Requires, to the extent funds are made available, the SBE to plan for and require the administration of the ACT test for all students in the eleventh grade unless the student has already taken a comparable test and scored at or above a level set by the SBE.

Requires, to the extent funds are made available for this purpose, the SBE to plan for and require the administration of diagnostic tests in the eighth and tenth grades that align to the ACT test in order to help diagnose student learning and provide for students an indication of whether they are on track to be remediation-free at a community college or university. Requires that this curricula include as part of its core content the Future Farmers of America (FFA) student youth organization and the Supervised Agricultural Experience learning program. Effective with the 2011 federal grant, directs the state board to transfer a prorated share of funds from all federal Career and Technical Education (CTE) funds available for state-level use to the Agricultural Education and FFA Program in the Department of Agricultural and Extension Education at NCSU. Requires that the transfer of funds be a percentage of the total based on the grades 9-12 duplicated agricultural education enrollment as compared to the total CTE grades 9-12 duplicated enrollment. Provides that the required rules governing interscholastic athletic activities adopted by the State Board of Education must provide:

1. That all coaches, school nurses, athletic directors, first responders, volunteers, students who participate in interscholastic athletic activities, and the parents of those students will annually receive a concussion and head injury information sheet. School employees, first responders, volunteers, and students must sign the sheet and return it to the coach before they can participate in interscholastic athletic activities, including tryouts, practices, or competition. Parents must sign the sheet and return it to the coach before their children can participate in any such interscholastic athletic activities.

2. If a student participating in an interscholastic athletic activity exhibits signs or symptoms consistent with concussion, the student must be removed from the activity at that time and not be allowed to return to play or practice that day. The student must not return to play or practice on a subsequent day until the student is evaluated by and receives written clearance for such participation.

3. That each school must develop a venue specific emergency action plan to deal with serious injuries and acute medical conditions in which the condition of the patient may deteriorate rapidly. The plan shall include a delineation of roles, methods of communication, available emergency equipment, and access to and plan for emergency transport.

Provides that the purpose of the pilot program is to reengage students and increase the graduation rates in North Carolina through an educational program that provides flexible scheduling and a blended learning environment with individualized and self-paced learning options. Provides that under the pilot program, the educational services and programming must be provided by an education partner that is a nonprofit or for-profit entity approved by the SBE. Requires that credits earned through Promise allow students to complete a postsecondary credential in less time than would normally be required. Directs all existing dual enrollment programs (i.e., Huskins, Concurrent Enrollment, Cooperative and Innovative High Schools, Learn and Earn, and Learn and Earn Online) to be consolidated and replaced by Career and College Promise. Identifies minimum outcomes to be measured. Directs community colleges to generate budget FTE for instruction provided through the Promise. Establishes reporting requirement regarding the number and cost of high school FTE served as a result of the Career and College Promise program. Repeals § 115D-1.1 (permitting enrollment of a student under 16 in a community college) and § 115D-1.2 (providing for the Learn and Earn Online program).

Repeals language (1) prohibiting generation of community college budget FTE if a community college contracts with a local school administrative unit for a high school teacher to teach a college course, and (2) permitting local community college administrative boards and local school boards to establish cooperative programs permitting high school students to complete college courses for credit. Replaces with language permitting community colleges to offer (in collaboration with local school administrative units), cooperative innovative high school programs, academic transition pathways leading to a career technical education certificate or diploma, and college transfer certificates requiring completion of 30 semester credit hours transfer courses, including English and math, for high school juniors and seniors.

Details what such policies must include. Encourages school officials to use a full range of responses to violations of disciplinary rules, such as conferences, counseling, and peer mediation.

Reasonable force - Provides that school personnel may use reasonable force to control behavior or to remove a person from the scene in those situations when necessary for any of the following reasons: (1) To correct students; (2) To quell a disturbance threatening injury to others; (3) To obtain possession of weapons or other dangerous objects on the person, or within the control, of a student; (4) For self-defense; (5) For the protection of persons or property; and (6) To maintain order on educational property, in the classroom, or at a school-related activity on or off educational property.

Corporal punishment - Directs each school board to determine whether corporal punishment will be permitted in its district. Specifies what the policies adopted for the administration of corporal punishment must include. Requires each school board to report annually to the state board of education on the number of times that corporal punishment was administered.

Suspension - Details when a principal has the authority to impose short- and long-term suspension on a student and what a student subject to short- and long-term suspension must be provided. Provides the procedures for imposing short- and long-term suspension.

Alternative education services - Provides that students who are long-term suspended must be offered alternative education services unless the superintendent provides a significant or important reason for declining to offer such services. Details what constitues a significant or important reason for declining such services.

365-day supension for gun possession - Requires all local boards to develop and implement policies and procedures requiring suspension for 365 calendar days of any student who is determined to have brought or been in possession of a firearm or destructive device on educational property or to a school-sponsored event off educational property.

Expulsion - Provides that upon recommentation of the superintendent, a board of education may expel any student 14 years of age or older whose continued presence in school constitutes a clear threat to the safety of other students or school staff. Provides the procedures for an expulsion. Modifies the procedure for dismissal or demotion of career employee. Requires an annual evaluation of licensed employees assigned to all schools identified as low-performing. Requires local boards to use performance standards and criteria adopted by State Board of Education (SBE) and allows local boards to adopt additional evaluation criteria and standards. Mandates probationary teacher observations in schools not identified as low-performing at least 3 times annually by a principal and at least one time annually by a teacher. Provides that if a teacher receives a performance rating that is below proficient or otherwise below standard a principal may place the teacher on a mandatory improvement plan equivalent to those in low-performing schools. Establishes that after reassessment of the teacher on the areas of deficiency identified in the mandatory improvement plan, if the teacher is not proficient in any of the performance standards identified or has not demonstrated sufficient improvement towards those standards, the superintendent may recommend demotion or dismissal. Establishes immunity for negligence for acts or omissions taken with regards to teacher evaluation/observations and institution of mandatory improvement plans. Directs the state board to take specified steps to implement an allotment formula for NCVPS beginning with the 2011-2012 school year. Directs NCVPS to provide the NCVPS program at no cost to all students enrolled in North Carolina public schools, Department of Defense schools, and schools operated by the Bureau of Indian Affairs. Directs the state board, in establishing the fee structure and payment structure for NCVPS, to consider recommendations from the eLearning Commission and the NCVPS Advisory Board. Directs the state board to establish a separate per student tuition for out-of-state, home-schooled, and private school students. Requires the board to direct NCVPS to develop a plan by September 15, 2011 to generate revenue from the sale of courses to out-of-state educational entities; requires that such revenue be used to offset instructional costs to local school administrative units and charter schools. Beginning in 2011, requires that the director of NCVPS submit a report on NCVPS to the state board by December 1 of each year. Requires that the report use data from the previous fiscal year and include statistics on actual versus projected costs to local school administrative units and charter schools, student enrollment, virtual teacher salaries, and measures of academic achievement. Requires that the NCVPS director continue specified efforts related to quality of course offerings, elimination of course duplication, and alignment of courses to the North Carolina Standard Course of Study. Directs the state board to reduce each district or charter school's classroom teacher allotment on the basis of ADM in grades 6-12 to provide $2,866,923 for NCVPS in the 2011-2012 fiscal year. Requires that the allotment reduction continue in future fiscal years and be adjusted annually based upon the percentage growth in NCVPS enrollment. Also requires that in fiscal year 2011-2012, the allotment to districts and charter schools be reduced to provide $2 million to create an NCVPS enrollment reserve, to be used to cover the NCVPS instructional costs of local school administrative units or charter schools with enrollments exceeding projected NCVPS enrollment. Beginning in fiscal year 2012-2013, requires the state board to annually reduce each local school administrative unit's or charter school's classroom teacher allotment, or other allotment, as determined by the state board, on the basis of ADM in grades 6-12 an amount that is the difference between $2,000,000 and the balance of the NCVPS enrollment reserve.

1. Is privately owned by a sole proprietorship, partnership, limited liability company, or corporation
2. Is established as a business entity or as a nonprofit charitable organization
3. Offers instruction to individuals who (i) have completed their elementary and secondary education or (ii) are beyond the age of compulsory secondary school attendance and have demonstrated an ability to benefit from that instruction for the attainment of educational objectives, vocational objectives, or both
4. Charges tuition or receives any consideration from a student for any portion of the instruction in any form, including written or audiovisual material
5. Educates, trains, or claims or offers to educate or train students in a program leading toward (i) examinations for licensing in a profession or vocation, (ii) employment at a beginning or advanced level, or (iii) a postsecondary educational credential below the associate degree level.

The term proprietary school includes a branch or extension of a private postsecondary educational institution of another state that is located in North Carolina or that offers educational services or education at a physical location within North Carolina.

The legislation also requires proprietary school policy and regulations to provide for, at a minimum, a full refund if a student withdraws before the first day of class or the school cancels the class and 75% refund if the student withdraws within the first 25% of the period of enrollment for which the student was charged.

Prior to the 2010-11 school year, directs the state board to:
(1) Develop a growth model establishing annual improvement goals in the four-year cohort graduation rate by local school administrative units.
(2) Establish as a short-term goal that local school administrative units meet the annual growth model goals for improvement in the four-year cohort graduation rate beginning with the graduating class of 2011 and continuing annually thereafter.
(3) Establish as statewide minimum goals four-year cohort graduation rates of 74% by 2014; 80% by 2016; and 90% by 2018.
(4) Establish as a long-term goal with benchmarks and recommendations to reach a statewide four-year cohort graduation rate of 100%.

Directs the state board to report annually to the Joint Legislative Education Oversight Committee beginning no later than November 15, 2010 on the aforementioned goals, benchmarks, and recommendations. Requires that the goals, benchmarks, and recommendations appropriately differentiate for students with disabilities and other student subgroups in each four-year cohort. The purpose of the ROPE Scholars Pilot Program is to strengthen middle grades education in order to provide students with the opportunity to graduate from high school with the core academic skills needed for postsecondary education and high-skilled employment, and thereby to reduce the high school dropout rate, increase high school and college graduation rates and decrease the need for remediation in institutions of higher education.

It is the intent of the ROPE Scholars Program to:
-Reduce class size to one teacher to every 17 students
-Provide annual salary increments of up to $5,000 per year to teachers certified in the fields of mathematics, science, or special education
-Provide a coordinator position at each participating school to assist in community and parental support
-Encourage students participating in the program, through agreements executed between the local school administrative unit and students and their parents or guardians, to:
(1) Maintain a 95% attendance rate each year; (2) Achieve a minimum of a "B" average; (3) Take the PSAT and the SAT or the ACT and achieve an adequate score, as determined by the state board; (4) Meet the standards for admission established by the board of governors of the University of North Carolina (5) Engage in community service work each month during the school year for the number of hours determined by the state board; and (6) Evidence good character by not engaging in unlawful conduct.
-Provide students who successfully participate in the program with college scholarships.

Directs the state board to develop a competitive process through which units may apply to participate in the pilot program. The number of participating units will be limited to three units in the 2008-09 fiscal year. The units will be selected from different geographical areas of the state and shall include at least one urban and one rural unit. The state board will develop a process to evaluate the effectiveness of the program, and is required to prepare a report for the legislative oversight committee that includes the cost of implementing the pilot program and indicates state laws, rules and policies that would preclude the implementation of the pilot.

The state board is required to adopt rules to facilitate job sharing by public school employees. These rules must provide that an employee in a job-sharing position shall receive paid legal holidays, annual vacation leave, sick leave, and personal leave on a pro rata basis. a. Identify which schools are meeting adequate yearly progress with subgroups as specified in the No Child Left Behind Act of 2001;
b. Study the instructional, administrative, and fiscal practices and policies employed by the schools selected by the state board that are meeting adequate yearly progress specified in the No Child Left Behind Act of 2001; c. Create assistance models for each subgroup based on the practices and policies used in schools that are meeting adequate yearly progress. The schools of education at the constituent institutions of The University of North Carolina, in collaboration with the University of North Carolina Center for School Leadership Development, shall assist the state board in developing these models; and d. Offer technical assistance based on these assistance models to local school administrative units not meeting adequate yearly progress, giving priority to those local school administrative units with high concentrations of schools that are not meeting adequate yearly progress. Requires the state board to determine the number of local school administrative units that can be served effectively in the first two years. The General Assembly strongly endorses the Governor's goal of making North Carolina's system of
education first in America by 2010. The Cabinet shall identify and support efforts that achieve the following purposes: (1) Support cooperative innovative high school programs; (2) Improve high school completion rates and reduce high school dropout rates; (3) Close the achievement gap; (4) Create redesigned middle schools or high schools; (5) Provide flexible, customized programs of learning for high school students who would benefit from accelerated, higher level coursework or early graduation; (6) Establish high quality alternative learning programs; (7) Establish a virtual high school; (8) Implement other innovative education initiatives designed to advance the state's system of education. Adds section concerning students who have been placed at risk of academic failure. Requires that schools identify students who have been placed at risk for academic failure. Stipulates that identification should occur as early as can be reasonable done and can be based on grades, observations, state assessments and other factors that impact student performance that teachers and administrators consider appropriate, without having to await the results of end-of-grade or end-of-course tests. At the beginning of the school year, a personal education plan must be developed for any student not performing at least at grade level, as identified by the state end-of-grade test. Parents are to be included in the implementation and ongoing review of personal education plans. Older language also stipulates that focused intervention and accelerated activities should include research-based best practices that meet the needs of students and may include coaching, mentoring, tutoring, summer school, Saturday school, and extended days. Requires local school administrative units to provide these activities free of charge to
students and provide transportation free of charge to all students who need it.
