Established that appropriate uses of funding include, but are not limited to: a. Salary and benefits for instructional staff, instructional support staff, and school-based youth services staff who are working with students who are participating in dropout prevention programs, alternative programs, and alternative schools, in a traditional or alternative setting, if the staff person's time is dedicated to working with returning dropouts or students who are deemed, at any time during the school year, to be at risk of dropping out, in order to provide services beyond those which are provided by the school district to students who are not identified as at risk of dropping out. However, if the staff person works part-time with students who are participating in returning dropout and dropout prevention programs, alternative programs, and alternative schools and has another unrelated staff assignment, only the portion of the staff person's time that is related to the returning dropout and dropout prevention program, alternative program, or alternative school may be charged to the program. b. Professional development for all teachers and staff working with at-risk students and programs involving dropout prevention strategies. c. Research-based resources, materials, software, supplies, and purchased services that meet listed criteria.d. Up to five percent of the total budgeted amount may be used for purposes of providing district-wide or building-wide returning dropout and dropout prevention programming targeted to students who are not deemed at risk of dropping out. For the fiscal year beginning July 1, 2013 and thereafter, establishes the ratio of the amount of modified allowable growth.

This section adds new language that expands the courses eligible for school aid formula supplementary weighting. A district that collaborates with a community college to provide a college-level class that uses an activities-based, project-based, and problem-based learning approach and that is offered through a partnership with a nationally recognized 501-(c)(3) provider of rigorous and innovative science, technology, engineering, and mathematics curriculum is eligible to receive additional weighting. A student enrolled in a career and technical course is exempt from the proficiency requirements of section 261E.3, subsection 1, paragraph e. A community college may require a student who applies for enrollment under a district-to-community college sharing or concurrent enrollment program to complete an initial assessment to determine the applicant's readiness to enroll in career and technical coursework, and the community college may deny the enrollment.

This section relates to teacher reviews, professional development, and administrator evaluations. Creates three new task forces: Statewide Educator Evaluation System Task Force, Iowa Teaching Standards and Criteria Review Task Force, and Teacher Performance, Compensation and Career Development Task Force. Requires 36 additional hours of practitioner collaboration (can be repurposed from existing professional development time). Requires annual review of teachers. The first two years of review are to be conducted by a peer group of teachers and are to be formative in nature -- not for recommending participation in an intensive assistance program or for compensation, layoff, termination, etc.. Requires annual evaluation of administrators. The Statewide Educator Evaluation System Task Force is to develop a statewide teacher evaluation system and a statewide administrator evaluation system that standardize the instruments and processes used throughout the state. Lists required components: Direct observation; balanced consideration of student growth measures; integration of the Iowa teaching standards; system applicability to teachers in all content areas. Also requires that recommendations include a tiered evaluation system that differentiates ineffective, minimally effective, effective and highly effective performance by teachers and administrators.

This section requires the department to develop and establish an online learning program model. Specifies that not more than 0.18% of students statewide and not more than 1.0% of a sending district's enrollment can be enrolled in courses where the content is delivered primarily over the internet. Directs the department to conduct an annual survey of students taking course delivered over the internet to determine if students are receiving competent private instruction from a licenses practitioner. Requires the department to submit an annual report to the General Assembly by January 15. Establishes an online learning program model and a statewide initiative within the department to provide distance education to high school students statewide. Requests the Legislative Council establish an online learning interim study committee and requires findings and recommendations in a report to the General Assembly by December 14, 2012.

Plans are to be implemented beginning the fall semester of 2015 for courses with typical annual enrollment of 100 or more but less than 200. Requires the Board of Regents to annually evaluate the effectiveness of the methodologies and improvement plans and submit findings and recommendations in its annual strategic plan progress report.

This section requires the state board to adopt, by rule, guidelines for school district implementation of basic levels of reading proficiency based on approved assessments and identification of tools to evaluate any student what may be determined deficient in reading. Assessments should include but are not limited to initial assessments, subsequent assessments, alternative assessments and portfolio reviews. Requires districts to administer a kindergarten readiness assessment prescribed by the Department to every resident prekindergarten or 4-year-old child enrolled in the district (until July 1, 2013). Establishes a Cross-Agency Assessment Instrument Planning Group to study and select one standard, multidomain assessment for implementation by all districts for purposes of kindergarten assessments. Requires districts to assess all students enrolled in kindergarten-3rd at the beginning of each school year for their level of reading or reading readiness on locally determined or statewide assessments.

Districts are required to provide intensive reading instruction to any student who exhibits a substantial deficiency in reading, based on assessments or teacher observations. Requires continuation of intensive reading instruction until the reading deficiency is remedied. Parents/guardians of any K-3 student must be notified at least annually if their child exhibits a substantial deficiency in reading. Districts are required to provide intensive reading instruction until the student is proficient. Districts must provide students identified as having a substantial deficiency in reading with intensive instructional services and supports free of charge (a minimum of 90 minutes daily of scientific, research-based reading instruction). Strategies may include but are not limited to: small group instruction; reduced teacher-student ratios; more frequent progress monitoring; tutoring or mentoring; extended school day, week, or year; or summer reading programs. Districts must provide a report to the parent re: progress and an outline of a plan.

Requires the state board to adopt standards that provide a reasonable expectation that a student's progress towards reading proficiency is sufficient to master appropriate 4th grade reading skills prior to the student's promotion to the 4th grade. Rules and guidelines are to be adopted by July 1, 2013. Beginning May 1, 2017, if a student's reading deficiency is not remedied by the end of 3rd grade, the district must notify the student's parent that they may enroll the student in the intensive summer reading program. If the parent does not enroll the student in the program, and the student is ineligible for a good cause exemption, the student must be retained in 3rd grade. If the student is exempt for good cause or completes the intensive summer reading program but is not reading proficient upon completion, the student may be promoted to 4th grade. In making promotion decisions, districts are required to place significant weight on reading deficiencies identified by assessments or teacher observations. Districts must also consider the student's progress in other subject areas and overall intellectual, physical, emotional or social development. Parents must be consulted prior to any decision to retain is made.

Districts are required to address reading proficiency in their comprehensive school improvement plan. Subject to appropriation, each district must provide professional development services to enhance the skills of elementary teachers in responding to a child's unique reading issues and needs.

Requires the Department to establish an Iowa reading research center for the application of current research on literacy, subject to appropriation.

Requires the university to collaborate with the community colleges to develop science, technology, engineering, and mathematics professional development programs for community college instructors and for purposes of STEM curricula development. This section requires institutions with approved practitioner programs to administer a preprofessional skills test to admission candidates. Institutions must also administer, prior to a student's completion of the program, subject assessments, designed by a nationally recognized testing service, that measure pedagogy and knowledge of at least one subject area, or a valid and reliable subject area specific, performance-based assessment for preservice teacher candidates, centered on student learning. A student may not complete the program if he/she does not score above the 25th percentile nationally.

"Pathways for Academic Career and Employment Act" . Establishes a pathways for academic career and employment program to provide funding to community colleges for the development of projects in coordination with the department of economic development, the department of education, Iowa workforce development, regional advisory boards and community partners to implement a simplified, streamlined, and comprehensive process, along with customized support services, to enable eligible participants to acquire effective academic and employment training to secure gainful, quality, in-state employment. Sets eligibility criteria: Projects that further the ability of members of target populations to secure gainful, quality employment. The "target population" includes: a. Persons deemed low skilled for the purposes of attaining gainful, quality, in-state employment; b. Persons earning incomes at or below 200% of the federal poverty level; c. Unemployed persons; d. Underemployed persons; e. Dislocated workers.

Program outcomes. Projects eligible for funding are expected to enable target populations to: a. Acquire and demonstrate competency in basic skills. b. Acquire and demonstrate competency in a specified technical field. c. Complete a specified level of postsecondary education. d. Earn a national career readiness certificate. e. Obtain employer-validated credentials. f. Secure gainful employment in high-quality, local jobs. Satisfaction of economic and employment goals include but are not limited to: a. Economic and workforce development requirements in each region served by the community colleges. b. Needs of industry partners in areas including but not limited to: (1) Information technology. (2) Health care. (3) Advanced manufacturing. (4) Transportation and logistics. Sets program component requirements: 1. Include measurable and effective recruitment, assessment, and referral activities designed for the target populations. 2. Integrate basics skills and work-readiness training with occupational skills training. 3. Combine customized supportive and case management services with training services to help participants overcome barriers to employment. 4. Provide training services at times, locations, and through multiple, flexible modalities that are easily understood and readily accessible to the target populations. Such modalities shall support timeless entry, individualized learning, and flexible scheduling, and may include online remediation, learning lab and cohort learning communities, tutoring, and modularization.

Requires each community college receiving funding for the program to develop a pipeline program that has the following goals: 1. To strengthen partnerships with community-based organizations and industry representatives. 2. To improve and simplify the identification, recruitment, and assessment of qualified participants. 3. To conduct and manage an outreach, recruitment, and intake process, along with accompanying support services, reflecting sensitivity to the time and financial constraints and remediation needs of the target populations. 4. To conduct orientations for qualified participants to describe regional labor market opportunities, employer partners, and program requirements and expectations. 5. To describe the concepts of the project implemented with funds from the pathways for academic career and employment program and the embedded educational and support resources available through such project. 6. To outline the basic skills participants will learn and describe the credentials participants will earn. 7. To describe success milestones and ways in which temporal and instructional barriers have been minimized or eliminated. 8. To review how individualized and customized service strategies for participants will be developed and provided.

Requires each community college receiving funding for the pathways for academic career and employment program to develop a career pathways and bridge curriculum development program with the following goals: 1. The articulation of courses and modules, the mapping of programs within career pathways, and establishment of bridges between credit and noncredit programs. 2. The integration and contextualization of basic skills education and skills training. Requires that the process provide for seamless progressions between adult basic education and general education development programs and continuing education and credit certificate, diploma, and degree programs. 3. The development of career pathways that support the attainment of industry-recognized credentials, diplomas, and degrees through stackable, modularized program delivery.

Establishes the "Gap Tuition Assistance Act" to provide funding to community colleges for need-based tuition assistance to applicants to enable completion of continuing education certificate training programs for in-demand occupations. Sets eligibility criteria for tuition assistance: 1. The program is not offered for credit, but is aligned with a certificate, diploma, or degree for credit, and does any of the following: a. Offers a state, national, or locally recognized certificate. b. Offers preparation for a professional examination or licensure. c. Provides endorsement for an existing credential or license. d. Represents recognized skill standards defined by an industrial sector. e. Offers a similar credential or training. 2. The program offers training or a credential in an in-demand occupation. For the purposes of this chapter, "in-demand occupation" includes occupations in the following industries: a. Information technology. b. Health care. c. Advanced manufacturing. d. Transportation and logistics. e. Any other industry designated as in-demand by a regional advisory board.

Amends regional academies. Intead of serving 9-12th grade student, such academies are allowed to serve 7th-12-grade students. Authorizes a district establishing a regional academy to collaborate and partner with, enter into an agreement or contract with one or more school districts, area education agencies, community colleges, accredited public and private postsecondary institutions, accredited nonpublic schools, businesses, and private agencies located within or outside of the state. Clarifies that the purpose of a regional academy is to build a culture of innovation for students and community, to diversify educational and economic opportunities by engaging in learning experiences that involve students in complex, real-world projects, and to develop regional or global innovation networks. If a plan is submitted to the department for approval that demonstrates how the regional acadeny will increase and assess student achievement or increase and assess competency-based learning opportunities for students, the department may waive or modify any statutory or regulatory provision applicable to school districts except those specifically refrenced. Authorizes a regional academy to include in its curriculum virtual or internet-based coursework and courses delivered via the Iowa communications network, career and technical courses, core curriculum coursework, other specified required courses and asynchronous learning networks. The school districts participating in are required to enter into an agreement on how the funding generated by the supplementary weighting received shalI be used and shall submit the agreement to the department for approval. Requires regional academies to included advanced level courses.

Requires institutions whose students are eligible for or who receive financial assistance under programs administered by the commission to report numbers of minority students enrolled in and minority faculty members employed at the institution (report is to be submitted to the general assembly, the governor, and the legislative services agency by March 1 annually.) Deletes explicit references to affirmative action. Requires that information on equal opportunity and affirmative action efforts in the recruitment, appointment, assignment, and advancement of personnel at the institution be provided upon request.

Excerpts from the fiscal note: modifies Iowa Code to meet the requirements of the federal Race to the Top (RTTT) initiative. . . [e]nactment of the Bill will qualify school districts with persistently lowest achieving schools eligible to receive U.S. Department of Education School improvement grants. The Bill provides the following:
• Eliminates the repeal of Iowa's Charter School legislation. Under current law, Code Chapter 256F will be repealed July 1, 2011.
• Eliminates the cap on the number of charter schools that may be authorized in the State.
• Creates Innovation Zone schools consisting of two or more school districts and an area education agency with the goal of improving student learning.
• Directs the Department of Education director to require persistently lowest-achieving schools to implement at least one of the interventions mandated by the U.S. Department of Education.

Assumptions: If the State of Iowa is awarded a RTTT grant, the Department of Education would retain 50.0% of the award and the remaining 50.0% would be allocated to participating school districts. Any administration, implementation, and additional staff costs incurred by the Department as a result of the RTTT requirements would be funded with RTTT grant funds. Additionally, it is assumed that the Department would also cover school district staff training costs as a result of the RTTT initiative through RTTT grant funds.
Fiscal Impact: No State General Fund impact is anticipated. If Iowa is awarded a Race to the Top grant, the estimated federal grant could total between $60.0 - $175.0 million between FY 2011 – FY 2014. If Iowa is awarded School Improvement grants for the persistently lowest achieving schools, the estimated grant could total approximately $18.0 million (maximum of $500,000 per eligible school).

Requires districts to meet the following requirements, but allows them to do so through direct instruction, collaboration with another school district, or use of the Iowa online advanced placement academy. Requires districts to provide descriptions of advanced placement courses; to ensure that advanced placement course teachers are appropriately licensed and meet the
minimum certification requirements of the national organization that administers the advanced placement program; establish prerequisite coursework for each advanced placement course offered and describe the prerequisites in the course registration handbook, which must be provided to every junior high school or middle school student prior to the development of a core curriculum plan; make advanced placement coursework available to a dually enrolled student under competent private instruction if the student meets the same criteria as a regularly enrolled student of the district.

From the fiscal note: Beginning in FY 2010, Educational Excellence Program Phase II allocations totaling $41.2 million to school districts and area education agencies (AEAs) will be rolled into the school aid formula and funded on a per pupil basis as part of the teacher salary supplement. The remaining General Fund standing appropriation to Educational Excellence Phase I for FY 2010 is estimated at $13.5 million and the Phase II set-aside is estimated at approximately $760,000. The estimated fiscal impact of Senate File 445 will be a reduction in General Fund expenditures in FY 2010 of $14.3 million compared to the current law estimate for FY 2010.

Amends previous language to remove "voluntary model" from the establishment of core curriculum for grades 9-12, beginning with students graduating in the 2010-2011 class. Prohibits the state board from requiring specific textbooks. Requires core curriculum technical assistance and implementation strategies for districts and accredited nonpublic schools, including assistance with the development of formative and end-of-course assessments that teachers can use to measure student progress. Requires an annual report to the general assembly regarding activities, findings and student progress under the core curriculum. For the school year beginning July 1, 2008 and thereafter, district board plans must include a timeline for each student to successfully complete, prior to graduation, all components of the state-designated career information and decision-making system administered by the department in accordance with federal law (Perkins Act). Phases out local option taxes and replaces them with statewide taxes over the next five years. Currently, districts with major retail centers collect more in local-option taxes than rural districts. Creates a statewide voluntary preschool program for four-year-old children. Provides that preschool teachers in the program must be certified and possess a bachelor's or graduate degree in early childhood education or another appropriate major from an accredited college or university with a major.

Directs preschool program teachers to collaborate with other agencies, organizations, and boards to enhance program capacity to meet the diverse needs of children and families participating in the program, including needs for early care, health and human services. Directs teachers in the program to work to maintain relationships with each child's family to enhance the child's development in all settings by collaborating with providers of parent education and family support opportunities.

Directs the state board to further define the following program requirements, which must be used to determine whether a district program is an approved local program:
a. Maximum and minimum teacher-to-child ratios and class sizes.
b. Applicable state and federal program standards.
c. Student learning standards.
d. Provisions for the integration of children from other state and federally funded preschools.
e. Collaboration with participating families, early care providers, and community partners including community empowerment area boards, head start programs, shared visions and other programs provided through the child development coordinating council, licensed child care centers, registered child development homes, area education agencies, child care resource and referral services, early childhood special education programs, Title I programs, and family support programs.
f. A minimum of 10 hours a week of instruction on the skills and knowledge included in the preschool student learning standards.
g. Parental involvement.
h. Provision for ensuring that children receiving care from other child care arrangements can participate in the preschool program with minimal disruption due to transportation issues.

Creates operational sharing incentives; Mandates a statewide study of efficiencies and sharing to be provided to the Legislature by January 2008. Provides additional weighting for districts that share one or more operational functions in the areas of superintendent management, business management, human resources, transportation, or operation and maintenance at least 20% of the school year. Provides that such additional funding is available to a district for a maximum of five years during the period from the 2008-2009 through the 2012-2013 budget years. Provides that supplementary funding after the first year is contingent upon the annual submission of information to the department documenting cost savings directly attributable to the shared operational functions. Directs the department to establish rules setting the criteria for determining the number of years for which supplementary weighting may be received, and for determining qualification of operational functions for supplementary weighting

Directs the department of management to annually set a weighting for each area education agency to generate the approved operational sharing expense using the area education agency's special education cost per pupil amount and foundation level. Provides that annual supplemental weighting is available to an area education agency for up to 5 years. Sets $50,000 and $200,000 as annual minimum and maximum of supplemental funding per area education agency.
Provides that supplementary funding after the first year is contingent upon the annual submission of information to the department documenting cost savings directly attributable to the shared operational functions.

Directs the department of education, by September 15, 2007, to, in consultation with the boards of directors of the area education agencies and other appropriate education stakeholders as necessary, develop a uniform process to facilitate discussion between district leaders to support rigorous and relevant student programming and efforts to increase student achievement through the sharing and efficiency of operations efforts with other school districts, educational partners, and governmental subdivisions. Specifies the process is intended to promote reductions in the costs of operations and create additional resource availability. Provides the process must provide a framework for a consistent regional plan for use by area education agencies. Specifies that processes to be developed must include district and area education agency services available to improve efficiencies, areas of potential sharing, and efficiency of operations. Provides other governmental subdivisions and private entities may be consulted for efficiency proposals. Directs districts involved in the processes to consider operational efficiencies, shared programming, transportation sharing, expansion of area education agency cooperatives, common schedules for school districts and community colleges, energy and insurance efficiencies, effective structure and delivery models that promote optimum student achievement, graduation requirements, and a rigorous, relevant curriculum.

Directs each area education agency, by January 15, 2008, to submit a plan to the department that identifies the existing, new, or expanded opportunities for school district sharing or efficiency of operations determined as a result of completing the process. Provides the plan must provide for long-term measures that identify money or time saved as a result of the sharing or efficiency of operations efforts, list the cooperative partners in specific sharing or efficiency of operations efforts, describe effective structure and delivery models that promote optimum student achievement, and include provisions for making educational stakeholders aware of the sharing and efficiency in operations opportunities available in each area.

Directs the department of education to review the plans submitted, identify barriers to potential sharing and efficiency in operations efforts, recommend a timeline for implementation of sharing and efficiency of operations efforts and a reduction in funding related to penalties for noncompliance with the implementation of sharing and efficiency of operations efforts, and submit its findings and recommendations to the general assembly by March 15, 2008.

Section 5: Strikes and rewrites section 256.11A. Authorizes the board of directors of a school district to file a request by August 1, 2007 for a waiver from the following requirements for the 2007-2008 school year:
a. Apply for a one-year extension of a waiver granted for the previous school year that the district have a qualified teacher librarian.
b. That the school district have a qualified guidance counselor. The board of directors of the school district may, not later than August 1, 2008, for the 2008-2009 school year, apply for a one-year extension of the waiver.
c. That the school district have a school nurse. The board of directors of the school district may, not later than August 1, 2008, for the 2008-2009 school year, apply for a one-year extension of the waiver.

Directs each attendance center to develop an attendance center professional development plan to promote group professional development. Provides the attendance center plan must be based, at a minimum, on the needs of the teachers, the Iowa teaching standards, district professional development plans, and the student achievement goals of the attendance center and the school district as set forth in the comprehensive school improvement plan.

Directs districts to create quality professional development opportunities. Provides the goal for the use of specified funds is to provide one additional contract day or the equivalent thereof for professional development and use of the funds is limited to providing professional development to teachers, including additional salaries for time beyond the normal negotiated agreement; pay for substitute teachers, professional development materials, speakers, and professional development content; and costs associated with implementing the individual professional development plans. Requires that the use of the funds be balanced between school district, attendance center, and individual professional development plans, making every reasonable effort to provide equal access to all teachers.

Provides details on the distribution of certain professional development funds. Requires each district to certify to the department of education how the district allocated the funds and that moneys were used to supplement, not supplant, the professional development opportunities the district would otherwise make available.

Directs that if funds are allocated to the department for district salaries or professional development, the department must, in collaboration with the area education agencies, establish teacher development academies for school-based teams of teachers and instructional leaders. Requires each academy to include an institute and provide follow-up training and coaching.

a. All property tax levies, income surtaxes, and local option sales taxes in place in the school district, listed by type of levy, rate, amount, duration, and notification of the maximum rate and amount limitations permitted by statute.
b. The amount of funding received on a per pupil basis through the operation of the school finance formula, and from any other state appropriation or state funding source.
c. Federal funding received per student or teacher population targeted to receive the funds, and any other federal grants or funding received by the district.
d. Teacher and administrator minimum, maximum, and average salary paid by the district, and the percentage and dollar increase under teacher and administrator salary and benefits settlement agreements.
e. Teacher and administrator health insurance and other alternative health benefit information, including the monthly premium, the percentage of the premium paid by the district, and the percentage of the premium paid by a teacher or administrator for single and family insurance.
f. Teacher and administrator employment statistics, including the annual number of licensed full-time and part-time teachers and administrators employed by the school district during the preceding five years, and including the number of teachers and administrators no longer employed by the district, and new hires.
g. Student enrollment levels during the preceding five years, including regular enrollment, special education enrollment, and enrollment adjustments made pursuant to supplementary weighting.
h. Such additional information as the school district may determine.

Requires copies of a district's financial report for the previous school year to be posted on the district Web site at the beginning of the school year. Provides that if the district does not maintain or develop a Web site, the school district must either distribute or post written copies of the financial report at specified locations throughout the school district.

Provides that, prior to certifying any levy by board approval, or submitting a levy for voter approval, local boards must facilitate public access to a complete listing of all outstanding levies within the school district by rate, amount, duration, and the applicable maximum levy limitations. Requires that the information on outstanding levies be posted on the district Web site at the beginning of the school year, and updated prior to board approval or submission for voter approval of any levy during the school year. Rewrites section 284.11 (former "Pilot program for team-based variable pay for student achievement"). New section 284.11 encourages school districts to establish teacher compensation opportunities that recognize the need for geographic or other locally determined wage differentials and provides incentives for traditionally hard-to-staff schools and subject-area shortages. Provides for state assistance to allow school districts to add a market factor to teacher salaries paid by the school districts. Provides that funds are to supplement, but not supplant, wages and salaries paid as a result of a collective bargaining agreement.

Authorizes department to spend up to $250,000 of an allocation to support the implementation of a national board certification support program.

Authorizes area education agencies to receive funds to support beginning teacher mentoring and induction programs.

Deletes selected provisions from section 284.13 on authorized allocations for teacher salaries, professional development, etc.

Requires a preliminary study to measure the cost and effectiveness in raising student achievement of a compensation system that provides financial incentives based on student performance. Beginning July 1, 2006, requires the commission to gather sufficient information to identify a pay-for-performance program based on student achievement gains and global content standards where student achievement gains cannot be easily measured. Directs the commission to review pay-for-performance programs in both the public and private sector. Based on this information, requires the commission to design a program utilizing both individual and group incentive components. Requires at least half of any available funding identified by the commission to be designated for individual incentives. Commencing with the school year beginning July 1, 2007, requires the commission to initiate demonstration projects, in selected kindergarten through grade twelve schools, to test the effectiveness of the pay-for-performance program. Directs the commission to select 10 school districts as demonstration projects. To the extent practicable, requires participants to represent geographically distinct rural, urban, and suburban areas of the state. Requires the commission, beginning in the 2008-2009 school year, to select twenty additional school districts as demonstration projects.

Requires the commission to prepare an interim report by January 15, 2007, followed by interim progress reports annually, followed by a final study report analyzing the effectiveness of pay-for-performance in raising student achievement levels. Requires the final study report to be completed no later than six months after the completion of the demonstration projects. Directs the general assembly to consider implementing the pay-for-performance program statewide for the 2009-2010 school year.

Governor vetoed provisions establishing a pay-for-performance commission to design and implement a pay-for-performance program and provide a study relating to teacher and staff compensation containing a pay-for-performance component. Governor directs the Institute for Tomorrow's Workforce to take the lead on this study. Governor likewise vetoed provisions directing the department to create a teacher remediation program to provide counseling and assistance for teachers whose students do not demonstrate adequate increases in achievement.

Mandates that the curriculum include lesson plans covering Iowa history, civics, government, and heritage studies, and that the curriculum contain enough content for the course to fulfill at least .5 unit of credit.

Requires the director of the department of cultural affairs to establish an Iowa studies committee to:
(1) Inform school districts, accredited nonpublic schools, and area education agencies of the Iowa studies professional development plan;
(2) Develop partnerships with organizations such as nonprofit history or humanities organizations, civic organizations, libraries, and the business community to support and promote Iowa studies statewide;
(3) Establish evaluation criteria for the Iowa studies professional development plan, including teacher and student evaluation and curriculum and plan effectiveness, which may include a survey of student participation in civic activities and involvement in the election process.
(4) Develop a strategy and plan to implement the Iowa studies professional development plan and curriculum in a limited number of schools and area education agencies across the state. Specifies that participation by a school or area education agency must be voluntary, but that a school or area education agency selected to participate in the plan must agree to participate in the evaluation component conducted by the Iowa studies committee.

Establishes membership of the Iowa studies committee. Requires the committee to:
a. Conduct an evaluation of the Iowa studies professional development plan using the evaluation criteria established by the committee.
b. Submit, for school years ending on or before June 30, 2009, an annual status report on the utilization of the Iowa studies professional development plan in school districts and accredited nonpublic schools to the chairpersons and ranking members of the senate and house committees on education. This report must include the number of schools utilizing the plan.
c. Submit its findings and recommendations in a final report based upon the evaluation data to the chairpersons and ranking members of the senate and house committees on education by January 15, 2010.

Requires the state board to establish guidelines and a review process for districts that approve voluntary desegregation plans. These guidelines must include criteria and standards for districts to observe when creating a voluntary desegregation plan. Requires the department to lend technical assistance to any district attempting to adopt a voluntary desegregation plan. Specifies that a district implementing a voluntary desegregation plan before July 1, 2004 must have until July 1, 2006 to comply with the state board guidelines the state board adopts pursuant to this section.

Deletes the requirement that in open enrollment program, the district of residence must send to the receiving district the Phase III funds allocated to the district of residence for the previous year for the full-time equivalent attendance of the student participating in the open enrollment program.

Makes provision relating to request for open enrollment submitted to a district prior to the district's adoption of a desegregation plan apply retroactively to July 1, 2002 for open enrollment transfer requests received by a district on or after July 1, 2002.

Amends rules regarding the Teacher Quality Program. Includes preschool teachers in "beginning teacher" definition for purposes of beginning teacher mentoring and induction program adopted in statute. Specifies that beginning teachers are the teachers who must undergo "comprehensive evaluation," and specifies that this evaluation is conducted to determine a beginning teacher's level of competency as measured against the Iowa teaching standards. Specifies that the "evaluator" is, per Iowa statute, an administrator or other practitioner who successfully completes an evaluator training program. Defines "intensive assistance" as the provision of organizational support and technical assistance to teachers, other than beginning teachers to ameliorate identified instruction and classroom concerns, for a period of not more than one calendar year. Replaces requirement that "mentor" have at least two of four years on nonprobationary status with requirement that mentor have four years of employment as teacher with nonprobationary status. Defines "performance review" as summative evaluation of a teacher who is not a beginning teacher, to determine whether the teacher's abilities are equal to district expectations and state teaching standards, adn to determine whether the teacher's practice is level with district expectations for career advancement as set out in statute. Specifies that "teacher" is defined as a person filling a nonadministrative position and may be a preschool teacher. Changes language to render district offering of beginning teacher mentoring and induction program mandatory rather than optional, and beginning July 1, 2002 rather than 2001 and 2003. Specifies that the evaluation of the beginning teacher must be conducted before the end of the beginning teacher's second year of teaching. Specifies that beginning teacher who completes the program must have met the Iowa teaching standards and must be recommended by the district for a standard teaching license.

Specifies that if any beginning teacher taking part in a mentoring and induction program leaves the participating district or area educational agency before completing the program, the participating district or area educational agency later hiring the beginning teacher must credit the beginning teacher with the time earned in a program before the hiring. If money is appropriated, a district or area education agency may receive state aid for up to two years for each beginning teacher the district or area education agency employs who was formerly working in an accredited nonpublic school or in another state as a first-year teacher. Requires the district or area education agency hiring the teacher to establish the conditions and requirements of a teacher in a mentoring and induction program.

Specifies that, in addition to any district, an area education agency is also eligible to offer a teacher a third year in the program, notify the board of educational examiners of the teacher's third year of particiaption in the program, participate in state program evaluations, develop a sequential two-year beginning teacher mentoring and induction plan, have the board adopt a beginning teacher mentoring and induction program plan, may choose to use or revise the model plan provided by the area education agency or develop a local plan and abide by specifications for required program components as set out in regulation. Specifies that successful completion of a teacher mentoring and induction program means the teacher's meeting the state teaching standards, and that a third year of eligibility may offered a participating teacher at the employing district's expense. Specifies that a teacher granted a third year of program eligibility must, in conjuction with the teacher's evaluator, work out a plan to meet the Iowa teaching standards and district career expectations, which plan will be implemented by the teacher and supported by the district's mentoring and induction program.

Adds new rule that the local board must provide comprehensive evaluations for beginning teachers using the Iowa teaching standards and criteria as listed in state board rules. For performance reviews of teachers other than beginning teachers, the board must provide evaluations that include at a minimum the Iowa teaching standards and criteria found in state board rules. Allows a local board and its certified bargaining representative to negotiate further teaching standards and criteria to apply in a performance review. Allows the board of a district where no certified bargaining unit exists to determine supplemental standards and criteria.

Adds new rule requiring the department to approve eligible providers and their programs to carry out evaluator training. Establishes requirements for trainers and programs. Adds new rule establishing application requirements for providers of evaluator approval training and department process for the approval of evaluator approval training program applications. Establishes new rule requiring districts to develop and implement a teacher evaluation plan by July 1, 2004. Plan must include: 1) use of the Iowa teaching standards and criteria; 2) provisions for the comprehensive evaluation of beginning teachers that comprises a review of the teacher's progress on the Iowa teaching standards and the use of the department-created comprehensive evaluation instrument; 3) performance reviews of teachers other than beginning teachers once every three years; evaluations must include at least a classroom observation of the teacher, a review of the teacher's progress on the state teaching standards established in rule and additional standards and criteria if adopted, a review of the implementation of the teacher's individual career development plan and supporting documentation from other evaluators, teachers, parents and students; 4) provisions for individual career development plans for teachers other than beginning teachers; 5) provisions for an intensive assistance program as provided in statute that aims at the remediation defined in rule or any other standards or criteria adopted in a collective bargaining agreement. Allows a local board and its certified bargaining representative to open evaluation and grievance processes for beginning teachers and for teachers other than beginning teachers to negotiation. When a supervisor or evaluator at any time deems a teacher's performance to be below district expectations or other standards or criteria approved in the collective bargaining agreement, the evaluator is required to advise the district to place the teacher in an intensive assistance program. States that the intensive assistance program and its implementation are not subject to negotiation or grievance procedures established in statute.

Requires each school or district to support the development and implementation of the individual teacher career development plan for teachers who are not beginning teachers. Establishes that the purpose of the individual plan is to offer individual and collective professional development. Establishes that the aims of an individual teacher career development plan must at a minimum be founded on the relevant Iowa teaching standards supporting the school's and district's student achievement goals as developed in the comprehensive school improvement plan, as well as the teacher's needs. Requires that, to the extent practicable, the learning opportunities offered to meet the goals of the individual teacher plan incorporate individual study and collaborative study of district-approved content. Requires the individual plan to be designed jointly by the teacher and the teacher's evaluator. Requires that a yearly meeting take place between the teacher and the teacher's evaluator to go over the goals and adjust the plan.
