Creating the postsecondary tiered technical education state aid act, replacing the current funding structure. Beginning in fiscal year 2012 and each fiscal year thereafter, each community college and technical college and the Washburn Institute of Teachnology would be eligible for postsecondary tiered technical education state aid from the state general fund for credit hours approved by the state board of regents, using a credit hour cost calculation model, that would include all of the following concepts: (1) Arrange into categories or tiers, technical education programs, recognizing cost differentials; (2) Consider target industries critical to the Kansas economy; (3) Respond to program growth; (4) Consider local taxing authority for credit hours generated by in-district students; and (5) Include other factors and considerations determined necessary by the state board of regents. The state board of regents would establish the rates to be used as the state's share in a given year, as well as in the actual distribution. The bill prohibits receipt of both tiered technical education state aid and non-tiered course state aid for any one credit hour. The bill provides for fund accounting and management requirements related to state aid received under the Act. The bill authorizes the state board of regents to adopt policies necessary or desirable to implement and administer the Act. Bill provides that each community college and technical college is eligible for a grant from the state general fund, in an amount determined by the state board of regents for non-tiered course credit hours approved by the board of regents after dialogue with community college and technical college presidents.

Enacts the uniform reporting system for receipts and expenditures for school districts. Requires the state board of education to develop and maintain the system. The system would include budgetary and proprietary accounts; allow districts to record any information required by state or federal law; provide records by fund, accounts, and other pertinent classifications; the amount appropriated, revenue estimates, actual reenues or receipts; amounts available for expenditure, total expenditures, unliquidated obligations, actual balances; and unencumbered balances of allotments or appropriations for each school district. The bill requires the department of education to annually publish a copy of school district budget form 150 for each school district, the estimated legal maximum gneeral fund budget, or any successor document containing the same information. The department of education also would be required to annually publish the following expenditures for each school district on a per pupil basis: (1) total In addition, the system must allow for data to be searched and compared on a district by district basis. The board also would be required to revise the system, direct school districts on the use of records and fiscal procedures, prescribe on Allows any school district having authority for ancillary school facilities weighting, cost of living weighting, or declining enrollment weighting to spend the motor vehicle-related revenue derived as a result of these weightings. Would change the starting date of the special education school finance formula that determines the minimum and maximum amount of special education state aid a school may receive. This provision would go into effect for the 2012-2013 and the 2013-2014 school years and end on June 30, 2014. The bill allows school districts to expend a portion of the unencumbered balances held in particular funds. The following funds would be considered the first priority for use: at-risk education; bilingual education; contingency reserve; driver training; parent education; preschool-aged at-risk; professional development; summer program; virtual school; and vocational education. The textbook and student materials revolving fund would be the second priority with the special education fund the last priority for use. Local school boards are not limited to using the funds in the priority list and are not required to expend the total unencumbered balance before utilizing the unencumbered balance in another fund.

Relating to postsecondary educational institutions. Allows revenues from rents, boarding fees and otoher charged related to university student housing at state universities to go to either the Housing System Suspense Fund or directly to the Housing System Operations Fund, at the discretion of the university. Allows interest earned from the Housing System Operations Fund and Housing System Repairs Fund to be transferred into those funds. Requires that interest earnings from the Johnson County Education Research Triangle sales tax be transferred from the State General Fund to the Johnson County Education Research Triangle of the University of Kansas, the University of Kansas Medical Center and the Kansas State University. Specifies date of month for fund transfer and method for determining the net earning. Continues the new categories and the levels established for FY 2011 that the Board of Regents may charge private and out-of-state postsecondary educational institutions in order to carry out the Board's statutory and regulatory responsibilities through July 1, 2012. The bill removes the requirement in existing law that second year Kansas State University veterinary medical students who perform spay or neuter surgeries at animal shelters by supervised by a faculty member of the Kansas State University Veterinary Medical Center. Specifies that the spay or neuter surgeries be supervised by a licensed veterarian and specifies the surgeries are limited to dogs and cats belonging to a pound or animal shelter.

Amends K.S.A. 2010 Supp. 72-5445. Allows school districts to offer employment contracts to teachers for one or up to two additional years (that is, a fourth or fourth and a fifth year contract) at the end of the teacher's probationary period, thus extending until the sixth year of employment the ability of the teacher to attain due process rights. (Current law states that a new teacher in a school district, area vocational-technical school or community college cannot attain due process rights in less than three years and there is no provision in current law to extend that time.) Any teacher offered a contract under the provisions of the bill would be evaluated and a plan of assistance would be written to assist the teacher meet areas needing improvement as noted in the evaluation. Before signing or rejecting the contract, a teacher would have not less than 48 hours from the time the contract is offered to review and consider the contract and plan of assistance. Additionally, the bill would require school districts to annually file a report with the State Board of Education and the House and Senate education committees, with information regarding numbers of teachers offered due process rights. The provisions related to the additional two years of probationary employment and the reporting requirements would expire on July 1, 2016.

Allows Fort leavenworth Unified School Distrit 207 t0 transport grades 10 through 12 students who reside at Forth Leavenworth to Leavenworth High School in Unified School District 453. Requires related transportation weighting to be calculated using only students counted on September 20. Bill also changes the school finance law to redefine non-resident pupil. Non-resident pupil would be defined as a student or member of the student's family who lives 2.5 or more files from the attendance center the student would attend in the district in which the student resides. Previously was "10 miles or more". Bill clarifies that provisions of the bill would not apply to school districts located in Johnson, Sedgwick, Shawnee or Wyandotte counties.

Governor established the Kansas Broadband Advisory Task Force with the following purposes and charges: (1) To develop recommendations for development and implementation of a broadband digital strategy to support statewide availability and adoption of broadband services consistent with the 2010 National Broadband Plan; (2) To coordinate key stakeholders input from both the public and private sectors to assist in broadband planning and implementation efforts in a technology-neutral manner; (3) To establish performance goals and metrics and the impact on achieving statewide universal availability and adoption of broadband services with greatest attention to un-served and under-served communities; (4) Advise the governor and the legislature on statutory, regulatory and policy changes necessary to support making affordable, quality broadband service available to every Kansas home and business and encourage its adoption and to provide feedback to federal agencies engaged in national broadband policy and funding efforts as they relate to Kansas; (5) Identify opportunities to leverage public/private partnerships in funding boardband sustainability and infrastructure; (6) Identify opportunities to foster economic development and technology innovation through partnerships between public, private and non-profit sectors; (7) This task force shall report annually to the governor and the secretary of commerce. To enhance early educational opportunities for Kansas children, Governor Mark Parkinson has created the Kansas Early Childhood Advisory Council. The Council will build on the work of the Kansas Children's Cabinet, the Kansas Early Childhood Comprehensive Systems Plan and the Kansas Early Learning Coordinating Council. It will conduct a periodic statewide needs assessment concerning the quality and availability of early childhood education and development programs and services for children from birth to school entry. This will include an assessment of the availability of high-qualith pre-kindergarten services for low-income child in Kansas. The advisory council will develop recommendations for increasing the overall participation of children in existing child care and early childhood education programs, as well as recommendations regarding the establishment of a unified data collection system.

Clarifies current law regarding gifts and donations to universities, and provides guidelines on the acceptance of gifts by a foundation. Gifts to the university, other than gifts of real property, would be considered property of the university foundation, upon written approval of the chief executive officer of the institution, unless prohibited in writing by the donor. As in current law, the property of a foundation would
not be considered to be public or state property. Foundations would have the ability to charge a reasonable administrative fee
and may be reimbursed for actual expenses. Property could be administered, invested, reinvested and expended solely for the

Amends the special education catastrophic state aid law by requiring that any federal or state special education aid be deducted when computing the entitlement for catastrophic aid, beginning in the 2009-2010 school year. The bill increased the threshold for determining eligibility for catastropic aid to twice the state aid paid per special teacher beginning in the 2010-2011 school year. The state board of education is directed to determine the minimum and maximum amounts of state aid paid to districts for the costs of special teachers, beginning in the 2011-2012 school year. Minimum and meximum amounts are to be calculated based upon total enrollment. Bill amends a provision in the special education law which provides for the payment of Medicaid replacement aid to school districts. Concerns the low-income family postsecondary savings accounts incentive program. Beginning in calendar year 2009, the treasurer may approve no more than 300 applications for a single district. If 300 applications from residents of a district are not approved in calendar year 2009 and any year thereafter, the treasure may approve additional applications submitted by residents of the remaining districts up to a total of 1,200 applications per pear. Applications shall be approved on a first come, first served basis. The treasurer is to prepare and submit to the governor and the legislature a report on the program on or before January 31 of each year which includes the number of accounts opened under the program, the amount of moneys contributed to such accounts by the participants, the amount of matching moneys transferred by the treasurer, the average income of the participants, an analysis of the success of the program in meeting the purpose of the program and any other information deeded appropriate by the treasurer. Provides that a student enrolled in a district and attending special education and related services and also attending a virtual school must be counted as that proportion of one pupil (to the nearest one-tenth) that the student's attendance at the non-virtual school bears to full-time attendance.

Repeals and replaces K.S.A. 72-6455 regarding each district's high density at-risk pupil weighting. Creates new section for districts with enrollments of at least 40% but less than 50% at-risk students. Provides that each eligible district's medium density at-risk pupil weighting must be determined by the state board by multiplying the number of at-risk pupils by .06. Provides that if a school district becomes ineligible for medium density at-risk pupil weighting because enrollment of at-risk pupils in the district falls below the minimum threshold, the medium density at-risk pupil weighting of the district must be the greater of: (1) The medium density at-risk pupil weighting in the current school year; (2) the medium density at-risk pupil weighting in the prior school year; or (3) the average of the
medium density at-risk pupil weighting in the current school year and the preceding two school years. Provides that the medium density at-risk pupil weighting provisions expire on June 30, 2011.
Establishes the special education funding task force, and requires the first meeting of the task force to be held on or before August 1, 2008. Directs the special education funding task force to:
(1) Study and make recommendations for changes in the existing formula for funding of special education and related services including medicaid replacement state aid
(2) Conduct hearings and receive and consider suggestions from teachers, parents, the department of education, the state board of education, other governmental officers and agencies and the general public concerning funding for special education and related services
(3) Make and submit reports to the legislature on the work of the task force concerning recommendations of the task force. Provides that such reports must also include recommendations for legislative changes and must be submitted to the legislature before the start of each year's legislative session.
Provides that the task force shall cease to exist on June 30, 2011.
Establishes new section regarding medicaid replacement state aid. Directs the state board to designate a portion of the special education services state aid appropriation as medicaid replacement state aid. Provides that the amount so designated may not exceed $9,000,000 in any school year. Provides that each school district is entitled to medicaid replacement state aid. Provides a formula for calculating each district's medicaid replacement state aid.

Provides that the Kansas Academy of Mathematics and Science (KAMS) may admit nonresident students. Requires KAMS students to pay those fees regularly charged high school students. Provides that tuition and fees charged to nonresident students may exceed the amount charged to Kansas resident students, and that nonresident students are responsible for the payment of all tuition and fees (tuition of Kansas residents is paid by the resident district). Provides admissions procedures to be followed in the event there are fewer than five academically talented students who apply for admission to KAMS from any one of the four congressional districts. Allows the board of regents to authorize admission of nonresident academically talented students and international academically talented pupils as well as additional Kansas residents. Requires at least three-fourths of the students enrolled in KAMS to be Kansas residents.
Provides that admission to KAMS must be determined solely pursuant to rules and regulations of the board of regents, and that no legislative provisions shall be construed to require a gifted student's admission to KAMS or inclusion of KAMS admission as a part of a gifted pupil's IEP.

Establishes the Kansas technical college and technical school commission. Provides that when making the initial appointments, the governor and legislature must appoint the same members appointed to the Kansas technical college and vocational school commission, as established in 2006 legislation. Directs the commission to:
(1) Study and conduct hearings on the governance, funding and mission of Kansas technical colleges and technical schools
(2) Submit reports of the commission's activities and recommendations regarding governance, funding and the mission of Kansas technical colleges and technical schools to the legislative educational planning committee. Requires that a preliminary report be submitted by November 15, 2007, and that a final report be submitted by November 15, 2008. Provides that such reports must include recommendations for legislative changes.

(9) develop recommendations for the best practices for early evidence-based intervention for children with autism.

Encourages other states to pass similar resolutions. Establishes the low-income family postsecondary savings accounts incentive program as a three-year pilot program to encourage qualified individuals and families to establish family postsecondary savings accounts. Defines qualified individuals and families as Kansas residents whose household income is not more than 200% of the federal poverty level at the time of application. Provides that the amount of contributions made to an account by a participant will be matched by the state on a dollar-for-dollar basis, up to $600, if the participant contributes at least $100 in each calendar year in which the account is open. Defines 'extraordinary declining enrollment' as a district enrollment which has declined during the preceding three school years at a rate of at least 5% per year or by at least 50 students per year, whichever is greater. Bars the board of any district with extraordinary declining enrollment from authorizing the issuance of any bonds for the construction of a new building without having first advised and consulted with the joint committee on state building construction. Following a hearing between the local board and the committee, directs the committee to make a recommendation on the advisability of the proposed issuance of bonds. Requires a copy of the committee's recommendation to be provided to the district and to the state board of education within 15 days of the date of the hearing.
Provides that if the joint committee recommends against the issuance of any bonds for the construction of a new building and if the district proceeds to issue bonds for such construction, the district is not entitled to state aid for such bonds.

Establishes the Kansas Foster Child Educational Assistance Act. Provides that the purpose of the act is to establish an educational assistance program under which eligible foster children receive tuition waivers to any area vocational school, area vocational-technical school, community college, municipal university, state educational institution or technical college. Requires participating foster children to pay all fees charged by the state postsecondary institution that are not directly required for the courses in the student's educational program. Requires participating student, as condition of continuing eligibility, to remain in good standing at the postsecondary institution and make satisfactory progress toward completion of the requirements of the educational program in which the eligible foster child is enrolled.
Directs the secretary to publish an annual report on the Kansas foster child educational assistance act and to present the report to the legislature. Requires the annual report to account for the ways in which the purpose of this act have been carried out. Establishes the Kansas Academy of Mathematics and Science as either:
(1) An accelerated residential, or on-line distance learning program for Kansas high school-age pupils who are academically talented in science and mathematics; or
(2) a rigorous, two-year program of college coursework tailored to individual abilities and taught by the faculty of a postsecondary educational institution designated by the board, or
(3) both. Both options are to allow gifted students to earn college credits and a high school diploma at the same time. Requires the state board of regents to determine whether KAMS is a residential program, a distance learning program or a combination of on-line and in person course work, seminars and learning activities.
Defines eligible students. Requires the state board of regents to prescribe the curriculum of KAMS, including coursework in mathematics through calculus II, chemistry, biology, physics, computer science, English and history. Specifies that the course of study for KAMS pupils must be subject to the state board's approval and must be designed to meet both the high school graduation requirements and the requirements for an associate of arts or an associate of science degree.
Requires the state board of regents to establish fees for students attending the KAMS program, which must be paid by the school district where the student is enrolled but must not exceed the base state aid per pupil.
Allows a total of at least 40 pupils to be admitted to KAMS. Requires 20 of the students to be chosen based on residence with no more than five residing in a single congressional district. Requires the remaining 20 pupils to be chosen without regard to residence in the state. Allows the Board of Regents the authority to expand the number of students beyond 40, but the same geographic distribution apply.
Gives the board authority to aid regent institutions in developing short-term summer academies and requires budget requests to include funds for operating such academies, which may be residential or use the KAN-ED system.

Makes changes to the School District Finance and Quality Performance Act, other school funding legislation, and enact policies relating to the state department, the Courts, and the Legislature. The bill provides for increases in Base State Aid Per Pupil (BSAPP), reimposes correlation weighting, and establishes a Local Activities Budget of 2 percent of the school district general fund budget. The bill appropriates
funding totaling $119,000,000 in FY 2006 and $20,000,000 in FY 2007 for various state aid programs. The bill funds the Skills for Success
Program in FY 2007, and makes other policy changes, including, for example: School District Budget Deadline – For the 2005-06 school year
only, the school district budget deadline for filing the budget with county clerks would be delayed from August 25 to September 7. For the 2005-06 school year only, the cap on the school district contingency fund would be increased from 4 percent to 6 percent of the school district's general fund budget. Requires that at least 65 percent of the moneys appropriated, distributed, or otherwise provided by the state to school districts would be expended in the classroom or used for instructional purposes as defined by the National Center for Education Statistics. School District Administrative Reorganization Plan – Requires the state board to design an administrative reorganization plan for all
school districts. Provides that no money from a school district's general fund can be spent for attorney fees or other costs in support of litigation against the State of Kansas or any state officer, official, agent, or agency. No money from a school district's general fund can be used by a district for lobbying. Computer Reporting System – Adds a provision that the Kansas Department of Education is to have the new computer reporting system required by 2005 HB 2247 in use by December 31, 2005. Teacher Bonuses – Allows the preschool at-risk, atrisk,
bilingual, and vocational education funds to carry forward balances or be used for teacher bonuses when the teachers' efforts resulted in achievement of mastery of basic reading skills based on State Board guidelines (preschool at-risk and at-risk funds); in achievement of English for ESL students.

Establishes the 2010 Commission. States that the commission shall cease to exist on December 31, 2010. Requires the commission to:
(a) Conduct continuous and on-going monitoring of the implementation and operation of the school district finance and quality performance
act and other provisions of law relating to school finance and the quality performance accreditation system;
(b) evaluate the school district finance and quality performance act and determine if there is a fair and equitable relationship between the costs of the weighted components and assigned weightings;
(c) determine if existing weightings should be adjusted;
(d) determine if additional school district operations should be weighted;
(e) review the amount of base state aid per pupil and determine if the amount should be adjusted;
(f) evaluate the reform and restructuring components of the act and assess the impact thereof;
(g) evaluate the system of financial support, reform and restructuring of public education in Kansas and in other states to ensure that the Kansas system is efficient and effective;
(h) conduct other studies, as directed by the legislative coordinating council, relating to the improving, reforming or restructuring of the educational system and the financing thereof;
(i) conduct hearings and receive and consider suggestions from teachers, parents, the department of education, the state board of education,
other governmental officers and agencies and the general public concerning suggested improvements in the educational system and the financing thereof;
(j) appoint advisory committees when deemed necessary. Such advisory committees shall conduct hearings and seek a wide variety of input from individuals and groups affected by and concerned with the quality, efficiency and cost of public elementary and secondary education in Kansas. Such individuals and groups shall include, but not be limited to, teachers, parents, students, the department of education, the state board of education, other governmental officers and agencies, professional educational organizations and associations, the business community, institutions of higher education, other persons who have an interest in the quality and efficiency of elementary and secondary education in Kansas and members of the general public interested in the improvement in the state's educational system and the financing thereof.
(k) make any recommendation it deems is necessary to guide the legislature to fulfill goals established by the legislature in meeting its constitutional duties of the legislature to: (A) Provide for intellectual, educational, vocational and scientific improvement in public schools established and maintained by the state; and (B) make suitable provision for the finance of the educational interests of the state;
(l) examine the availability of revenues to ensure adequate funding of elementary and secondary education in the state;
(m) examine school district efficiencies and whether districts are using best practices to deliver a high quality level of services and programs;
(n) examine school district consolidation and impediments thereto;
(o) examine voluntary activities, including extracurricular activities, which affect educational costs;
(p) monitor and evaluate associations and organizations that promote or regulate voluntary or extracurricular activities including, but not limited to, the Kansas state high school activities association;
(q) conduct other studies, as directed by the legislature, relating to the improving, reforming or restructuring of the educational system and the financing thereof;
(r) make and submit annual reports to the legislature on the work of the commission concerning recommendations of the commission relating
to the improving, reforming or restructuring of the educational system and the financing thereof and other topics of study directed to the commission by the legislative coordinating council. Such report also shall include recommendations for legislative changes and shall be submitted to the legislature on or before December 31 of each year.

Establishes procedures for local tax levies. Establishes in every district a fund called the teacher salary enhancement fund. Creates a formula for determining a district's cost of living weighting. Authorizes any balance remaining in a district's vocational education fund at the end of the budget year to be carried forward into the vocational education fund for succeeding budget years; makes other changes. Changes ''state prescribed percentage'' to 27% for school year 2005-2006, 29% for school year 2006-2007 and 30% for school year 2007-2008 and each school year thereafter. Allows any district that has adopted a local option budget for school year 2004-2005 in an amount equal to the state prescribed in effect prior to the effective date of this act to adopt a local option budget for school year 2005-2006 in an amount equal to the state prescribed percentage in effect on July 1, 2005, by adoption of a resolution. Such resolution shall not be subject to protest or election. Modifies ''statutorily prescribed mill rate.'' Bars school districts from adopt or renew a resolution imposing a tax levy in excess of the statutorily prescribed mill rate.
Creates new sections defining ''extraordinary declining enrollment'' as an enrollment which has declined during the preceding three school years at an average rate of at least 5% or by at least 50 pupils, and setting forth rules for bonds and tax levies in districts experiencing such enrollment losses.
States that for school year 2005-2006, districts shall not be paid supplemental general state aid for that portion of the local option budget in excess of the state prescribed percentage in effect prior to the effective date of this act.

Allows the board of education of any school district, any teacher of mathematics, science, physics, chemistry or biology, and a business firm to enter a partnership agreement under which such business firm agrees to employ such teacher in a position that requires mathematics or science skills commensurate with the classes that the teacher regularly teaches when school is not regularly in session. Provides the business with a state income tax credit of 25%, or 30% for a teacher teaching in a school district in a rural community, underserved area, or underperforming urban area. Limits the total amount of credits for the program per fiscal year to $500,000. Limits the total amount of credits per congressional district to $125,000.
Establishes the mathematics and science teacher service scholarship program, which grants up to 50 new scholarships each year to qualified students who are Kansas residents working toward certification to teach math or science in grades 6-12 and who agree to teach in an accredited public or private school in Kansas for at least four years. Creates in the state treasury the mathematics and science teacher service scholarship program fund and the mathematics and science teacher service scholarship repayment fund.

Authorizes the state board of regents to allow any state institution of higher education to convert all classified staff employee positions or any portion thereof in the institution to the unclassified service of state employment. Those classified staff employees whose positions are converted from classified to unclassified status shall retain all health and flexible benefits and leave and retirement benefits provided to them under the state classified employee system. Establishes parameters of such actions. Specifies that these newly designated unclassified employees must be referred to as ''university support staff'' and the university of Kansas medical center must be considered a state institution of higher education separate from the university of Kansas, Lawrence, and its campuses. Provides that nothing in this act shall affect the representation rights of collective bargaining organizations that represent employees of a state institution of higher education, nor shall the provisions of this act affect any term or condition of any collective bargaining agreement in effect on the effective date of this act. Revises statute 75-2935 to include in the definition of "unclassified service" positions at state institutions of higher education that have been converted to unclassified positions per the provisions above.

The major changes include the following: Allows school districts to spend up to 15 percent of the federal funding they receive on early intervention services. The bill requires a meeting or provide the option of mediation to resolve conflicts between parents and the school district prior to a due process hearing. Requires that hearing officer decisions be based on whether the school provides a free appropriate education, not on technical violations of procedural requirements except under certain conditions, and provides a two-year statute of limitations for bringing complaints.Allows a school district to recover attorney's fees for frivolous complaints. Provides for the conduct of an individual education
plan (IEP) meeting and the content of the IEP and prohibits a school district from having its attorney present at the IEP meeting unless the parents are represented by an attorney at the meeting. Expands the definition of "parent" to include foster parents, if they are appointed the education advocate of an exceptional child. Authorizes the state board to participate in any pilot project authorized by federal law. Clarifies that it is the duty of the school district to identify disabled children who are homeless and who are limited English proficient.Requires that all records of an exceptional child who transfers from one school district to another be transferred with the child or as soon thereafter as possible.
Specifies what school districts must do when a child who receives special education services transfers from one school district to another.
Specifies numerous requirements for the discipline of children with disabilities. Requires parental consent for evaluation and for the initial provision of services. HB 2331 amends statutes governing the National Board Certification program. Under current law, teachers attaining National
Board Certification receive an annual salary bonus from the state of $1,000 for the ten years of the certification period. The bill removes the ten-year limit to allow the salary bonus to be provided for those teachers who are re-certified for an additional ten years. In addition, teachers participating in the standards program prior to initial certification currently receive a scholarship to assist with the costs of the program. The bill codifies this scholarship at $1,100 and also provides for a $500 scholarship to assist with the costs of the re-certification program. The bill amends the statutes governing the Teacher Service Scholarship. This scholarship is awarded to students who are planning to teach in a hard-to-fill discipline or underserved geographic area. Under current law, a hard-to fill discipline is defined as one in which there is a critical shortage of teachers as determined by the Board of Education. The bill specifies that the State Board of Regents will serve as the representative of the public postsecondary education system before the Governor and the Legislature. (Under current law, the State Board of Regents is assigned the role of advocating for adequate resources and sufficient authority to enable postsecondary institutions to achieve their missions.) The State Board of Regents is directed to develop and
implement, in conjunction with the postsecondary educational institutions, a comprehensive plan for coordinating all program offerings by
postsecondary educational institutions. Commencing on July 1, 2004, the state board of regents shall have authority to review and approve institutional improvement plans, and, on the basis of each plan, shall develop and implement a performance agreement with each postsecondary educational institution. Performance agreements shall incorporate the goals, priorities, policies and mission objectives identified in the institutional improvement plans, and the performance measures, which will be used to demonstrate compliance and progress. (e) Commencing on July 1, 2005, each postsecondary educational institution's receipt of new state funds shall be contingent on achieving compliance with its performance agreement. The state board shall determine the amount of new state funds to be received by each postsecondary educational institution, taking into account the postsecondary educational institution's level of compliance with its performance agreement and the funds available for distribution. The State Board of Regents is directed to develop a unified budget for state funding of postsecondary educational institutions, present that budget to the Governor and the Legislature each year, and receive and allocate the state funds appropriated for funding of postsecondary educational institutions in accord with legislative directives, except for allocations based on institutional performance allocations. (This replaces the current law which directs the State Board to approve for state funding purposes educational programs, courses of instruction, and out-district program and course locations and to review budget and state funding requests of postsecondary educational institutions in order to present a unified budget for higher education.) The Kansas postsecondary education savings program trust fund is established in the state treasury. Such savings trust fund shall consist of moneys deposited by depositors in accordance with this act, moneys acquired from governmental and private sources and state general fund appropriations, if any. All interest derived from the deposit and investment of moneys in such savings trust fund shall be credited to the fund. At the end of any fiscal year, all unexpended and unencumbered moneys in such savings trust fund shall remain therein and not be credited or transferred to the state general fund or to any other fund.
