Repeals provisions that encouraged boards to ensure that pupils were provided age-appropriate instruction in human growth and development. Replaced with provision to foster a partnership between parents and schools to promote the optimal health and well-being of pupils. Defines "medically accurate information" as that which is scientifically-based and published, where appropriate, in peer-reviewed journals and textbooks. Adds to definition of "age-appropriate" by adding "consistent with adolescent development and community standards." Repeals 118.019 (1m) (b) 1., 2. and 3. These sections described the makeup of the instructional program (if provided by local board). Adds that if a school board elects to provide an instructional program, when the board establishes the curriculum for the instructional program, the board is required to make determinations as to whether and, if so, for what subjects covered in the curriculum the pupils are to be separated by gender. If an instructional program is provided, lists a number recommendations such as that abstinence is the only reliable way to prevent pregnancy and sexually transmitted infections, and requires the program to identify the skills necessary to remain abstinent. Clarifies that nothing in the subsection is to be construed to prohibit a school board from approving an instructional program that includes instruction on abstinence from sexual activity or that is abstinence-centered. For school boards offering a human growth and development curriculum, requires the appointment of an ad hoc advisory committee whose role is to advise the board on the design and implementation of the curriculum and to review the curriculum. Establishes membership of such a committee (i.e., no more than 1/5 parents and no more than 25% employees or board members and/or their spouses).

Requires that beginning July 1, 2012, each teacher preparatory program in the state submit to the department a list of individuals who have completed the program and who have been recommended by the program for licensure, together with each individual's date of program completion, from each term or semester of the program's most recently completed academic year and sets filing requirements. Also creates an educator effectiveness section (115.415) that applies to all public schools, including charter schools, and whereby 50% of the total evaluation score is based on measures of student performance, including performance on state assessments, district-wide assessments, student learning objectives, school-wide reading at the elementary and middle-school levels, and graduation rates at the high school level. The other 50% of the total evaluation score is based on the extent to which the teacher or principals' practice meets the core teaching standards adopted by the 2011 Interstate Teacher Assessment and Support Consortium. Creates the Governor's Read to Lead Development Fund and the Read to Lead Development Council. Sets membership of the Council. Allows for awarding of grants to any person other than a school board for support of a literacy improvement program. Makes appropriations from which the Governor may draw to award such grants. Grants are to support assessments of reading readiness, literacy and early childhood development programs and/or literacy improvement aids. Establishes a separate, nonlapsible trust fund, designated the Governor's Read to Lead Development Fund, consisting of all gifts, grants, bequests, and other contributions made to the fund. Section 20 (118.016) requires that school boards and charter school governing bodies use the appropriate, valid, and reliable assessment of literacy fundamentals selected by the Department and annually assess each pupil enrolled in kindergarten for reading readiness. Requires that results be reported to the pupil's parent. Section 21 (118.19 (14)) prohibits the Department from issuing a beginning teaching license (grades K-5) or in special education, reading teacher unless the applicant has passed an examination identical to the Foundations of Reading test administered in 2012 as part of the Massachusetts Tests for Educator Licensure. Requires that the passing score be set no lower than the level recommended by the developer of the test, based on Wisconsin's standards. Requires that beginning July 1, 2012, each teacher preparatory program in the state submit to the department a list of individuals who have completed the program and who have been recommended by the program for licensure, together with each individual's date of program completion, from each term or semester of the program's most recently completed academic year and sets filing requirements.

Act 156 (amends 115.787) Requires that an individualized education program that indicates a goal of a technical education high school diploma should specify the course of study that the pupil must take to attain that goal. Adds a new section:
118.33 (1) (g) 1. A school board may grant a technical education high school diploma to a pupil who does all of the following:
a. Satisfies the established subject/course credit requirements
b. Earns in the high school grades the same total number of credits that the school board requires of other pupils for high school graduation.
c. Successfully completes a technical education program, established by the school board, in a subject or subjects.
2. In establishing a technical education program under subd. 1. c., the school board may incorporate standards for industry-recognized certifications. Annually, the department shall provide to each school board operating high school grades a list of such certifications. The school board shall indicate on a pupil's technical education high school diploma the certifications attained by the pupil.

Defines "covered individual" and limits use of seclusion or physical restraint to those individuals (teachers or student teachers). Sets standards for seclusion. Defines "physical restrain" and conditions under which it may apply. Requires parental notification as soon as practicable, but no later than one business day after the incident. Requires private schools participating in either the Milwaukee Parental Choice Program or the Choice Program for Eligible School districts to report family information to the Department of Public Instruction. Family income data is then to be verified by the Department of Revenue (DOR) to ensure that the family income falls within the eligibility requirements for vouchers. Clarifies that the DOR does not make a determination about eligibility but verifies whether the pupil is eligible to participate on the basis of family income. If DOR is unable to verify eligibility, DOR must notify the Department of Public Instruction (DPI), which must utilize an alternative process to determine eligibility. Adds several accrediting bodies to the list of approved accreditors for participating private schools. Requires the state superintendent to terminate the participation of a private school in either program if the private school retains a disqualified person before the end of a seven-year period following the issuance of an order barring a private school from participating. Appropriates funding for the Milwaukee Parental Choice Program (MPCP) and choice programs in other eligible school districts (the latter is an expansion). Section 2532m. (118.60 of the statutes) is created to address parental choice programs for eligible school districts. "Eligible school district" means a school district that satisfies all of the following: 1. The school district's equalized value per member, as determined in accordance with s. 121.15 (4) on October 15 of the 2nd fiscal year of the current fiscal biennium for the distribution of equalization aid in that year, is no more than 80 percent of the statewide average. 2. The school district's shared cost per member, as determined in accordance with s. 121.07 on October 15 of the 2nd fiscal year of the current fiscal biennium, for the distribution of aid in that year is no more than 91 percent of the statewide average. 3. The school district is eligible, in the 2nd fiscal year of the current fiscal biennium, to receive aid under s.121.136. 4. The school district is located in whole or in part in a city of the 2nd class.

For the parental choice program, clarifies re: participating private schools; makes revisions re: family income requirement (family income includes income of the pupil's parents or legal guardians); additional tuition and fees, participation open to any private school, accrediting agency, pupil assessments, family applications, auditing standards, payments directly to the private school, enrollment cap, and state department duties (Department of Revenue references were vetoed). Prohibits bargaining collectively with a collective bargaining unit containing a general municipal employee with respect to any factor or condition of employment except wages. http://legis.wisconsin.gov/2011/data/acts/11Act10.pdf Wages would include only total base wages and would exclude any other compensation, including, but not limited to, overtime, premium pay, merit pay, performance pay, supplemental compensation, pay schedules, and automatic pay progressions. Unless approved by referendum as described below, prohibits any increase in base wages that exceeds the total base wages for authorized positions 180 days before the expiration of the previous collective bargaining agreement by a greater percentage than the increase in the consumer price index. Provides that, if a local governmental unit (this includes technical college districts, local cultural arts district, or any other political subdivision of the state) wishes to increase the total base wages of its general municipal employees in an amount that exceeds these CPI limits, the governing body of the local governmental unit must adopt a resolution to that effect. The resolution must specify the amount by which the proposed total base wages increase will exceed the CPI limit. The resolution may not take effect unless it is approved in a referendum called for that purpose. The referendum must occur in November for collective bargaining agreements that begin the following January 1. The results of a referendum apply to the total base wages only in the next collective bargaining agreement. These referendum provisions would also apply to elementary and secondary school
districts, except that the referendum would occur in April for collective bargaining agreements that begin in July of that year. For state employees, a statewide referendum would be required, but there is no specification of the timing of the referendum or the required ballot language. Provide that no local governmental unit, or any school district, except as provided under the Municipal Employment Relations Act (MERA), may collectively bargain with its employees. If a local governmental unit has in effect, on the effective date of the bill, an ordinance or resolution that is inconsistent with this requirement, the ordinance or resolution would not apply and may not be enforced. Each local governmental unit that is collectively bargaining with its employees would be required to determine the maximum total base wages expenditure that is subject to collective bargaining under the provisions of the bill. Beginning on January 1, 2012, except as otherwise provided in a collective bargaining agreement, an employer may not offer a health
care coverage plan to its employees if the employer pays more than 88 percent of the average premium cost of plans offered in any tier with the lowest employee premium cost under this subsection. Some provisions distinguish between public safety employees (firefighters, police) and general municipal employees (includes teachers). Limits negotiated agreements to one year and specifies that they are subject to renegotiation (was four years).

Teachers are considered municipal employees and municipal employees have the right to refrain from paying dues while remaining a member of a collective bargaining unit.

Requires the governing board of every private school participating in the Milwaukee parental choice program to adopt pupil academic standards in mathematics, science, reading and writing, geography and history. Requires a school participating in the Milwaukee parental choice program to administer the state's 4th grade, 8th grade and 10th grade examinations to all students in those grades who are participating in the parental choice program, and to administer to program participants all other examinations in reading, mathematics, and science that are required to be administered to public school pupils under the No Child Left Behind Act of 2001. Provides for exceptions if the state superintendent informs specified legislative leaders by January 2010 that the department will adopt or approve substantially redesigned exams in the 2011-12 school year. Makes provisions related to assessment of English language learners and students with disabilities applicable to private school students participating in the Milwaukee parental choice program. Also requires a governing body of a private school to excuse a student participating in the Milwaukee parental choice program from taking a state assessment.

Requires the governing body of each private school participating in the Milwaukee parental choice program to develop a policy specifying criteria for granting a high school diploma to pupils participating in the choice program. Requires that the criteria include the pupil's academic performance and the recommendations of teachers.

Requires the governing body of each private school participating in the Milwaukee parental choice program to develop criteria for promoting students from grade 4 to 5, and from grade 8 to 9. Requires criteria to include (1) the pupil's score on the state assessments administered in grades 4 and 8, unless the pupil has been excused by the student's parent from taking the exam; (2) the pupil's academic performance; (3) the recommendations of teachers, which must be based solely on the pupil's academic performance; (4) and any other academic criteria specified by the governing body of the private school. Provides that effective September 1, 2010 a student who does not meet the criteria may not be promoted.

Defines "administrator" for purposes of voucher program. Requires all administrators in a participating private school to have at least a bachelor's degree from an accredited postsecondary institution (provides an exception for an administrator of a participating private school that prepares and trains pupils in rabbinical studies). Provides that "Progress records" has the meaning given in s. 118.125 (1) (c). Requires private schools participating in the voucher program to pay a nonrefundable fee set by the department. Adds provision that the amount of the fee must be such that the total fee revenue covers the costs of employing one full-time auditor to evaluate the financial information submitted by the private schools under the program. Increases educational requirements for teachers at private schools participating in the Milwaukee parental choice program (prior legislation required teachers to have at least a high school diploma or equivalent; new provision requires all of the private schools' teachers to have a bachelor's degree from an accredited postsecondary institution). Excludes teachers who teach only courses in rabbinical studies. Provides that if a teacher teaching at a participating private school on July 1, 2010 does not have at least a bachelor's degree and has been teaching at the private school for at least the five consecutive years leading up to July 1, 2010, the teacher may apply to the department for a temporary, nonrenewable waiver provided the teacher is working toward a bachelor's degree. Provides no waiver may extend beyond July 31, 2015.

Defines "preaccreditation" for purposes of voucher program as the review and approval of an educational plan. Requires any private school that is a first-time participant in the Milwaukee parental choice program on the effective date of this Act and that is not accredited to obtain preaccreditation from the Institute for the Transformation of Learning at Marquette University by August 1 of the school year in which the private school intends to participate in the program. Specifies that a private school that has obtained preaccreditation is not required to obtain accreditation. Removes the Institute for the Transformation of Learning at Marquette University as a private school accreditor for purposes of the Milwaukee parental choice program. Provides that a private school accredited by any of specified accrediting bodies is not required to obtain preaccreditation from the Institute for the Transformation of Learning at Marquette University as a prerequisite to providing instruction in additional grades or in an additional or new school.

Adds that any private school participating in the Milwaukee parental choice program must provide at least 1,050 hours of direct pupil instruction in grades 1-6 and at least 1,137 hours of direct pupil instruction in grades 7-12. Existing law provides that no more than 22,500 pupils may participate in the Milwaukee parental choice program. New provision adds that if the number of pupils being served falls below 22,500, the state superintendent must issue an order notifying participating private schools that they may begin accepting additional pupils. Defines pupils who must be considered 1st priority, 2nd priority, etc. when private schools are accepting additional pupils to reach the 22,500-pupil threshold.

Amends provisions relating to the pupil application process to require a private school that rejects an application to include in the rejection notice the reason for the rejection. Adds that a private school may reject an applicant only if it has reached its maximum general capacity or seating capacity. Amends processes for reimbursing parents of participating pupils only for the 2009-10 and 2010-11 school years. Adds provision to address paying local districts for pupils in participating private schools that close after the beginning of the school year. Requires all participating private schools to provide to all pupils and their parents specified information on the school's policies, for-profit or nonprofit status, names of private school contacts and names of members of the school's governing body or shareholders (if applicable). Requires participating private schools to annually report to the department of education specified information on pupil enrollments in the previous year, data on pupil progression from grades 4-5 and grades 8-9, and on graduation for the previous 5 years, scores on all standardized tests (to the extent permitted by federal law), and a copy of the academic standards adopted by the school. Provides that this information provided to the department must be made available to any pupil or parent upon request.

Additionally requires participating private schools to: (1) Administer a department-developed reading test to all 3rd graders attending the private school through the Milwaukee parental choice program; (2) Adopt specified academic standards; (3) Develop a written policy governing visitors and visits to the private school; (4) Ensure that any teacher's aide has a high school diploma or the equivalent; (5) Annually schedule two meetings to allow parents of pupils attending or applying to attend the school to meet with members of the school's governing board and provide all parents at least 30 days written notice of this meeting; (6) Maintain progress records for each pupil attending the private school through the program, and keep these records for at least 5 years after the pupil ceases to attend the school; (7) Upon request, provide a pupil or the pupil's parent with a copy of the pupil's progress records; (8) Provide for the transfer of all participating pupils' progress records should the school cease operations as a private school; (9) Ensure that an accrediting agency reports to the department on the school's compliance with specified components. Previous law allowed an eligible school board that has entered into a five-year renewable student achievement guarantee (SAGE) contract with the Department of Public Instruction (DPI) to reduce class size to 15 pupils in grades Kindergarten to three in schools with specified low-income enrollment to receive $2,250 for each low-income pupil enrolled in grades eligible for SAGE funding. DPI has not been authorized to enter into new SAGE contracts after June 30, 2001, but DPI has entered into five-year renewal contracts if certain conditions are met. DPI has been permitted to waive requirements of the SAGE program under these contracts.
This bill permits the school board of an eligible school district to enter into a five-year SAGE contract with DPI in the 2010-11 school year on behalf of one or more schools if all of the following apply:
- In the previous school year, each school had an enrollment that was at least 30% low income.
- The school board is not receiving a grant under the Preschool to Grade 5 Program on behalf of any of the schools.
- None of the schools is a beneficiary of a SAGE contract.

Under the Act, for contracts that begin in the 2010 school year, the contract must require the school board to reduce class size to 18 in each participating school in the following manner:In the 2010-11 school year, in at least grades Kindergarten and one; in the 2011-12 school year, in at least grades Kindergarten to two; in the 2012-13 to 2014-15 school years, in at least grades Kindergarten to three. DPI must pay to each school district that has entered into a SAGE contract $2,250 multiplied by the number of low-income
pupils enrolled in grades eligible for funding in each school in the school district that is covered by a contract entered into in the 2010-11 school year and by renewals of SAGE contracts.

Prohibits a person that holds itself out to the public in any way as a legitimate institution of higher education from using the term "college" or "university" in its name unless the person provides an educational program for which it awards an associate or higher degree and the person is accredited. "Grandfathers" the use of the term "college" or "university" in the name of any entity listed below that was doing business in Wisconsin prior to the effective date of the bill:
1. Schools of a parochial or denominational character offering courses having a sectarian objective.
2. Schools primarily offering instruction avocational or recreational in nature and not leading to a vocational objective.
3. Courses conducted by employers exclusively for their employees.
4. Schools, courses of instruction, and training programs that are approved or licensed and supervised by other state agencies and boards.
5. Schools approved by the Department of Public Instruction (DPI) for the training of teachers.

Exempts certain institutions from needing EAB approval to operate in Wisconsin:
1. In-state schools that are exempt from taxation under section 501 of the Internal Revenue Code and that either were incorporated in this state prior to January 1, 1992, or had their administrative headquarters and principal places of business in this state prior to 1970 (i.e., accredited private colleges and universities).
2. Schools that are supported mainly by taxes (i.e., the University of Wisconsin (UW) System and the Wisconsin Technical College System (WTCS)).
3. Schools of a parochial or denominational character offering courses having a sectarian objective.
4. Schools primarily offering instruction avocational or recreational in nature and not leading to a vocational objective.

Under the Act, if a designated scholar declines a scholarship, a high school must designate as alternate scholars any seniors with the same GPA as the scholar or, if there is no other student with the same GPA, any remaining seniors with the next highest GPA, but not less than 3.800 or the equivalent. Prior to enactment of the Act, if a high school did weight its courses for purposes of determining GPAs, and no other student had the same GPA as the original scholar, the school could designate as an alternate scholar the student with the next highest GPA. However, if a high school did not weigh its courses, an alternate scholar was required to have the same GPA as the original scholar.

If a student is awarded a scholarship, is enrolled full time in a participating institution of higher education, and maintains at least a 3.000 GPA, they are eligible for a scholarship in the subsequent year. The Act specifies that if the student does not enroll in a participating institution of higher education in the subsequent year, they are eligible for the scholarship in the second year
following the year in which they previously received the scholarship.

1. Create a school safety plan with active participation from appropriate parties such as local law enforcement officers, fire fighters, school administrators, teachers, pupil service professionals, and mental health professionals.
2. Specify the process for reviewing the plan.
3. Include general guidelines specifying procedures for emergency prevention and mitigation, preparedness, response, and recovery as well as methods for conducting drills required to comply with the plan.
4. Determine who shall receive the school safety plan training, which is based upon the school district's prioritized needs, risks, and vulnerabilities.
5. Drill school safety plan procedures twice a year or substitute a school safety drill for a fire, tornado, or other hazard drill.
6. Have the school safety plan in place within three years after this Act goes into effect and review it at least once every three years following implementation.

The purpose of the statute on instruction in human growth and development instruction is to encourage all school boards to ensure that pupils in their districts are provided ageappropriate instruction in human growth and development. The Act provides that the instruction should
support and enhance communication between pupils and their parents and provide pupils with the knowledge, skills, and support necessary to make healthy decisions now and throughout their lifetimes and to make responsible decisions about sexual behavior. The Act defines "age-appropriate" as suitable to a particular age group of pupils based on the developing cognitive and emotional capacity of and behaviors typical for the age group. a school board that elects not to provide an instructional program in human growth and development must, by September 30 of each school year, send home to the parent or guardian of each pupil enrolled in the school district a notice that includes all of the following:
-- A statement that the school board is encouraged by state statute to provide instruction in human growth and development in grades kindergarten to 12.
-- The subjects of instruction required if the school board were to provide instruction in human
growth and development.
-- A statement that the school board is not providing any instruction in human growth and

Current law directs school districts to administer certain standardized examinations to pupils enrolled in the 4th, 8th, and 10th grades. Current law prohibits the school board from using the results of the examinations to evaluate teacher performance, to discharge, suspend, or formally discipline a teacher; or as the reason for the nonrenewal of a teacher's contract. 2009 Wisconsin Act 60 allows the results of the state required standardized examinations and the standardized examinations required under the federal No Child Left Behind Act to be used for the evaluation of teacher performance if certain conditions are met. In order to use the results, the school board must develop a teacher evaluation plan that includes a description of the evaluation process, multiple criteria in addition to examination results, the rationale for using examination results for evaluating teachers, and an explanation of how the school board intends to use the evaluations to improve pupil academic achievement. Act 60 also requires a school district to bargain collectively over the development of or any changes to the teacher evaluation plan.

The bill requires that anyone who teaches in a public school or charter school must hold a teaching license issued by the department of public instruction (DPI). Teachers in virtual charter schools (defined as a charter school offering an online learning program) are exempt from this provision until July 1, 2009. Virtual charter schools are not required to be in the school district of the approving school board, unlike regular charter schools.

Beginning with the 2009-10 school year, school boards that establish a virtual charter school must ensure that no more than 85% of pupils attending do so through the Open Enrollment Program. School boards are not authorized to establish a virtual charter school before the 2009-10 school year. DPI must make online courses available for a reasonable fee.

Each school board or chartering entity must do the following: 1. Determine which pupils may enroll in an online course, which courses are available and the number of courses a student may take; 2. provide a safe and secure online environment; 3. Assign an appropriately licensed teacher for each course; 4. Ensure that students enrolled part-time have direct contact with a teacher for at least 20 minutes per week per course, that elementary school students enrolled full-time have direct contact with a teacher for at least 2 hours every school day, and that high school students enrolled full-time have direct teacher contact for at least 30 minutes each school day; 5. Determine the average equivalency hours for online courses; and, 6. Ensure only state residents enroll in online courses.

Under current law, the number of pupils who may attend a private school under the Milwaukee Parental Choice Program (MPCP) is capped at 15 percent of the enrollment of the Milwaukee Public Schools (MPS). If in any school year there are more spaces available in the private schools participating in the MPCP than the maximum number of pupils allowed to attend the private schools under the MPCP, the law directs the Department of Public Instruction (DPI) to prorate the number of spaces available at each participating private school. This bill provides that the number of pupils who attend private schools under the MPCP may not exceed 22,500. That number is to be determined in the same manner as public school enrollment is determined; for example, most kindergarten pupils are counted as 0.5 pupil. Under current law, to participate in the MPCP, a pupil must be a member of a family with a total family income of no more than 1.75 times the federal poverty level. This bill allows a pupil to continue to attend an MPCP school if the pupil's family income does not exceed 2.2 times the federal poverty level. The bill also provides that siblings of pupils attending an MPCP school are subject to the higher limit. Under current law, a pupil may participate in the MPCP only if, in the previous school year, the pupil was enrolled in the MPS, was attending a private school under the MPCP, was enrolled in grades kindergarten to three in a private school located in the city of Milwaukee other than under the MPCP, or was not enrolled in school. This bill eliminates this eligibility requirement. This bill requires a private school participating in the MPCP to administer
nationally normed, standardized tests in reading, science, and mathematics to the pupils attending the school in the fourth, eighth, and tenth grades under the MPCP. Beginning in 2006 and annually thereafter until 2011, the private school must provide the scores of all standardized tests that it has administered to the School Choice Demonstration Project, currently at Georgetown University. The bill directs the Legislative Audit Bureau, based upon the standardized test score data that it receives from the project, to review and analyze the test score data and submit reports to the legislature annually from 2007 to 2011. The reports must include the results of various tests, including standardized state tests administered to representative samples of pupils in the MPCP and pupils enrolled in the MPS. Act 125.

From Legislative Council Memo: Prior law required each school board to annually distribute, by January 1, to the parent or guardian of each pupil enrolled in the school district a copy of the school district performance report (SPR) or give it to each pupil to take home. The SPR contains information, by school and by school district, on items such as: academic achievement, including scores on statewide pupil assessment examinations; various indicators of school and school district performance, including attendance data and suspension and expulsion data; certain staffing and financial data; information about use of the open enrollment program; and the method of reading instruction. The SPR also includes a comparison of the school district's performance on academic achievement and certain other indicators of performance with the performance of other school districts in the same athletic conference. 2005 Wisconsin Act 62 does the following:
• Requires that each school board distribute or send home the SPR only upon request; provides that annually, by January 1, each school board must notify the parent or guardian of each pupil enrolled of the right to request the SPR.
• Requires that, if requested, the SPR be distributed or sent home annually by May 1.
• Provides that if the school district maintains an Internet site, the SPR must be made available to the public on that site.

In addition, the calculation of a city's, village's, or town's levy does not include any tax increment that is generated by a TID. With regard to technical college districts, the levy limit is the levy for the previous year multiplied by 1.026. The bill contains exceptions to the levy limit for political subdivisions that transfer the provision of services, for cities or villages that annex town territory, and for a county levy that relates to a county Children with Disabilities Education Board. The levy limit may also be exceeded if a political subdivision's or technical college district's resolution to do so is approved in a referendum. A town with a population of less than 2,000 may exceed the levy limit if a resolution to do so is approved by an annual or special town meeting.
