Modifies tax code to provide the means for low- and moderate-income students (185% of poverty) who reside in the attendance boundary of a low-achieving school, to apply for an opportunity scholarship to attend a participating public or private school. Funds may not be used to attend a career and technology center or charter schools (brick-and-mortar or cyber). Schools approved to receive students must charge scholarship students no more than their set tuition rate, and if necessary, must initiate a lottery to determine enrollment.

Businesses that donate to opportunity scholarship organizations are eligible for a tax credit through the program. Defines and establishes parameters for a "scholarship organization." Requires reports from such organizations that include total number of applications received, total and average amounts of scholarships awarded, total number of applications processed and amounts of application fees charged -- either per application or in the aggregate through a third-party processor; and tax status. For 2012-2013, a business tax credit cannot exceed $400,000 annually per firm; for 2013-2014 and thereafter, the tax credit cannot exceed $750,000 annually per business firm. Requires the Department of Revenue to grant a tax credit of up to 90% of the total amount contributed if the business provides a written commitment to provide the scholarship organization with the same amount of contribution for two consecutive tax years. Defines a "pass-through" entity (pg. 91).

Sets eligibility requirements for scholarship applicants, including 185% of the Federal poverty level. Excludes home schooled students and prohibits scholarships for students who have been recruited for athletic purposes. Maximum scholarship awards: $8,500 except for a student with a disability ($15,000). Grant amounts for students who attend or will attend a nonpublic school cannot exceed the amount of the per pupil subsidy of the school district of residence. Allows districts to establish a program of tuition grants to provide for education of students who reside within the district and attend or will attend a public or nonpublic school on a tuition-paying basis. A student receiving a grant to attend a public school is counted in average daily membership for purposes of funding, except when a student attends a public school outside the school district (included in the ADM of the school district the student attends). Requires that transportation be provided and reimbursed. Participating schools are not required to accept a student if it does not offer appropriate programs or is not structured or equipped with the necessary facilities to meet the special needs of the recipient.

Provides the Pennsylvania Supreme Court with exclusive and original jurisdiction to hear any challenge or to render a declaratory judgment concerning constitutionality.

This section adds new article VI-A converning school district financial recovery in all school districts other than Philadelphia. Requires the state department to develop and implement an early warning system plus guidelines to compile and analyze information on the financial condition of district to determine whether a district should be place in financial watch status. Sets parameters for when the Secretary of Education must issue a declaration of school district financial recovery status. No more than 9 districts may be under a declaration of financial recovery or in receivership at any time. Establishes other expectations and processes. Establishes a Financial Recovery Transitional Loan Program in the Department of Education and sets processes, procedures. Also requires the Department to annually prepare a report on the finances of Intermediate Units (IUs), including funds received and contracts and agreements executed.

Requires written contracts of employment for district superintendents and assistant superintendents and details mandatory requirements of those contracts. Places a cap on the amount of any severance agreement for a superintendent. Allows contracts to include written performance measures, mutually agreed upon by the school board and the superintendent. Makes contracts subject to the Commonwealth's Right-to-Know Law. Requires school boards to disclose at their next public meeting their reasons for termination if they have removed a superintendent or assistant superintendent from office.

Act 123 establishes a task force within the Department of Education on homeless children's education. Provides for its powers and duties and providing for administrative support.Requires the Task Force to conduct a study that includes:
(1)  A demographic survey of homeless parents and homeless youth.
(2)  An assessment of the difficulties in providing educational services to homeless students.
(3)  An assessment of barriers to serving the needs of preschool children experiencing homelessness, including access to early intervention services.
(4)  An assessment of successful strategies for serving homeless students, including strategies for informing parents, homeless shelters, students and school districts of the educational services available to homeless students.
(5)  An assessment of best practices used in other states to educate homeless students.
(6)  Recommendations regarding the collection and use of data currently collected by the department.

Creates professional and temporary employment pool for employees from a district where students have been reassigned to another district. Employees in the pool must be offered employment by an district receiving students who have been reassigned to whenever that district has a vacancy that a pool employee is certified to fill. The district receiving students may not hire any new employee until the position has been offere, in order of seniority, to all certified members of the pool. Employees hired from the pool are to be credited with all accumulated sick leave and years of service for the purpose of salary schedule placement.

Provides that one year after a contract impasse, the Secretary of Education may request a public hearing in the school district of impasse. Requires the hearing to include testimony from the board, administration, employee organization and any other party requested by the Secretary. Requires the public to have 30 days to submit written testimony and allows from testimony from experts commenting on the social, emotional and educational well being of students in the district. Requires the Secretary to issue a report on recommendations regarding the impasse 90 days following the hearing.

Section 1704-B continues provisions of the Empowerment Act that were scheduled to expire June 30, 2012. A Commonwealth Partnership School District is authorized to: 1) cancel or renegotiate any contract, other than collective bargaining agreements, for the purpose of making necessary economies in the operation of schools; 2) reassign, transfer, or suspend administrators, mainly principals, based on an unsatisfactory review and evaluation without considering seniority or providing for a hearing; and 3) dispose of unused and unnecessary lands and buildings in excess of 25 years in age by negotiated sale, provided experts verify the value is equal to or greater than what could be received by sealed bid or by entering into agreements with an urban redevelopment authority. A Commonwealth Partnership School District is defined as a district that the Secretary of Education determined on or after July 22, 2006, and not later than September 9, 2006 to have met the following criteria: (1) a decline of 15% or more in enrollment during the preceding five years; (2) a loss in revenue during the immediately preceding three years due to the statutory removal of one or more sources of revenue; and (3) a 2004-2005 equalized millage rate greater than 27. The School District of Pittsburgh is the only district designated as such.

Section 1123 requires the Secretary of Education--by June 30, 2013--to create a rating tool to measure the performance of professional staff in all districts, intermediate units, area vocational-technical schools, charter schools, and cyber charter schools. Requires the classroom teacher rating tool to give consideration to classroom observation and practice related to student performance. Student performance will comprise 50% of the overall rating and must be based upon multiple measures of student achievement. The principal rating tool must give consideration to planning and preparation, school environment, delivery of service, and professional development. Student performance is to comprise 50% of the overall rating and must be based upon multiple measures of student achievement. The rating tool for non-teaching professionals must give consideration to planning and preparation, school environment, delivery of service, and professional development. Student performance in the building of the nonteaching professional will comprise 20% of the overall rating. Each rating tool must characterize performance as either distinguished, proficient, needs improvement, or failing. Professional employees are to be rated at least annually and temporary professionals at least twice annually.

Allows districts to enter into agreements with other political subdivisions to provide for the safety and security of the school. Defines as a cooperative agreement between districts which allows students to participate in courses not currently available in their resident district. Courses offered can be delivered outside of a regular school building in whole or in part using technology such as the Internet, video conferencing or other electronic means. Requires the cooperative agreement establishing an open campus initiative to outline the following policies: 1) grading; 2) credit; 3) promotion; 4) participation; 5) participation by students from nonparticipating school entities, including a fee schedule for determining tuition charges for those students; 6) use and distribution of tuition revenue; 7) discipline; 8) attribution of student data; 9) sharing of costs; 10) adding or removing courses.

A participating student and the student's parent must sign a form acknowledging they have received and reviewed an informational sheet based on these guidelines. A student athlete who exhibits signs or symptoms of sudden cardia arrest must be removed from play and may not return to play until he or she is cleared to do so, in writing, by a licensed physician, certified registered nurse practitioner, or cardiologist.

Increases the maximum amount of a contract before it must be put out for bids. Under current law, a district must seek written or phone price quotes from at least three contractors or suppliers for contracts over $4,000 but not more than $10,000. This increases those limits to $10,000 and $18,500, respectively. Increases point at which a district must advertise for bidders in a newspaper to $18,500. For projects costing $10,000 or less, districts could use their own maintenance staff. Provides that all these limits in the future increase based on the Consumer Price Index for All Urban Consumers, with an annual cap of 3 percent. Applies to all publc school entities, the Thaddeus Stevens College of Technology, and the universitites of the Pennsylvania State Sytstem of Higher Education.

Requires the Departments of Education and Health to develop and post on their websites guidelines and relevant materials to inform mand educate students concerning head injuries. The Departments are to inlcude information provided by the Centers fo rDisease Control and Prevention. A student participating in interscholastic athletics and the student's parent/guardian must sign a form acknowledging they have receive and reviewed these guidelines. A student athlete who exhibits signs or symptoms of a concussion must be removed from plan and may not return to play until her or she is cleared to do so, in writing, by an appropriate medical professional. Imposes penalties. Requires the state department of education to require all school entities to submit annual violence statistics and reports by July 31 of each year, verify corrective action plans, develop and update forms to be used by schools and police departments, verify that each school entity and local law enforcement agency has a memorandum of understanding (MOU), publish to the department's site a school safety annual report outlining all incidences of violence, make targeted grants to fund programs addressing school violence, implement an internet-based system for management of student discipline, and assist with staff training. Sections 1553, 2023 require the state department to develop a model dating violence policy to assist districts in developing their own policy for reporting purposes. Authorizes district to establish a policy to address incidents of dating violence (procedures, discipline, and statement that it will not be tolerated). Authorizes districts to provide training to school personnel. Allows districts to integrate age-appropriate dating violence education into health curriculum for grades 9-12. Article XX-G requires institutions of higher education and private licensed schools to establish a sexual violence awareness education program for attending students. Specific guidelines are required, including a follow-up program for the duration of the school year for new students and a report to the state department on the implementation of the program.

Sets the school finance distribution formula based primarily on what it will take for students to meet the state's academic standards. The amount is based largely on the findings of the 2007 Costing-Out Study. Provides for a transferring pupil's disciplinary record to be transmitted to the transferring public or private school, upon request. Provides for school employee background checks, budgets, classroom placement of twins, bullying, scholastic records, educational support, early learning programs, virtual high schools, charter schools, school transportation, educational empowerment districts, community colleges, educational improvement business tax credits, public records, libraries and special education.

EARLY CHILDHOOD EDUCATION 
The 2008-09 education budget invests $86.4 million in Pennsylvania Pre-K Counts, a 15 percent increase from 2007-08, to enable 800 more children to participate in the commonwealth's hallmark, voluntary pre-kindergarten initiative and to respond to parents' requests for more full-day enrollment opportunities among some of the existing half-day programs. 
CLASSROOMS FOR THE FUTURE 
The budget includes $45 million for technology and $15 million for professional development to continue the multi-year rollout of Classrooms for the Future.
SCIENCE: IT'S ELEMENTARY 
The effort to promote science learning in elementary schools will receive $14.5 million – a 7.4 percent increase – in 2008-09, enabling thousand of more students to benefit from this hands-on learning experience and be ready for higher-order science classes in middle and high school.
DUAL ENROLLMENT
Pennsylvania's Dual Enrollment program is designed to serve a wide-range of students, but particularly those who attend college at disproportionately low rates. The budget continues the $10 million in annual funding for Dual Enrollment, which allows high school students to take college courses through community colleges and four-year colleges and universities. By encouraging the participation of students who might otherwise be unlikely to attend college, the Dual Enrollment program helps ensure all students have the opportunity to earn a post-secondary degree and become self-sufficient, productive taxpayers.
HIGHER EDUCATION 
The budget continues to invest in the commonwealth's higher education institutions to offer affordable and accessible post-secondary education in Pennsylvania. State funding for student tuition grants through PHEAA will increase by $21.2 million, or 5.5 percent. The state's community colleges will receive a 3 percent operating increase. An additional $14.5 million will be provided to the State System of Higher Education to keep down tuition increases.

New state board regulations change high school graduation requirements to ensure the academic preparedness of high school seniors. These regulations institute a series of optional, end-of-course high school exams in the core academic areas of math, science, English and social studies. They are collectively known as Graduation Competency Assessments, or GCAs and will go into effect starting with the graduating class of 2014. Students will have a menu of ways to show they have the necessary skills in English, math, science and social studies to succeed in college and careers. These options include:
• Passing the new Graduation Competency Assessments.
• Passing the Pennsylvania System of School Assessment.
• Passing an Advanced Placement or International Baccalaureate test.

These provisions set parameters for how staff of a "distressed" district in which pupils have been reassigned to another district are to be hired. For example, employees go into a pool and are to be offered employment by bordering districts whenever there is a vacancy to fill, provided no employee within the district with the vacancy is certified to fill the position. Section 14 (Section 1607.1) gives the secretary authority to designate two or more districts that must accept on a tuition basis the high school students from a distressed district -- so long as the designated district's border is no more than three miles from the distressed district's border. (Defines as a district that has operated under a special board of control or has been placed on the education empowerment list.) Sets mechanisms for how high school students from distressed school districts are reassigned. Sets tuition rates for receiving districts and requires distressed districts to provide transportation. Section 16 (Section 1704.1-B) authorizes a district superintendent to recommend to the board of school directors dismissal of a management employee for unsatisfactory performance or wilful misconduct. Section 18 (Section 1707-B(b) is amended to change the membership of a board of control in an education empowerment district from five to seven residents of the district -- five of whom are appointed by the mayor and two elected by and from the members of the elected board of school directors.

Provides for exemptions from the head tax and earned income tax. Relates to local services taxes and collection by an employer. Provides for homestead and farmstead exclusions. Regulates tax rates. Deletes provisions regarding occupational privilege taxes. Notes that if a school district levied an emergency and municipal services tax, the school district may continue to levy the local services tax in the same amount the school district collected on the effective date of the subclause. However, if a municipality located in whole or in part within the school district subsequently levies the local services tax, the school district may only collect five dollars $5) on persons employed within the municipality each calendar year. A school district that did not levy an emergency and municipal services tax on the effective date of the subclause is prohibited from levying the local services tax. If a school district and a municipality located in whole or in part within the school district both levy a local services tax at a combined rate exceeding ten dollars ($10), the school district's pro rata share of the aggregate local services taxes levied on persons employed within the municipality is to be collected by the municipality or its tax officer based on payroll periods as provided under subclause (i) and is to be paid to the school district on a quarterly basis within sixty days of receipt by the municipality or its tax officer. A Pennsylvania Department of Health Program. Pre-existing school health regulations require that a school nurse or teacher conduct height and weight measurements of students annually and that every effort be made to determine the pattern of growth for each child. The revised procedures require the height and weight measurements to be used to calculate Body Mass Index (BMI) which is plotted on growth charts developed by the Centers for Disease Control and Prevention (CDC).  The revised procedures were voluntary for the 2004-2005 school year. Mandatory implementation begins in school year 2005-06 for grades K-4 and will expand to three additional grades each year thereafter until all 12 grades are included. Each school district and charter school will receive materials that provide guidance on properly measuring children's heights and weights, calculating and plotting BMI and notifying parents/guardians of the screening results.

(5) Identification and implementation of professional development and instructional strategies and methods to improve the academic performance of students who are classified as students with disabilities, as limited English proficient students or as students who have been enrolled in a school district for less than two years.

Requires the Department of Education to establish a clearinghouse of information related to specific strategies for improving the academic performance of students in eligible school districts. This clearinghouse is to include best practices, methods and instructional strategies based on scientific research, including, but not limited to: 1 (1) Parental involvement programs and policies. (2) Classroom instructional strategies. (3) Curriculum redesign. (4) School safety. (5) Tutoring programs. For a student victim to be entitled to transfer to another school under this chapter, the violent criminal offense first must be reported to law enforcement authorities by the student, the student's parent or guardian, or school officials. A student victim (or the student's parent or guardian) may apply to the LEA to transfer to another school within 30 calendar days after the incident is reported to school authorities. Except as provided as follows, a student who attends a persistently dangerous school must be offered the opportunity to transfer to a safe public school within the LEA, including a charter school. A student who attends a persistently dangerous school may apply to transfer at any time while the school maintains that designation. Responsibilities of LEAs toward victims of violent criminal offenses: Within 10 calendar days of receiving notice of the violent criminal offense, the LEA shall notify the student victim that the student has the right to transfer to a safe public elementary or secondary school within the LEA, including a public charter school. The notification and offer to transfer shall state that no student is required to transfer to another school. The standards proposed by the department and approved by the state board affirm the use of flexibility in the current certification system and approve additional certification avenues designed to provide new routes for becoming certified. More specifically, the standards support the continued use of the intern certificate to provide flexible and accelerated pedagogical training and the structuring of the student teaching semester to include assessments of pedagogical skills in lieu of a written test. In regard to additional certification avenues, the standards provide that: 1) individuals holding Pennsylvania instructional certificates are eligible to add additional subject areas to existing certificates by means of satisfactory performance on an appropriate subject-matter test or tests; 2) individuals certified in other states who have 3 years of teaching experience in another state during the 7 years immediately prior to application are eligible to obtain Pennsylvania certification without meeting further academic and testing requirements; and 3) those individuals completing a Board approved National teacher-training program are eligible to obtain Pennsylvania certification without meeting further academic and testing requirements. The standards also establish that the Department will develop a process for reviewing local assessments designed to determine whether Title I funded instructional paraprofessionals demonstrate the rigorous standard of quality required by NCLB.

Requires state department to conduct a study of public schools providing Internet instruction.
