Every professional licensing board organized pursuant to the Nevada Revised Statues is ordered to:
Facilitate endorsement of a current license from another state as long as the requirements for licensure in that jurisdiction are substantially equivalent to the requirements in Nevada; and
Where possible, provide for a temporary or provisional license allowing a military spouse to practice while fulfilling requirements needed to qualify for endorsement in this state, or while awaiting verification of documentation supporting such an endorsement; and
Expedite application procedures for a military spouse, including where possible the approval of a license based on an affidavit from the applicant that the information provided on the application is true and that verifying documentation has been requested.

Amends provisions relating to credit for certain courses without attending class. Specifies that each district's board of trustees must make available to school counselors, students and parents a list of the courses of study for which a student may be granted credit without having attended the regularly scheduled course. Directs each board of trustees to (1) review and approve the exam developed by the principal and the pupil's teacher who provides instruction in the course in which credit is being sought, (2) review and approve any exam the principal determines to be more rigorous than that selected by a committee of teachers and administrators. Sets timelines for a pupil who wishes to receive credit by exam and who is deficient in an area of study to submit an application for such credit by exam. Removes the provisions creating the 10-member elected State Board of Education and provides for the election and appointment of members whose terms will commence on January 8, 2013. Bill provides for the appointment of the superintendent of public instruction by the governor from a list of candidates submitted by the state board. Further provides that the superintendent serves at the pleasure of the governor and is in the executive department of state government. Bill provides that the superintendent of public instruction is responsible for ensuring that the duties and responsibilities of the previously created Commission on Educational Excellence, Advisory Council on Parental Involvement, Commission on Educational Technology, Council to Establish Academic Standards for Public Schools, and the Commission on Professional Standards in Education are successfully carried out by the commissions, councils and programs. The bill further revises the qualifications and duties of the superintendent of public instruction to: (1) possess the knowledge and ability to carry out the duties of the position; (2) provide that the superintendent is the educational leader for the K-12 public education in the state; (3) require the superintendent to enforce the observations of statutes and regulations governing K-12 public education; and (4) request a plan of corrective action if the superintendent determines that a school district or charter school has not complied with those statutes and regulations. Provisions of the bill require the state board, in developing the plan to improve the academic achievement of pupils enrolled in public schools, to establish clearly defined goals and benchmarks for improving the achievement of pupils and prescribes those goals and benchmarks. Requires the Commission on Professional Standards in Education to submit annual reports to the State Board and the Legislative Committee on Education describing the status of the regulations adopted by the Commission and a work plan designating the proposed activities of the Commission during the next year. Provisions assign the three regional training programs for the professional development of teachers and administrators and designates the schools districts which will fall within the jurisdictions of the three programs. The bill requires the governing body of each of the regional training programs to establish an evaluation system for the teachers and other licensed educational personnel who participate in the program and prescribes the requirements of that evaluation system. The bill provides for the funding of the three regional training programs and requires the Department of Education to transfer sums to the appropriate districts for the purchase of professional development for teachers and administrators.

Increases the term of a member of the Youth Legislature from 1 to 2 years, with the possibility of a single, successive 2-year reappointment if the member continues to meet thequalifications for initial appointment. Expands the eligibility requirements to allow pupils in grade 9 to apply for appointment to the Youth Legislature. The position of a member of the Youth Legislature becomes vacant upon the unexcused absense of the member from any two official, scheduled meetings, courses, events, seminars or activities of the Youth Legislature. Transfers the duties and powers of the Commission on Economic Development to the Office of Economic Development.

Bill provides that a pupil who has failed to pass the same subject area of the high school proficiency examination each time the pupil took the examination, including the final administration of the examination to the pupil before the date on which he or she is otherwise regularly
scheduled to graduate, may receive a standard high school diploma if the pupil obtained a cumulative score that meets the required cumulative score prescribed by the State Board and also satisfies certain additional conditions. The bill also removes the satisfaction of the existing alternative criteria as a means by which a pupil may receive a standard high school diploma. The bill requires the board of trustees of each school district, on or before December 31, 2012, to submit to the Director of the Legislative Counsel Bureau for transmittal to the next
regular session of the Legislature a report on the number of pupils who were awarded a standard high school diploma pursuant to the criteria prescribed by this bill. The bill authorizes school districts to adopt a policy that allows a high school pupil who has failed to comply with minimum attendance requirements the opportunity to make up the credits which the pupil missed during his or her absence. Existing law prescribes the actions which must be taken by a juvenile court against a child who has been adjudicated in need of supervision because the child is a habitual truant. This bill authorizes a juvenile court to order the parent or legal guardian of such a child to attend conferences with the
child's teacher and appropriate school administrators to address the status of the child as a habitual truant and to develop a plan to ensure that the child attends school. The bill authorizes the parent or legal guardian of a child between the ages of 16 and 18 years to indicate on a work permit that is issued to the child by the county, if any, the maximum number of hours that his or her child may work and the particular hours in which that work may occur during the week or on the weekend. Existing law provides that a child under the age of 16 years may be employed in certain occupations for not more than 48 hours in any 1 week and 8 hours in any 1 day. Section 9 of this bill revises the hours that a child may be employed to 20 hours in any 1 week when school is in session and 48 hours in any 1 week when school is not in session.authorizing certain pupils to receive a standard high school diploma without passing all subject areas of the high school proficiency examination under certain circumstances; authorizing the board of trustees of a school district to adopt a policy that allows certain pupils enrolled in high school the opportunity to make up credit; authorizing a juvenile court to impose certain orders against the parent or legal guardian of a child who is adjudicated in need of supervision because the child is a habitual truant; revising provisions governing employment of minors.

Existing law provides that a teacher or administrator must be evaluated at least once each year. Teachers and administrators who have completed their probationary period is considered postprobationary. Postprobationary teachers or administrators who receive an unsatisfactory evaluation, or any other equivalent evaluation which designates overall performance is below average for 2 consecutive schools years will be deemed to be a probationary employee and must serve an additional probationary period. Sections 4 of this bill provides that the provisions of Section 1 of this are are not superseded by the terms of a collective bargaining agreement. Section 5 authorizes a teacher or administrator deemed to be probationary and dismissed before the completion of the current school year to request an expedited hearing.

Expands the requirements of the annual reports of accountability to include a reporting of the number and percentages of administrators, teachers, and other staff for each elementary school, middle school or junior high school and high school and for each school district in the state. Requires the board of trustees of each school district to: (1) establish a program of performance pay and enhanced compensation for the recruitment and retention of licenses teachers and administrators; and (2) implement the program commencing with the 2014-15 school year. Section 9 provides that if a written evaluation of a probationary teacher or administrator states that overall performance is "unsatisfactory": (1) evaluation must include a written statement that the contract of the person so evaluated may not be renewed for the next school year and that the employee may request reasonable assistance in correcting the deficiencies identified in the evaluation; and (2) the person must acknowledge in writing that he or she has received and understands the written statement. Section 12 revises the grounds for which a teacher may be suspended, dismissed or not reemployed to include gross misconduct. Section 13 provide that a postprobationary teachers receiving an unsatisfactory evaluation or a minimally effective evaluation must be evaluated three times in the immediately succeeding school year. Effective July 1, 2013, Sections 14 and 16 of this bill revise the policies for evaluations of teachers and administrators to require the designation of an individual teacher or administrators as "highly effective,", "effective," "minimally effective", or "ineffective" and provide that the policies must require that certain information on pupil achievement which is maintained by the automated system of accountability information for Nevada account for at least 50% of the evaluations. Section 19.6 provides that a board of trustees of a school district that determines a reduction in the existing workforce of the licensed educational personnel in the school district is necessary must not base the decision to lay off a teacher or an administrator solely on the seniority of the teacher or administrator and my consider other factors.

Existing law requires certain persons who apply for employment or a contract with a private postsecondary educational institution to submit a completed fingerprint card that must be taken by an agency of law enforcement and authorization for the postsecondary institution to conduct an investigation of the background of the applicants. (NRS 394.465) This bill allows the fingerprint card
and authorization to be submitted electronically to the Central Repository for Nevada Records of Criminal History. This bill also exempts an applicant from the background check if: (1) the applicant will provide instruction from a location outside this state through a licensed program of distance education; (2) the applicant previously underwent a background check; and (3) the Administrator of
the Commission on Postsecondary Education determines that an additional background check is not necessary.

Under existing law, each school district is required to schedule and provide annually a minimum of 180 days of school and a charter school is required to provide at least as many days of school as are required for other public schools in the school district in which the charter is located. For the 2011-2013 biennium, Section 6.5 of this bill authorizes the board of trustees of a school district and the governing body of a charter school to request a waiver of not more than 5 noninstructional days from the required minimum number of school days for a school year in that biennium during an economic hardship to avoid the layoff of teachers and other educational personnel employed by the school district or charter school. A request for a waiver must be reviewed by the Superintendent of Public Instruction and, if approved, transmitted to the Interim Finance Committee, which makes the final determination of whether to grant a waiver. The circumstances in which an economic hardship exists for a school district or charter school are identical to the circumstances in which an economic hardship exists under existing law for a school district or charter school to request a waiver from the required minimum expenditures for textbooks, instructional supplies, instructional software and instructional hardware. Section 7 sets forth the intent of the legislation in establishing a program certified by the the board of trustees of a school district or the governing body of a charter school whereby employees of school districts and charter schools who are members of the Public Employees' Retirement System and who take furlough leave due to extreme fiscal need be held harmless in the accumulation of retirement service credit and reported salary. Section 7 further sets forth provisions concerning the furlough leave as it relates to the Public Employees' Retirement System in a manner similar to the furlough program of state employees.

Prohibits a minor from using an electronic communication device, such as a cell phone, to possess, transmit or distribute a sexual image of himself or herself or of another minor. A minor who uses an electronic communiction device to transmit or distribute a sexual image of himself or herself is considered a child in need of supervision for the purposes of the laws governing juvenile justice for the first violation, and is considered to have committed a delinquent act for a second or subsequent violation. A minor who uses an electronic communication device to possess a sexual image of another minor is considered a child in need of supervision, while a minor who uses an electronic device to transmit or distribute a sexual image of another minor is considered to have committed a delinquent act. Also provides that a minor who violates the provisions of this act is not considered a sex offender and is not subject to registration or community notification as a jevenile sex offender or as a sex offender. Section 4 of this bill revises the definition of "cyber-bullying" to clarify that the term includes the use of electronic communication to transmit or distribute a sexual image of a minor. The revised definition also applies to certain other provisions related to eduction. Specifically, the term applies to existing law which requires the Council to Establish Academic Standards for Public Schools to establish the standards of content and performance for courses of study in computer education and technolocy. Those standards must include a policy for the ethical, safe and secure use of computers and other electronic devices which includes methods to ensure the prevention of cyber-bullying. Further, the revised definition applies to existing law which prohibits a person from using any means of oral, written or electronic communication, including the use of cyber-bulling, to knowingly threaten to cause bodily harm or death to a pupil or school employee with the intent to: (1) intimidte, frighten, alarm or distress the pupil or school employee; (2) cause panic or civil unrest; or (3) interfere with the operation of a public school. Section 1 of this bill removes the requirement that the automated system of accountability information have the capacity to identify which paraprofessionals are assigned to provide services to individual pupils and removes the requirement that the information on pupil achievement maintained in the system be used to evaluate paraprofessionals. Under existing law, the board of trustees of each school district and the governing board of each charter school are required to administer certain examinations to determine the achievement and proficiency of pupils and to report the results of those examinations to the Department of Education. Authorizes the principal of a high school or the principal's designee to postpone the administration of the high school proficiency
examination in the subject area of mathematics or science, or both, for a pupil enrolled in grade 10 for not more than 1 year if: (1) the
principal and the teacher who provides instruction in the applicable subject area determine, based upon the criteria for grading established by the school district for the applicable subject area, that the pupil is not academically ready to take the examination; and (2) the parent or legal guardian of the pupil agrees in writing that the pupil is not academically ready for that subject area of the examination. If the administration of the examination is postponed, the pupil's academic plan for high school must be revised to ensure that: (1) the pupil is enrolled in or scheduled to enroll in the appropriate course work for his or her grade level and receives the necessary preparation to enable the pupil to take the subject area of the high school proficiency examination which was postponed; and (2) the pupil participates in the statewide program to prepare pupils for the high school proficiency examination or enrolls in a course of study offered by the board of trustees of the school district designed to assist pupils with passing the high school proficiency examination; authorizes the board of trustees of a school district to administer the practice test of the high school proficiency examination to pupils enrolled in high school.

Requires the Nevada Interscholastic Activities Association and the board of trustees of each school district to adopt policies concerning the prevention and treatment of injuries to the head sustained by pupils while participating in sports and other athletic activities and events. The policy must require that a pupil who sustains or is suspected of sustaining an injury to the head while participating in such activity or event: (1) be immediately removed from the activity or event; and (2) may not return to the the activity or event unless the parent or legal guardian of the pupil provides a written statement from a health care provider medically clearing the pupil to participate and the date on which the pupil may return to the activity. Annually, a pupil participating in interscholastic activites and his parent or legal guardian must sign a form acknowledging they have received a copy of the policy and understand its terms and conditions before the pupil may participate. The board of trustees of each school district is required to adopt a similar policy for participation in the Nevada Interscholastic Activities Association. Certain organizations for youth sports in this State is required to adopt a similar policy.

Excuses compulsory attendance if a child is enrolled in a private school or if a notice of intent to homeschool the child is filed with the superintendent of schools of the school district in which the child resides. Authorizes the board of trustees of a school district or the governing body of a charter school, as applicable, to require a birth certificate or other documentation to prove the identity of the homeschooled child who wishes to participate in certain activities and classes offered by the public schools in this State and requires such proof under certain circumstances. Sets forth requirements concerning a notice of intent to homeschool and establishes certain rights for a child that is being homeschooled and the parents of that child. Sets forth requirements concerning notice of intent of a homeschooled child to participate in programs and activities, which must be filed before a homeschooled child may participate in
certain classes, activities and programs in a public school or through a school district, or through the Nevada Interscholastic Activities Association. Prescribes the information that must be provided by a homeschooled child who wishes to enroll in a public high school to demonstrate competency in those courses of study or successful completion of those courses. Requires the board of trustees of each school district to maintain on its Internet website pertinent information concerning the examinations available to children in the school district. Requires each school district to ensure that homeschooled children who reside in the school district have adequate notice of the availability of the website.

Expands the annual reports of accountability information to include the rate of pupils who drop out of school in grades 6, 7 and 8. Requires the State Board to prescribe alternative criteria that a pupil may satisfy to receive a standard high school diploma if that pupil passes the mathematics and reading subject areas of the high school proficiency examination but has not passed the examination in its entirety after taking the examination at least three times before 12th grade. Provides that a pupil may be granted credit for a course without attending the course if he passes an examination, as prescribed by the State Board, demonstrating competency in the subject area of the course. Requires the board of trustees of each school district to adopt a policy for a pupil to be placed on academic probation and to earn credits required for high school while the pupil is completing the requirements for promotion to high school. Also requires each school district to provide assistance, upon the request of a public school within the school district, in the development of an application for a grant. Provides that the Commission shall not award a grant of money from the Account for a program of full-day kindergarten. Places a limitation on the amount of money that may be expended from the Account each biennium for expenses incurred by members of the Commission to travel to the school districts and schools that receive allocations from the Account. Also authorizes the Commission to spend a maximum amount of money from the Account each biennium for: (1) the costs incurred by the Commission to hold meetings and conferences for recipients of allocations from the Account to discuss or display effective programs, practices and strategies; and (2) an evaluation of the programs that received allocations from the Account by an independent consultant.

Expands the eligibility for independent study to include all pupils who are enrolled in public schools, pupils who are enrolled in an alternative program and pupils who are enrolled in a program designed to meet the requirements for an adult standard diploma. This bill requires the governing body of a charter school sponsored by the board of trustees of a school district located in certain larger counties to enroll pupils who live in the district before enrolling pupils who live outside the district. This bill provides that a person who holds a valid license to teach with an administrative endorsement may be employed as an administrator at the charter school. This bill also reduces the period during which a licensed teacher who is on a leave of absence from a school district to work at a charter school may return to a guaranteed comparable teaching position.

In lieu of complying with the pupil-teacher ratio, a school district in a county whose population is less than 100,000 may, in consultation with the recognized associations representing licensed educational personnel, develop a plan to reduce the district's pupil-teacher ratios per class for specified grade levels in elementary schools. Legislative Counsel's Digest: Existing law provides for the establishment of courses of study and academic standards for the public schools in this State. (Chapter 389 of NRS) This bill requires the Board of Regents of the University of Nevada to work with the State Board of Education and the Council to Establish Academic Standards for Public Schools to ensure that students enrolled in a program for the education of teachers are provided instruction in the standards for high school pupils. Existing law sets forth the requirements for issuance of a baccalaureate degree by the Board of Regents. (NRS 396.560) This bill specifies the manner in which a student is determined to have completed a full course of study for the issuance of a diploma of graduation from the System. Existing law prescribes 6-year terms of office for the members of the Board of Regents. (NRS 396.040) This bill reduces the terms of office to years. The current members elected will continue to serve out their 6-year terms of office. This provision becomes effective only if AJR 11 of the 72nd Session of the Nevada Legislature is not passed by the 73rd Session of the Legislature. Existing law requires that all credits earned at a community college within the System be transferable to a university or state college within the System if the course catalog identifies the course by the same title and description. (NRS 396.568) This bill requires that all courses earned at a community college within the System automatically transfer to a university or state college within the System and removes the requirements regarding the course catalog. This bill also provides that a student who has been awarded an associate's degree must be enrolled as a junior if he enrolls in any institution within the System. 2. Who scores at or above the 99.9th percentile for his age on an aptitude or achievement test, including, without limitation, the Scholastic Aptitude Test or the American College Test.

Addresses the mathematics portion of the high school proficiency exam. A passing score on this exam is required for Nevada students to obtain a high school diploma. The bill requires the Department of Education to reset the passing score in accordance with a 95 percent confidence interval for the recommended passing score. This change will make the passing rate for students similar to that of the reading portion of the test. For 2003 only, students graduating in 2003 who have otherwise met all requirements for graduation must be allowed to participate in district graduation ceremonies under the presumption that they have passed the tests; however, such a student would not receive a diploma until their score was determined to meet or exceed the new passing score. The Department is directed to incrementally increase the passing score over the next several years, until it is at least the same as the current passing score for the class graduating high school in 2007. During the 2003-2005 interim period, the school districts are required to review their curriculum and the amount and type of mathematics credits they require for high school graduation, make any necessary adjustments, and submit certain information to the Superintendent of Public Instruction for report back to 2005 Legislature. If a postprobationary teacher who is an administrator is not reemployed as an administrator after either year of his probationary period, and there is a position as a teacher available for the ensuing school year in the school district in which the person is employed, that person must be offered contract as a teacher for the ensuing school year. If the person fails to accept the contract as a teacher, the person shall be deemed to have rejected the offer of a contract as a teacher. An administrator who has completed his probationary period and is thereafter promoted to the position of principal must serve an additional probationary period of 1 year in the position of principal. If the administrator serving the additional probationary period is not reemployed as a principal after the expiration of the additional probationary period, the board must offer the person a contract for the ensuing school year for the administrative position in which [he] the person attained postprobationary status. In lieu of tutoring, the parent or legal guardian of such a child may agree with the entity that employs the child that the entity will pay the costs for the child to receive other educational or instructional services, which are equivalent to tutoring.
