Defines "education entity" as a school district, an education service district, a community college district or community college service district, the Oregon University System or public university thereof, and the health professions and graduate science programs of the Oregon Health and Science University. Prior to the beginning of each fiscal year, directs the governing body of each education entity to enter into an achievement compact with Oregon Education Investment Board for the fiscal year. Directs the board to establish the terms for achievement compacts, but specifies terms that achievement compacts may include. Requires the governing body of each education entity to identify a target number and percentage of students for achievement of the outcomes (both aggregate and by student subgroup), measures of progress and goals specified in the achievement compact for the fiscal year. Permits the board to adopt a timeline and method for governing boards of education entities at the end of the fiscal year to report achievements made. Provides certain waivers for purposes of entering into achievement compacts.
Requires each school district and education service district to form an achievement compact advisory committee to develop an achievement compact and ensure the achievement compact is implemented. Establishes membership and duties of achievement compact advisory committees. Permits state associations representing educators, administrators and school districts and education service district board members to develop and recommend
to the Oregon Education Investment Board (1) collaborative models and resources, including professional development opportunities, that may be used by districts and achievement compact advisory committees for the achievement of student success, and (2) processes for collaboration in the development of achievement compacts for their institutions, including professional development opportunities, for the achievement of student success.
Repeals these provisions effective July 1, 2015.
Directs the Oregon Education Investment Board to work with the Quality Education Commission to identify best practices for school districts and the costs and benefits of the adoption of those best practices by school districts.

Revises the purpose of the Early Learning Council to ensuring that children enter school ready to learn, determines responsibilities, membership and term limits and establishes the Early Learning Council Fund. Abolishes the State Commission on Children and Families and its Account and transfers of duties, functions and powers to the Early Learning Council and the Youth Development Council. Abolishes the Commission for Child Care and Account and trasfers duties, functions and powers to the Early Learning Council. Provides that for the purpose of furthering the mission of the Oregon Education Investment Board to oversee a unified public education system, the Chief Education Officer has direction and control over specified positions, including the commissioner for community college services, the chancellor of the Oregon University System, the executive director of the Oregon Student Access Commission, the early childhood system director, the executive director of the higher education coordinating commission and the deputy superintendent of public instruction. Clarifies that the Chief Education Officer's authority does not include the authority to appoint or remove a person from any of the aforementioned positions. Calls on the Higher Education Coordinating Commission shall work with the State Board of Higher Education, community college districts and independent for-profit and not-for-profit institutions of higher education carry out the goal of increasing the number of students who receive academic credit for prior learning through a variety of avenues. "Prior learning" is defined by the knowledge and skills gained through work and life experience, through military training and experience and through formal and informal education and training from institutions of higher education in the United States and in other nations. An annual report on the progress of meeting the goals should be submitted no later than December 1 of each calendar year.
Provides that the Higher Education Coordinating Commission will prepare a report for the Legislative Assembly that proposes a partnership with Western Governors University,
an on-line, competency-based university to provide enhanced postsecondary access and financial aid, and submit a report to the legislature by November 1, 2012.

Expands definition of a public/private official for purposes of reporting abuse or sexual abuse to include an employee of a higher education institution and a coach, assistant coach or trainer of an amateur, semiprofessional or professional athlete, if compensated and if the athlete is a child, as well as an official working for the following public or private organization providing child-related services or activities: youth groups or centers, scout groups or camps, summer or day camps, survival camps or groups, centers or camps that are operated under the guidance, supervision or auspices of religious, public or private educational systems or community service organizations. Excluded from the list of organizations are: community-based, nonprofit organizations whose primary purpose is to provide confidential, direct services to victims of domestic violence, sexual assault, stalking or human trafficking.
Makes reporting and other policies previously applicable only to child abuse applicable to adult victims as well. Provides that students, in addition to school employees, can be perpetrators of abuse and sexual conduct.
Requires reports of abuse or sexual conduct to be immediately given to the school board's designated person to receive such reports, and removes supervisors from that option. Provides that if a public or private official reasonably believes that the information is already known by a law enforcement agency or the Department of Human Services and that the duty to report under this section is personal to the public or private official alone, regardless of whether the official is employed by, a volunteer of or a representative or agent for any type of entity or organization that employs persons or uses persons as volunteers who are public or private officials in its operations.

(1)Establishes the Task Force on Accountable Schools, consisting of 14 members appointed as follows: (a) President of the Senate is to appoint two members from the Senate; (b) the Speaker of the House is to appoint two members from the House; (c) The President of the Senate and the Speaker of the House will jointly appoint: two members who are school district superintendents; two members who are school administrators; two members who are teachers; one member from a professional education organization; one member representing the Department of Education; and two members from education advocacy groups.
(2) The task force is to develop a plan to improve accountability practices for schools.
(3) The task force is to recommend: (a) A new student summative assessment to be used in schools that is based on a national standard and occurs as required by federal law. (b) Measures of college and career readiness to be used in which evaluate: advanced course and dual enrollment completion; national and state assessment results; dropout and graduation rates; postsecondary educational participation; and programs to close any achievement gaps. (c) A statewide standardized simple performance report and rating system based on letter grades that includes: Absolute student achievement and growth; school trends over time; and comparisons to similar schools. (d) Implementation of formative testing and instructionally useful student performance data systems for student achievement; (e) Tools, resources and targeted assistance forschools needing assistance to meet state standards.
(4) A majority of the voting members of the task force constitute a quorum for the transaction of business.
(5) Official action by the task force requires the approval of a majority of the voting members of the task force.
(6) The task force is to elect one of its members to serve as chairperson.
(7) If there is a vacancy for any cause, the appointing authority is to make an appointment which is to be immediately effective.
(8) The task force is to meet at the time and places specified by the call of the chairperson or of a majority of the voting members of the task force.
(9) The task force may adopt rules necessary for the operation of the task force.
(10) The task force is to submit a report that includes recommendations for legislation to an interim committee of the legislative assembly related to education no later than January 1, 2012.
(11) The legislative administration committee is to provide staff support to the task force.
(12) Non-legislative members of the task force are not entitled to compensation or reimbursement for expenses and serve as volunteers to the task force.
(13) All agencies of state government are directed to assist the task force in the performance of its duties.

Directs the board to submit a report to the interim legislative committees on education by December 15, 2011 to describe legislative measures to provide for any of 6 specified approaches.
Establishes the Early Learning Council to assist the board in overseeing a unified system of early childhood services, including the funding and administration of those services. Directs the board to conduct an analysis of plans to merge, redesign or improve the coordination of early childhood services and to align early childhood services with child-centered outcomes. Directs the council to establish a plan to implement early childhood services that could be implemented by June 30, 2012 to achieve specified goals.
Repeals these provisions effective March 15, 2016. Allows certain school districts of an education service district to withdraw from the education service district. Requires the education service district to distribute to school districts that withdrawn the school district's prorated amount of specified funds available to the education service district. Reduces the amount of distribution to education service districts in 2011-12 and 2012-13. Directs that the withdrawing school district receive 90% of the district's prorated share of specified funds available to an education service district.
The measure creates the Office of Regional Education Services (ORES) under the direction and control of the State Board of Education, with a director of the ORES selected by the superintendent of public instruction. The ORES is directed to establish best practice policies, benchmarks, provide training and support to ESD superintendents, and make recommendations. The ORES director is allowed to enter into contracts necessary to perform the duties required by the measure. The measure establishes a formula for an amount to be transferred from the State School Fund to the Regional Education Services Account each fiscal year beginning in 2011-12. The measure provides that the ORES may expend no more than $500,000 per biennium from the account and that access monies in the account must be transferred back to the State School Fund on June 30 or each odd-numbered year for distribution to school districts. Authorizes the Oregon Student Assistance Commission to establish Access to Student Assistance Programs in Reach of Everyone (ASPIRE) to provide information about financial aid and education and training options beyond high school to students in Oregon secondary schools. The goals of the programs are to: (a) Provide mentoring and resources to help students access education and training beyond high school; (b) Help high schools build a sustainable community of volunteer mentors; and (c) Educate students and families about the scholarship application process and other options for paying for post-secondary education. The programs are to bring together students, school staff, community volunteers and parents to help students overcome obstacles to their continuing education. The programs may provide training, technical assistance and other resources to Oregon high schools on how to establish a volunteer-based program. Adult volunteers who are trained through the program may provide mentoring, training and encouragement to students about postsecondary options and financial aid.

Abolishes Certificate of Initial Mastery and Certificate of Advanced Mastery. From the staff summary: The Certificate of Initial Mastery (CIM) and Certificate of Advanced Mastery (CAM) were originally included in the Oregon Educational Act for the 21st Century in 1991, but the exact requirements and implementation dates were changed and/or delayed during several successive legislative sessions. The CIM represents standards of knowledge and skill proficiencies that students can demonstrate in English, mathematics, and science and are benchmarked to the 10th grade level. The CAM combines achievement of the CIM with additional academic proficiencies and career-related proficiencies achieved through a variety of hands-on, real-world learning experiences. HB 2263C abolishes the CIM and CAM but keeps the associated academic content standards and assessments. According to the Department of Education, many sections of the law removed by HB 2263C were never funded or implemented. Local school districts were required to make available components of the CIM but it was never required statewide for graduation (although some individual school districts did incorporate a modified CIM into local graduation requirements). The CAM is still not available to all students as the full implementation date is September 2008. The State Board of Education adopted new high school diploma requirements in January 2007.
Allows school districts to prepare budgets annually or biennially. Allows assessments for a specific group of students to be waived or allows a student to request that a school district waive assessment. Allows a school district to award an alternative credential to a student who does not satisfy the requirements if the student, with additional services and accommodations, does not satisfy the requirements for a diploma. Directs department to contract with nonprofit entity to administer, with department, nationally-normed assessment to all grade 10 students to predict success of students on college entrance exams. Provides contractor selection criteria. Requires provision of assessment during 2008-2009 school year. The purpose of the assessment is to predict the success of students on, and provide practice for students taking, college entrance exams; to identify students with high potential to excel in advanced placement (AP) or other honors courses based on a research-based correlation of scores on the grade 10 assessment to advanced placement examinations; to examine students in mathematics, reading and writing; and to provide results that can be used by Oregon's higher education institutions to recruit students to attend college.
Also modifies Early Childhood Improvement Program. Eliminates Learning Centers, Oregon 21st Century Schools Program, School Improvement and Professional Development Program, and Statewide Literacy Hotline.

To be eligible for an Approved NCLB Alternative Route License, the applicant must:
(a) Hold a bachelor's degree; (b) Demonstrate core academic subject matter competency by: (A) Passing the TSPC approved rigorous state test required for the grade-level and subject-matter area; or (B) Holding an undergraduate major or coursework equivalent in the core academic subject in the teaching area (does not apply to elementary authorizations); or (C) Holding a graduate degree in the core academic subject in the teaching area (does not apply to elementary authorizations). Per federal law:
(a) Teachers on the Approved NCLB Alternative Route Teaching License are considered highly qualified for only three years; and (b) The license is not renewable and is not eligible for any extension. Teachers who have taught on a Restricted Transitional License for one-year or less, upon application with a district may be eligible for the Approved NCLB Alternative Route Teaching License provided the requirements of section (8)(a) and (b) of this rule are met.
Makes changes regarding Highly Qualified Teachers, the High ObjectiveUniform State Standard of Evaluation (HOUSSE) standards, and No Child Left Behind to meet federal requirements. Teachers new to the profession teaching core academic subjects in grades seven (7) and eight (8) in an Oregon middle or junior high school must meet the following criteria in order to meet the federal definition of "highly qualified teacher." The teacher must:
(1) Hold a Basic, Initial, Approved NCLB Alternative Route Teaching License or Preliminary Teaching License in any one of the core academic areas and satisfy one of the following: (a) Pass a rigorous state exam in the core academic subject matter area; or (b) Hold an undergraduate major in the subject core academic matter area; or (c) Hold a graduate degree in the core academic subject matter area; or (d) Complete coursework equivalent to an undergraduate majoring the core academic subject; and (e) Be properly assigned in the core academic subject matter area in grades seven (7) or eight (8).
(2) Teachers on an approved conditional assignment permit for any core academic subject are not considered highly qualified under any circumstances. Similar provisions apply to teachers not new to the profession.

Conforms to law changes made by HB 3184. HB 3184 affects the education service delivery of Education Service Districts (ESDs). There are four main components.
Reduces the money that ESDs receive from the State School Fund from the current 5% of the State School Fund to 4.75%, and changes the minimum funding amount for ESDs from $1 million to $950,000. These reductions begin in the 2006-07 State School Fund distribution.
The measure also defines core services to be provided by ESDs to component school districts and requires ESDs and component school districts to develop local service plans.
HB 3184 specifies under what circumstances an ESD may provide entrepreneurial services. Those circumstances are as follows: the services are part of the local service plan; the services are provided pursuant to a business plan; and the primary purpose of the services is to address a need of component school districts.
The bill also establishes a changed governance structure for ESD boards for three pilot districts: Willamette ESD, High Desert ESD, and Northwest ESD.

Amends ORS 332.114. In order to receive a high school diploma from a school district, a student must meet the requirements established by the State Board of Education and, while in grades 9 through 12, must complete:
(a) At least 24 credit hours, as defined by rule of the board;
(b) Three years of mathematics; and
(c) Four years of English.
(2) Notwithstanding subsection (1) of this section, a school district may award a diploma to a student who does not meet the requirements of subsection (1)(b) or (c) of this section if the student:
(a) Has met or exceeded the academic content standards for mathematics or English established by the board; or
(b) Displays proficiency in mathematics or English at a level established by the board.
The requirements of section 1 of this 2005 Act apply to students who receive a high school diploma from a school district on or after July 1, 2009.

Requires education service districts to provide regionalized core services to component school districts. The goals of these services are to:
(a) Assist component school districts in meeting the requirements of state and federal law;
(b) Improve student learning;
(c) Enhance the quality of instruction provided to students;
(d) Provide professional development to component school district employees;
(e) Enable component school districts and the students who attend schools in those districts to have equitable access to resources; and
(f) Maximize operational and fiscal efficiencies for component school districts.
(2) The services must be provided according to a local service plan developed by the education service district and component school districts. Services goals must include Programs for children with special needs, including but not limited to special education services, services for at-risk students and professional development for employees who provide those services; technology support; school improvement services for component school districts; administrative and support services for component school districts; other services that an education service district is required to provide by state or federal law.
(3) In addition to the services specified, a local service plan may include other services that are designed to meet regional needs.
(4) A local service plan must also contain annual performance measures for the education service district.
(5) A local service plan must: (a) Be adopted by the board of the education service district. (b) After being adopted, be approved on or before March 1 by resolution of two-thirds of the component school districts.
Allows an education service district to provide entrepreneurial services and facilities to public and private entities and to school districts that are not component school districts of the education service district (on contract or under reimbursable conditions) under certain conditions.
Allows for a pilot education service district.

Creates the Oregon Virtual School District within the Department of Education. The purpose is to provide online courses to kindergarten through grade 12 public school students. Requires online courses to meet academic content standards meet other criteria adopted by the state board. Teachers must be properly licensed or registered. All school districts and public charter schools may allow students
to access the online courses offered by the Oregon Virtual School District. Allows the Superintendent of Public Instruction to contract with education service districts, school districts, public charter schools, community colleges, state institutions of higher education or any other public entity to provide online courses through the Oregon Virtual School District.
Statutes and rules that apply to other school districts do not apply except as provided under this section or by rule of the state board. The Oregon Virtual School District is not considered a school district for purposes of apportionment of the State School Fund and the department may not receive a direct apportionment from the State School Fund for the Oregon Virtual School District. Allows the board to adopt the rules necessary for the administration of the Oregon Virtual School District and requires the board to adopt rules to establish:
(a) The procedure and criteria to be used for the selection of online courses to be offered through the Oregon Virtual School District;
(b) The qualifications of students who may access online courses through the Oregon Virtual School District;
(c) The number of credits for which students may access online courses through the Oregon Virtual School District; and
(d) The student-to-teacher ratio for online courses offered through the Oregon Virtual School District.
Requires reports to the legislature.
if a public charter school offers any online courses as part of the curriculum of the school, then 50 percent or more of the students
who attend the public charter school must reside in the school district in which the public charter school is located.
Transfers $2 million into the fund.

Creates the Oregon Innovation Council to provide advice to the Governor, the Legislative Assembly, public and private post-secondary educational institutions, public agencies that provide economic development and the private sector on issues related to:
(a) Promoting agreements between public and private post-secondary educational institutions and private industry that increase technology transfer and the commercialization of research;
(b) Promoting investment in specialized research facilities and signature research centers where Oregon has a distinct or emerging advantage for creating new products and businesses;
(c) Stimulating seed and start-up capital investment and entrepreneurial capacity that will promote economic growth in Oregon traded sector industries;
(d) Developing the entrepreneurial and management capacity critical to the competitiveness of Oregon traded sector industries and rapidly growing global markets;
(e) Enhancing the international competitiveness of Oregon traded sector industries; and (f) Identifying workforce issues for occupations critical to the competitiveness of Oregon traded sector industries, including but not limited to scientific, engineering, information technology and business management occupations.
(2) The Oregon Innovation Council shall advise the Engineering and Technology Industry Council on how to coordinate the Engineering and Technology Industry Council¢s goals and policies with the state plan developed under section 5 of this 2005 Act.
(3) The council, the Oregon Economic and Community Development Commission, the State Board of Higher Education and the office of the State Treasurer shall coordinate policies and programs related to the duties of the council.
(4) Based on the state plan developed under section 5 of this 2005 Act, the council may distribute moneys in the Oregon Innovation Fund by grant or pursuant to contracts with public and private post-secondary institutions, state agencies and private sector entities.
SECTION 5. (1) The Oregon Innovation Council shall develop a state plan for innovation and economic competitiveness.

Purposes of sections 1 to 20 of this 2005 Act are to:
(1) Create a seamless education system for students enrolled in grades 11 and 12 to: (a) Have additional options to continue or complete their education; (b) Earn concurrent high school and college credits; and (c) Gain early entry into post-secondary education.
(2) Promote and support existing accelerated college credit programs, and support the development of new programs that are unique to a community¢s secondary and postsecondary relationships and resources.
(3) Allow eligible students who participate in the Expanded Options Program to enroll full-time or part-time in an eligible post-secondary institution.
(4) Provide public funding to the eligible post-secondary institutions for educational services to eligible students to offset the cost of tuition, fees, textbooks, equipment and materials for students who participate in the Expanded Options Program.

Requires that initial charters be in effect for a period of not more than five years and are to be renewed upon the authorization of the sponsor. The first renewal of a charter are for the same time period as the initial charter. Subsequent renewals of a charter are for a minimum of five years but may not exceed 10 years. The renewal of a charter shall use the process required by this section. Renewals must follow the following process:
-- The public charter school governing body is to submit a written renewal request to the sponsor for consideration at least 180 days prior to the expiration of the charter.
-- Within 45 days after receiving a written renewal request from a public charter school governing body, the sponsor must hold a public hearing regarding the request for renewal.
-- Within 10 days after the public hearing, the sponsor must notify the public charter school governing body of the sponsor¢s intent about the renewal of the charter.
-- Within 20 days after the public hearing, the sponsor must approve the renewal of the charter or state in writing the reasons for denying the renewal of the charter.
-- If the sponsor approves the renewal of the charter, the sponsor and the public charter school governing body are to negotiate a new charter within 90 days after the date on which the sponsor approved the renewal of the charter unless the sponsor and the public charter
school governing body agree to an extension of the time period.
-- If the sponsor does not renew the charter, the public charter school governing body may address the reasons stated under paragraph (e) of this subsection and any remedial measures suggested by the sponsor and submit a revised request for renewal to the sponsor.
-- Notwithstanding other provisions, a sponsor and a public charter school governing body may agree in the charter of the school to a timeline for renewing the charter that is different from the timeline required by paragraphs (b) to (g) of this subsection.
-- If the sponsor does not renew the charter based on the revised request for renewal, the public charter school governing body may appeal the decision of the sponsor to the state board for a review of whether the sponsor used the process required by this section in denying the renewal of the charter.
-- If the board finds that the sponsor used the process required by this section in denying the request for renewal, the board is to affirm the decision of the sponsor. A public charter school governing body may seek judicial review of an order of the board.
-- If the board finds that the sponsor did not use the process required by this section in denying the request for renewal, the board must order the sponsor to reconsider the request for renewal.
-- If after reconsideration the sponsor does not renew the charter, the public charter school governing body may seek judicial review of an order of the sponsor.
-- If the board is the sponsor of a public charter school and the board does not renew the charter based on the revised request for renewal, the public charter school governing body may seek judicial review of whether the board used the process required by this section in denying the request for renewal.
-- The sponsor is required to base the charter renewal decision on a good faith evaluation of whether the public charter school: (A) Is in compliance with this chapter and all other applicable state and federal laws; (B) Is in compliance with the charter of the public charter school;
(C) Is meeting or working toward meeting the student performance goals and agreements specified in the charter or any other written agreements between the sponsor and the public charter school governing body; (D) Is fiscally stable; and (E) Is in compliance with any renewal criteria specified in the charter of the public charter school.
-- The sponsor must base the renewal evaluation primarily on a review of the public charter school¢s annual performance reports,
annual audit of accounts and annual site visit and review and any other information mutually agreed upon by the public charter school governing body and the sponsor.

Allows any student to refuse to dissect any vertebrate or invertebrate animal or the parent or legal guardian of a public school student to refuse to allow the student to dissect any vertebrate or invertebrate animal. A school district that includes dissection as part of its coursework must permit students to demonstrate competency in the coursework through alternative materials or methods of learning that do not include the dissection of animals. These alternative materials and methods may include but are not limited to: (a) Videotapes, DVDs and CD-ROMs;

Adds interpreting services, social work services, and school nurse services designed to enable a child with a disability to receive a
free appropriate public education as described in the individualized education program of the child. Clarifies that "Related services" does not include a medical device that is surgically implanted or the replacement of a medical device that is surgically implanted. Requires districts to reevaluate each child with a disability in accordance with rules adopted by the State Board of Education and to ensure that an individualized education program is developed, reviewed and revised for each child with a disability. Amends hearing procedures. Allows districts to order a change in placement to an appropriate interim alternative educational setting for up to 45 school days without regard to whether the behavior is determined to be a manifestation of the child¢s disability because the child has inflicted serious bodily injury upon another person while at
school, on school premises or at a school function under the jurisdiction of the Department of Education or school district; and adds an additional reason: If school personnel order a change in placement to an interim alternative educational setting for more than 10 school days for a child with a disability who violates a code of student conduct and the behavior that gave rise to the violation is determined not to be a
manifestation of the child¢s disability. Allows school personnel to consider any unique circumstances on a case-by-case basis when determining whether to order a change in placement for a child with a disability who violates a code of student conduct. Amends membership of the State Interagency Coordinating Council. Prohibits personnel or teachers from requiring a child to obtain a prescription for a substance covered by the Controlled Substances Act, 21 U.S.C. 801 et seq., as a condition of attending school, receiving an evaluation to determine eligibility for early childhood special education or special education or receiving early childhood special education or special education services.

From Staff Measure Summary (Fiscal Note): A person desiring to conduct business as an athlete agent in the State of Oregon is required to obtain an athlete agent permit from the Department of Education. The permit for the athlete is for one year and the applicant must pay a non-refundable fee, attest they have not been convicted of any crime listed in ORS 342.143, and submit to a criminal background check.
House Bill 3179-A modifies the current statute and establish the Uniform Athlete Agents Act which provides for the uniform registration, certification, and background check of sports agents seeking to represent student athletes who are or may be eligible to participate in intercollegiate sports. The bill would impose specified contract terms on the agreements and provide educational institutions with the right to notice along with a civil cause of action for damages resulting from a breach of specified duties. The bill would also require the agents to disclose their training, experience, and education, whether they or an associate have been convicted of a felony or crime of moral turpitude,

Authorizes the City of Hillsboro to establish for the 2005-2006 and 2006-2007 school years the pilot program of Cyber Awareness, Responsibility and Ethics (CARE). If the City of Hillsboro establishes the pilot program:
(a) The goal of the pilot program is to help students who are 8 to 10 years of age become safe and responsible citizens of the cyber community. To meet this goal, the City of Hillsboro through the pilot program shall encourage: (A) Partnerships between school districts and local law enforcement agencies to have members of local law enforcement agencies act as mentors and provide focus, oversight and
guidance in the classroom; and (B) Peer teaching among students.
(b) A school district may notify the City of Hillsboro that the school district would like to participate in the pilot program. A notice provided by a school district under this subsection must include the following information:
(A) How the school district will implement the pilot program;
(B) How the activities of the school district under the pilot program will help the school district implement the Children¢s Internet Protection Act (P.L. 106-554);
(C) How the school district will encourage students to participate in the pilot program;
and
(D) Which local law enforcement agencies will form partnerships with the school district.

New teachers must hold a basic, initial or preliminary teaching license. Establishes "Approved NCLB Alternative Route Teaching License." Upon filing a correct and complete application in form and manner prescribed by the Commission, a qualified applicant shall be granted an Approved NCLB Alternative Route Teaching License. (1) The application must be filed jointly by the hiring district and the teacher seeking the license. (2) Districts hiring a highly qualified teacher based on the Approved NCLB Alternative Route Teaching License must ensure that the license has been obtained by the teacher prior to assignment within the district. (3) The Approved NCLB Alternative Route Teaching License shall be restricted to use within the district that has jointly applied for it with the teacher. (4) The license is not transferable to another district. (5) The district must submit an approved plan with the licensee's application that describes how the teacher will receive high-quality professional development that is sustained, intensive and classroom-focused before and while teaching in the district. The plan must also include how the teacher will be making progress toward completing full state licensure requirements in the next three years. (6) The license expires exactly three-years from the date of issue and is not subject to the 120-day grace period.Should the teacher seek to obtain another Approved NCLB Alternative Route Teaching License with another district, the license is only valid for the remainder of the three years from the initial date of the license. Also establishes the Highly Objective Uniform STate Standard of Evaluation (HOUSSE) for teachers who have taught three years or more. Elementary HOUSSE standards: (A) Complete an approved elementary teacher education program or the coursework equivalent to sixty quarter hours distributed as follows: (i) Eighteen quarter or twelve semester hours in language arts; (ii) Twelve quarter or eight semester hours in mathematics; (iii) Nine quarter or six semester hours in science; (iv) Nine quarter or six semester hours in U.S. history, cultural geography, and other social sciences; (v) Three quarter or two semester hours in health education; (vi) Three quarter or two semester hours in physical education; (vii) Three quarter or two semester hours in music education; (viii) Three quarter or two semester hours in art education; or (B) Complete the TSPC Alternative Assessment procedure; or (C) Obtain a certificate as Early Childhood Generalist, Early Childhood Art, Early Childhood Music, or Early Childhood ESOL from the National Board for Professional Teaching Standards; or (D) Hold a Standard Elementary License; or (E) Hold a master's degree; and (c) Be properly assigned to a self-contained classroom in grades preprimary through eight.
