Relating to low-performing schools and school districts: Provides that if a local school district violates accreditation standards determined to be the basis for immediate withdrawal of accreditation, there shall be a show cause hearing conducted by the commission on school accreditation; Authorizes the parent or guardian of a child enrolled in a school district whose accreditation has been withdrawn to petition for a transfer into an accredited school district and to provide for the transfer of state adequate program funds to the transferee school district; Authorizes the State Board of Education to abolish a school district and administratively consolidate with one or more existing school districts in emergency situations with the approval of the transferee school district; Authorizes loans to school districts under conservatorship from the school district emergency assistance fund and provides that such fund is a special fund which shall not lapse into the state general fund; Authorizes and directs the State Board of Education and The State Department of Education to change the performance level terminology for schools and school districts to "A", "B", "C", "D" and "F" based on established benchmarks of student achievement and growth; Provides that such new terminology for accreditation rating purposes is effective upon full implementation of Common Core State Standards and Assessments; Provides that a board member or superintendent in office at the time the governor declares a state of emergency in a school district is not eligible to serve in that office in such school district and provides that the new superintendent in such school district be appointed.

Establishes the Mississippi Dyslexia Therapy Scholarship For Students With Dyslexia program. Outlines student eligibility requirements for receipt of a scholarship and the term of the scholarship. Stipulates the obligations of parents, students and schools and school districts, and prescribes the duties of the department of education and the state board of education regarding the administration of the scholarship program. Grants authority to the Department of Education to verify the eligibility of nonpublic schools and to establish the process for notifications of violations. Authorizes the state board of education to deny, suspend or revoke a school's participation in the scholarship program.

Requires that all compulsory-school-age children be screened for dyslexia during the period between the spring of kindergarten and the fall of grade 1 and other appropriate times as deemed necessary in the public schools of this state. Establishes procedures for screening and evaluation of students for dyslexia and related disorders. Requires that school diagnosticians receive additional training in the evaluation and diagnosis of dyslexia. Requires that students receive comprehensive academic evaluations by trained diagnosticians in the diagnosis of dyslexia if screening indicates risk of dyslexia.

Requires the department of education to submit an annual report to the legislature summarizing student performance, student assessments, funding and any recommended changes. Prescribes appropriate dyslexia qualifications for administrative and instructional personnel. Requires the state department of education to serve as the local educational agency for those schools. Requires the state to pay directly to the school any federal or state aid attributable to a student with a disability attending the school.

Authorizes students to dually enroll in their home high school and a local community college in a dual credit program consisting of high school completion courses and a work skills certificate program. Establishes this dual credit option on a pilot program basis to be implemented statewide in the 2013-2014 school year. Prescribes the components of the dual credit option program and provides state funding under the Mississippi Adequate Education Program for the dual credit program. Requires the county tax assessors to annually submit to the State Department of Education certain information relating to the assessed value of property which is used by the department in determining the amount that each school district must contribute toward the cost of the Mississippi Adequate Education Program. Requires the State Department of Education to make a form available to the tax assessors for the submission of the reports.

Establishes the Mississippi Dyslexia Education Scholarship Program and Commission for the purpose of recruiting and training qualified persons to practice dyslexia instruction in this state. Creates the Mississippi Dyslexia Education Scholarship Commission to administer the program. Establishes a board for the Mississippi Dyslexia Education Scholarship Commission and prescribes its powers and duties. Outlines the eligibility requirements for undergraduate students seeking entry into the program. Authorizes the Commission to provide financial assistance to program participants, and requires participants to enter and complete dyslexia education programs. Requires participants who fail to complete their dyslexia education program to repay, on a pro rata basis, any financial assistance received through the program plus penalties.

Establishes the Certified Teacher of the Visually Impaired Scholarship program, to be administered by the Mississippi instructional resource center. Provides that funding for the scholarship is subject to appropriation and shall be administered by the Mississippi Department of Education.

Provides for a new county board of education to be elected in such county in a november 2013 special election. Provides that the new county board of education shall serve as the lead agency to consolidate the school districts in such county and to direct the state board of education to administratively consolidate any school district which does not voluntarily follow the consolidation order. Abolishes the former school boards following the administrative consolidation and provides for the transfer of school district assets and liabilities. Provides for the appointment of a new county superintendent of education in said county. Provides for execution of teacher and school district employee contracts in the new school districts and provides for the preparation of school district budgets in the new school districts. Directs the state board of education to promulgate regulations to implement such administrative consolidation.

Provides a legal duty for school superintendents to report incidences of sexual involvement of school employees with a student, and provides criminal penalties for failure to report.

Provides for the removal of appointed or elected school superintendents of underperforming school districts under certain circumstances.

Enacts the Education Reform Act of 2006. Section 10 directs the state board to establish the Mississippi Virtual Public School (MVPS) beginning in the school year 2006-07. The MVPS must be evaluated annually according to: (1)  the accountability and viability of the MVPS, as demonstrated by its academic, fiscal and operational performance; (2) the access of each student in the MVPS to a sequential curriculum that meets or exceeds the state's academic standards and which has an interactive program with significant online components.(3) Whether or not each student achieves the required number of hours of learning opportunities prescribed by each course per academic year, or alternatively, has demonstrated mastery or completion of appropriate subject areas. Subject to appropriation, the MVPS will provide to each student enrolled in the school all necessary instructional materials. Subject to appropriation, the sponsored school must ensure that each student is provided access to the necessary technology, such as a computer and printer, and to an Internet connection for school work purposes. Teachers must meet all qualifications for licensure in the state.  Any student who meets state residency requirements may enroll in the MVPS, and enrollment must be free of charge. Costs associated with the operation of the virtual school must be shared by the department of education, subject to appropriation, and/or the local school districts.

If the amount of revenue collected or estimated to be collected from local sources, on behalf of a school district during a fiscal year, is less than the amount provided for in the duly adopted budget of the school district for the fiscal year as a result of Hurricane Katrina, then the school district may issue promissory notes in an amount and in the manner set forth in Section 27-39-333, not to exceed the estimated shortfall of revenue from local sources, but in no event to exceed fifty percent (50%) of its budget anticipated to be funded from the sources of the shortfall for the fiscal year.  Any school district issuing promissory notes under this subsection may do so only if such school district receives prior approval by the State Superintendent of Education that the school district received damage from Hurricane Katrina.  In order for a school district to issue notes under the provisions of this section, the superintendent of the local school district must recommend such action to the school board and the board must duly adopt and enter upon its official minutes a resolution setting forth specific findings as to how the district meets the requirements of this section.

Clarifies that assistant teachers will receive the same number of sick days as licensed teachers. In addition, under the donation of leave provision for school employees, the definition of catastrophic illness was amended to conform to the same definition as is provided in law for state employees in order to provide a uniform definition of catastrophic illness. Also, the bill clarifies several important points as it relates to PERS administration of school leave provisions and the way they impact the retirement allowance. First, the bill clarifies that that payment for up to 30 days of unused leave may only be made upon retirement. Second, it clarifies that "vacation" leave is the same as "personal" leave. And third, it clarifies that unused vacation or personal leave accumulated by licensed employees in excess of the maximum five (5) days which may be carried over from one (1) year to the next may be converted to sick leave not to exceed the conversion of ten (10) days of personal or vacation leave days to sick days per year. In the case of unused vacation or personal leave accumulated by nonlicensed employees, no more than ten (10) days of unused personal or vacation leave may be converted to sick leave per year. Any personal or vacation leave previously converted to sick leave under a lawfully adopted policy before the effective date of Senate Bill No. 2297, 2004 Regular Session, shall be recognized as accrued leave by the local school district and available for use by the employee. The leave converted under a lawfully adopted policy may be certified to the Public Employees' Retirement System upon termination of employment and any such leave previously converted and certified to the Public Employees' Retirement System shall be recognized.

In particular, the State Auditor will have more flexibility regarding on-site audits and authority to establish specific policies and procedures to audit the processes, accuracy, validity and procedures used by local school districts to submit electronic student data and other data to the State Department of Education.

Reviews and audits shall be conducted with advance notice, except that unannounced audits may be made upon determination of the State Auditor based on complaints or valid concerns. In addition, examiners shall make every effort to work with school districts in scheduling audits in consideration of instructional activities such as statewide testing.

The State Board of Education shall include reporting standards for school districts as part of the accreditation process to include penalties within the accreditation system for adverse findings resulting from reviews or audits.

Any student who, prior to July 1, 2003, has been accepted into the Critical Needs Teacher Scholarship Program under the authority of Section 37-159-3(4) shall be allowed to begin or remain in the scholar loan program, and conversion for those students with fewer than four (4) annual awards shall be based on one (1) year of service in either (a) a geographic area of the state in which there exists a critical shortage of teachers as determined by the State Board of Education, or (b) a subject area of the curriculum in the public schools in which there exists a critical shortage of teachers as determined by the State Board of Education, for each year a loan was received by the student.  For those students that receive the equivalent of four (4) annual awards, such students shall render three (3) years of service.

It is the intent of the legislature to provide for accountability in the teaching profession and to provide for the nonrenewal of licensed education employees in a timely, cost-efficient and fair manner, to provide the employee with an opportunity for a hearing, and to require nonrenewal decisions to be based upon valid educational reasons or noncompliance with school district personnel policies. Clarifies that the protection under the Act applies only to licensed education personnel. In addition, it establishes a new probationary period where the notice and hearing requirements are not applicable for the first two years of Mississippi school employment, and at least one year in the current district. The language provides "grandfather" protection for existing employees meeting these conditions. February 1 is the date for a school board to give initial notice of its preliminary non-reemployment decision to the superintendent. The superintendent, without prior approval of the school board, shall give notice to any principals being nonrenewed no later than March 1 and for other educators no later than April 15. New procedures are established for an employee receiving notice of nonrenewal. A board designee can set the date and time of the hearing without requiring the board to have a special meeting just for that purpose.
