PHASE 1
--Establishes "core indicators of student performance" at the school level:
Reading measured by proficiency assessment of Wyoming students (PAWS )in grades 3-8 and 11; 8th grade standardized, curriculum based college readiness test (ACT Explore) measured by percentage of students meeting or exceeding college benchmark readiness score for each subject area (English, reading, math and science); 11th grade standardized, curriculum based readiness test (ACT) measured by percentage of students meeting or exceeding college benchmark readiness score for each subject area (English, reading, math, science).
-- Uses school year 2010-11 statewide summative assessment data as baseline--PAWS--to be compared to 2011-2012 results
--Department of Education to compute combined school score for each core indicator and measure improvement from year to year, beginning with school year 2011-2012
--Improvement target for each core indicator is "positive progress" at the school-level

the classroom; (c) Developed outside of and not as a part of the requirements under NCLB; (d) Administered separately and at
different times from the statewide summative assessment in other subject areas; (e) Fully implemented in the 2012-2013 school
year and each year thereafter; (f) At least 30 days prior to issuing a request for proposal to commence development and
implementation of a statewide summative assessment, the state superintendent shall submit the proposed RFP to the Select
Committee on Accountability for review
Local school district boards of trustees will:
--Continue to use "body of evidence" system until school year 2012-2013 to extent not inconsistent with growth assessment
features
--Implement the statewide benchmark assessment system established by the State Board of Education which requires
administration of benchmark testing not less than two times per year, with appropriate linkages to teachers and schools within
districts
--Statewide education accountability system requires evaluation of school principal performance by district superintendent
--Shall report in writing to State Board of Education verification of principal performance including that principals have scored
sufficiently to continue employment.

Relates to the Western Regional Higher Education Compact; imposing a repayment provision on specified students; defining the requirements of the loan or service repayment program; and providing for an effective date. In the interest of recruiting health care professionals, this is a repayment program for participating students in medicine, dentistry, podiatry, and osteopathic medicine, An agreement must be obtained from each student admitted as a WICHE program student to a participating institution of higher education for the 2012-2013
academic year and thereafter. Each student must: (A)(1) Actively engage in full-time medical practice in the state for not less than 3 years; The taking of a medical residency program in the state shall be credited toward the practice requirements at the rate of one-third (1/3) year of full-time practice for each year of service in a medical residency program in the state; or (2) repay the amount expended by the state of Wyoming on the student's education in the WICHE program, with interest. If the student withdraws before completion of the degree program, interest will begin to accrue at an interest rate equal to the Stafford loans. At no time will the interest rate be more than 8%. (B) The student may apply to the Commission to be reliefed of the obligation of repayment if the repayment would cause a hardship. The Commission shall annually report the number of students relieved from repayment to the joint labor, health and social services interim committee not later than October 1; (C) Any monies collected by students in the WICHE program will be credited to the WICHE program repayment account and expended upon appropriation by the legislature. (D) The provisions of this paragraph shall not apply to the fields of occupational therapy, physical therapy, optometry, physician assistant or veterinary medicine.

Extends Hathaway scholarship eligibility for students attending a community college in Wyoming. Increases the semesters of Hathaway Scholarship--opportunity, performance and honor--availability from 4 semesters to 8 semesters for students attending Wyoming community colleges that have received a degree or certificate from a community college or have successfully completed coursework that enables the student to enroll in a program that will result in a professional degree offred by a community college. This change is available for students that received the scholarship prior to the fall semester of 2011-2012 so long as scholarship eligibility is otherwise maintained. The University of Wyoming and the Wyoming community college are required to report to the Joint Education Committee and Joint Appropriations Committee by November 1, 2011 in relation to implementation of standardized remediation efforts and recommendations that will improve retention rates for students that receive a Hathaway Scholarship. Select Committee is to recommend changes to the Teacher Accountability Act which provide a consistent, reliable and clearly defined evaluation process to measure teacher performance based upon growth in student performance.
Act applies to all teacher contracts from and after July 1, 2012.

These emergency rules amend the existing rules related to the school foundation program. The emergency rules provide additional definitions for terms used throughout the rules. The emergency rules add a new section 8 which provides a process for a school district to apply to the department of education for a modification of a school's grade configuration. The emergency rules amend the process for attendance taking by the schools and require that attendance be taken every period in middle schools, junior high schools and high schools. The emergency rules provide regulations for the calculation of average daily membership for distance education students and require that school districts choose one of three methods of calculation of average daily membership for all part-time students. The emergency rules provide for the adjustment of prior school year average daily membership if a new school opens, a district changes boundaries, a school's grades served are reconfigured or a district moves programs and students from one school to another. These emergency rules add a new chapter to the education rules to deal with distance education. The new chapter provides uniform rules for the offering of distance education courses and the transfer and acceptance of credit for those courses. The new chapter provides a process for enrolment into the Wyoming Switchboard Network and sets out the responsibilities of the Department and both the resident and nonresident districts. The emergency rules specify what data must be collected by the nonresident district and monitored by the Department. The rules provide the requirements for the memorandum of understanding which will serve as the funding agreement between the resident and nonresident districts. The state has previously established a family college savings program under which persons may save for college and receive favorable income tax treatment for earnings on the monies set aside (often referenced as 529 savings plans in reference to the IRS code provision). The plan is administered through the office of the state treasurer who contracts with a program manager. Given the small size of the Wyoming plan, the state treasurer sought flexibility to allow different options for the Wyoming plan, which might include combining the plan in some fashion with other state plans. This bill allows that flexibility by removing the requirement for the state treasurer to establish a plan. The bill makes conforming amendments to current law in recognition of this change. The bill removes the select committee on capital financing and investments from taking part in administration of the plan.

Effective school year 2006-2007 and each requires the state Commissioner to establish a program of administering a standardized, curriculum based, achievement college entrance examination and a job skills assessment test selected by the state superintendent to all students in the eleventh grade. Students with an individual education plan may be excused from taking either the college entrance examination or the job skills test. The examination and test selected by the state superintendent needs to meet certain criteria: be administered throughout the United States, be relied upon by institutions of higher education, and at a minimum test in the areas of reading, writing and mathematics. The jobs skills assessment test is required at a minimum to test in the areas of applied math, reading for information and locating information. The state pays all costs and schedules a day during which both examinations shall be provided to and one (1) shall be administered to all eleventh grade students throughout the state. The date is to be selected so that following receipt of scores, students may timely register for senior year classes which may be necessary to allow the student to qualify for a state provided scholarship. The state superintendent may enter into agreements with an administrator of the college entrance examination and an administrator of the jobs skills assessment test and adopt rules as necessary to ensure compliance with any requirements of an administrator, such as a secure environment. School districts are required to provide the opportunity for all home school and private school students in the eleventh grade and residing within the district to take the test. This bill contains an appropriation of $75,000,000 from the BUDGET RESERVE ACCOUNT to the proposed Energy Institute Endowment Account (Energy Acct.). This appropriation will be deposited in the Energy Acct. in 3 deposits of $25,000,000 each on April 1, 2005, July 1, 2005 and April 1, 2006.
Upon receipt or as soon thereafter as reasonable appropriate, the State Treasurer will make distributions from the Higher Ed. Acct. and the Scholarship Acct. as follows;
Two-thirds of each account to the University of Wyoming (UW)
One-third of the Higher Ed. Acct. equally to each Wyoming community college
One-third of the Scholarship Acct. to the Community College Commission, to be distributed to each community college based on low income enrollment
Upon receipt, UW and each community college shall transfer these funds to their respective foundation to be permanently invested. Only the earnings from the investment of these funds may be expended, in accordance with the provisions described in the bill.
Assumptions: Investment income earned in FY 2005 (April 1 through June 30, 2005) from the Higher Ed. Acct. is estimated at $277,000 for the UW and $138,500 for the community colleges. The estimates in the table above represent the total projected increase in investment income from the Higher Ed. Acct. and the Scholarship Acct. Of those totals, $317,000 of UW's increase per year and $158,000 of the community colleges increase per year is from the Scholarship Acct. The remainder is from the Higher Ed. Acct.
Estimates are based on an anticipated annual rate of return of 4.75 percent for FY 2005 though FY 2008.
