(4) develop a plan to move to online tests;
(5) determine the most effective means to assess student proficiency in written communication; and
(6) include specifications for diagnostic tests for use by teachers during the school year.

Requires the state board, before November 2006, to submit a report on the testing program to the budget committee, the legislative council, and the office of management and budget. Specifies that the report must provide the estimated costs for the program beginning with tests given during the 2007-2008 school year.

Allows a contract for testing students during the 2006-2007 school year to be issued, but requires testing contracts for any subsequent school year to follow the state board's approval of the testing plan.

Section 3: Authorizes school corporations (districts) individually, in collaboration with other school corporations, and through the educational services centers to take action to reduce noninstructional expenditures and allocate the resulting savings to student instruction and learning. Such actions may include the following:
(1) Pooling of resources with other school corporations for various forms of insurance, whether by pooling risks for coverage or for the purchase of coverage, or by the creation of or participation in insurance programs,
(2) Aggregating natural gas purchases, and
(3) Consolidating purchases with other school corporations or units of government of the following:
(A) School buses and other vehicles and vehicle fleets.
(B) Fuel, maintenance, or other services for vehicles or vehicle fleets.
(C) Food services.
(D) Facilities management services.
(E) Transportation management services.
(F) Textbooks, technology, and other school materials and supplies.
(G) Any other purchases a school corporation may require. Purchases may be made by contiguous school corporations, as part of regional consolidated purchasing arrangements, or from consolidated sources under multistate cooperative bidding arrangements.

Authorizes a school corporation to use shared services arrangements with other school corporations and units of government, including:
(1) the use of shared administrative services overseeing transportation, food service, facilities, or other operations;
(2) the use of shared administrative services to manage finance, payroll, human resources, information technology, purchasing, or other administrative services; and
(3) the use of shared resources to provide instruction, supplemental services, extracurricular activities, or other student services.

Authorizes a school corporation to collaborate with contiguous school corporations to explore the use of cooperatives among school corporations, commonly managed school corporations, or the consolidation of school corporations to provide effective and efficient management of the school corporations or functions of the
school corporations.

Directs Educational service centers to support and facilitate actions by school corporations, including by the use of an educational service center's existing cooperative agreements. Requires the educational service centers to annually report to the state board the results of the efforts of the educational service centers during the preceding school year.

Directs the state board to explore methods, including statewide purchases, to reduce the expense to school corporations for the purchase of textbooks, technology, and school buses and other vehicles. Directs the state board to survey the school corporations annually to determine actions taken by the school corporations to allocate resources to student instruction and learning.

Directs the state board to analyze each school corporation's expenses for the 2004-2005 and 2005-2006 school years to determine how much each school corporation spent, from whatever source, directly or indirectly, on (1) Student academic achievement expenditures; (2) Student instructional support expenditures; (3) Overhead and operational expenditures; and (4) Nonoperational expenditures. Requires the state board to determine the types of expenses that are included in each category. Requires the state board, not later than June 30, 2007, to report the results of the analysis to the state superintendent, the governor, and the general assembly.

Beginning with the 2006-2007 school year, and using the 2005-2006 school year as a baseline:

(1) Directs the office of management and budget to analyze and report to the state board, the governor, and the general assembly concerning the progress or lack of progress of each school corporation, all school corporations in each educational service center's area, and in the state as a whole in improving the ratio of student instructional expenditure to all other expenditures for the previous school year;
(2) Directs the state board to publicly recognize each school corporation and educational service center that has an improved ratio of student instructional expenditures to all other expenditures during the previous school year;
(3) Directs the office of management and budget and the division of finance of the department to be available to consult with and provide technical assistance to each school corporation that did not have an improved ratio of student instructional expenditures to all other expenditures during the previous school year; and
(4) Directs each school corporation to report specific data to the public in the school corporation's annual performance report.

Beginning with the 2007-2008 school year, requires each governing body to establish goals for expenditures in the following categories: (1) Student academic achievement expenditures; (2) Student instructional support expenditures; (3) Overhead and operational expenditures; and (4) Nonoperational expenditures that will increase the school corporation's allocation of taxpayer resources directly to student instruction and learning, in light of the unique circumstances present in the school corporation. Directs the state board to recognize and reward the school corporations that have met their goals.

Authorizes public 4-year postsecondary institutions, Ivy Tech Community College and Vincennes University to establish "fast track to college" programs that allow students to simulatneously earn a high school diploma and credits for a college degree or, in the case of Ivy Tech and Vincennes University, a certificate program or associate's degree. Requires eligible students to be at least 19 and not enrolled in a school or at least 17 and have his/her high school's consent. Districts of eligible high school students are to pay the student's tuition for high school courses taken at the postsecondary institution.

To complete the requirements for a high school diploma under this section, the individual must have:
        (1) passed:
            (A) the graduation examination given under IC 20-32-4;
            (B) an examination for a general educational development diploma;
            (C) an examination equivalent to the graduation examination:
                (i) administered by the postsecondary institution; and
                (ii) approved by the department; or
            (D) an examination that demonstrates the student is ready for college level work:
                (i) administered by the state educational institution; and
                (ii) approved by the department; and
        (2) completed the coursework necessary to meet:
            (A) the minimum high school course requirements established by the state board; and
            (B) the requirements of the postsecondary institution.

Requires the postsecondary institution to notify the state board when an individual has completed a fast track to college program. Requires the state board, upon receiving notification, to (1) grant the student a high school diploma indicating the name of the postsecondary institution at which the student earned the high school diploma and (2) give the postsecondary institution the diploma to award to the individual. Requires a postsecondary institution establishing a fast track to college program to report annually to the education roundtable the number of program participants and diplomas granted.

Requires the state board to design a high school diploma for students who complete a high school fast track to college program.

Adds conditions to the list of provisions for which full accreditation of a proprietaryy institution cannot be issued: If the owner or chief administrator of the postsecondary proprietary educational institution has not been the owner or chief administrator of a postsecondary proprietary institution that has had its accreditation revoked or has been closed involuntarily in the five (5) year period preceding the application for accreditation. However, if the owner or chief administrator of the postsecondary proprietary educational institution has been the owner or chief administrator of a postsecondary proprietary educational institution that has had its accreditation revoked or has been closed involuntarily more than five (5) years before the application for accreditation, the commission may issue full accreditation at the commission's discretion.

Also raises the amounts of surety bonds required from postsecondary proprietary educational institutions, and increases the mature balance in the Career College Student Assurance Fund. Currently, if the fund balance in the Career College Student Assurance Fund is greater than $100,000, then the surety bond required of the institution is reduced. The bill removes the proportionate reduction in surety bonds and does not require a surety bond if the fund balance is $1 M or more. The increase would help insure that if a postsecondary proprietary educational institution closed, students would be able to recover tuition they may have paid.

Establishes Chapter 11.5, the Double Up For College Program
Sec. 1. As used in this chapter, "postsecondary credit" means credit toward an associate degree, a baccalaureate degree, or a vocational certification granted by a state educational institution (as defined under IC 20-12-0.5-1) upon the successful completion of a course taken under the program.

Sec. 2. As used in this chapter, "program" refers to the double up for college program established under this chapter.

Sec. 3. As used in this chapter, "secondary credit" means credit toward high school graduation requirements granted by a student's school corporation upon the successful completion of a course taken under the program.

Sec. 4. (a) The double up for college program is established for secondary school students in grades 11 and 12. School corporations (districts) and state educational institutions may collaborate to offer early college, dual credit, or dual enrollment programs that meet the educational objectives of the school corporation and are offered by the state educational institutions.
(b) A student may enroll in courses offered by a state educational institution under the program on a full-time or part-time basis during grade 11 or grade 12, or both.
(c) A state educational institution that participates in an early college, a dual credit, or a dual enrollment program may, by agreement with a school corporation:
(1) ensure that the content and rigor of each course offered is adequate to warrant providing credit to a student as if the student took the course as a student at the state educational institution;
(2) set the criteria for the faculty member, instructor, or other individual responsible for teaching each course with the:
(A) state educational institution responsible for hiring the personnel to instruct dual credit courses taught by the state educational institution; and
(B) school corporation responsible for hiring personnel to instruct dual credit courses taught by the high school; and
(3) determine with the school corporation the terms and conditions under which:
(A) students may be admitted to the program while attending high school;
(B) the state educational institution will award credit, if any, for specified courses successfully completed by students through the school corporation; and
(C) the school corporation will award credit, if any, for specified courses successfully completed through the state educational institution.
(d) A student is entitled to credit toward graduation requirements for each course the student successfully completes at the eligible institution.
(e) Courses offered under the program that are listed in the:
(1) statewide core transfer library courses that are transferable on all campuses of the state educational institutions in accordance with the principles in IC 20-12-0.5-13; or
(2) articulation agreements that apply to any campus in the Ivy Tech Community College of Indiana system and to Vincennes University and draw from liberal arts and the technical, professional, and occupational fields;
are among those eligible for the program. If a student passes a course through the program that is part of an articulation agreement between the state educational institution offering the course and other state educational institutions, the course shall transfer under the terms and standards of the articulation agreement between the state educational institutions.
(f) Based on the demand for enrollment in the identified courses and the resources available to the state educational institutions, the identified courses may be offered through:
(1) onsite instruction;
(2) telecommunication; or
(3) a combination of methods described in subdivisions (1) and (2);
at on-campus or off-campus sites.

Sec. 5. A school corporation may, by agreement with an institution of higher education, offer counseling concerning early college, dual credit, or dual enrollment courses that the school corporation considers appropriate, including:
(1) notice of the courses and schedule;
(2) available post-secondary credit;
(3) responsibilities of the student;
(4) any tuition and other costs;
(5) the consequences of the failure to complete a course; and
(6) other matters concerning the program and opportunities presented by the program.

Sec. 6. (a) A student may apply for enrollment to a state educational institution. The state educational institution shall accept or reject the student based on the standards ordinarily used to decide student enrollments. However, a student in the program may not be refused admission solely because the student has not graduated from a secondary school.
(b) A state educational institution may grant financial assistance to a student for courses taken under this program based on the student's:
(1) financial need; or
(2) academic achievement;
or any other criteria.
(c) A state educational institution shall waive tuition for a student who is:
(1) eligible for free or reduced lunch in high school;
(2) accepted into the program; and
(3) accepted for admission to the state educational institution.

Sec. 7. A student shall receive postsecondary credit toward meeting the degree requirements at the state educational institution at which the student successfully completed a dual credit course. If the student enrolls in a state educational institution other than the state educational institution at which a dual credit course was completed, the other state educational institution:
(1) shall grant credit for courses that are in the core transfer library or subject to an articulation agreement; and
(2) may grant credit for other courses.

Sec. 8. After June 30, 2008, a state educational institution or campus of a state educational institution that offers dual credit courses in liberal arts, professional, or career and technical disciplines must be accredited by the National Alliance of Concurrent Enrollment Partnerships.

Requires schools to report the reasons for student suspensions and expulsions to the department of education, and to categorize suspended and expelled students by gender, ethnicity and disability status. Provides that the agreement may require the court to do one or more of the following:
(1) Establish a flexible program for the supervision of a student who has been suspended or expelled.
(2) Supervise a student who has been suspended or expelled.
(3) Require a student who has been suspended or expelled to participate in a school program (including an alternative educational program) for the supervision of a student who has been suspended or expelled.

Provides that the agreement may require a school corporation to do one or more of the following:
(1) Define the violation for which a student who has been suspended or expelled shall be referred to the court.
(2) Refer a student who has been suspended or expelled for a violation described in subdivision (1) to the court.
(3) Establish a school program (including an alternative educational program) for the supervision of a student who has been suspended or expelled.
Provides that the court and the school corporation may jointly determine which violations leading to suspension or expulsion are eligible for referral to the court. Provides that the school corporation and the court must determine how the costs of supervising a student under the agreement shall be paid.

Allows the school corporation to disclose the education records of a student who has been suspended or expelled to a court. Provides that a parent or guardian has the right to be present during the student's appearance, and may be required to be present during the student's appearance. Requires that the discipline rules adopted by a school's governing body define "habitual truant" to include, at a minimum, a student who has more than ten unexcused absences in a school year. Permits a public school student who is at least 16 years of age and less than 18 years of age to withdraw from school by: (1) attending an exit interview; (2) obtaining the consent of the student's parent; and (3) obtaining the consent of the school principal. Requires that the school principal provide the student and the student's parent with information concerning the consequences of dropping out of school during the exit interview, and to provide the department of education with the number of students who withdraw from school. Includes certain additional groups of students in the determination of a school's graduation rate. Establishes certain procedures concerning a student who has left school and whose location is unknown to the school. Creates the professional standards fund to be administered by the department. States that money in the fund does not revert to the state general fund at the end of a state fiscal year.

Requires the department to work with teacher education schools and departments to develop a system of teacher education that ensures individuals who graduate from the schools and departments are able to meet the highest professional standards.
