Requires that the results of this review be included in a report to the legislature.

Requires a public postsecondary institution to grant a waiver from the institution's required student health plan, if requested by a student.
Adds categories of students to the types of students who are not required, under current law, to have a statement of immunization on file with the public or private postsecondary institution as a prerequisite to enrolling, subject to exemptions provided in law. Specifically excludes students attending only extension, online, or evening or weekend adult accelerated programs.
Requires MnSCU institutions to compile course schedules with all course materials required and recommended for each course. The course schedule must include, to the extent practicable, information now required of bookstores. Course schedule information must be available on the institution's Web site. Makes notification to the campus bookstore of selected course material mandatory for MnSCU academic departments or instructors. Also requires the notice of selection must be provided to the bookstore and students 45 days, instead of 30 days, before the start of the term in which the selected material will be used. Requires notice 45 days prior to the start of the term if an earlier version of a book is an acceptable substitute for a new edition.
Increases from $300 million to $405 million the maximum amount of the aggregate principal of revenue bonds issued by MnSCU.
Changes "individual" to "person" to accommodate trusts as a designated account owner in the Minnesota college savings plan.
Exempts postsecondary schools offering only avocational, recreational, or remedial subjects from having to be licensed as a private career school if, before August 1, 2008, its name included academy or institute.
Expands the safety officer survivor educational grant program to include grants for graduate education. Sets the maximum award for graduate education at the tuition maximum for four-year programs as set in session law.
Requires the MnSCU board of trustees to establish a work group to study methods to reduce the cost of textbooks for students, including alternative textbook delivery methods, cross-campus delivery, and expanded use of e-books to provide textbook cost savings. Directs the commissioner to convene an advisory panel to advise the commissioner on applicants' qualifications, and select between three and six qualified applicants by April 1, 2013.
Directs participating districts to submit project data to the commissioner for the commissioner to analyze districts' progress and best practices and submit a final report to the legislature by February 1, 2018, recommending whether or not to continue or expand the pilot project.

Provides clarification on the district of residence for a homeless pupil, such that the pupil resides in the district where the parent or guardian resides unless parental rights have been terminated, the parent lives out of state or is an inmate at a correctional facility or halfway house. For students in this situation their district of residence will be the district the student resided when the qualifying event occured. Allowes the Commissioner of Education to determine residence in the event of a dispute. Provides that serving districts or charter schools are responsible for transporting homeless pupils to and from their districts of residence. [Article 1, Sec. 1, Subd. 2]
Allows a homeless student to continue to enroll in a nonresident district if his/her parent or guardian moves to another district, without the approval of the nonresident district or resident district. [Article 1, Sec. 13, Subd. 2a]

Allows any student in grade 10-12 enrolled in a district or American Indian-controlled tribal contract or grant school to enroll in a career or technical education (CTE) course offered by a Minnesota state college or university. Requires a 10th grade student to have passed the 8th grade Minnesota Comprehensive Assessment in reading as a condition of enrollment. Provides that a secondary student may enroll in his/her first postsecondary options course through this provision. Allows a student who was refused enrollment by a state college or university to apply to an eligible institution offering a CTE course. Requires the postsecondary institution to to allow a student to take additional courses for secondary credit if the student receives a grade of "C" or better on the CTE course. Defines a CTE course.

Provides that a charter school board may enter into a renewable agreement with a school district, within whose boundaries it operates, to enhance student achievement. Prohibits a charter school authorizer from requiring a collaboration agreement as a condition of entering into or renewing a charter. Provides that a school district does not need to be an authorizer and that the agreement may not impact the authority or autonomy of the charter school or cause the state to pay twice for a student, service or facility. Provides that such agreement may include collaboration regarding facilities, transportation, training, assessments, performance standards. (a) Directs the education commissioner to convene a 12-member advisory task force to develop recommendations for repurposing integration revenue funds to create and sustain opportunities for students to achieve improved educational outcomes. Requires the task force to consider how to effectively narrow and close the academic achievement gap and foster students' academic success, among other things.
(b) Suggests that the funding allocation for the new program ensure funding stability for districts receiving revenue under the current integration program. Requires revenue under the new program to be used for purposes recommended by the task force and approved by the legislature.
(c) Includes on the task force six members appointed by the education commissioner, three members appointed by the house speaker, and three members appointed by the senate. Directs the commissioner to convene the first task force meeting and to provide assistance upon request. Directs task force members to seek input from experts and to develop recommendations to improve students' academic achievement.
(d) Requires the commissioner to submit a task force report to the legislature by February 15, 2012, recommending how best to allocate funds previously allocated as integration revenue funds in order to achieve improved educational outcomes for students.
(e) Establishes the base appropriation for the new program in fiscal years 2014 and 2015.
(f) For taxes payable in 2013, allows districts to certify a levy in an amount equal to the district's certified levy for taxes payable in 2012.(Article 13, Sec 49)

Directs the department, in consultation with teachers and administrators and other education stakeholders to create and publish a teacher evaluation process that complies with the requirements of this section and applies to all teachers without an annual teacher evaluation agreement.

Encourages the board of trustees to offer an optional tuition plan for Minnesota resident students pursuing two-year and four-year degrees that meets the goal of holding tuition constant at the rate charged in the first semester.
Eliminates the statutory requirements that provide a state-funded matching grant for low- and middle-income families who participate in the Minnesota college savings plan established under section 529 of the Internal Revenue Code.
Statutorily prohibits the use of state or federal funds, for state programs, to support human cloning or for expenses incidental to human cloning. States that this section does not affect stem cell research.
Requires the Office of Higher Education (OHE) to study the for-profit graduate education sector in Minnesota.

Strikes language allowing a new teacher to teach for up to three years without first having passed the reading, writing, and math basic skills test that is a condition of licensure.
Allows the Board of Teaching to grant continuing licenses only to eligible persons who have passed the basic skills test.
Adds a cross reference to indicate that applicants for a Minnesota teaching license who were trained in other states must take and pass the state's basic skills reading, writing, and math exam during the term of their one-year temporary teaching license.

Establishes the healthy kids awards program to reward k-12th grade schools that implement policies and practices that create opportunities for students to be physically active and make healthy food choices throughout the day. The program seeks to integrate physical activity into nonphysical education classes, recess, and extracurricular activities throughout the day in addition to the physical education received in physical education classes. The program also seeks to integrate nutrition education and healthy food and beverage choices throughout the school environment, including classrooms, cafeteria, vending, school stores, and fund-raising. The program requirements align with the Institute of Medicine's guidelines for school food and beverages.
School districts may submit letters of intent to participate in the healthy kids awards program to the commissioner of education by September 15 of each school year. Schools that report to the commissioner of education and meet the program criteria developed by the commissioner will have a "Healthy Kids Award" indicator placed on the school report card.

A private institution that does not participate in the federal Pell program must participate within three years of an ownership change to continue as an eligible institution, subject to an appeal for a single one-year extension. For purposes of federal accountability requirements, directs the commissioner to develop reading and math assessments for grades 3 through 8, state-developed high school reading and math tests aligned with state standards, and science assessments. Prohibits the commissioner from requiring students to achieve a passing score on high school science assessments in order to graduate. Requires assessment results to include a value-added growth indicator of student achievement. Requires schools, school districts, and charter schools to administer statewide assessments to evaluate student proficiency in the context of the state's grade-level academic standards. Makes the temporary alternative to the state's reading and math GRAD tests applicable in the 2009-2010 through 2013-2014 school years. Makes the statutory timeline for aligning assessments to standards effective July 1, 2010, and the legislature specifically authorizes the number, subject area, grade level, and consequence of a high school math assessment. Causes the 11th grade math GRAD to remain in effect if the legislature does not act by July 1, 2010.

(6) Selecting teachers and other staff consistent with current law and collective bargaining agreements and memoranda of understanding. Requires at least 70% of the teachers to be selected by the site prior to final
approval of the agreement.
Itemizes revenue allocated to the site. Exempts site-governed schools from the same laws and rules as charter schools, except that site-governed schools are subject to government data practices laws, the open meeting law, PELRA, teacher continuing contract and tenure laws, and teacher prep time and lunch requirements. Directs the school board and the site council to agree to performance standards and expectations that include student achievement targets premised on multiple indicators, criteria and process addressing school sites that fail to meet accountability requirements, and other agreed-upon performance terms.
Allows a school board to terminate an agreement for cause.

Authorizes a school district to apply to the commissioner for a waiver from the requirement to maintain racial balance within a district school if the racial imbalance in that school results from: (1) The enrollment of protected multiracial students and the proportion of enrolled multiracial students reflects the proportion of multiracial students who reside in the school attendance area or who are enrolled in the grade levels served by the district; or (2) The enrollment of limited English proficiency students in a transition program that includes an intensive English component. The commissioner must grant the waiver if the district in which the school is located offers the multiracial students or the limited English proficiency students, as appropriate, the
option of enrolling in another school with the requisite racial balance, and the students' parents choose not to pursue that option..

Encourages postsecondary institutions to apply for accreditation by the National Alliance of Concurrent Enrollment Partnership. Establishes school district eligibility to receive aid for the costs of providing postsecondary courses at the high school. Beginning in fiscal year 2011, districts only are eligible for aid if the college or university concurrent enrollment courses offered by the district are accredited by the National Alliance of Concurrent Enrollment Partnership, in the process of being accredited, or are shown by clear evidence to be of comparable standard to accredited courses. Aid. An eligible district shall receive $150 per pupil enrolled in a concurrent enrollment course. The money must be used to defray the cost of delivering the course at the high school. The commissioner shall establish application procedures and deadlines for receipt of aid payments.

Districts and charter schools must revise and align local academic standards and high school graduation requirements in health, physical education, world languages and career and technical education to require students to complete the revised standards beginning in a school year determined by the school district or charter school. The legislature encourages districts to integrate or offer instruction on character education including, but not limited to, character qualities such as attentiveness, truthfulness, respect for authority, diligence, gratefulness, self-discipline, patience, forgiveness, respect for others, peacemaking, and resourcefulness. Instruction should be integrated into a district's existing programs, curriculum, or the general school environment. The commissioner shall provide assistance at the request of a district to develop character education curriculum and programs.
The commissioner must first use federal funds for character development education programs to the extent available under United States Code, title 20, section 7247. Districts may accept funds from private and other public sources for character development education programs developed and implemented under this section.

A school site decision-making team must include at east one parent of a pupil in the school. For purposes of formation of a new site, a school site decision-making team may be a team of teachers that is recognized by the board as a site. At least one-half of the members shall be employees of the district, unless an employee is the parent of a student enrolled in the school site, in which case the employee may elect to serve as a parent member of the site team.

The state may pay all or part of the fee for advanced placement or international baccalaureate examinations. The commissioner shall pay all examination fees for all public and nonpublic students of low-income families, as defined by the commissioner, and to the limit of the available appropriation, shall also pay a portion or all of the examination fees for other public and nonpublic students sitting for an advanced placement examination, international baccalaureate examination, or both.
The colleges and universities of the Minnesota State Colleges and Universities system must award, and the University of Minnesota and private postsecondary institutions are encouraged to award, college credit to high school students who receive a score of three or higher on an advanced placement or four or higher on the international baccalaureate program examination.

The state may reimburse college level examination program (CLEP) fees for a Minnesota public high school student who has successfully completed one or more college-level courses in high school and earned a satisfactory score on one or more CLEP examinations in the following subjects: composition and literature, mathematics and science, social sciences and history, foreign languages, and business and humanities. The state may reimburse each successful student for up to six examination fees. The commissioner shall establish application procedures and a process and schedule for fee reimbursements. The commissioner must give priority to reimburse the CLEP examination fees of students of low-income families.
The colleges and universities of the Minnesota State Colleges and Universities system must award, and the University of Minnesota and private postsecondary institutions are encouraged to award, college credit to high school students who receive a satisfactory score on a CLEP examination under this section. The commissioner, in consultation with the Minnesota State Colleges and Universities, shall set a passing score for college credits.

Upon receiving a student's application signed by the student's parent or guardian, a school district, area learning center, or charter school must declare that a student meets or exceeds a specific academic standard required for graduation under this section if the local school board, the school board of the school district in which the area learning center is located, or the charter school board of directors determines that the student: (1) is participating in a course of study, including an advanced placement or international baccalaureate course or program; a learning opportunity outside the curriculum of the district, area learning center, or charter school; or an approved preparatory program for employment or postsecondary education that is equally or more rigorous than the corresponding state or local academic standard required by the district, area learning center, or charter school; (2) would be precluded from participating in the rigorous course of study, learning opportunity, or preparatory employment or postsecondary education program if the student were required to achieve the academic standard to be waived; and (3) satisfactorily completes the requirements for the rigorous course of study, learning opportunity, or preparatory employment or postsecondary education program. Consistent with the requirements of this section, the local school board, the school board of the school district in which the area learning center is located, or the charter school board of directors also may formally determine other circumstances in which to declare that a student meets or exceeds a specific academic standard that the site requires for graduation under this section. (b) A student who satisfactorily completes a postsecondary enrollment options course or program under section 124D.09 is not required to complete other requirements of the academic standards corresponding to that specific rigorous course of study.

Pupils four or five years of age on September 1 of the calendar year in which the school year commences and enrolled in a prekindergarten program implemented by the district before July 1, 2003, may be reported as kindergarten years 2004 and earlier.

For purposes of computing special education base revenue, the cost of providing transportation for children with disabilities includes (A) the additional cost of transporting a homeless student from a temporary nonshelter home in another district to the school of origin, or a formerly homeless student from a permanent home in another district to the school of origin but only through the end of the academic year; and (B) depreciation on district-owned school buses purchased after July 1, 2005, and used primarily for transportation of pupils with disabilities, calculated according to paragraph (a), clauses (ii) and (iii). Depreciation costs included in the disabled transportation category must be excluded in calculating the actual expenditure per pupil transported in the regular and excess transportation categories.
Notwithstanding paragraph (e), if the pupil is homeless and placed in a public or private homeless shelter, then the district that enrolls the pupil under section 127A.47, subdivision 2, shall provide the transportation, unless the district that enrolls the pupil and the district in which the pupil is temporarily placed agree that the district in which the pupil is temporarily placed shall provide transportation.

Gifted and talented revenue for each district equals $4 times the district's adjusted marginal cost pupil units for fiscal year 2006 and $9 for fiscal year 2007 and later. A school district must reserve gifted and talented revenue and, consistent with section 120B.15, must spend the revenue only to: (1) identify gifted and talented students; (2) provide education programs for gifted and talented students; or (3) provide staff development to prepare teachers to best meet the unique needs of gifted and talented students.
School districts may identify students, locally develop programs, provide staff development, and evaluate programs to provide gifted and talented students with challenging educational programs. School districts may adopt guidelines for assessing and identifying students for participation in gifted and talented programs. The guidelines should include the use of: (1) multiple and objective criteria; and (2) assessments and procedures that are valid and reliable, fair, and based on current theory and research.

A secondary student may possess and use nonprescription pain relief in a manner consistent with the labeling, if the district has received a written authorization from the student's parent or guardian permitting the student to self-administer the medication. A parent or guardian of twins or higher order multiples may request that the children be placed in the same classroom or in separate classrooms if the children are in the same grade level at the same school. The school may recommend classroom placement to the parents and provide professional education advice to the parents to assist them in making the best decision for their children's education. A school must provide the placement requested by the children's parent or guardian, unless the school board makes a classroom placement determination following the school principal's request according to this section. The parent or guardian must request the classroom placement no later than 14 days after the first day of each school year or 14 days after the first day of attendance of the children during a school year if the children are enrolled in the school after the school year commences. Replaces references to "results oriented graduation rule" with "academic standards." (Retains requirement that students pass basic skills test to be eligible for high school graduation.) Requires students to complete district-determined course credit requirements to be eligible for high school graduation starting with students entering the ninth grade during the 2004-05 school year.
Establishes language arts, math, science, social studies and the arts as subject areas required for statewide accountability. Requires public elementary and middle schools to offer at least three and require at least two of the following four arts areas: dance, music, theater and visual arts. Requires public high schools to offer at least three and require at least one of the following five arts areas: media arts, dance, music, theater and visual arts. Requires the commissioner to submit proposed science and social studies standards to the legislature by February 1, 2004. Requires the commissioner to consider recommendations from specified stakeholders when developing state academic standards in language arts, math, science, social studies and the arts. Specifies that standards must: (1) be clear, concise, objective, measurable, and grade-level appropriate; (2) not require a specific teaching methodology or curriculum; and (3) be consistent with the constitutions of the United States and the state of Minnesota. Requires the commissioner to adopt rules for implementing statewide rigorous core academic standards in language arts, math and the arts. Specifies that after the rules are initially adopted, the commissioner may not amend or repeal these rules nor adopt new rules on the same topic without specific legislative authorization. Requires these academic standards to be implemented for all students beginning in the 2003-2004 school year. Additionally requires the commissioner to supplement the required state academic standards with grade-level benchmarks, although high school benchmarks may cover more than one grade. Establishes other requirements regarding benchmarks.
Requires every district to establish its own standards in the elective subject areas of health and physical education, vocational and technical education, and world languages. Requires every district to offer courses in all above elective subject areas, and to use a locally selected assessment to determine whether a student has achieved an elective standard. Additionally requires every district, by the 2007-08 school year, to adopt graduation requirements that meet or exceed state graduation requirements. Must provide students who enter grade 9 in or before the 2003-04 school year the opportunity to earn a diploma based on existing local graduation requirements in effect when student entered ninth grade.
Establishes graduation requirements based on course credits in language arts, math, science, social studies and electives, including the arts, for students entering grade 9 in the 2004-05 school year.
Beginning the 2005-06 school year and later, requires annual statewide testing in language arts and math in grades 3 through 8 and at the high school level. Also requires annual science assessments in one grade in grades 3-5 span, the grades 6-9 span, and the grades 10-12 span for the 2007-08 school year and later. Requires a state-developed test in a subject other than writing, developed after the 2002-03 school year, to include both multiple choice and constructed response questions. Requires state tests to be aligned with state academic standards, and for statewide results to be aggregated at the school and district level. Deletes language excluding test scores of students receiving limited English proficiency instruction from school and district testing results. Permits exemption of limited English proficiency students if the student has been in the United States for fewer than three years. Requires state assessments, by the 2006-07 school year to include a value-added component to measure student achievement growth over time. Requires commissioner to include alternative assessments for the very few students with disabilities for whom statewide assessments are inappropriate and for students with limited English proficiency.
Permits school, district or charter school to use a high school student's performance on a state assessment as a percentage of the student's final grade in a course or to place the student's assessment score on the student's transcript.
Requires the commissioner to develop language arts, math and science assessments aligned with state standards, which districts must use. Specifies that commissioner must not develop state assessments for academic standards in social studies and the arts.

Requires the board of teaching to adopt rules to implement a statewide credential for education paraprofessionals who assist a licensed teacher in providing student instruction. Any paraprofessional holding this credential or working in a local school district after meeting a state-approved local assessment is considered to be highly qualified under federal law. Under this subdivision, the board of teaching, in consultation with the commissioner, must adopt qualitative criteria for approving local assessments that include an evaluation of a paraprofessional's knowledge of reading, writing, and math and the paraprofessional's ability to assist in the instruction of reading, writing, and math. Requires the commissioner to approve or disapprove local assessments using these criteria. Requires the commissioner to make the criteria available to the public. In adopting these rules, the board must consider including provisions that provide training in: students' characteristics; teaching and learning environment; academic instruction skills; student behavior; and ethical practices. Within the first 60 days of supervising or working with students, a district must provide each paraprofessional with initial training in emergency procedures, confidentiality, vulnerability, reporting obligations, discipline policies, roles and responsibilities and a building orientation.

Administrative costs are limited to 8% for community-based or non-profit organizations and 5% for school districts of the total state funds received from the district or consortium. This cannot exceed the actual unreimbursed cost of administering ABE services. To be eligible to deliver ABE services, a non-profit or community-based organization must demonstrate that it: 1) is legally established; 2) can meet the ABE reporting requirements; 3) provides training for instructional staff; and 4) develops a learning plan for each participating adult learner with measurable goals or have prior experience.
Performance Tracking System (Section 15). Requires all ABE programs to develop and implement a performance tracking system by July 1, 2000 to collect data on the following core indicators: 1) improvements in literacy skill levels; 2) participation in post-secondary education, training, subsidized employment or career advancement; and 3) receipt of a secondary school diploma or equivalent.
Bill also establishes a base aid for ABE programs equal to $1.80 times the population of the district or a minimum of $4,000. After the basic population aid is paid in full, the difference between the state total and the basic population aid is allocated among districts/programs as follows:
1) eighty-four percent is distributed based on a program's relative share of contact hours in the prior year; 2) eight percent is distributed based on a district's relative share of the students with limited English proficiency enrolled in the district in the prior year; and 3) eight percent is distributed based on a district's relative share of adults in the district without a high school diploma according to the last federal census.
For FY 2002 and later, also establishes two limits to the state ABE aid distributed to ABE programs. Total aid for a program cannot exceed four times the rate per prior year contact hour. A program's aid distributed on the basis of contact hours cannot grow by more than 17 percent per year or $20,000, whichever is more.
Legislation additionally directs the Board of Teaching to develop a competency-based license for adult learners as an alternative to the current licensing requirements.
