Background: Legislation authorizing the West Virginia Board of Education (WVBE) to designate Education Innovation Zones in schools, groups of schools and departments or subdivisions of a school or schools was entered into statute in October, 2009. The legislation takes into consideration that rules are established in public education to manage the resources efficiently, allot time among the activities and processes required and to ensure attention to the goals mandated. It is also understood that rules may limit the flexibility of professional educators to engage in those activities and implement those approaches that may best improve the learning of their students for the twenty-first century. Therefore, it is believed that allowing individual schools to seek and receive exceptions from certain statutes, policies and rules and interpretations through the creation of school innovation zones will provide them greater control over important educational factors that impact student achievement. Legislation was passed in the regular session of the Legislature in 2011 that created another category of Innovation Zones to be designated as "Local Solution Dropout Prevention and Recovery Innovation Zones". The intent and purpose of the legislation is as follows: increase graduation rate and reduce number of dropouts, provide a testing ground for innovative graduation programs, incentives, and approaches, provide schools and communities with opportunities for greater collaboration to plan and implement systemic approaches for increasing graduation rate and lessen dropout rate, provide information regarding the effects of specific innovations, collaborations, and policies, and document educational strategies that increase graduation rates, prevent dropouts and enhance student success; establishes a separate category of Innovation Zones known as School System Collaborative Innovation Zone by adding thereto a new section, in accordance with the provisions of W.Va. Code §18-5B-12, relating to allowing flexibility within county school systems; and authorizing the WVBE to select a county school system to serve as a School System Collaborative Innovation Zone.
Major Revisions or Reasons for New Policy: Revisions were required to Policy 3236 to incorporate the legislation establishing a School System Collaborative Innovation Zone.

Adult Basic Education

Community College

Authorizes a program of adult basic education at each state community and technical college campus where developmental education services are provided. This approach to providing adult basic education links the programs students study under with developmental education and creates a simpler, clearer pathway for adults to enter college.

Transfers title to certain property to state board. Under certain circumstances, State board may pay transportation of any certified unemployed person participating in any vocational program.

Establishes West Virginia Earn a Degree Graduate Early initiative (EDGE) to connect public schools with higher education to prepare public high school students for success in the workplace or postsecondary education and to provide the opportunity for these students to earn community and technical college credit free of charge for certain courses. EDGE's goals include increasing postsecondary enrollment.

Creates the Collaborative Degree Completion Program to increase the number of West Virginians who hold or can earn a college credential and increase the education and technical skills of the states' workforce.

Requires certain agreements between community and technical college consortia, career and technical centers and public high schools to cooperatively deliver services effectively and efficiently where needed most.

Clarifies duties of community and technical consortia planning districts and specifies certain accountability procedures.

Defines programs of study and directs consortia to focus on identifying and providing student programs of study leading to placement in high demand, high wage occupations.

Amends and reenacts the law relating to the authority of school curriculum teams and local school collaborative processes with respect to selection and use of testing and assessment instruments not required by statute or state board when certain conditions are met. Provides that school curriculum teams should: (1) Provide professional opportunities for teachers, administrators and other school personnel that allow them to have a direct voice in the operation of their schools and to create a culture of shared decision-making focused on the ultimate goal of raising student achievement; (2) Encourage the use of different, high-quality models of teaching, scheduling and other aspects of educational delivery that meet a variety of student needs; (3) Increase high-quality educational opportunities for all students that close achievement gaps between high-performing and low-performing groups of public school students; and (4) Provide public schools with increased school-level freedom and flexibility to achieve these purposes when they have achieved exceptional levels of results-driven accountability. Local Solution Dropout Prevention and Recovery Innovation Zone Act:
Creates the Local Solution Dropout Prevention and Recovery Innovation Zone Act to: (1) Provide for the establishment of Local Solution Dropout Prevention and Recovery Innovation Zones to increase graduation rates and reduce the number of dropouts; (2) Provide schools and communities with opportunities for greater collaboration to plan and implement systemic approaches that include evidence-based solutions for increasing graduation rates and reducing the number of dropouts; (3) Provide a testing ground for innovative graduation programs, incentives and approaches to reducing the number of dropouts; (4) Provide information regarding the effects of specific innovations, collaborations and policies on graduation rates and dropout prevention and recovery; and (5) Document educational strategies that increase graduation rates, prevent dropouts and enhance student success. Provides the application process, contents, factors to be considered in evaluating the applications and standards for review for designating schools/school districts Local Solution Dropout Prevention and Recovery Innovation Zones.

Early Warning Indicator System:
Directs the state board to develop a statewide system in electronic format that will provide schools with easily identifiable early warning indicators of students at risk of not graduating from high school. Requires the system to be delivered through the uniform integrated regional computer information system (the West Virginia Education Information System) and to at a minimum incorporate data on the attendance, academic performance and disciplinary infractions of individual students. Directs the state board to require implementation of the system in Local Solution Dropout Prevention and Recovery Innovation Zones along with a plan of interventions to increase the number of students earning a high school diploma. Provides that the zones may be used as a pilot test of the system.

Authorizes the Higher Education Policy Commission to collect and disseminate information concerning higher education institutions. Requires each institution to annually provide the commission, as requested, all information the commission or council considers necessary to assess the performance of the institution and to determine whether the institution continues to meet the minimum standards for conferring degrees. This information includes, but is not limited to:(1) Consumer information the commission or council considers necessary, including, but not limited to, graduation and retention rates, transfers, post-graduation placements, loan defaults and numbers and types of student complaints; (2) A detailed explanation of financial operations including, but not limited to, policies, formulas and procedures related to calculation, payment and refund for all tuition and fees; and (3) An assessment of the adequacy of the institution's curriculum, personnel, facilities, materials and equipment to meet the minimum standards for conferring degrees. Permits the commission to revoke an institution's authority to confer degrees when the institution's governing body, chief executive officer, or both, have done any one or more of the following: (1) Failed to maintain the minimum standards for conferring degrees; (2) Refused or willfully failed to provide information to the commission or council pursuant to this subsection in a manner and within a reasonable time frame as established by the commission or council, as appropriate; or (3) Willfully provided false, misleading or incomplete information to the commission or council. Requires the commission to compile the information collected and report on the information to the Legislature annually beginning December 1, 2012. Clarifies the duties and responsibilities of the Higher Education Policy Commission (HEPC). Sets deadlines in coming years for working toward fulfilling pay levels included in a state-determined salary schedule. Provides that a tutition and fee increase greater than five percent for resident students requires the approval fo the HEPC. Requires, by July 1, 2015, the governing board of each state institution of higher education under the jurisdiction of the HEPC, including the governing boards of Marshall University and West Virginia University, to attain a graduation rate for full-time undergraduate students that equals or exceeds the peer-established graduation rate (W. Requires the state board in conjunction with the Division of Homeland Security and Emergency Management to promulgate by December 31, 2011, a legislative rule for the establishment of an up-to-date, school specific crisis response plan at every school in the state. Requires the state board to consider, in developing the rule, plans currently being developed as part of the safe schools initiative currently underway by the School Building Authority and the Division of Homeland Security and Emergency Management. Provides that those portions of a school's access safety plan may be used as a portion of the school's school specific crisis response plan if there are any overlapping requirements. Details what the rule must include. Requires the county board to keep the current crisis response plan of each school in the county on file and, unless otherwise provided for, provide a copy of each school's crisis response plan to each local emergency response agency that has a role in the plan. Provides that upon request, a redacted copy of a school crisis response plan shall be made available for inspection by the public with any information removed that is necessary for compliance with the necessary safeguards. School Safety--Bullying Prevention/Conflict Resolution

Expands the definition of harassment, intimidation or bullying to include an electronic act, communication, transmission or threat which is administered by means of telephone, wireless phone, computer, pager or any electronice or wireless device whatsoever, and includes but is not limited to transmission of any image or voice, email or text message using any such device. Expands the locations where harassment, imtimidation or bullying is prohibited to include a school bus and a school bus stop. One pilot program requires the state superintendent to establish a special community development school pilot program for implementation in a public school with significant enrollments of disadvantaged, minority and underachieving students for the purpose of developing and implementing strategies that can be replicated. Amends rules relating to postsecondary program review. Adds section 133-10-4, which requires each institution to develop a reporting format that includes mission, faculty, curriculum, resources, student learning outcomes, other learning and service activities, viability and program improvement. Provides that the program review process must include a five-year schedule, delineate the roles of faculty, administrators and the institutional governing board, and include an external review process that includes at least one reviewer as an outside evaluator for each program reviewed.

Requires each institution to submit the results of the program review to the Higher Education Policy Commission. Requires the following to be reported: name and degree level of program; synopses of significant findings, including findings of external reviewer(s); plans for program improvement, including timeline; identification of weaknesses or deficiencies from the previous review and the status of improvements implemented or accomplished; five year trend data on graduates and majors enrolled; summary of assessment model and how results are used for program improvement; data on student placement (i.e., number of students employed in positions related to the field of study or pursuing advanced degrees); and final recommendations approved by governing board. For programs with specialized accreditation, the institution must provide a copy of the letter continuing the conferral of accreditation. Accredited programs that meet productivity guidelines will not be subject to further review by the Commission.

Adds section 133-10-7, which provides the commission will conduct a productivity review on a biennial basis of programs that have been established for at least five years. Programs will be required to meet at least one of the indicators established in rule for degree awards and enrollment in majors at either the baccalaureate, master's/first professional or doctoral level. Programs that do not meet productivity standards will be recommended for placement on probationary status by the institutional governing board for a 4-year period, during which time institutions will be expected to increase program enrollment and degrees awarded.

Amends guidelines for governing boards in employing and evaluating university presidents or other administrative heads at specified postsecondary campuses. Requires the search procedure adopted by the governing board to be approved by the West Virginia Higher Education Policy Commission prior to being implemented. Requires that other constituencies of the institution (beyond faculty, students and staff) be represented if a search committee is appointed. Provides non-classified employees must also be invited to meet with candidates.

Provides that the chancellor must serve as an ex officio, non-voting member on all search committees or bodies serving in that capacity during the search process. Provides that the commission reserves the right to conduct independent interviews of one or more finalists, as long as sufficient prior notice is given to the governing board.

Reduces maximum length of initial offer of employment as president from three to two years. Provides that evaluation of the president must occur every third year of his/her employment (previously was every fourth year), and that the committee performing such evaluation must include faculty and staff, as well as students. Also requires the governing baord to conduct a written evaluation of the president at the end of the initial contract period.

Provides the commission may not approve any request for an increase in compensation of a president prior to receiving an evaluation of that president for the year immediately preceding the requested increase.

"Revisions were needed in Policy 2510 to allow local school districts greater flexibility in the implementation of the rigorous academic standards and high quality programs that characterize West Virginia's 21st century teaching and learning initiative. The intent of these proposed revisions is to place the focus on providing students with excellent learning opportunities that result in student mastery of West Virginia's high quality content standards and objectives (CSOs) rather than on a prescriptive compliance language that may discourage 21st century creativity and innovation. Thus, these revisions were designed to allow counties more
flexibility in the implementation of a rigorous curriculum that is tailored to the unique needs and constraints of each school without compromising the intent and spirit of the 21st teaching and learning initiative.

"Proposed revisions include removing restrictive language requiring 60 minutes of daily uninterrupted reading at grades 3-4, allowing counties/schools greater latitude in scheduling appropriate learning opportunities for students. The requirement for a 225 minute block for core courses for grades 5-8 was removed and replaced with language that requires a 180 minute block for core courses, again to allow greater local flexibility for scheduling learning opportunities for students. Proposed revisions also remove the grade 5-8 requirement for annual implementation of programs and/or separate courses in advisory, guidance and counseling, career exploration and technology. Policy language was revised to clarify the recommendation that all students in the professional pathway be enrolled in Algebra I in 8th grade. Policy language remains that requires a foreign language to be offered for students in grades 7 and 8, but removes prescriptive language that requires counties to use the 1A in grade 7 and 1 B in grade 8th scheduling option. At grades 9-12, language was revised to allow Life Science and Earth Science to satisfy the requirement for chemistry for 9th graders entering in 2008-09 and 2009-10, allowing more time for districts to secure chemistry teachers and lab facilities. Language requiring a college transition English course was removed and language was added to allow counties to determine options for students who need additional time to successfully complete Algebra I and to allow counties to grant up to two math credits for students' successful course completion. Language requiring a specific sequence for required social studies courses was added, and language was revised to allow state-approved Career Technical Education courses to satisfy the Arts requirement for graduation.


Major Revisions or Reasons for New Policy:
 
* Reading requirement for grades 3-4: Policy language was revised to allow local flexibility in the scheduling of a 90 minute uninterrupted reading block that may include reading and language arts instruction provided through whole group, small group and reading center activities.
 
* Reading requirement for grades 5-8: Policy language was revised to reduce the required time for core courses to 180 minutes giving responsibility for determining time allocations that provide adequate time for students to achieve mastery of the WV CSOs to the principal and a team of teachers.
 
* Algebra I in 8th grade: Policy language was changed from use of the word "expect" to the word "recommend" to clarify that the intent of current policy
is to recommend that all students in the professional pathway be enrolled in Algebra I in 8th grade.
 
* Required programs/courses in Advisory, Counseling, Career Exploration and Technology: Policy language requiring these programs to be implemented annually was replaced with language that requires these activities (advisory, career exploration and counseling) to be integrated into an organized advisory program that includes career guidance and counseling and allows local flexibility for scheduling these activities. The intent of the revised language is to allow local decision making for the scheduling of technology applications instruction throughout the grade 5-8 curriculum, rather than in a separate technology course.
 
* Required foreign language course in grades 7 and 8: Policy language requires districts to offer a foreign language course for students in grades 7 and 8 as described in current policy. Language that prescribes the specific method of scheduling this course was removed to allow more flexibility at the local level and to ensure the implementation of quality programs. Additionally, the revised policy language will also provide WVDE/counties/schools flexibility in addressing staffing and scheduling needs in order to support the development of articulated foreign language programs at the elementary level.
 
* Required course in chemistry: Policy language was revised to permit Life Science or Earth Science to satisfy the graduation requirement for chemistry/conceptual chemistry for 9th graders entering in 2008-09 and 2009-10, allowing more time for districts to secure chemistry teachers and lab facilities. (Students entering 9th grade in 2010-11 must have chemistry/conceptual chemistry to meet graduation requirements.)
 
* College transition English course: Policy language was revised to remove the college transition English course requirement with the expectation that instruction in the required English classes will address the needs of student who do not achieve the state assessment college readiness benchmark for English.
 
* Students who need additional time to complete Algebra I: While language in Policy 2510 is consistent with research indicating the best option for scheduling additional time for Algebra I CSO mastery is to do so within the same year, policy language permits the local-level identification of students who need additional time to master Algebra I content standards and objectives. The identification of students for this option must be a data-driven decision and counties may select from a number of scheduling options to assure that students master the Algebra I CSOs. Scheduling options such as "double blocking" Algebra I, Algebra Support and Algebra I, or other similar options may be determined at the local level, as long as the priority of the selected option is to provide students the best possible opportunity to succeed in mastery of the Algebra I CSOs. Counties selecting a scheduling option that places students who need extra time in two separate math courses may grant students up to two math credits toward graduation upon successful course completion. Counties that provide identified students additional time by enrolling them in two separate math courses may award up to two math credits toward graduation requirements upon students' successful completion of each
course. (A student who is identified as being in need of additional time to master Algebra I CSOs, and who has been determined by an IEP Team to be unable
even with extended learning opportunities and significant instructional modifications to meet state and county standard graduation requirements, may, in accordance with Policy 2510, Section 5.6.9.a., receive a modified diploma.)
 
* Social studies course sequence: Policy language was added to indicate a required sequence of social studies courses: World Studies to 1900; United
States Studies to 1900; Twentieth and Twenty-First Centuries Studies; Civics for the 21st Century. This sequence is required to assure maximum understanding of the material and alignment of content with state assessment.
 
* Additional courses to satisfy the Arts requirement: Policy language was added to permit students in Skilled Pathway concentrations that complete state approved career/technical courses that reflect creative and innovative arts content may substitute these courses for the arts credit required for graduation. Designation of these courses will be made by state-level administrators of career/technical and arts programs.

Creates the Higher Education Energy and Water Savings Revolving Loan Fund proposed by the Governor. Through an initial investment of $7 million, it is anticipated that the higher education institutions will propose, and if approved for a loan, initiate projects that will result in significantly greater savings over time through reductions in energy and water usage. Projects will be considered for loans on a competitive basis and those offering the highest savings and quickest payback will be funded. Institutions would repay the loan with the dollars saved from reduced energy and water costs. Once the payback point is reached, subsequent savings would accrue to the benefit of the institution. The most recent updates to Policy 2525: West Virginia's Universal Access to a Quality Early Education System support quality in the classroom and consistency among the programs across the state. They also strengthen personnel standards and continue to support collaboration. The major changes include increasing the minimum participation from two days a week to three days a week during the school year and limiting teacher caseloads to 30 students. The policy also requires five-year-olds to be assessed to determine if Pre-k placement is the best option for them when a parent requests Pre-k enrollment instead of kindergarten. It also authorizes the development of the permanent authorization credential for community partners with teachers who are not certified and requires all screenings to be completed using the HealthCheck protocol to create standardization of screenings and physicals.

From Fiscal Note: The purpose of this bill is to revise the standards, assessment and accountability system to accommodate the higher order thinking and learning skills consistent with the state's 21st Century Initiative. School and district improvement plans are to be electronic. The annual performance measures used for school and school system accreditation are separated from those required by the federal No Child Left Behind Act. The comprehensive statewide student assessment program will define a system of assessments to be administered under the direction of the state board. The assessment program is broadened to authorize formative assessments across the grade levels to support summative assessment, improve student achievement and promote 21st Century skills. The grade levels tested for calculating adequate yearly progress (AYP) would be 3 through 8 and 11.Allows the state board to require that student proficiencies be measured through the ACT EXPLORE and the ACT PLAN assessments or approved comparable assessments. Sets a uniform statewide assessment rate of at least 95% or the average of the participation rate for the current and the precenting two years is nine-five percent for the school, county and state. Another level of accreditation status is added for schools called "Distinguished" status, and the current "Seriously Impaired" status is renamed as "Low Performing" status.

Provides for payment of tuition and fees for any member of the Army National Guard or Air National Guard during the period of his or her service who is enrolled in a course of undergraduate study or a Master's degree program and is attending any accredited college, university, business or trade school located in West Virginia or is attending any aviation school located in West Virginia for the purpose of taking college-credit courses; allows a member of the West Virginia National Guard who is receiving payments for tuition and fees under this section, and is discharged from the military service due to wounds or injuries received in the line of duty, to continue to receive payments for tuition and fees under this section as if he or she were still a member.

Provides children and spouses of deceased armed service personnel who meet certain requirements with a tuition and fees waiver at a state postsecondary education or training institution, or up to two thousand dollars per year to attend a private postsecondary education or training institution.

Until a professional educator qualifies for a permanent certificate, requires the educator who has a certificate based on a bachelor's degree to complete the following within five years from the date the certificate first became valid:

(1) File an application on a prescribed form with the State Department of Education;
(2) Present an official transcript of six semester hours of approved credit as may be prescribed by the state board;
(3) Successfully complete a beginning teacher internship program, if applicable; and
(4) Submit a recommendation based on successful teaching experience from the county superintendent of schools of the county in which the holder last taught or resides.

Allows the holder of a professional certificate that has been valid for five years to have the certificate made permanent upon meeting any of the following requirements:

(1) Completion of the second certificate renewal as outlined above required for educators within their first five years of being granted an initial certificate;
(2) After five years of service in the public schools, presentation of a transcript showing the completion of requirements for a master's degree from an institution of higher education accredited to offer the master's degree and in a program relevant to the public school program or completion of a fifth year of training leading to a bachelor's degree in library science from a school fully approved by the American Library Association; or
(3) Certification through the National Board for Professional Teaching Standards.

Allows a person who has reached the age of sixty and holds a renewable certificate, as provided in this section, to not present renewal credit but meet all other renewal requirements.

Allows up to 25 professional educators that are members of either the teachers retirement system or the defined contribution system to be designated as 21st Century Learner Fellows, which entails being employed by a state institution of higher education or a research corporation for a specific project, without forfeiting their membership in either system; requires the state Superintendent of Education to give preference to a person who is certified by the National Board for Professional Teaching Standards and demonstrates leadership within his or her content field in designating fellows; allows participation in public employee insurance programs by fellows during their fellowships; limits the responsibility of a state institution of higher education or a research corporation for a fellow's annual and sick leave earned from prior employment.

Specifies that the strategic plan may address faculty, libraries and technology resources, research collaboration, and coordination with K-12 education, but may not contain a recommenation that would result in the abolition of an existing program.

Requires the consortium to present an interim report to the Governor and the Legislative Oversight Commission on Education Accountability by December 1, 2006 and a final report containing the Collaborative Engineering Strategic Plan, with recommendations for implementation, by July 1, 2007.

Policy 2525 sets the standards for implementing high quality universal pre-kindergarten programs. This policy covers all public school preschool programs and any community program such as Head Start or child care that contracts with the county school system to provide a WV Pre-k classroom. Health and safety standards are now a part of the policy. Included in these standards are requirements that meals must be provided if a pre-k classroom is in operation for more than four hours; all children who enter a program must have age appropriate immunizations; and classroom size will be limited to no more than 20 children. All pre-k classrooms not administered by the West Virginia Department of Education (WVDE) must be licensed through the West Virginia Department of Health and Human Resources (WVDHHR) Day Care Licensing.

During Phase II, the alternative program teacher must be visited and critiqued no less than one time per week by members of a professional support team, and be observed and formally evaluated at the end of five weeks and at the end of ten weeks by the appropriately certified members of the team. At the end of the ten-week period, the alternative program teacher is to receive a formal written progress report. In order to enhance the competitive position of doctoral institutions in the current environment for research and economic development, expenditures for equipment and material for research projects must be handled efficiently and effectively and the acquisition and use of grant funds should be simplified and expedited through the use of centers for economic development and technology advancement. These regulations also require that public schools respond immediately and consistently to incidents of harassment, intimidation, bullying, substance abuse and/or violence or other Student Code of Conduct violations in a manner that effectively deters future incidents and affirms respect for individuals. These regulations require county boards to design and implement prevention and response programs, to outline investigatory and reporting procedures, and to delineate penalties for violations of this policy. The state board believes further that public schools should undertake proactive, preventive approaches to ensure a nurturing, orderly and safe school environment that fosters learning and personal-social development. Public schools must create, encourage, and maintain a safe, drug-free, and fear-free school environment in the classroom, on the playground, and at school-sponsored activities. Assuring such an educational environment requires a comprehensive program supported by everyone in the school organization, as well as parents/guardians, and the community. The legislature finds that schools that have implemented programs to strengthen student learning ability are reporting statistically significant improvement in the statewide test scores in reading, language and math of students referred to the programs. Therefore, it is the intent of the Legislature through this section to establish a more formal method to fund programs that strengthen student learning ability. The state board is required to establish a program for strengthening student learning ability that includes the following: (1) A procedure for schools to apply for funds to implement programs to strengthen student learning ability in accordance with the provisions of this section; (2) Specific factors for determining the need for each school applying for funds in accordance with subsection (e) of this section; (3) A method for judging applications for funds on a competitive basis; and (4) A determination of the maximum percentage of total funds appropriated for the purposes of this section which may be distributed for use in grades six through twelve so that the priority for program implementation is at the prekindergarten and elementary levels. Proposed programs must include the following:
(1) Assessment of the cognitive abilities of students; (2) Physical screening that identifies barriers to a student's ability to learn; (3) Development of a student-specific program to improve student learning ability based on the results of the assessment and physical screening; (4) Administration of learning development exercises that strengthen the ability of students to learn; and (5) An evaluation of the program's impact, including factors such as student test scores and other measures of student performance, the program's impact on special education referrals, program cost and other information considered important for judging the value of the program.

Prohibits suspension as discipline for failure to attend class; stipulates other methods of discipline may be used for the pupil which may include, but are not limited to, detention, extra class time or alternative class settings; abolishes corporal punishment; gives teachers authority to exclude from classrooms or school bus any pupil who is guilty of disorderly conduct, who in any manner interferes with an orderly educational process, who threatens, abuses or otherwise intimidates or attempts to intimidate a school employee or a pupil, who willfully disobeys a school employee, or who uses abusive or profane language directed at a school employee. Any pupil excluded shall be placed under the control of the principal of the school or a designee. The excluded pupil may be admitted to the classroom or school bus only when the principal, or a designee, provides written certification to the teacher that the pupil may be readmitted and specifies the specific type of disciplinary action, if any, which was taken. When a teacher excludes the same pupil from his or her classroom or from a school bus three times in one school year, and after exhausting all reasonable methods of classroom discipline provided in the school discipline plan, the pupil may be readmitted to the teacher's classroom only after the principal, teacher and, if possible, the parent(s), guardian(s) or custodian(s) of the pupil have held a conference to discuss the pupil's disruptive behavior patterns, and the teacher and the principal agree on a course of discipline for the pupil and inform the parent(s), guardian(s) or custodian(s) of the course of action. Thereafter, if the pupil's disruptive behavior persists, upon the teacher's request, the principal may, to the extent feasible, transfer the pupil to another setting.
