Provides that the cost is to be borne by the state. Each district superintendent and each nonpublic school administrator is required to report the number of 11th graders who took the ACT, including the writing test; too the three WorkKeys assessments; and the number of students who were exempted from these requirements.

Addresses rapid enrollment by appropriating $5 million from the oil and gas impact grant fund to any district with a 7% and at least 25 student increase over the previous fall enrollment count. Continues the requirement to use 70% of new funding for increasing teacher compensation or hiring additional staff. Creates a special interim legislative committee to study education and taxation issues.

Clarifies that in order to obtain a high school diploma, a student must have successfully completed 22 units of high school coursework and any additional units required by the entity issuing the diploma. Articulates the 22 units of high school coursework that constitute the minimum requirement for high school graduation: 4 units English Language Arts (lit., composition and speech); 3 units math; 3 units science, including 1 physical science, 1 biology and 1 of any other science or 2 half-units of any other science; 3 units social studies, including 1 U.S. history, 1/2 unit of U.S. government and 1/2 unit of economics or 1 unit or 2 half-units of any other social studies; 1 physical education or 1/2 physical education and 1/2 health; 3 units of foreign languages, Native American languages, fine arts or career and technical education; and any 5 additional units. Requires the education standards and practices board (ESPB) to establish and administer a first-year teacher support (mentoring) program. Requires the employment of a coordinator who will select and train experienced teachers who will serve as mentors. If a district has no first-year teachers, the coordinator will select and train experienced teachers who will work with administrators to identify the needs of non-first-year teachers and help those teachers through the use of research-validated interventions and proven instructional methods. Permits ESPB to provide compensation, including stipends, to mentors and experienced teachers who assist beginning teachers. The board may not spend more than 5% of the moneys for administrative purposes. Expands the program to include districts, special education units, area career and technology education centers, regional education associations, and schools funded by the Bureau of Indian Education.

Creates a new section that defines attendance (absence) (15.1 - 20 - 02.1).
1. To be deemed in attendance for purposes of this chapter, a student may not be absent from school without excuse for more than:
a. Three consecutive school days during either the first half or the second half of a school
or school district's calendar;
b. Six half days during either the first half or the second half of a school or school district's
calendar; or
c. Twenty-one class periods.
Requires each district board and the governing body of each nonpublic school to adopt a policy that:
a. Defines an excused absence as any absence from school, if that absence is supported
by either a verbal or written excuse supplied by the student's parent, teacher, or school administrator; and
b. Articulates the type of documentation that may be requested to verify a student's absence.
Does not preclude a school district or nonpublic school from withholding credit, removing a student from a course, or taking other punitive measures against a student who does not arrive in a timely fashion or who exceeds a specific number of absences, as
determined by the school district or nonpublic school.

The intercollegiate athletic teams sponsored by the university of North Dakota shall be known as
the university of North Dakota fighting Sioux. Neither the university of North Dakota nor the state board
of higher education may take any action to discontinue the use of the fighting Sioux nickname or the
fighting Sioux logo in use on January 1, 2011. Any actions taken by the state board of higher education
and the university of North Dakota before the effective date of this Act to discontinue the use of the
fighting Sioux nickname and logo are preempted by this Act. If the national collegiate athletic
association takes any action to penalize the university of North Dakota for using the fighting Sioux
nickname or logo, the attorney general shall consider filing a federal antitrust claim against that
association.

Adds six new sections to chapter 15.1-19, relating to the prevention of bullying in public schools.
Defines bullying as conduct that occurs in a public school, on school district premises, in a district owned or
leased schoolbus or school vehicle, or at any public school or school district sanctioned or sponsored activity or event and which:
(1) Is so severe, pervasive, or objectively offensive that it substantially interferes with the student's educational opportunities;
(2) Places the student in actual and reasonable fear of harm;
(3) Places the student in actual and reasonable fear of damage to property of the student; or
(4) Substantially disrupts the orderly operation of the public school.

Clarifies that "Conduct" includes the use of technology or other electronic media.

Requires, prior to July 1, 2010, each districts to adopt a policy to address bullying at a public school, on school district premises, in a district owned or leased schoolbus or school vehicle, or at any public school or school district sanctioned or sponsored activity or event. A student may not engage in bullying or in reprisal or retaliation against (1) A victim of bullying; (2) An individual who witnesses an alleged act of bullying; (3) An individual who reports an alleged act of bullying; or (4) An individual who provides information about an alleged act of bullying. education, licensed day care center, licensed child care facility, headstart program, or nursery school for the first time, the school, licensed day care facility, headstart program, or school superintendent of the jurisdiction shall: a. Require the child's parent, guardian, or legal custodian to present to the school, licensed day care facility, or school superintendent of the jurisdiction, within forty days of enrollment, proof of identity of the child; and b. Request the appropriate school records for the child from the previous school attended by the child. The school enrolling the child shall make the request within thirty days of enrollment of the child. When a school, licensed day care facility, or school superintendent receives a notice from

Requires districts to administer annually to students in grades 2-10 the measures of academic progress test or any other interim assessment approved by the superintendent of education. Requires all 11th grade public and nonpublic school students to take the ACT or set of three WorkKeys assessments (students choose which). The district pays for the cost of one summative assessment and its administration per student. Requires the career advisor or counselor to meet with students to review results. Students can be exempt if taking the test is not required by an IEP or if there are other special circumstances. If the state superintendent determines that costs can be reduced through the use of a state procurement process, the superintendent is to work with districts to procure and arrange for administration of assessments and withhold each district's share of the total cost from state aid. Students under age 21 pursuing a GED may take the ACT or three WorkKeys assessments, and the student's career advisor or guidance counselor must meet with the student to review the student's assessment results.

Beginning with the 2010-11 school year, each district must have available one full-time equivalent student performance strategist for every four hundred students in average daily membership in kindergarten through grade three. Each school district shall submit documentation to the superintendent of public instruction, at the time and in the manner directed by the superintendent, verifying the amount of time that each student performance strategist expended in tutoring students on a one-to-one basis or in groups ranging from two to five, or in providing instructional coaching to teachers. For purposes of this section, a "student performance strategist" must meet the qualifications of an elementary school teacher as set forth in
section 15.1-18-07 and serve as a tutor or an instructional coach.

Requires the department to develop a program leading to a certificate in career development facilitation. The department shall award the certificate to any individual who:
a. Holds a baccalaureate degree from an accredited institution of higher education;
b. Has at least a five-year employment history; and
c. Successfully completes the department's programmatic requirements.
2. An individual holding a certificate awarded under this section is a career advisor.
Allows the department to provisionally approve an individual to serve as a career advisor if the individual:
a. Holds a baccalaureate degree from an accredited institution of higher education;
b. Has at least a five-year employment history; and
c. Provides the department with a plan for completing the department's programmatic
requirements within a two-year period.
2. Provisional approval under subsection 1 is valid for a period of two years and may not be
extended by the department.

Any resident student who graduates from a high school during or after the 2010-11 school year is eligible to receive a North Dakota career and technical education scholarship provided the student completes all requirements for a high school diploma and:
1. a. Completes one unit of algebra II; b. Completes two units of a coordinated plan of study recommended by the department of career and technical education and approved by the superintendent of public instruction; and c. Completes three additional units, two of which must be in the area of career and technical education; 2. Obtains a grade of at least "C" in each unit or one-half unit required for the diploma; 3. Obtains a cumulative grade point of at least "B", as determined by the superintendent of public instruction; and 4. Receives: a. A composite score of at least twenty-four on an ACT; or b. A score of at least five on each of three WorkKeys assessments. Requirements for an academic scholarship are similar, except for the WorkKeys score option, and requiring one unit of advanced placement and AP exam or a dual-credit course.

Scholarships are available to eligible students in the amount of $700 for each semester during which enrolled full time at an accredited state institution and maintains a cumulative grade point average of 2.75. Scholarships are capped at $6,000 and go to the institutions in which the students are enrolled. Students are not required to be enrolled in consecutive semesters. Beginning July 1, 2010, each school district shall ensure that its curriculum for either
economics or problems of democracy includes the exposure of students to concepts of
personal finance, including:
a. Checkbook mechanics, including writing checks, balancing, and statement
reconciliation;
b. Saving for larger purchases;
c. Credit, including credit card usage, interest, and fees;
d. Earning power, including jobs for teenagers;
e. Taxation and paycheck withholdings;
f. College costs;
g. Making and living within a budget; and
h. Mortgages, retirement savings, and investments.
Upon written request, the state superintendent may allow a school district annually to select courses other than economics or problems of democracy for purposes of
exposing students to the concepts of personal finance, as listed in this section, provided the school district can demonstrate that the number of students exposed to the concepts in
the other selected courses would meet or exceed the number of students exposed under the requirements of subsection 1. The requirements may be provided by the regular classroom teacher of the course in which the concepts of personal finance are incorporated.

For 2009-10, requries 180 days in the calendar, with 173 days used for instruction. Three must be used for holidays; up to two must be used for parent-teacher conferences or compensatory time for conferences held outside school day; and two days must be used for professional development. For 2010-11, requires at least 181 days in the calendar. 174 days must be used for instruction; three days for holidays; up to two days must be used for: 1) Parent-teacher conferences; or (2) Compensatory time for parent-teacher conferences held outside of regular school hours; and d. Two days must be used for professional development. Sec. 5 defines a full day of instruction as at least 5.5 hours for kindergarten and elementary students and at least six hours for high school students.
Beginning with the 2011-12 school year, requires districts to provide a school calendar of at least 182 days.
a. 175 must be used for instruction; b. Three must be used for holidays, c. Up to two days must be used for: (1) Parent-teacher conferences; or (2) Compensatory time for parent-teacher conferences held outside of regular school hours; and d. Two days must be used for professional development.
4. A day for professional development must consist of: a. Six hours of professional development, exclusive of meals and other breaks, conducted within a single day; or b. Two four-hour periods of professional development, exclusive of meals and other breaks, conducted over two days.
5. If a school district offers a four-hour period of professional development the district may schedule instruction during other available hours on that same day and be credited with providing one-half day of instruction to students. This subsection does not apply unless the one-half day of instruction equals at least one-half of the time required for a full day of instruction, as defined in this section.
Beginning with the 2010-11 school year, if a district elects to provide an optional third day of professional development, the school district shall do so by: a. Meeting the requirements for a day of professional development as set forth in subsection 4; or b. Shortening four instructional days, for the purpose of providing for two-hour periods of professional development, provided: (1) Each instructional day on which such professional development occurs includes at least four hours of instruction for kindergarten and elementary students and
four and one-half hours for high school students; (2) The instructional time for each course normally scheduled on that day is reduced proportionately or the daily schedule is reconfigured to ensure that the same course is not subject to early dismissal more than one time per school calendar, as a result of this subdivision; and (3) All teachers having a class dismissed as a result of this subdivision are required to be in attendance and participate in the professional development.

Establishes procedures for how the Council will approve grants.

a. Also requires the state board of higher education to collaborate with the information technology department to coordinate higher education information technology planning with statewide
information technology planning and to provide advice to the information technology department regarding the development of policies, standards, and guidelines relating to
access to or use of wide area network services. Requires the state board of higher education to present information regarding higher education information technology planning, services, and major projects to the information technology committee on request of the committee.

A second new section prohibits the northern tier network, part of a national research network infrastructure, from replacing any wide area network services to any city, county, or school district which are provided by the information technology department. Prohibits the North Dakota university system from using the northern tier network infrastructure for traditional internet, voice, video, or other telecommunications services beyond those required for research networks. The North Dakota university system or any entity associated with the university system
may not resell any portion of the northern tier network infrastructure to nonuniversity entities other than research collaborators. Requires the North Dakota university system to provide a comprehensive biennial report of northern tier network activities for the 2007-09 biennium and must submit to a biennial audit of the northern tier network activities beginning with the 2009-11 biennium.

program of instruction for students who are English language learners. The program may be provided
by a school district or in conjunction with one or more districts.
Program establishment. The superintendent of public instruction shall:
1. Appoint a state advisory committee to assist with the establishment and administration of
English language learner programs and the state English language proficiency
assessment;
2. Establish standards for English language learner programs;
3. Ensure that the English language learner programs use effective research-based methods
to teach the students;
4. Assist school districts with the development and administration of English language learner
programs and services;
5. Employ a program administrator and other necessary personnel; and
6. Coordinate federal, state, and local funding to maximize the services available to students.
English language learner services - Individualized plans. If a school district determines
through assessment that a student requires English language learner services, the school district shall
convene a team to review the student's language and educational needs. The team may develop an
individualized language plan and recommend specialized language instruction and related services.

If school districts participating in joint powers agreements wish to receive reimbursement for expenses, as provided in section 19 of this Act, the school districts must request that the superintendent of public instruction approve their joint powers agreement. In order for the superintendent of public instruction to approve a joint powers agreement, the superintendent shall determine and annually verify that:
1. a. The participating school districts are contiguous; and b. (1) The total land mass of the participating school districts exceeds 4000 square miles [1035995 hectares];

To teach grades 7-12, an individual must be licensed to teach by the education standards and practices board and must: 1. Have a major equivalency in the areas taught by the individual and defined by the educational standards and practices board as core academic areas; or 3. Have a major, a major equivalency, a minor, or a minor equivalency in each area taught by the individual and not defined by the education standards and practices board as a core academic area.
A specialty teacher (art, business education, computer education, a foreign language, music, physical education, and special education) at any grade level from 1-8, may teach provided the individual:
a. Is licensed to teach by the education standards and practices board;
b. Is approved to teach in that area by the education standards and practices board; and
c. Meets all requirements set forth in rule by the superintendent of public instruction.
2. An individual may teach Native American languages provided the individual is an
eminence credentialed teacher.
3. An individual may teach in the areas of trade, industry, technical occupations, or health
occupations, provided the individual has been issued a license to teach in such areas by
the education standards and practices board.

Relates to assessment of public school students in reading, mathematics and science. From the Fiscal Note: SB 2065 requires the state to develop and implement state assessments in reading/English language arts, mathematics, and science in identified grades as established by a specified schedule. The fiscal impact from SB 2065 falls entirely on the state. School districts are responsible for the administration of the state assessments within their proscribed instructional periods; therefore, there are no additional costs that impact local schools.

A student's parent may apply to a contiguous school district for admission of the student at any time during the school year if: a. The student was a victim of violence occurring within the school in which the student was enrolled and the violence was documented; b. The superintendent of public instruction has declared the school in which the student was enrolled to be an unsafe school; or c. The superintendent of public instruction has identified the school in which the student was enrolled as one that requires program improvement for six consecutive years.
2. The school district receiving an application under subsection 1 shall review the application to ensure compliance with the provisions of subsection 1 and shall notify the student's parent and the student's school district of residence of the arrangements for the student's transfer within five days from the date the application was received. 3. The student's school district of residence shall consider the student transferred as of the date of enrollment by the admitting district. 4. Upon transfer of a student under this section, the board of the admitting district and the
board of the student's school district of residence shall enter into a tuition agreement. A school district participating in an open enrollment program may not give or offer to give a student remuneration, or directly or indirectly exert influence on the student or the student's family, in order to encourage participation in the open enrollment program. For purposes of this subsection, directly exerting influence means providing information about the school district to individuals who are not residents of that district unless the information is requested. If the members of the board of a school district believe that another school district has violated this subsection, the board may file a complaint with the superintendent of public instruction. Upon receipt of a complaint alleging a violation of this subsection, the superintendent of public instruction shall hold a hearing and accept testimony and evidence regarding the complaint. If the superintendent finds that a school district has violated this subsection, the superintendent may withhold some or all of the transportation aid payments to which the district would be otherwise entitled for a
period of one year from the date of the finding. A decision by the superintendent under this subsection is appealable to the state board of public school education. A decision by the state board of public school education is final.

The bill removes the requirement that a person seeking resident tuition by virtue of his/her guardian or parent's residency be less than eighteen years of age. The parent or guardian must be a legal resident of the state and have resided in North Dakota for twelve months. Previously, any student who graduated from a North Dakota high school would satisfy the requirements for resident tuition. The bill limits that scope to students who have graduated from a North Dakota high school within six years of beginning of the academic term. The bill grants resident tuition status to spouses and dependents of employees who work for any institution of higher education of the state. Prior to the bill, only spouses and dependents of an instructor who lives and teaches in North Dakota institution of higher education would qualify for resident tuition.

If an individual has been licensed to teach in North Dakota for a period of thirty years, the education standards and practices board shall grant the individual lifetime licensure. Nothing in this section precludes the board from taking any action against an individual's lifetime license if the board determines that the action is warranted under this chapter.
