CAVetoed 09/2012Postsec.Primarily from bill summary: Provides that the purpose of the California Hope Public Trust is to increase revenue for higher education by developing state properties that are currently underutilized. Establishes the California Hope Public Trust in state government, to be governed and administered by the department of general services with input from a 9-member advisory board of the trust. Requires the department of general services by March 31, 2013, and annually thereafter, to submit to the trust a complete and thorough inventory of all state-owned real estate and property that is not exempt from transfer to the trust and all lease agreements between any state agency and private or nonpublic management groups. Requires the trust by January 1, 2015, and at least biennially thereafter, to review that inventory of state-owned property, in consultation with the board, and determine which properties are to be controlled by the trust. Requires the trust, in consultation with the board, by January 1, 2015, and as appropriate thereafter, to request that the legislature enact legislation to authorize the trust to control any of those properties. Authorizes the trust to hire staff for these purposes. Requires the department of general services to provide the board with suitable office accommodations.

Requires the trust to accomplish various objectives, including, among others, to generate a return on real estate holdings in the possession of the trust, and to use private sector management and accounting methods to provide for the efficient and effective utilization of state assets. Authorizes the trust to carry out various powers, including, among others, to acquire or dispose of any property, to construct and maintain any building, and to lease property to public or private entities. Prohibits the trust from selling or disposing of any land reported as excess or any surplus state real property under certain statutes. Prohibits the trust from taking responsibility of certain lands under the responsibility of the Judicial Council and other specified types of land and property. Notwithstanding the above, provides that these provisions will become operative only to the extent legislation is enacted to authorize the trust to control those properties. Requires the budget of the trust to be subject to appropriation in the annual Budget Act.

Requires all net proceeds received or generated as a result of activities of the trust to be paid to the California Hope Public Trust Fund created by this bill, and requires the trust to use the money in that fund, upon appropriation by the legislature in the annual Budget Act in accordance with a specified schedule, to support the California State University, California Community Colleges, and University of California systems.

Commencing on or before July 1, 2016, and each year thereafter, requires the trust to report to the legislature on the activities undertaken by the trust and include a financial statement showing the trust's assets, liabilities, revenues, and expenditures, and a summary of net proceeds. Repeals these provisions on January 1, 2019, unless legislation is enacted that becomes effective before that date, that transfers management and control over property to the trust.

Authorizes the Director of General Services to give priority to proposals by the state that further the purposes of the California Hope Public Trust.

Directs the governor, in making his/her budget report, and budget units in preparing their estimates, to use zero-base budgeting, beginning with the budget report presented to the general assembly in January 2013. Requires the governor's budget report to include zero-base budgeting for the agencies and programs identified by the house and senate budget offices in consultation with the governor's office of planning and budget. Such offices must require each agency to use zero-base budgeting at least once every 10 years and may not require any agency or program to use zero-base budgeting more than once every 8 years. Specifies information that must be included in each budget unit's budget estimate in any year in which zero-base budgeting applies. Specifically provides that the board of regents of the University of Georgia is a budget unit subject to these provisions, and that programs of the board of regents be periodically subject to zero-base budgeting. Requires the department of education's budget as presented in the January 2013 budget report be submitted as a zero-base budget.Automatically repeals these provisions effective June 30, 2020, unless reauthorized by the general assembly.

Enacts the Community College Aid Act. Specifies distribution of state aid appropriations among the six community college areas for 2013-14 and future fiscal years. Amends provisions relating to maximum property tax levy rates authorized to be levied by community college areas. Assigns certain duties to the Coordinating Commission for Postsecondary Education with respect to the Community College Aid Act and authorizes the Commission to adopt and promulgate related rules and regulations. Also creates the Nebraska Community College Student Performance and Occupational Education Grant Committee and sets membership. Gives this committee more authority in developing guidelines for grants and allows determination of allocation of funds (within certain parameters).

Directs the chancellor to study specified issues and consult with the presidents of constituent institutions of the university system of Ohio in developing the plan. Directs the chancellor to specify in the plan (1) The manner in which a state institution of higher education may become eligible for restructured financial and operational authority, and performance measures and criteria to determine eligibility; (2) Specific areas of financial and operational authority subject to increased flexibility; and (3) The nature and term of the management agreement required between the state and an institution. By August 15, 2011, directs the chancellor to submit to the general assembly and the governor a report of findings and recommendations for use in developing policy changes necessary to implement the plan. Provides no institution may be designated a charter university until the general assembly, after considering the chancellor's plan, has enacted legislation establishing a procedure for making the designation. Prohibits the chancellor from adopting, amending or rescind any rules with respect to designating institutions as charter universities until that legislation is enacted. TXSigned into law 06/2011Postsec.Directs each institution of higher education to post on its Web site specified information on financial transactions. Permits an institution to comply with this requirement by providing on its Web site an easily noticeable direct link, the purpose of which is clearly identifiable, to a Web site maintained by the comptroller that provides information concerning the institution that is similar to the information required under statute. Permits a local government and an institution of higher education or university system to contract with one another to perform any governmental functions and
services.

Permits the governing board of each institution to maintain unsecured deposits in a foreign bank as necessary to support the institution's academic and research operations in the foreign country in which the bank is located, provided that no appropriated or tuition funds other than those collected from students enrolled in the affected programs are deposited. Substantially revises provision related to institution financial reporting. Repeals most existing language and replaces with provision requiring each institution of higher education to a complete an annual financial report as prescribed in the Government Code. Establishes certain provisions on the collection of delinquent obligations. Requires that a suit by the University of Texas System or on behalf of a component institution be brought in Travis County. Authorizes an institution of higher education to make any payment through electronic funds transfer or by electronic pay card. Establishes provisions applicable to a credit balance of less than $25 held by an institution of higher education that is presumed abandoned, and specifies that provisions in the property code do not apply to small credit balances held by an institution of higher education in an unclaimed money fund. Establishes circumstances under which a state security issued by an institution of higher education, or issued at the request of or for the benefit of an institution of higher education, is not subject to board approval, including provisions defining "substantial interest in a business entity" for purposes of determining whether an institution of higher education may enter into a contract or other transaction with the business of a board member of the institution has an interest or substantial interest in the entity. Directs an institution or university system to determine whether and the extent to which it will send and accept electronic and digital signatures.

Coenrollment in Public Schools and Adult Education Programs
Prohibits funding for coenrollment in public schools and adult general education programs, except that for the 2011-2012 fiscal year students may enroll in core courses for credit recovery or dropout prevention for up to two courses. Provides that high school students are exempt from the payment of block tuition for general adult education programs.

Facilities
Expands the class size reduction lottery bond program to include other educational facilities. Suspends temporarily the state match for facilities and operating challenge grant programs for colleges and universities, effective July 1, 2011. Provides that existing eligible donations will remain eligible for future match and that the suspension may be removed once $200 million of the grant backlog has been matched. Allows a university board of trustees to expend carry-forward balances from prior year operational appropriations on legislatively approved fixed capital outlay projects authorized for the establishment of a new campus.

Finance
Streamlines library operations through consolidation and joint purchasing. Requires creation of a union catalog for higher education. Requires the Florida College System Council of Presidents to develop and recommend an equitable funding formula for the distribution of certain state funds to the college system institutions. Provides for the use of a funding formula to ensure equitable distribution of district workforce funds. Provides a $200,000 limit on the amount of state funds that may be paid for salaries of college and university presidents and administrative employees. Terminates the University Concurrency Trust Fund.

Finanical Aid/Scholarships
Increases the Florida Medallion Scholarship test scores in 2013-2014, from 1050 to 1170 for SAT, including the applicable home school test scores. Increases or establishes required community service hours for Bright Futures applicants. Requires applicants for Bright Futures, and certain other programs to submit the Free Application for Federal Student Aid prior to disbursement of funds. Prioritizes state student financial aid to the neediest (Pell eligible) students for the Florida Work Experience Program and the First Generation in College Program.

Northwest Regional Data Center
Designates the Northwest Regional Data Center as a primary data center.

Student Enrollment Pilot Program
Authorizes a spring and summer term student enrollment pilot program at the University of Florida for the purpose of aligning student enrollment and the availability of instructional facilities. Authorizes Bright Futures scholarships in the summer for these students.

Transient Student Admission
Authorizes the implementation of a transient student admission application process through the Florida Academic Counseling Tracking for Students system to include admissions, readmissions, financial aid, and transfer of credit functions. Authorizes a fee of $5 to support the system.

Tuition
Provides an exemption from the 30 percent need-based expenditure requirement from the tuition differential fee if the university has covered the entire tuition and fee costs of all resident students who are eligible for need-based aid. Authorizes alternative documentation for tuition fee waivers for Purple Heart veterans. Increases the tuition surcharge for excess hours to 100 percent in excess of 115 percent of the credit hours required for a degree. Requires a block tuition and corresponding out-of-state fee for students enrolled in adult general education courses. Community College
Creating the postsecondary tiered technical education state aid act, replacing the current funding structure. Beginning in fiscal year 2012 and each fiscal year thereafter, each community college and technical college and the Washburn Institute of Teachnology would be eligible for postsecondary tiered technical education state aid from the state general fund for credit hours approved by the state board of regents, using a credit hour cost calculation model, that would include all of the following concepts: (1) Arrange into categories or tiers, technical education programs, recognizing cost differentials; (2) Consider target industries critical to the Kansas economy; (3) Respond to program growth; (4) Consider local taxing authority for credit hours generated by in-district students; and (5) Include other factors and considerations determined necessary by the state board of regents. The state board of regents would establish the rates to be used as the state's share in a given year, as well as in the actual distribution. The bill prohibits receipt of both tiered technical education state aid and non-tiered course state aid for any one credit hour. The bill provides for fund accounting and management requirements related to state aid received under the Act. The bill authorizes the state board of regents to adopt policies necessary or desirable to implement and administer the Act. Bill provides that each community college and technical college is eligible for a grant from the state general fund, in an amount determined by the state board of regents for non-tiered course credit hours approved by the board of regents after dialogue with community college and technical college presidents.

Allows revenues from rents, boarding fees and otoher charged related to university student housing at state universities to go to either the Housing System Suspense Fund or directly to the Housing System Operations Fund, at the discretion of the university. Allows interest earned from the Housing System Operations Fund and Housing System Repairs Fund to be transferred into those funds. Requires that interest earnings from the Johnson County Education Research Triangle sales tax be transferred from the State General Fund to the Johnson County Education Research Triangle of the University of Kansas, the University of Kansas Medical Center and the Kansas State University. Specifies date of month for fund transfer and method for determining the net earning. Continues the new categories and the levels established for FY 2011 that the Board of Regents may charge private and out-of-state postsecondary educational institutions in order to carry out the Board's statutory and regulatory responsibilities through July 1, 2012. The bill removes the requirement in existing law that second year Kansas State University veterinary medical students who perform spay or neuter surgeries at animal shelters by supervised by a faculty member of the Kansas State University Veterinary Medical Center. Specifies that the spay or neuter surgeries be supervised by a licensed veterarian and specifies the surgeries are limited to dogs and cats belonging to a pound or animal shelter.

Sets the maximum annual increase for tuition at Minnesota State Colleges and Universities for Minnesota undergraduate resident students during the biennium ending June 30, 2013 at three percent each year for colleges and at five percent the first year and four percent the second year at universities.

Specifies that a nonpublic institution that provides student data or records to the Office of Higher Education is not liable for a breach of confidentiality.

Sets the age of eligibility for the senior citizen higher education program at 62 years, reversing the 2010 change in law to increase the age of eligibility to 65.

Sets a statutory amount for the tuition and fee maximum used to calculate the state grant award if a maximum is not set in law. The statutory maximum is the highest tuition and fee amount charged by a public two-year institution for two-year programs and the highest amount charged by a public four-year institution for four-year programs.

Encourages the board of trustees to offer an optional tuition plan for Minnesota resident students pursuing two-year and four-year degrees that meets the goal of holding tuition constant at the rate charged in the first semester.

Eliminates the statutory requirements that provide a state-funded matching grant for low- and middle-income families who participate in the Minnesota college savings plan established under section 529 of the Internal Revenue Code.

Statutorily prohibits the use of state or federal funds, for state programs, to support human cloning or for expenses incidental to human cloning. States that this section does not affect stem cell research.

Requires the Office of Higher Education (OHE) to study the for-profit graduate education sector in Minnesota.

Repeals: The requirement for public institutions to sell American-made clothing and apparel in their bookstores to the extent possible; the requirement that public employers purchase or require employees to furnish uniform or protective accessories that are not made in America; the matching grant program that is part of the Minnesota College Savings plan; the requirement to provide one-time Achieve grants to students who were eligible before January 1, 2009, and have not yet been awarded the grant.

Requires each institution to annually provide the commission, as requested, all information the commission or council considers necessary to assess the performance of the institution and to determine whether the institution continues to meet the minimum standards for conferring degrees. This information includes, but is not limited to:(1) Consumer information the commission or council considers necessary, including, but not limited to, graduation and retention rates, transfers, post-graduation placements, loan defaults and numbers and types of student complaints; (2) A detailed explanation of financial operations including, but not limited to, policies, formulas and procedures related to calculation, payment and refund for all tuition and fees; and (3) An assessment of the adequacy of the institution's curriculum, personnel, facilities, materials and equipment to meet the minimum standards for conferring degrees. Adds new language authorizing state and city university trustees to execute contracts for up to $20,000 without prior approval by any state officer or agency, but subject to specified state policies, and to negotiate increases in such dollar amounts with the state comptroller. Adds new language that guidelines promulgated by the state and city university boards of trustees must require that competitive proposals be solicited for purchases, and must include requirements that purchases and contracts be at the lowest available price.

Provides that for a period of 3 years after the effective date of the amendatory Act, in order to create, maintain or increase a working cash fund, the board of trustees of a community college district may incur an indebtedness for such purpose and issue bonds therefor from time to time, in an amount or amounts not exceeding in the aggregate at any one time outstanding 150% (rather than 75%) of the taxes permitted to be levied for educational purposes and for operations and maintenance of facilities purposes for the then current year to be determined by multiplying the aggregate of the authorized maximum educational tax rate and the maximum operations and maintenance tax rate applicable to such district by the last assessed valuation as determined at the time of the issue of those bonds plus 150% (rather than 75%) of the last known entitlement of such district to taxes as by law now or hereafter enacted or amended, imposed by the General Assembly of the State of Illinois to replace revenue lost by units of local government and school districts as a result of the abolition of ad valorem personal property taxes, pursuant to Article IX, Section 5(c) of the Constitution of the State of Illinois.

Allows the board of trustees of a community college district to establish a line of credit with a bank or other financial institution in an amount not to exceed (1) if anticipating state revenues due in the current fiscal year, 85% of the amount or amounts of the revenues due in the current fiscal year, as certified by the President/CEO of the Illinois Community College Board or other official in a position to provide assurances as to the amounts; and (2) if anticipating state revenues expected to be due in the next subsequent fiscal year, 50% of the amount or amounts of the revenues due in the current fiscal year, as certified by the President/CEO of the Illinois Community College Board or other official in a position to provide assurances as to the amounts. Requires that all moneys so borrowed be repaid exclusively from the anticipated revenues within 60 days after the revenues have been received. (8) Evaluating strategies to reduce costs through additional college placement testing and accelerated degree completion

Calls for the creation of the following committees, and identifies tasks for each committee: (1) Increased Degree Attainment, Financial Aid and Workforce Training; (2) Implement Innovation and Cost Containment; and (3) Regional Strategies/Partnerships for Research and Economic Development.

Directs the committee to submit its interim findings and recommendations on matters potentially impacting the executive budget by September 30, 2010. Directs the commission to an interim report of its activities, findings and recommendations by November 30, 2010. Provides the interim report must focus primarily on increasing degree attainment, concentrating increased educational attainment in STEM areas and other high-demand and high-income fields, a model for higher education funding, and partnerships through which public and private colleges and community colleges participate actively in economic development and workforce training. Directs the commission to continue to meet and make recommendations on additional stated objectives throughout 2011.

Provides this executive order will become effective upon signing and remain in full force and effect until March 26, 2011 unless amended or rescinded by further executive order.

(4) The academic progress made by students as well as other outcomes related to Closing the Gaps by 2015.

Directs institutions to collect data and evaluate success based on the following elements and connect them to the accelerated targets for Closing the Gaps by 2015: (A) Partnership with high-need, low-college going rate public schools; (B) Pre-college academic outreach; (C) Application assistance; (D) Financial aid assistance; (E) Academic support programs; (F) Tutoring/mentoring programs; (G) Academic advising; and
(H) Early Alert Systems that include academic support for at-risk students.

Provides that the coordinating board reserves the right to audit any program reported as a part of the Uniform Recruitment and Retention Strategy. Defines "noncompliance" with any Closing the Gaps by 2015 reporting requirements, including the Uniform Recruitment and Retention Strategy. Expresses legislative intent to refine higher education reporting requirements to provide for more effective, manageable and transparent reporting by the higher education segments.

Requests that the University of California notify each high school's governing board of (1) the number of graduates who enrolled in the university in the previous year and the number of graduates who were required to take the entry level writing requirement and (2) the comparable numbers of all California high school graduates who enrolled in the university. Requests that the university of California report such information to the department of finance and the joint legislative budget committee. Establishes legislative intent that California State University (CSU) assess and report the entry-level proficiency of all first-time freshmen. Requires the CSU system to annually report to the legislature, by campus:
(1) The total number of regularly admitted and specially admitted first-time freshmen
(2) The proportion of regularly admitted and specially admitted first-time freshmen that are exempt from entry-level proficiency exams
(3) The proportion of regularly admitted and specially admitted first-time freshmen that become exempt through each of the approved alternatives
(4) The entry-level proficiency exam pass rates of regularly admitted and specially admitted first-time freshmen.

Directs the California State University to and requests that the University of California report annually to the legislature on specified components of their institutional financial aid programs for undergraduate, graduate and professional degree students, including the typical financial aid package for a typical dependent undergraduate student with a parent income of $20,000, $40,000, $60,000, $80,000 and $100,000.

Amends Section 66057 by establishing legislative intent that the University of California and the California State University accommodate enrollment growth by maximizing the utilization of existing instructional facilities during the summer term before building new classrooms and teaching laboratories. Also establishes legislative intent that the University of California and the California State University make requests for capital outlay funding for space for classrooms and class laboratories justified using legislatively approved utilization standards and a reasonable assumption of summer-term enrollment. Adds provisions related to five-year capital outlay for UC and CSU systems. Requests that the University of California and requires that California State University report annually to the legislature on summer enrollment counts and on efforts undertaken to increase summer enrollment.

Repeals 66352, "Task force on instruction in business ethics." Eliminates provision in 67312(b) that the California State University must and the University of California system may report on its efforts to serve students with disabilities (requirement that California Community Colleges submit such reports remains in place).

Adds Section 67501, which directs the California State University and California Community Colleges, and permits the University of California, to annually submit to the legislature a comprehensive five-year capital outlay plan that includes specifeid components. Requires five-year plans to be updated annually.

Adds Section 67502, which requests that the the Regents of the University of California provide the joint legislative budget committee and the department of finance with a summary of all instructional and research space in the university system. Specifies elements the summary must address. Requires the California State University to provide the joint legislative budget committee and the department of finance with a summary of all instructional and faculty office space in the university system.

Adds Section 67503, which requests that the Regents of the University of California, and requires California Community Colleges and the California State University, to annually report on the utilization of classrooms and teaching laboratories.

Adds Section 67504, which relates to the Long Range Development Plans (LRDPs) that each University of California campus and medical center periodically develops to guide physical development.

Repeals 71020, requiring the California Community Colleges Board of Governors every three years to develop and submit a diversity paper concerning its own membership.

Adds 92611.9, establishing legislative intent that the University of California carefully monitor the use and effects of the contracting of services at newly developed facilities. Requests that the UC system annually report to the fiscal committees of the legislature on specified provisions related to hiring and contracting.

Adds Chapter 10.5. Establishes the Jobs and Education for Texans (JET) grant program and fund to award grants to public junior colleges and public technical institutes, and to eligible nonprofit organizations to:
(1) Develop or support nonprofit organizations' programs that prepare low-income students for careers in high-demand occupations. Eligible programs must help students prepare for, apply to and enroll in a public junior college/technical institute, provide matching funds, and demonstrate that they have achieved or will achieve above average developmental course completion rates, persistence rates, and 3-year degree or certificate completion rates among participating students.
(2) Defray the start-up costs of new career and technical education programs in high-demand occupations
(3) Provide scholarships for students who demonstrate financial need and who are enrolled in training programs for high-demand occupations.

In awarding grants to public junior colleges and public technical institutes for the development of new career and technical education courses or programs, provides the comptroller may consider whether the course or program offers new or expanded dual credit career and technical educational opportunities in public high schools.

Directs the comptroller to conduct a study of the feasibility of basing part of all public postsecondary technical training program funding on the program's economic benefit to the state, and of estimating the additional tax revenue from employers generated by the ability of public junior colleges/technical institutes/state colleges to prepare students for employment fields for which there is employer demand. Requires the comptroller to report to the lieutenant governor and speaker of the house by January 2011 for legislative action based on the results of the study.

Defines "green jobs" as jobs in the field of renewable energy or energy efficiency. Establishes the Green Job Skills Development Fund and Training Program to support the implementation and expansion of green job skills training programs. Specifies that an eligible training program must be hosted by a regional partnership designed to implement training programs that lead trainees to economic self-sufficiency and career pathways. Requires regional partnerships to include at a minimum a postsecondary institution; chamber of commerce, local workforce agency, local employer, or other public or private participating entity; economic development authority; and community or faith-based nonprofit organization that works with one or more targeted populations.

Specifies criteria that eligible green job skills training programs must meet. Requires programs receiving grants to target specified groups of individuals for training, including low-income workers, unemployed youth and adults, individuals who did not complete high school, or other underserved sectors of the workforce in high poverty areas. Provides that a training program may use grant funds for support services, including basic skills, literacy, GED, English as a second language, and job readiness training, career guidance, and referral services. Establishes grant application procedures. Specifies training programs the comptroller must give preference to, and requires 20% of funds to be reserved for job skill training programs that serve the unemployed and those with incomes at or below 200% of the poverty level. Establishes grantee reporting requirements, and requires the comptroller to report biennially on submitted information to the governor, lieutenant governor and speaker of the house. Directs the comptroller to adopt standards for a green job skills training program awarded a grant.

Students in a four-year institution are required to have 120 credit hours in order to receive their degree. Currently, there is a "30-hour rule" that allows students to take up to 30 extra hours before graduating without being penalized with out-of-state tuition rates. This rule exempts students who have previously earned a baccalaureate degree, allowing them to complete a second degree with possibly more than 150 hours on their transcript. The rule does not, however, exempt students who have previously earned an associate degree, about 66 hours of transferrable coursework.

In Texas, there are 29 Early College high schools and many programs around the state that allow high school students to graduate with an associate degree along with their high school diploma. When these students transfer to a four-year institution, their 66 associate degree hours transfer either toward their baccalaureate degree or as elective hours, depending on the university. Normally, about half of the hours are counted as elective hours, putting students over the 30-extra hours they are allowed to take before being penalized with higher tuition rates by the time they reach junior or senior status.

The purpose of this bill is to add students with associate degrees to the list of exemptions in order for them to be able to continue to four-year institutions without worrying about higher tuition rates toward the end of their college careers.

S.B. 1343 relates to the formula funding for public institutions of higher education for certain credit hours that do not count toward a degree.

Section 6: Creates Section 61.0596, "University Funding for Excellence in Specific Programs and Fields; Incentive Grants". Provides that the section is to help general academic teaching institutions that are not categorized as "research universities" or "emerging research universities" in the state system to develop and maintain specific programs or fields of study of the highest national rank or recognition for that type of program or field. To that end, directs the higher education coordinating board to award incentive grants to general academic teaching institutions that the board considers to have demonstrated the greatest commitment to success in developing or improving the quality of the institution's existing degree program. Requires institutions to use such grants for faculty recruitment or other faculty support for the degree program for which the grant is awarded, including establishment of endowed faculty positions or enhancement of faculty compensation. Specifies that an institution may designate only one degree program at a time for consideration for new incentive grant funding. Directs the higher education coordinating board to set a series of benchmarks for each degree program designated by an institution. Provides the institution becomes eligible for incentive grant funding for each benchmark the board determines the institution to have met. Subchapter C creates the "Research University Development Fund" to provide research universities and emerging research universities with funding to recruit and retain highly qualified faculty and enhance research productivity at those universities. For each state fiscal year, directs the higher education coordinating board to distribute any funds legislatively appropriated for this purpose (and any other funds available for this purpose) to research universities and/or emerging research universities based on the average amount of total research funds expended by each institution annually during the three most recent state fiscal years, according to rates based on the average annual amount of research funds expended by the institution.

Subchapter D creates "Performance Incentive Funding". Defines "critical field" to include (1) engineering, computer science, math, physical science, allied health, nursing, or teacher certification in science or math and (2) any other field of study identified as a critical field by the coordinating board in "Closing the Gaps," the state's master plan for higher education. Defines "at-risk student" as an undergraduate student at a general academic teaching institution other than a public state college who meets any of the following criteria:
(1) Whose SAT or ACT score is less than the national mean score
(2) Who has been awarded a Pell Grant
(3) Who was at least 20 years old on the date of initial enrollment in the institution
(4) Who is enrolled as a part-time student
(5) Who did not receive a high school diploma but received a high school equivalency certificate within the last 6 years.

For each state fiscal year, directs the higher education coordinating board to distribute any legislatively appropriated performance incentive funds (and any other funds available for this purpose) to general academic teaching institutions according to a formula established in legislation and based on degrees awarded to at-risk and not at-risk students in critical fields and noncritical fields, with degrees awarded in noncritical fields/to not at-risk students receiving the lowest weight, degrees awarded in noncritical fields/ to at-risk students and in critical fields/ to not at-risk student receiving additional weight, and degrees awarded in critical fields to at-risk students receiving the highest weight.

Subchapter F creates the "Texas Research Incentive Program" (TRIP). Directs the higher education coordinating board to develop and administer the Texas Research Incentive Program (TRIP), to provide matching funds to help emerging research universities leverage private gifts to enhance research productivity and faculty recruitment. Establishes a formula for the state to provide matching grants to emerging research universities that receive private gifts or endowments aimed at enhancing research activities at the institution, including a gift or endowment for endowed chairs, professorships, facilities, equipment, program costs, or graduate stipends or fellowships. Identifies circumstances under which an eligible institution is not entitled to matching funds under the program. Provides that in the event of insufficient funds to provide matching grants to all eligible institutions, matching grants must be awarded in order of the date on which their receipt is certified by the coordinating board.

Subchapter G creates the "National Research University Fund". Authorizes a general academic teaching institution to receive a distribution of money from the fund for each year of a state fiscal biennium if the institution meets specified criteria. Provides that a general academic teaching institution that becomes eligible to receive a distribution of money remains eligible to receive a distribution in each subsequent state
fiscal year. Directs the coordinating board to report to the legislature in each even-numbered year certain information to be used to determine which institutions are initially eligible for distributions of money from the fund. Specifies that the University of Texas at Austin and Texas A&M University are ineligible to receive National Research University Fund monies. Directs the amount to be allocated to eligible institutions in each fiscal year to be based on an equitable formula adopted by the legislature. Specifies that monies received from the fund may be used only to (1) Provide faculty support and pay faculty salaries; (2) Purchase equipment or library materials; (3) Pay graduate stipends; and (4) Support research performed at the institution, including undergraduate research.

Sets the school finance distribution formula based primarily on what it will take for students to meet the state's academic standards. The amount is based largely on the findings of the 2007 Costing-Out Study. Provides for a transferring pupil's disciplinary record to be transmitted to the transferring public or private school, upon request. Provides for school employee background checks, budgets, classroom placement of twins, bullying, scholastic records, educational support, early learning programs, virtual high schools, charter schools, school transportation, educational empowerment districts, community colleges, educational improvement business tax credits, public records, libraries and special education.

EARLY CHILDHOOD EDUCATION 
The 2008-09 education budget invests $86.4 million in Pennsylvania Pre-K Counts, a 15 percent increase from 2007-08, to enable 800 more children to participate in the commonwealth's hallmark, voluntary pre-kindergarten initiative and to respond to parents' requests for more full-day enrollment opportunities among some of the existing half-day programs. 
CLASSROOMS FOR THE FUTURE 
The budget includes $45 million for technology and $15 million for professional development to continue the multi-year rollout of Classrooms for the Future.
SCIENCE: IT'S ELEMENTARY 
The effort to promote science learning in elementary schools will receive $14.5 million – a 7.4 percent increase – in 2008-09, enabling thousand of more students to benefit from this hands-on learning experience and be ready for higher-order science classes in middle and high school.
DUAL ENROLLMENT
Pennsylvania's Dual Enrollment program is designed to serve a wide-range of students, but particularly those who attend college at disproportionately low rates. The budget continues the $10 million in annual funding for Dual Enrollment, which allows high school students to take college courses through community colleges and four-year colleges and universities. By encouraging the participation of students who might otherwise be unlikely to attend college, the Dual Enrollment program helps ensure all students have the opportunity to earn a post-secondary degree and become self-sufficient, productive taxpayers.
HIGHER EDUCATION 
The budget continues to invest in the commonwealth's higher education institutions to offer affordable and accessible post-secondary education in Pennsylvania. State funding for student tuition grants through PHEAA will increase by $21.2 million, or 5.5 percent. The state's community colleges will receive a 3 percent operating increase. An additional $14.5 million will be provided to the State System of Higher Education to keep down tuition increases.

Specifies that the 2008 data must provide a baseline and must include at least the following baseline data for the past five years by program, department, campus, and university:
(1) The number of full-time equivalent students
(2) The number of students who have transferred to other institutions of higher education within the University of Hawaii system
(3) The number of students who have graduated
(4) The number of full-time equivalent faculty
(5) The number of openings in major workforce shortage areas, including teaching, nursing, and technology, as data are available through the department of labor and industrial relations or similar sources
(6) The number of graduates filling job openings in major workforce shortage areas, as data are available.

Provides that, beginning in 2009, the incentive and performance report and plan must continue to provide the quantitative data, as well as a qualitative data analysis of the success of efforts to enroll, transfer and graduate students, and how this objective matches the university's strategic plan and the state's workforce needs. Specifies that the allocation of up to 2% of incentive and performance funds must be based on these results. Requires the University of Hawaii to include measurable goals and performance data in its strategic plan.

Requires the annual incentive and performance report to describe the success of previous incentive and performance plans by analyzing the outcome performance measures in relation to plan goals. Provides that the report must also propose the following year's incentive and performance plan, including identifying the goals, performance outcome measures, and sources of funding, which may include new general fund appropriations, reallocated existing general fund appropriations, and other sources of funding available to the university. 

Establishes a task force to assist the university in developing a budgetary system that includes an equitable, consistent and responsive funding formula for the distribution of fiscal resources to the various campuses. Requires the task force to submit to the president of the University of Hawaii, for the president's approval, a report of its progress, and any findings and recommendations, including:
(1) Information as to how full-time equivalent enrollment, historical enrollment growth, future enrollment growth, enrollment mix and similar factors should be linked to funding, through formula funding, base funding, incentive funding or any other methodology
(2) The consultant's analysis and expert opinion as to the methodology to be employed and as to whether campuses are underfunded or overfunded, based upon past enrollment growth, current enrollment, enrollment mix, funding and other factors
(3) The consultant's recommendations as to the amount of adjustments to the campus base budgets that are needed to compensate for shortfalls in prior years and how those adjustments should be accomplished
(4) A target date for the completion of a funding formula together with any proposed legislation to establish and implement the funding formula.

Requires the report, if approved by the president, to be submitted to the legislature prior to the convening of the 2009 session.

Beginning with fiscal year 2011, students with test scores between the top five percent and the top three percent qualify for a scholarship of $1,000. Creates the Access Missouri Financial Assistance program, defines eligibility criteria and maximum and minimum financial awards. Repeals Gallagher student financial assistance and college guarantee programs and directs that certain gambling boat boarding fee revenue that currently goes to the Missouri College Guarantee Fund be instead deposited into the Access Missouri Financial Assistance Program.

Enacts the Higher Education Student Funding Act, limiting tuition increases that institutions may charge. Grants Missouri Higher Education Loan Authority (MoHELA) authority to transfer assets of the authority to the newly created Lewis and Clark Discovery Fund. Requires MoHELA to distribute $350 million of assets of the authority to the fund not later than September 30, 2013. Moneys in the fund may be appropriated by the general assembly only for funding for capital projects at public colleges and universities and funding for the Missouri Technology Corporation's ability to work with colleges and universities in identifying opportunities for commercializing technologies. Directs the department of economic development to allocate a percentage of the state ceiling for private activity bonds to MoHELA.

States that undergraduate tuition and fees for state university resident students are established within proviso in the General Appropriations Act or law. Requires each board of trustees to set university tuition and fees for graduate, graduate professional and nonresident students, although these may not exceed the average full-time tuition and fees for corresponding programs at member schools of the Association of American Universities. Bars the annual percentage increase in tuition and fees set by each board of trustees for students enrolled prior to the fall of 2005 from exceeding the legislature's annual percentage increase for resident undergraduate students. Requires at least 20 percent of the amount raised by tuition increases to be allocated by each university to need-based financial aid for students. Allows tuition and fees for for graduate, graduate professional, or nonresident students to exceed a cap set for undergraduate resident students.

Requires an undergraduate student to pay 75% over the in-state tuition rate for any credit hours exceeding 120 percent of the number of credit hours required to complete the student's degree program. Provides that a community college student who has earned the associate degree need not pay the full cost for a maximum of 24 hours taken while enrolled at a community college which apply to the student's baccalaureate degree. Provides that an undergraduate student at a state university or in a baccalaurate program at a community college must pay the higher rate for exceeding the aforementioned credit hour limit, regardless of whether those hours were taken while enrolled at a community college, a state university or any private postsecondary institution if the student received state funds while enrolled at the private postsecondary institution.

States that credit hours earned under the following circumstances are not calculated as hours required to earn a degree:
(a) College credits earned through an accelerated mechanism identified in s. 1007.27;
(b) Credit hours earned through internship programs;
(c) Credit hours required for certification, recertification, or certificate degrees;
(d) Credit hours in courses from which a student must withdraw due to reasons of medical or personal hardship;
(e) Credit hours taken by active-duty military personnel;
(f) Credit hours required to achieve a dual major undertaken while pursuing a degree;
(g) Remedial and English as a Second Language credit hours; and
(h) Credit hours earned in military science courses (R.O.T.C).

Requires postsecondary institutions to implement a process for notifying students regarding these requirements, which notice must be provided upon the student's initial enrollment in the institution and again upon the student's having earned the credit hours required to complete the degree program in which he or she is enrolled. Requires the notice to include a recommendation that each student who intends to earn credit hours at the institution beyond those required for his or her enrolled degree program meet with his or her academic advisor.

Adds that the state educational institutions may adjust the tuition and fee rates only if appropriations to the state educational institution in the state budget act are reduced or withheld, and that if a state educational institution adjusts its tuition and fee rates, the total revenue generated by the tuition and fee rate adjustment cannot exceed the amount by which appropriations to the state educational institution in the state budget act were reduced or withheld.

Requires the commission for higher education to complete the establishment of the initial core transfer library and for at least 70 courses and the initial articulation agreements for at least 12 degree programs before July 1, 2007.

Generally, the bill prohibits a political subdivision from increasing its levy by a percentage that exceeds the percentage change in the political subdivision's equalized value due to new construction, less improvements removed, not including any such changes in a tax incremental district (TID). In addition, the calculation of a city's, village's, or town's levy does not include any tax increment that is generated by a TID. With regard to technical college districts, the levy limit is the levy for the previous year multiplied by 1.026. The bill contains exceptions to the levy limit for political subdivisions that transfer the provision of services, for cities or villages that annex town territory, and for a county levy that relates to a county Children with Disabilities Education Board. The levy limit may also be exceeded if a political subdivision's or technical college district's resolution to do so is approved in a referendum. Assumptions: Investment income earned in FY 2005 (April 1 through June 30, 2005) from the Higher Ed. Acct. is estimated at $277,000 for the UW and $138,500 for the community colleges. The estimates in the table above represent the total projected increase in investment income from the Higher Ed. Acct. and the Scholarship Acct. Of those totals, $317,000 of UW's increase per year and $158,000 of the community colleges increase per year is from the Scholarship Acct. The remainder is from the Higher Ed. Acct.
 
Estimates are based on an anticipated annual rate of return of 4.75 percent for FY 2005 though FY 2008.

Independent four-year colleges must have representation on all formal and informal committees and commissions dealing with higher education statewide issues. Also addresses instate tuition for certain students. Beginning with school year 2002-2003, the annual amount of a LIFE Scholarship for eligible resident students attending a four-year independent institution must be the cost of attendance up to a maximum of the average annual cost of tuition at the state's four-year public institutions of higher learning in the corresponding academic year. In addition, beginning with school year 2002-2003, eligible resident students attending two-year independent institutions may not receive an annual LIFE scholarship of more than the maximum cost of tuition at two-year regional public institutions for thirty credit hours a year or its equivalent."
