The State Board of Education must establish standards for agricultural education that may be adopted by a private school accredited by an agency recognized by the United States Department of Education. Any such private school must reimburse the Department annually for the cost of oversight and maintenance of the program.

Under current law, if a school receives a report of child abuse arising from school personnel following the district's policy on spanking or the use of reasonable force to protect persons or property, the school superintendent or school board president must send a notice of the incident to the county juvenile officer. This act requires the notice to be sent to the law enforcement in the county. Also, under current law, the report of the incident must be investigated by a law enforcement officer designated by the juvenile officer. This bill changes the laws regarding travel hardships for public school students by prohibiting any current or retired school administrator from appointment to a board of arbitration regarding an appeal regarding a change in a school district's boundaries in which the voters in one of the districts votes against the change and the voters of the other district vote for the change.
In the provisions regarding the Commissioner of Education within the Department of Elementary and Secondary Education reassigning a pupil because of a travel hardship, the bill authorizes the continuance of any assignment granted before August 28, 2012, until the student, and any sibling of the student, completes his or her course of study or the parent withdraws the student.
The bill establishes a process to make reassignment mandatory for any pupil or sibling of a pupil living in St. Albans, St. Elizabeth, or Gravois Mills, under conditions which include a minimum driving distance of at least 17 miles to the current school, the other school is at least seven miles closer, and the transfer will not cause the receiving district to exceed its class size restrictions. A reassignment must be made in the order that applications are received. If a parent withdraws a student after receiving a travel hardship, any subsequent hardship assignment is discretionary. Requires the Department of Elementary and Secondary Education to ensure that specified criteria are implemented in every district regarding the enrollment and educational success of foster care children.
If a foster care student transfers before or during the school year, the receiving school must initially honor placement of the student in educational courses and programs based on the student's previous enrollment or educational assessments from the sending school, provide comparable services to a foster care student with disabilities based on his or her current Individualized Education Program, and make reasonable
accommodations and modifications to address the needs of incoming foster care students with disabilities, subject to an existing 504 or Title II Plan, to provide equal access to education. The receiving district may conduct subsequent evaluations to ensure appropriate placements.
Schools may waive the prerequisites or other preconditions for placement in a course or program and must waive specific courses required for graduation if similar course work has been satisfactorily completed at another school or provide reasonable justification for the denial. If a waiver is not granted, the receiving school must provide an alternative means of acquiring the required course work so that graduation may occur on time. This act modifies the laws governing charter schools.
SECTION 29.205 – The State Auditor may audit any charter school in the same manner as any agency of the state.
SECTION 160.400 – In addition to the St. Louis City and Kansas City School Districts, charter schools may be operated in unaccredited districts. Charter schools may be operated in districts accredited without provisions if sponsored by the local school board except that a local school board with an enrollment of 1550 students or greater cannot enroll more than thirty-five percent of its enrollment in charter schools it sponsors, as described in the act. Charter schools may be operated in a provisionally accredited district after three full school years of provisional accreditation and APR scores consistent with a classification of provisionally accredited or unaccredited beginning in the 2012-2013 school year. In addition, if the provisional accreditation is related to financial stress or hardship, the State Board of Education must vote to decide whether charters may operate. The sponsor is limited to the local school board or a sponsor that has met accountability standards, as described in the act.
This act modifies sponsorship. If the State Board of Education appoints a special administrative board for Kansas City, the special administrative board may sponsor charter schools. This act removes the restriction that a sponsoring public four-year college or university have its primary campus in the school district or in a county adjacent to the county in which the district is located. In addition, a community college whose service area encompasses some portion of the district may be a sponsor. Currently, any private four-year college or university located in St. Louis City with an enrollment of one thousand students and an approved teacher preparation program may be a sponsor. This act eliminates the requirement that the institution be located in St. Louis City but requires that its primary campus be located in Missouri. Additional sponsors include the special administrative board of the St. Louis City School District, any two-year private vocational or technical school, as described in the act, and the Missouri Charter Public School Commission.
In an unaccredited or provisionally accredited district where a charter school is sponsored by an entity other than the local school board, when the district becomes classified as accredited, a charter school may continue to be sponsored by the entity sponsoring it prior to the classification of accreditation. Such a school will not be limited to the local school board as a sponsor. Charter schools in Kansas City and St. Louis may be sponsored by any eligible entity, regardless of the districts' accreditation classification. A charter school whose charter provides for the addition of grade levels may add grade levels until the planned expansion is complete.
The mayor of St. Louis City may request a two-year private vocational or technical school or the Missouri Charter Public School Commission to sponsor a workplace charter school.
When a charter school chooses to affiliate with a four-year college or university, the college or university will no longer be required to be located within the county in which the school district lies or in an adjacent county.
A school district or the State Board of Education, when acting as a sponsor, may have expenses associated with sponsorship be defrayed by having the Department of Elementary and Secondary Education withhold up to 1.5% of the charter school's state and local funding. A sponsor that receives 1.5% funding to defray expenses associated with sponsorship must submit annual reports to the Joint Committee on Education demonstrating compliance with requirements.
A charter school sponsor must develop policies and procedures for the following: the review of a charter school proposal; the granting of a charter; the performance framework of a charter; the renewal, revocation, and nonrenewal processes; additional criteria for oversight of the charter; and procedures to be used when a school closes. The Department of Elementary and Secondary Education is required to provide guidance to sponsors in developing these procedures and policies.
Currently, the State Board may suspend a sponsor's ability to sponsor a school for a period of one year. This act modifies the State Board's existing monitoring and suspension authority and instead requires the State Board to evaluate sponsors, as described in the act, to determine compliance with sponsorship standards every three years. If the Department of Elementary and Secondary Education determines that a sponsor is in material noncompliance with sponsorship duties, it must be notified and given remediation time. If compliance does not improve, the Commissioner of Education must conduct a public hearing and recommend corrective action to the State Board of Education. The State Board will have final determination over corrective action. If the State Board removes sponsorship authority for any currently operating charter school, the Missouri Charter Public School Commission will become the school's sponsor.
SECTION 160.403 – The Department of Elementary and Secondary Education must establish an annual application and approval process for all entities eligible to sponsor charter schools. All information and guidelines for eligible sponsors must be made available by November 1, 2012.
This act identifies the information that must be included in an eligible sponsor's application.
By April 1 annually, the Department must grant or deny a sponsoring authority to a sponsor applicant. Within thirty days of the Department's decision, it must execute a renewable sponsoring contract with each approved sponsoring entity. The term will be six years in length and may be renewed.
SECTION 160.405 – This act modifies the framework of a charter school's charter. The charter will be a legally binding performance contract that describes the obligations and responsibilities of the school and the sponsor.
The term of a charter will be for five years, instead of the current provision that allows charters to be not less than five but not greater than ten years. This act identifies additional items that must be contained in a charter. Charter schools operating on August 27, 2012 will have until August 28, 2015 to meet the new requirements for items that must be in a charter.
A charter must be submitted to the sponsor and follow the sponsor's policies and procedures for review and granting. The charter must be consistent with the sponsor's charter sponsorship goals and capacity. In addition, the charter must be approved by the State Board of Education by December 1 prior to the proposed opening date of the charter school.
This act modifies the definition of "high risk" student.
This act eliminates judicial review for the disapproval of a charter.
Charter schools must conduct a background check of education personnel, including through the employee criminal history background check and the Family Care Safety Registry.
Charter schools with local educational agency status must comply with all federal audit requirements for such charters.
Currently, charter schools must collect baseline data during at least the first three years to determine performance. This act requires charter schools to establish baseline student performance during the first year of operation and collect student performance data, as described in the act, throughout the duration of the charter to annually monitor student academic performance, based upon grade levels offered by the school.
The performance standards for alternative and special purpose charter schools that target high-risk students must be based on measures defined in the school's performance contract with its sponsors.
Charter schools are required to comply with all applicable federal and state special education laws including IDEA and Section 504 of the Rehabilitation Act of 1973.
This act allows proposed or existing high risk or alternative charter schools to include alternative arrangements for students to obtain credits for satisfying graduation requirements in the charter application and charter. Alternative arrangements may include credit for off-campus instruction, embedded credit, work experience, independent studies, and performance-based credit options. Upon approval of the charter by the State Board of Education, any alternative arrangements will be approved at the same time.
The Department of Elementary and Secondary Education must conduct a study of any such charter school granted alternative arrangements for students to obtain credit to assess student performance, graduation rates, educational outcomes, and entry into the workforce or higher education.
The sponsor, governing board, and charter school staff must jointly review the school's performance, management, and operations during the first year of operation and then every other year after the most recent review, instead of the current requirement of at least once every two years.
This act removes the requirement that a charter school become a local educational agency for the sole purpose of direct access to federal grants and allows the school to become an agency if the sponsor and the governing board reach a written agreement to become an agency.
Sponsors must annually review the charter school's compliance with statutory standards including statewide assessment participation, completion of the annual report card, data collection, a method to measure pupil progress, and publication of the charter school's annual performance report. Sponsors must have intervention policies to give schools notice of contract violations or performance deficiencies, as described in the act. A sponsor must have a policy to revoke a charter if there is evidence of underperformance or a violation of the law or the public trust that imperils students or public funds, as described in the act.
This act limits the length of probationary status for a charter school to no more than twelve months, provided that no more than one designation of probationary status is allowed for the duration of the charter contract.
This act removes judicial review of a sponsor's final decision to revoke a charter. Instead, the decision to revoke a charter will be subject to an appeal to the State Board of Education, which must then determine whether the charter will be revoked.
Sponsors must conduct a renewal process of charter schools based on objective evidence, as described in the act, including annual performance report results. Beginning August 1 during the year in which a charter is up for renewal, a sponsor must demonstrate to the State Board of Education that the charter school is in compliance with federal and state law and the school's performance contract, including academic performance requirements. The sponsor must also submit a revised charter application to the State Board of Education, which must determine if the sponsor has demonstrated compliance. If compliance is demonstrated, the State Board must renew the charter.
SECTION 160.410 – This act requires charter schools whose mission includes student drop-out prevention or recovery to enroll nonresident pupils from the same or an adjacent county who reside in residential care facilities, transitional living group homes, or independent living programs whose last school of enrollment is in the school district where the charter school is established, who submit a timely application. Charter alternative and special purpose schools may also give a preference for admission to high-risk students, as defined, when the school targets these students through its proposed mission, curriculum, teaching methods, and services.
Charter schools may limit admission based on gender if the school is a single-gender school.
Students of a charter school who are present for the January membership count in Section 163.011 will be counted in the performance of the charter school on the statewide assessments in that calendar year, unless otherwise exempted as English language learners.
If a charter school is operated by a management company, a copy of the contract must be made available for public inspection.
If a student attending a charter school moves so that he or she no longer lives in the school district where charter schools may operate, he or she may complete the current semester at the charter school and will be considered a resident student. The parent or legal guardian will be responsible for the student's transportation.
If a change in school district boundary lines occurs so that a student no longer lives in a school district, or if action by the State Board of Education occurs under Section 162.081 where charter schools may operate, the student may complete the current academic year at the charter school. The parent or legal guardian will be responsible for the student's transportation.
The Foster Care Bill of Rights (Sections 167.018 and 167.019) will apply to charter schools.
SECTION 160.415 – This act contains requirements to be included in a request for proposals if a proposed charter school intends to contract with an education services provider for substantial educational services, management services, or both.
The Department of Elementary and Secondary Education may withhold funding at an adequate level during a charter school's last year of operation until the Department determines that school records, liabilities, and reporting requirements, including a full audit, are satisfied.
SECTION 160.417 – By October 1, 2012, and each October 1 thereafter, the Department of Elementary and Secondary Education must identify charter schools experiencing financial stress using information from the report required by Section 162.821. A list of charter schools experiencing financial stress will be provided to the Governor, Speaker of the House of Representatives, and President Pro Tem of the Senate.
Parameters for financial stress are defined in the act.
By November 1, the sponsor must notify the governing board of a charter school if it is identified as experiencing financial stress. The governing board must develop and approve a budget and education plan, which must be submitted to the sponsor within forty-five days. Requirements for what must be included in the plan are described in the act. The sponsor may make suggestions to improve the plan.
The Department may withhold any payment of financial aid until such time as the charter school is in compliance with these requirements.
SECTION 160.420 - In addition to existing criminal background check requirements, charter schools must ensure that a Family Care Safety Registry check is conducted for employees.
Multiple provisions are repealed because they are identical to provisions contained in Section 160.415.
SECTION 160.425 – This act creates the Missouri Charter Public School Commission. It will have nine members, all appointed by the Governor with the advice and consent of the Senate. Members will serve a term of four years, except for the initial appointees, whose terms are staggered. Commission members will be: one member selected from a slate of three candidates recommended by the Commissioner of Education |

(1) Requires the Coordinating Board for Higher Education within the Department of Higher Education to require all two- and four-year public higher education institutions to identify and use
best practices in remediation identified by the board and other institutions and organizations and to eliminate practices that have been found to be ineffective in preparing or which delay
students from enrollment in college-level courses;
(2) Requires the board with the assistance of the Committee on Transfer and Articulation to require all two- and four-year public higher education institutions to create by July 1, 2014, a
statewide core transfer library of at least 25 lower division courses that are transferable among all public higher education institutions;
(3) Requires the board to develop a policy to foster reverse transfer so that any student who has accumulated sufficient hours in combination from more than one public institution that grants
an associate degree to be awarded a degree. The department must maintain the alignment of the statewide assessments for entry-level courses in English, mathematics, foreign languages,
sciences, and social sciences associated with an institution's general education core with previously established compentencies;
(4) Allows the board to charge and collect fees from out-of-state public institutions for the costs of reviewing and assuring the quality of programs they offer;
(5) Requires the board to include in its annual report to the Governor and General Assembly campus-level data on student persistence and progress toward implementing revised remediation,
transfer, and retention practices;
(6) Changes the laws regarding the coordinating board's responsibility for proprietary schools to:
(a) Allow a proprietary school that has been in continuous operation for at least five years to apply to the board for a two-year certificate of approval;
(b) Allow the board to increase the base fee charged by the board for an annual certificate of approval from one-tenth of a cent to thirteen one-hundredths of a cent per $1 of net tuition and fees income with a maximum fee of $5,000 and a minimum fee of $500 per school. Currently, the minimum fee is $250 with a maximum of $2,500. The fee for a certificate of approval to recruit students is raised from $250 to $500, with a maximum of $5,000. The board may increase the base annual fee and the minimum and maximum amounts by administrative rule every five years, beginning in Fiscal Year 2013, to no more than the federal
Consumer Price Index since the last fee increase;
(c) Allow the board to establish additional appropriate fees through administrative rule for generating sufficient funding to cover the costs associated with the certification program, with the advice of the Proprietary School Advisory Committee; and
(d) Allow the board to review a new program proposal within 90 days from the date that a certified school submits the proposal and within 60 days from the submission of a revised program. If the review has not occurred in that period, the program may be offered until the department completes its review and identifies a substantive issue for correction. The school will have 90 days after notification of the deficiency to correct the deficiency without having to cease offering the program;
(7) Creates the Proprietary School Certification Fund for the deposit of all fees regarding proprietary schools to fund the costs associated with the operation of the program;
(8) Increases the maximum bond amount that the board may require for a proprietary school from $25,000 to 100,000;
(9) Requires the department to collect only that data needed to administer, supervise, and enforce the provisions of the proprietary school program and, subject to appropriations, to provide a system for the electronic submission of all data;
(10) Changes the responsibility for the appointment of the members of the Proprietary School Advisory Committee from the coordinating board to the Commissioner of Higher Education within the department and requires that at least three of the seven members of the committee represent degree-granting schools and at least one of the three represents a school that confers a bachelor's degree or higher;

Modifies S.B. 54. SCS/SB 1 c[ ][ ] This act modifies provisions relating to communications between school district employees and students.Current law requires each school district to promulgate a written policy on teacher-student and employee-student communication by January 1, 2012, which would include restrictions on teachers' use of work-related internet sites and nonwork-related internet sites, as described in the act. This act modifies the components that must be included in each school district's policy. It repeals the existing components and requirements and instead requires each district to promulgate a written policy concerning employee-student communication by March 1, 2012. The policy must include, but not be limited to, the use of electronic media and other mechanisms to prevent improper communications between staff members and students. This act repeals the prohibition on a teacher establishing, maintaining, or using a work-related internet site unless it is available to school administrators and the child's legal custodian, physical custodian or legal guardian. This act also repeals the prohibition on a teacher establishing, maintaining, or using a nonwork-related internet site which allows exclusive access with a current or former student. This act also repeals the definitions of: exclusive access, former student, work-related internet site, and nonwork-related internet site.

Grants the Office of the Child Advocate the authority to file any findings or reports of the Child Advocate regarding the parent or child with the court and to issue recommendations regarding the disposition of an investigation, which may be provided to the court and the investigating agency. The Office may also mediate between alleged victims of sexual misconduct and school districts.SECTION 160.261 - If a student reports alleged sexual misconduct by a teacher or other school employee to a school employee who is required to report to the Children's Division, the employee and the school district superintendent must forward the allegation to the Children's Division within twenty-four hours. Any reports made to the Children's Division must be investigated by the Division in accordance with Division procedures. The school district must not conduct an investigation for purposes of determining whether the allegations should be substantiated. A district may investigate the allegations for purposes of making a decision regarding the accused employee's employment. This act also requires the investigating officers to review the report using a preponderance of evidence standard. SECTION 160.262 - This act authorizes the Office of the Child Advocate to offer mediation services when requested by both parties when child abuse allegations arise in a school setting. The mediator must not be a mandated reporter of child abuse. No student, parent of a student, school employee, or school district will be required to enter into mediation. If either party does not wish to enter into mediation, mediation will not occur. Procedures for mediation are described in the act. SECTIONS 160.2100 & 160.2110: This act creates the Task Force on the Prevention of Sexual Abuse of Children. This act shall be known and may be cited as ''Erin's Law." Task Force members must be individuals who are actively involved in the prevention of child abuse and neglect and child welfare. The President Pro Tem of the Senate, the Minority Leader of the Senate, the Speaker of the House of Representatives, and the Minority Leader of the Senate may each appoint one member of the General Assembly to the task force. Additional membership is specified.

Establishes the Farm-to-Table Advisory Board consisting of at least one representative from the University of
Missouri-Extension Service; the departments of Agriculture, Corrections, Economic Development, and Elementary and Secondary
Education; and the Office of Administration. The Director of the Department of Agriculture will appoint one person who is actively
engaged in the practice of small agribusiness. The representative from the Department of Agriculture will serve as chair of the board and coordinate meetings. The board must hold at least two meetings but may hold more if necessary to fulfill its requirements.
Purpose of the Advisory Board is to provide recommendations for strategies that allow schools and state institutions to more
easily incorporate locally grown agricultural products into their cafeteria offerings, salad bars, and vending machines and that
increase public awareness of local agricultural practices and the role that local agriculture plays in sustaining healthy
communities and supporting healthy lifestyles.

Repeals sections 335.036, 335.200, 335.203, 335.206, and 335.209 of the Revised Statutes of Missouri. Enact four new sections relating to higher education financial assistance programs. This bill requires the Department of Higher Education to make available a nonrenewable advanced placement incentive grant of $500 to any recipient of financial aid under the A+ Schools or Access Missouri programs if the recipient received a score of three or higher on two advanced placement examinations in mathematics or science while attending a Missouri public high school. The Nursing Education Incentive Program, established within the Department of Higher Education to address nursing shortages. The State Board of Nursing within the Division of Professional Registration in the Department of Insurance, Financial Institutions and Professional Registration is authorized to provide funding for the program. Subject to appropriations, Department of Higher Education will award grants to eligible higher education institutions accredited by the Higher Learning Commission of the North Central Association based on criteria to be determined by the board and the Department of Higher Education. Grant award amounts cannot exceed $150,000, and no campus may receive more than one grant per year. An eligible institution must offer a nursing program that meets the predetermined category and area of need as established by the board and the Department of Higher Education, based on data from sources specified in the bill. The bill also repeals the provisions regarding an obsolete incentive grant program which focused on nontraditional nursing students and the provisions regarding the Nurse Training Incentive Fund.

Repeals sections 172.030, 173.005, and 174.450 of the Revised Statutes of Missouri and enact in lieu thereof three new sections relating to higher education governing boards. Currently, the Coordinating Board for Higher Education, the University of Missouri Board of Curators, and the Missouri State University Board of Governors have nine voting members, with no more than one person appointed from the same Congressional district. This bill requires at least one voting member, but no more than two, to be appointed from each Congressional district.A member who is in office on the effective date of the bill may complete his or her term.

Relates to school retirement system in Kansas City. Actuarial equivalent tables and formulas are to be set forth in a written document which may be changed from time to time if recommended by the retirement system's actuary and approved by the board of trustees. The assets of the retirement system are to be held in trust for the exclusive benefit of members and their beneficiaries and for defraying reasonable administrative expenses of the retirement system. No part of such assets are to be used for or diverted to any purposes other than for such exclusive benefit or for any purpose inconsistent with the requirements of this retirement plan. In the event of the complete termination of the retirement system or the complete discontinuance of contributions to the retirement system, the rights of all members to benefits accrued to the date of termination or discontinuance shall be fully vested and nonforfeitable. If a member leaves employment with an employer to perform miliary service and dies while in such service the member's survivors are entitled to any additional benefits (other than benefit accruals relating to the period of qualified military service) that would have been provided had the member resumed employed and then terminated on account of death. The members period of qualified military services is to be counted as creditable service for purposes of vesting but not for purposes of determining the amount of the member's retirement allowance. Provisions are made for retiree performing substitute, part-time or temporary employment as long as they earn no more than fifty percent of the annual salary or wages last paid before retirement. If a person exceeds hour limit or such compensation limit, payment of the retirement allowance will be suspended for the month in which such limit was exceeded.
Any member may elect to have their distribution transferred directly to another eligible retirement plan.

Specifies that recipients of the Bright Flight Scholarship Program must be residents of Missouri; expands scholarship eligibility to individuals who have received a General Education Development diploma, who have completed a homeschooled program of study, who have completed secondary coursework through the Virtual Public School, or any other program of academic instruction that satisfies the compulsory attendance law. Provides that qualifying score necessary for a student to receive a scholarship will be determined at the beginning of an eligible student's final year of secondary coursework. Provides all students in the top 3% of the state ACT or SAT test-takers will receive awards prior to any student in the top fourth or fifth percent. If sufficient funds are appropriated, each eligible student with a qualifying score in top fourth or fifth percentile will be offered a $1,000 scholarship. Students are allowed to renew the scholarship as long as they remain in compliance with requirements of the act. If military service interrupts schooling, provisions are made for awardees to receive scholarship following military service. Bill also modifies the financial assistance amounts provided through the Access Missouri Financial Assistance Program to allow for students attending schools in the two-year sector are eligible for $1300 maximum and $300 minimum each year and students attending schools in the four-year sector, including Linn State Technical College are eligible for $2850 maximum and $1500 minimum each year. Requires regulations to be issued requiring contractors and subcontractors working on public works construction projects at public schools to establish and implement a random drug and alcohol testing program. Removes the requirement but allows the General Assembly to make an annual appropriation to the Missouri Career Development and Teacher Excellence Plan, commonly known as the Career Ladder Program. Beginning in Fiscal Year 2012, the state portion of career ladder payments will only be made available to school districts if an appropriation is made. Any state appropriation must be made prospectively in relation to the year in which work under the program is performed. A school district may fund the program for its teachers for work performed in years for which no state appropriation is made available. Creates the Persistence to Graduation Fund. Department of Elementary and Secondary Education will establish a procedure for school districts to apply for grants to implement drop-out prevention strategies. Grants may be available to school districts that have at least sixty percent of students eligible for a free and reduced lunch. Grants will be awarded for one to five consecutive years. Upon expiration, school district may apply for an extension. The Department of Elementary and Secondary Education must give preferences to school districts that propose a holistic approach to drop-out prevention as described in the act. The Department may stop payments to a district it it determines that the district is misusing funds or if the district's program is deemed ineffectual. The Department must provide written notice 30 days prior to cessation of funds. Department must report annually to the legislature the recipients and amount of grants and data for the preceding five years for each recipient district.

Participating school districts must report annually to the Department of Elementary and Secondary Education and the department must report annually to the Joint Committee on Education on the program's effectiveness. Act also changes the requirement for compulsory attendance age for school districts (except St. Louis City school district). Act changes compulsory attendance age to seventeen or successful completion of sixteen credits toward high school graduation. For the purposes of homeschooling, act defines a completed credit towards high school graduation as 100 hours or more of instruction in a course. Home school education enforcement and records will be subject to review only by the local prosecuting attorney.

Study will examine charter schools' impact on the constituents of the district by using a contractor through a proposal process. Study must include an analysis of the administrative and instructional practices of each charter school and include findings on best practices that lend themselves to replication or incorporation in other schools. Student performance assessment must include, but may not be limited to: MAP test performance; student re-enrollment rates; educator, parent and student satisfaction data; graduation rates and performance of students enrolled in the same public school for three or more consecutive years.

Beginning with the 2010-2011 school year, school districts must ensure that students in elementary school participate in moderate physical activity for the entire school year for an average of 150 minutes per week, or 30 minutes per day. Students with disabilities must participate to the extent appropriate. Middle school students may, at the school's discretion, participate in at least 225 minutes of physical activity per week, or 45 minutes per day. Elementary school students must be provided a minimum of one recess period of twenty minutes per day, which may be incorporated into the lunch period. The Commissioner of Education must annually select for the recognition of students, schools and school districts that are considered to have achieved improvement in fitness. A school district may meet any of these requirements above the state minimum physical education requirement by additional physical education instruction or other activities approved by the individual school district under the direction of any certificated teacher or administrator or other school employee under the supervision of a certificated teacher or administrator.

Nothing in the act will preclude a private, parochial, or home school student residing within a school district offering virtual courses from enrolling in the school district for purposes of participating in virtual courses. Creates pilot program within the Missouri Preschool Project. Program will serve up to 1250 students with preschool services and be administered by the Department of Elementary and Secondary Education in collaboration with the Coordinating Board for Early Childhood. School districts that are classified as unaccredited and non-sectarian community-based organizations located within such school districts may receive grants. Grants run for three years and are renewable. At least 50 percent of the placements must be offered through non-sectarian community-based organizations. Children who are one to two years away from kindergarten entry may participate in the program. Children of active duty military personnel will receive admission preference. The program must comply with current early childhood standards. Community-based organizations may employ teachers with at least an associate's degree provided they show they are on the path to obtaining a bachelor's degree within five years. School districts and community-based organizations must collect both short- and long-term data about student performance where feasible and the Department of Elementary and Secondary Education must make a good faith effort to collect long-term student performance data. The Department will accept applications in competitive bid process to begin implementing the program in the 2010-2011 school year. Grants awarded in this program are subject to appropriation.

Creates the Volunteer and Parents Incentive Program to be implemented and administered by the Department of Elementary and Secondary Education.
Under the program, the Department will provide a reimbursement to parents or volunteers who donate time at certain schools. To be eligible, individuals must donate time at a school in a district that is unaccredited or provisionally accredited or has a population of at least 50% at risk students as described in the act. Subject to appropriation, for every 100 hours donated by a volunteer or parent, the department will provide him or her with a reimbursement for the cost of three credit hours at a public institution of higher learning located in Missouri. The reimbursement cannot exceed $500 every two years. If a participating school district becomes classified as accredited, it may continue to participate in the program for an additional two years

Act allows school boards to establish a four-day school week instead of five-day school week by the adoption of a resolution by a majority vote of board members. Any school district that does so must file a calendar with the Department of Elementary and Secondary Education. A minimum term for a school district adopting a four-day school week includes 142 days and 1044 hours of pupil attendance. A school district that adopts a four-day school week and subsequently meets at least two fewer performance standards on its annual performance report over a two year period must revert to a five-day school week. If the school district then meets the same number of performance standards it had met prior to adopting the four-day school week, it can resume a four-day school week. Current law requires a school district to make up the first six days of school lost or canceled due to inclement weather and half the number of days lost of canceled in excess of six days. This act provides that such make-up will occur if necessary to ensure that the district's students will attend a minimum of 142 days and a minimum of 1044 hours for the school year. School districts that adopt a four-day school week may schedule make-up days on Friday.

Establishes "Foster Care Education Bill of Rights." Each district must designate a staff person to be an educational liaison for foster care children. Liaison would assist with proper educational placements, transferring between schools, ensuring transfer of grades and credits, requesting school records, and submitting school records that have been requested. A child placing agency will promote educational stability for foster care children when making placements. Each school district must accept for credit any full or partial course work satisfactorily completed by a pupil while attending certain schools. A pupil who completes the graduation requirements of his or her school district of residence while under the jurisdiction of the juvenile court will receive a diploma. Students who are absence from school for placement changes or court-ordered activity will have grades and credits calculated as of the date the pupil left school. Such absence will not result in a lowering of the pupil's grades. Subject to federal law, school districts are authorized to permit access of pupil school records to a child placing agency for the purpose of fulfilling educational case management responsibilities required by the juvenile officer or by law and to assist with school transfer or placement of a pupil. Each child who is in foster care or is placed in a licensed residential care facility is entitled to a full school day of education unless the school district determines that fewer hours are warranted. A full school day is defined as six hours under the guidance and direction of teachers in the education process for children in foster care or for children placed for treatment in a licensed residential care facility by the Department of Social Services. For children placed for treatment in a licensed residential care facility by the Department of Social Services, the Commissioner of Education, or his or her designee, will be an ombudsman to assist the family support team and the school district.

Creates the "Teacher Choice Compensation Package" for the St. Louis City School District to permit performance-based salary stipends, upon the decision of a teacher, to reward teachers for objectively demonstrated superior performance. It also creates the Teacher Choice Compensation Fund in the State Treasury. The General Assembly must annually appropriate $5 million to the fund. A teacher must give up his or her right to a permanent appointment for the duration of his or her employment with the school district to participate in the Teacher Choice Compensation Package. If a teacher chooses to no longer participate in the Compensation Package, he or she may not resume permanent teacher status with the district. Teachers will qualify annually in October.
Stipends will be offered in increments of $5,000, up to $15,000 but must not exceed 50% of a teacher's base salary. The Department will make a payment to the district in the amount of the stipend, which will be delivered as a lump sum in January following the October qualification. If funds are insufficient, the Department may prorate payments.
The Teacher Choice Compensation Package will be open to every person employed by the St. Louis City School District regardless of certification status, provided the other requirements are satisfied. Stipends will be prorated for part-time employees and will be forfeited for any teacher dismissed for cause. Beginning with the 2010-2011 school year, teachers who opt out of their permanent contract may be eligible based on the following: student scores on a value-added test instrument as described in the act, evaluations by principals or other administrators, evaluations by parents, and evaluations by students. The Department is required to develop or identify model instruments for use by school districts, which may also use or develop their own instruments. The Department is required to develop criteria for determining eligibility for stipend increments. Test-scores will be given more weight than evaluations. The level of scores required must take into account classroom demographics.

Allows the governor to establish the "P-20 Council" as a private-not-for-profit corporation on behalf of the state. The purpose of the Council will be to create a more efficient and effective education system to more adequately prepare students for entering the workforce and will be reflected in the articles of incorporation and bylaws. Indicates the makeup of the Council's board of directors. Council may receive and borrow money, enter into contracts, and spend money for activities appropriate to its purposes. Duties of the Council may include: studying the potential for a state-coordinated economic and educational policy; determining where obstacles make state support of certain programs difficult; creating programs; and exploring ways to better align academic content. Council must submit an annual report to the governor and the legislature containing information about its operations. Act allows the Departments of Economic Development, Elementary and Secondary Education, and Higher Education to contract with the Council for activities described in the act. Act repeals statute requiring the Commissioner of Higher Education, Chair of the Coordinating Board for Higher Education, Commissioner of Education, President of the State Board of Education, and Director of the Department of Economic Development to meet and discuss ways to create a more efficient and effective education system.

The publication must state it does not confer any right or rights beyond those conferred by federal or state law. In addition, the publication must state that it is only for informational purposes. The publication must contain ten points of information, as described in the act. Department must ensure that the content is consistent with legal interpretations of existing federal and state law and provides equitable treatment of all disability groups and interests. In addition, the Department must post a copy of it on its website and each school district must provide a copy of "The Parents' Bill of Rights" upon determining that a student qualifies for an individualized education program and at such time as a school district is required under state or federal law to provide the parent or parents with notice of procedural safeguards.

Increases the amount of the Bright Flight scholarships from $2,000 to $3,000 beginning with fiscal year 2011. Beginning with fiscal year 2011, students with test scores between the top five percent and the top three percent qualify for a scholarship of $1,000. Creates the Access Missouri Financial Assistance program, defines eligibility criteria and maximum and minimum financial awards. Repeals Gallagher student financial assistance and college guarantee programs and directs that certain gambling boat boarding fee revenue that currently goes to the Missouri College Guarantee Fund be instead deposited into the Access Missouri Financial Assistance Program.
Enacts the Higher Education Student Funding Act, limiting tuition increases that institutions may charge. Grants Missouri Higher Education Loan Authority (MoHELA) authority to transfer assets of the authority to the newly created Lewis and Clark Discovery Fund. Requires MoHELA to distribute $350 million of assets of the authority to the fund not later than September 30, 2013. Moneys in the fund may be appropriated by the general assembly only for funding for capital projects at public colleges and universities and funding for the Missouri Technology Corporation's ability to work with colleges and universities in identifying opportunities for commercializing technologies. Directs the department of economic development to allocate a percentage of the state ceiling for private activity bonds to MoHELA.

Creates the teaching fellows program. For each of the first four years that an applicant teaches in a qualifying district, up to one-fourth of the applicant's educational loans, not to exceed $5,000 per year, will be repaid. For students without educational loans, a stipend of up to $5,000 may be issued. At the conclusion of the fifth academic year that an applicant teaches in a qualifying district, an amount equal to $1,000 shall be granted to the applicant. Directs the department of higher education to promulgate rules to enforce the provisions of this act. Directs the department to create and maintain a coordinator position who will be responsible for identifying, recruiting and selecting potential students for the program.

REPORT CARDS
Currently, school districts are required to produce an annual
accountability report card for each school building, distribute
copies to the households with students, and make copies available
to other members of the public upon request. This bill transfers
the responsibility for producing the report card to the
Department of Elementary and Secondary Education, specifying that
there will be report cards for each district, each public school
building in a district, and each charter school. The report card
will be designed to satisfy federal and state statistical
disclosure requirements about academic achievement, finances,
staff, and other indicators. Districts must provide the report
card information by December 1, or as soon as it is ready, and
give preference to distribution methods that will include the
information with other important information, such as student
report cards.
TEACHERS AND PRINCIPALS
Currently, the definition of "teacher" for the purposes of tenure
includes certified teachers who teach at the pre-kindergarten
level. The bill clarifies that these teachers must be teaching
in pre-kindergarten programs for which no fees are charged. The
superintendent's supervision of the City of St. Louis district
schools is subject to policies established by the school board,
rather than subject to the control of the board, and the
permissible length of the superintendent's contract is raised.
Currently, the hiring of a treasurer, a commissioner of school
buildings, and a director of personnel is required. The bill
makes the hiring of these positions permissive. The requirement
that the district's teaching appointments and promotions be based
on merit is extended to all employee appointments and promotions.
The remaining references to principals are removed from the City
of St. Louis tenure statute.
SCHOOL DISTRICTS
Currently, when a school district participates in the Career
Ladder Program, it must match state funds on a sliding scale
based on the assessed valuation per eligible pupil. The bill
permits any district that opted out of the program between July
1, 2001, and July 1, 2005, to rejoin by July 1, 2006, at the same
matching level it qualified for when it last participated in the
program.

Specifies that all valid teaching certificates issued prior to September 1988 are exempt from the professional development requirement that follows. Narrows types of teacher licences available to an initial professional certificate and a career continuous professional certificate. Specifies that the state board must require holders of the four year initial professional certificate to: (a) Participate in a mentoring program approved and provided by the district for a minimum of two years; (b) Complete thirty contact hours of professional development, which may include hours spent in class in an appropriate college curriculum; and (c) Participate in a beginning teacher assistance program. Changes requirements for receipt of the career continuous professional certificate to: four years of teaching under the initial professional certificate and upon verification of the completion of the requirements articulated in paragraphs (a), (b), and (c) of subdivision (1) of this subsection. (b) The career continuous professional certificate shall be continuous based upon verification of actual employment in an educational position as provided for in state board guidelines and completion of fifteen contact hours of professional development per year which may include hours spent in class in an appropriate college curriculum. Should the possessor of a valid career continuous professional certificate fail, in any given year, to meet the fifteen-hour professional development requirement, the possessor may, within two years, make up the missing hours. In order to make up for missing hours, the possessor shall first complete the fifteen-hour requirement for the current year and then may count hours in excess of the current year requirement as make-up hours. Should the possessor fail to make up the missing hours within two years, the certificate shall become inactive. In order to reactivate the certificate, the possessor shall complete twenty-four contact hours of professional development which may include hours spent in the classroom in an appropriate college curriculum within the six months prior to or after reactivating his or her certificate. The requirements of this paragraph shall be monitored and verified by the local school district which employs the holder of the career continuous professional certificate.
(c) A holder of a career continuous professional certificate shall be exempt from the professional development contact hour requirements of paragraph (b) of this subdivision if such teacher has a local professional development plan in place within such teacher's school district and meets two of the three following criteria:
a. Has ten years of teaching experience as defined by the state board of education;
b. Possesses a master's degree; or
c. Obtains a rigorous national certification as approved by the state board of education.
Allows a teacher who has not been employed in an educational position for three years or more to reactivate his or her last level of certification by completing twenty-four contact hours of professional development which may include hours spent in the classroom in an appropriate college curriculum within the six months prior to or after reactivating his or her certificate.
Requires the state board to, upon an appropriate background check, issue a professional certificate classification in the areas most closely aligned with an applicant's current areas of certification, commensurate with the years of teaching experience of the applicant, to any person who is hired to teach in a public school in this state and who possesses a valid teaching certificate from another state, provided that the certificate holder shall annually complete the state board's requirements for such level of certification.
Adds that pleading guilty or being found guilty of enticement of a child or attempting to entice a child are offenses that will cause a teaching license to be revoked. Adds that when a teaching certificate holder pleads guilty or is found guilty of any offense that would authorize the state board of education to seek discipline against that holder's certificate of license to teach, the local board of education or the department of elementary and secondary education shall immediately provide written notice to the state board of education and the attorney general regarding the plea of guilty or finding of guilty.

Beginning with the 2004-2005 school year and for each school year thereafter, requires every public institution of higher education in the state to require all students living in on-campus housing to sign a written waiver stating that the institution of higher education has provided the student, or if the student is a minor, the student's parents or guardian, with detailed written information on the risks associated with meningococcal disease and the availability and effectiveness of the meningococcal vaccine. States that any student who elects to receive the meningococcal vaccine shall not be required to sign the aforementioned waiver and must present a record of said vaccination to the institution of higher education. Requires the state board to adopt rules to facilitate job-sharing positions for classroom teachers, as the term "job-sharing" is defined in this section. Rules must allow a classroom teacher in a job-sharing position to receive paid legal holidays, annual vacation leave, sick leave and personal leave on a pro rata basis. "Job-sharing position" must mean any position: (1) Shared with one other employee; (2) Requiring employment of at least seventeen hours per week but not more than twenty hours per week on a regular basis; and (3) Requiring at least seventy percent of all time spent in classroom instruction as determined by the employer; provided that, job sharing position shall not include instructional support or school services positions including, but not limited to, guidance counselor, media coordinator, psychologist, social worker, audiologist, speech and language pathologist, and nursing positions. Specifies that any teacher participating in the job-sharing program must be a member of the public school retirement system, and must receive creditable service on a pro rata basis in that system. Requires any such person to have the option of being a member of the nonteacher school employee retirement system. The option election must be filed with the board of trustees of the public school retirement system within ninety days of first such employment or within ninety days of August 28, 2003, whichever later occurs.

Allows a retired certificated teacher receiving a retirement benefit from the state retirement system to teach full-time for a district for up to two years without losing his or her retirement benefit, provided that the district has a shortage of certified teachers, as determined by the district. Bars the total number of such retired certificated teachers from exceeding fifteen certificated teachers at any one time. Requires the employer's contribution rate to be paid by the hiring district and the employee's contribution rate to be paid by the employee. Specifies that any additional actuarial costs resulting from the hiring of a retired certificated teacher pursuant to the provisions of this section must be paid by the hiring district.
In order to hire teachers under this policy, the district must: (1) Show a good faith effort to fill positions with nonretired certificated teachers; (2) Post the vacancy for at least one month; (3) Have not offered early retirement incentives for either of the previous two years; (4) Solicit applications through the local newspaper, other media, or teacher education programs; (5) Determine there is an insufficient number of eligible applicants for the advertised position; and (6) Declare a critical shortage of certificated teachers that is active for one year.
ANOTHER SECTION OF STATE STATUTES IS MODIFIED IN THE SAME BILL (this section differs slightly from the one above): Allows a retired certificated teacher receiving a retirement benefit from the retirement system to teach full-time for a district for up to two years without losing his or her retirement benefit, provided that the district has a shortage of certified teachers, as determined by the district. The total number of such retired certificated teachers shall not exceed, at any one time, the lesser of ten percent of the total teacher staff for that district, or five certificated teachers. Allows a person receiving a retirement benefit to be employed full-time for up to two years for a district covered by such retirement system, without losing his or her retirement benefit, provided that the district has a shortage of noncertificated employees, as determined by the district. The total number of such retired noncertificated employees shall not exceed, at any one time, the lesser of ten percent of the total noncertificated staff for that district, or five employees. Requires the employer's contribution rate to be paid by the hiring district.
