Adds new rule: 6.69.8 NMAC 'Teacher and School Leader Effectiveness,' which is intended to establish uniform procedures for conducting annual evaluations and effectiveness of licensed school teachers and administrators. A. As soon as possible but not later than the commencement of the 2013-2014 school year, all school districts are required to develop and submit to the department for approval and for implementation during the 2013-2014 school year, an effectiveness evaluation system for measuring performance of licensed school employees. B. School districts may continue to use the highly objective uniform statewide standards of evaluation for evaluating, promoting, terminating and discharging licensed school employees for performance during the 2012-2013 school year. C. Each school district is required to report annually to the department the results of its effectiveness evaluations of its licensed school employees and the alignment of its effectiveness evaluation system with the three-tiered licensure system. Systems must include measures of student achievement growth worth 50%, observations worth 25% and other multiple measures worth 25%, unless otherwise provided for and differentiate among at least five levels of performance, which include the following:
(a) exemplary, meets competency;
(b) highly effective, meets competency;
(c) effective, meets competency;
(d) minimally effective, does not meet competency; and
(e) ineffective, does not meet competency.
Requires annual effectiveness evaluation for every school leader. Requires that All ratings for the performance of a school leader be based 50% on the change in a school's A through F letter grade, 25% based on the school's multiple measures and 25% based upon documented fidelity observations of the school leader. Requires, whenever possible, that evaluations include student achievement growth data for students assigned to the public school for at least three consecutive school years, provided that, the student achievement growth component of the effectiveness evaluation shall be based on the change in the school's A through F letter grade.

Amends rule 6.19.8 NMAC 'Grading of Public Schools,' which was adopted on December 15, 2011 and implemented the 'A-B-C-D-F Schools Rating Act.' Defines "Supplemental accountability model" or "SAM" as any schools that qualify for a modified accountability calculation. Modifies measures used to calculate grades. For example, to be eligible as a SAM school, the school must serve a student population where 10% or more of the students are 19 years of age or older, or where 20% or more of the non-gifted students qualify for special educational services. Additionally the school, when established, must have the primary mission to address the needs of students who are at risk of educational failure as indicated by poor grades, truancy, disruptive behavior, eligibility for special education services, or other factors associated with temporary or permanent withdrawal from school. Adds PLAN, accuplacer, international baccalaureate or IB to indicators used for determining college readiness (i.e., ACT, PSAT, dual credit, SAT, or AP scores) or career readiness (i.e., pre-apprenticeship programs, and cooperative education programs). In calculating graduation rates for school grades, schools that do not have members of any cohort are exempted from the graduation component of school grading for that year; the exempted school's overall grade will be comprised of the remaining grading components and its overall points will be adjusted to the standardized scale. Makes other amendments.

From Fiscal Note: Provides for two chartering authorities – the local school district and the state. The bill allows charter schools to elect their chartering authority between a school district or the PEC as well as allowing charter schools to change their chartering authority upon charter renewal. The bill provides that state-charted schools are independent of school districts and as such, the state-chartered school governing bodies are generally treated as local school district boards. The bill creates the Charter Schools Division within the department. With regard to local board charter schools, the bill does not require a charter school authorized by a school district to qualify as a board of finance because it would continue to be a component unit of the school district for audit purposes. Additionally, charter schools authorized by a school district would be treated no differently than they currently are relative to transportation; i.e., local districts must continue to negotiate the provision of transportation to charter school students eligible for transportation.
The bill requires that state-chartered schools governing bodies must function as boards of finance and be qualified prior to the first year of operation. Failure of the governing body of a proposed state-chartered school to qualify as a board of finance constitutes grounds for denial, nonrenewal or revocation of its charter. Charter schools authorized by the PEC can apply for their own transportation funds based upon their eligible student membership and are prevented from owning school buses and providing their own transportation system but transportation is funded and provided in a manner similar to the funded local district bus-contracted services. However it appears language contained in the bill may allow state-chartered schools to act as their own bus contractors. While the bill provides for state-chartered schools to contract for transportation and other services they are prohibited from contracting with a for-profit entity for the management of the school.

From fiscal impact statement: This bill does not contain an appropriation; however, enactment of this legislation is likely to have a significant impact on the expenditure of the Lottery Tuition Fund. The lack of clear statutory definitions of "tuition" and "general fees" has contributed to a trend by some institutions of higher education to reclassify an increasing portion of their combined "tuition and fee" charges as "tuition." The impact of this reclassification is to increase the value of Lottery Success Scholarships for eligible recipients, thereby increasing the expenditure rate from the Lottery Tuition Fund. From Fiscal Note: The bill requires all school districts to have submitted a five-year facilities plan which includes enrollment projections, a current preventative maintenance plan, the capital needs of charter schools located in the district, and projections of facility needs to maintain a full-day kindergarten program prior to PSFA approving school construction or a district letting contracts for school construction. PSFA notes this is consistent with requirements currently in effect for districts applying for grant assistance. Provisions contained in the bill increase the current 3 to 9 percent caps currently in place on the amount of operational cash balances a public school district may retain to 5 to 15 percent depending on total program cost. School districts have complained the caps currently in place are unfair and are causing undue pressure with regard to expenditures which require the district to expend funds prior to requesting reimbursement. The committee substitute also provides for the secretary of education to waive all or a portion of reductions for excess cash balances if the funds are needed to provide a local match or to reduce the districts share of amounts granted for qualified high priority projects.
The Senate Finance Committee Substitute for the Senate Education Substitute for Senate Bill 450 is an omnibus public school capital outlay bill making changes to the public school capital outlay (PSCO) program, requiring school district master facilities plans, providing for certain
districts to receive assistance in developing and updating five-year facilities plans, providing for capital outlay fund local match assistance for qualified high priority projects, increases statutory caps on school district cash balances, and creates a fund to pay for new school one-time costs. The bill also provides funding to fully implement the lease payment assistance program, provides for use of PSCO funds to demolish abandoned buildings, changes the method with which high growth school construction is addressed, and provides funding to correct deficiencies at the New Mexico School for the Blind and Visually Handicapped and the New Mexico School for the Deaf. Also included in the bill are provisions increasing the SB-9 guarantee from $60.00 to $90.00 per unit, continuing the exempt status of Public School Facilities Authority (PSFA) employees, providing for PSFA to act as its own purchasing agent and creating a study committee and making

These schools must develop an improvement plan with documentation of performance measures in which it failed to make AYP; (2) measurable objectives to indicate the action that will be taken to address failed measures; (3) benchmarks to be used to indicate progress in meeting academic content and performance standards; (4) an estimate of the time and the resources needed to achieve each objective in the improvement plan; (5) the support services that shall be provided to students and applications for federal and state funds; and (6) any other information the public school that needs improvement, the local superintendent, the local school board or the department deems necessary. May apply to the department for financial assistance. Must provide transportation or pay the cost of transportation for students who choose to enroll in a higher ranked school. After 3 consecutive years, the school must provide supplemental services, including after-school programs, tutoring and summer services, within available funds. Requires the state board to adopt rules that govern the priority for studnets for who supplemental services are provided and for whom transportation costs are paid. After 4 consecutive years, the school is subject to corrective action and the district must do one of the following (1) replace staff as allowed by law; (2) implement a new curriculum; (3) decrease management authority of the public school; (4) appoint an outside expert to advise the
public school; (5) extend the school day or year; or (6) change the public school's internal organizational structure. If a public school fails to make adequate yearly progress for 5 consecutive years, the district must take one or more of the following actions: (1) reopen as a charter school; 2) replace all or most of the staff as allowed by law; (3) turn over the management of the public school to the department; or
(4) make other governance changes. Testing requirements: (1) for grades kindergarten through two, diagnostic and standards-based tests on reading that include phonemic awareness, phonics and comprehension by the 2003-2004 school year; (2) for grades three through nine and for grade eleven, standards-based academic performance tests in mathematics, reading and language arts and social studies by the 2005-2006 school year; provided that testing in ninth grade and testing in social studies shall not occur until the legislature has provided funding for test development and implementation; (3) for grades four, six, eight and eleven, standards-based academic performance writing tests by the 2005-2006 school year and (4) for one of grades three through five and six through nine and for grade eleven, standards-based academic performance tests in science by the 2007-2008 school year. C. The department shall involve appropriate licensed school employees in the development of the standardsbased academic performance tests. D. All students shall participate in the academic assessment program. The state board shall adopt standards for reasonable accommodations in academic testing for students with disabilities and limited English proficiency, including when and how accommodations may be applied. The legislative education study committee shall review the standards prior to adoption by the state board. E. Students who have been determined to be limited English proficient may be allowed to take the standards-based academic performance test in their primary language. A student who has attended school for three consecutive years in the United States shall participate in the English language reading test unless granted a waiver by the department based on criteria set by the state board. Service learning must be offered as an elective. Students may not receive a diploma if they have not passed a state graduation examination in reading, English, math, writing, science and social science. Without passage of such exam, student receives an appropriate state certificate indicating the number of credits earned and the grade completed. May pass the test within 5 years and receive a diploma. Amends Section 22-2A-6. Remediation programs, academic improvement programs and promotion policies shall be aligned with alternative school or district-determined assessment results and requirements of the assessment and accountability program. Schools must provide remediation opportunities to students in grades 1-8 who fail to make adequate yearly progress. Costs for remediation programs and academic improvement programs are borne by the district. The cost of summer and extended day remediation programs and academic improvement programs offered in grades nine through twelve shall be borne by the parent; however, where parents are determined to be indigent according to guidelines established by the state board, the district shall bear those costs. Parents must be notified no later than the end of the second grading period that his child is failing to make adequate yearly progress. Students in grades 1-7 who have not made adequate yearly progress must participate in remediation, and if they still don't make AYP, must be retained in the same grade for no more than one year in order to have additional time to master the required content standards.

Amends Section 22-10A-6 to require the state board to set requirements that provide a reasonable period of time for teachers to comply with the reading course (3 hours) requirement. Adds new section (22-10A-7), which establishes requirements for level one licensure - a three-year license. Districts must provide for mentorship and evaluation of level one teachers. At the end of this term, teachers must be evaluated for competency, and unless progress has been satisfactory, should not be granted a level two license. Level one requires: BA, successful completion of a state-board approved teacher preparation program from a nationally accredited or state-approved institution; has passed the New Mexico teacher assessments examination; meets other requirements such as background checks. Allows department to issue alternative level one licenses to applicants who meet requirements of 10A-8: BA, masters, including 12 graduate hours in subject area of instruction for which applying for a license or doctoral or law degree; passed New Mexico teacher assessments examination; 12 semester hours in teaching principles in an approved program or demonstrated that has met the state board-approved competencies for level one teachers that correspond to the grade level that will be taught. Requires state board to establish competencies for specific grade levels, types and subject areas. Sets minimum salary for a level one teacher at $30,000 - beginning with 2003-2004 school year (with state board adoption of highly objective uniform statewide standard of evaluation). Level two and Level three licenses (22-10A-10) are established. Both are nine-year license. Sets minimum salary requirements for each. Level 3 licenses have levels A & B. 22-10A-12 adds limited license reciprocity. 22-10A-13 adds Native American Language and Culture Certificates for persons proficient in Native American language and culture who meets criteria established by the state board. With the shift to prior year funding beginning with the 1999-2000 school year, new students do not generate grade or other program units the first year in which they are enrolled. In an effort to address the problem, the 1999 General Appropriation Act included language to increase the growth factor form 0.05 to 1.00 for the 1999-2000 school year and the 2000 General Appropriation Act included a categorical appropriation of $2,554.1 to be distributed to districts with a growth rate of greater than 1 percent for the 2000-2001 school year.
