WVSigned into law 03/2012Community CollegeAuthorizes a program of adult basic education at each state community and technical college campus where developmental education services are provided. This approach to providing adult basic education links the programs students study under with developmental education and creates a simpler, clearer pathway for adults to enter college.

Transfers title to certain property to state board. Under certain circumstances, State board may pay transportation of any certified unemployed person participating in any vocational program.

Establishes West Virginia Earn a Degree Graduate Early initiative (EDGE) to connect public schools with higher education to prepare public high school students for success in the workplace or postsecondary education and to provide the opportunity for these students to earn community and technical college credit free of charge for certain courses. EDGE's goals include increasing postsecondary enrollment.

Creates the Collaborative Degree Completion Program to increase the number of West Virginians who hold or can earn a college credential and increase the education and technical skills of the states' workforce.

Requires certain agreements between community and technical college consortia, career and technical centers and public high schools to cooperatively deliver services effectively and efficiently where needed most.

Clarifies duties of community and technical consortia planning districts and specifies certain accountability procedures.

Defines programs of study and directs consortia to focus on identifying and providing student programs of study leading to placement in high demand, high wage occupations.

Coenrollment in Public Schools and Adult Education Programs
Prohibits funding for coenrollment in public schools and adult general education programs, except that for the 2011-2012 fiscal year students may enroll in core courses for credit recovery or dropout prevention for up to two courses. Provides that high school students are exempt from the payment of block tuition for general adult education programs.

Facilities
Expands the class size reduction lottery bond program to include other educational facilities. Suspends temporarily the state match for facilities and operating challenge grant programs for colleges and universities, effective July 1, 2011. Provides that existing eligible donations will remain eligible for future match and that the suspension may be removed once $200 million of the grant backlog has been matched. Allows a university board of trustees to expend carry-forward balances from prior year operational appropriations on legislatively approved fixed capital outlay projects authorized for the establishment of a new campus.

Finance
Streamlines library operations through consolidation and joint purchasing. Requires creation of a union catalog for higher education. Requires the Florida College System Council of Presidents to develop and recommend an equitable funding formula for the distribution of certain state funds to the college system institutions. Provides for the use of a funding formula to ensure equitable distribution of district workforce funds. Provides a $200,000 limit on the amount of state funds that may be paid for salaries of college and university presidents and administrative employees. Terminates the University Concurrency Trust Fund.

Finanical Aid/Scholarships
Increases the Florida Medallion Scholarship test scores in 2013-2014, from 1050 to 1170 for SAT, including the applicable home school test scores. Increases or establishes required community service hours for Bright Futures applicants. Requires applicants for Bright Futures, and certain other programs to submit the Free Application for Federal Student Aid prior to disbursement of funds. Prioritizes state student financial aid to the neediest (Pell eligible) students for the Florida Work Experience Program and the First Generation in College Program.

Northwest Regional Data Center
Designates the Northwest Regional Data Center as a primary data center.

Student Enrollment Pilot Program
Authorizes a spring and summer term student enrollment pilot program at the University of Florida for the purpose of aligning student enrollment and the availability of instructional facilities. Authorizes Bright Futures scholarships in the summer for these students.

Transient Student Admission
Authorizes the implementation of a transient student admission application process through the Florida Academic Counseling Tracking for Students system to include admissions, readmissions, financial aid, and transfer of credit functions. Authorizes a fee of $5 to support the system.

Tuition
Provides an exemption from the 30 percent need-based expenditure requirement from the tuition differential fee if the university has covered the entire tuition and fee costs of all resident students who are eligible for need-based aid. Authorizes alternative documentation for tuition fee waivers for Purple Heart veterans. Increases the tuition surcharge for excess hours to 100 percent in excess of 115 percent of the credit hours required for a degree. Requires a block tuition and corresponding out-of-state fee for students enrolled in adult general education courses. Rules relating to definitions, use of funds, essential program components, and the advisory committee are amended. Establishes the Jobs and Education for Texans (JET) grant program and fund to award grants to public junior colleges and public technical institutes, and to eligible nonprofit organizations to:
(1) Develop or support nonprofit organizations' programs that prepare low-income students for careers in high-demand occupations. Eligible programs must help students prepare for, apply to and enroll in a public junior college/technical institute, provide matching funds, and demonstrate that they have achieved or will achieve above average developmental course completion rates, persistence rates, and 3-year degree or certificate completion rates among participating students.
(2) Defray the start-up costs of new career and technical education programs in high-demand occupations
(3) Provide scholarships for students who demonstrate financial need and who are enrolled in training programs for high-demand occupations.

In awarding grants to public junior colleges and public technical institutes for the development of new career and technical education courses or programs, provides the comptroller may consider whether the course or program offers new or expanded dual credit career and technical educational opportunities in public high schools.

Directs the comptroller to conduct a study of the feasibility of basing part of all public postsecondary technical training program funding on the program's economic benefit to the state, and of estimating the additional tax revenue from employers generated by the ability of public junior colleges/technical institutes/state colleges to prepare students for employment fields for which there is employer demand. Requires the comptroller to report to the lieutenant governor and speaker of the house by January 2011 for legislative action based on the results of the study.

Defines "green jobs" as jobs in the field of renewable energy or energy efficiency. Establishes the Green Job Skills Development Fund and Training Program to support the implementation and expansion of green job skills training programs. Specifies that an eligible training program must be hosted by a regional partnership designed to implement training programs that lead trainees to economic self-sufficiency and career pathways. Requires regional partnerships to include at a minimum a postsecondary institution; chamber of commerce, local workforce agency, local employer, or other public or private participating entity; economic development authority; and community or faith-based nonprofit organization that works with one or more targeted populations.

Specifies criteria that eligible green job skills training programs must meet. Requires programs receiving grants to target specified groups of individuals for training, including low-income workers, unemployed youth and adults, individuals who did not complete high school, or other underserved sectors of the workforce in high poverty areas. Provides that a training program may use grant funds for support services, including basic skills, literacy, GED, English as a second language, and job readiness training, career guidance, and referral services. Establishes grant application procedures. Specifies training programs the comptroller must give preference to, and requires 20% of funds to be reserved for job skill training programs that serve the unemployed and those with incomes at or below 200% of the poverty level. Establishes grantee reporting requirements, and requires the comptroller to report biennially on submitted information to the governor, lieutenant governor and speaker of the house. Directs the comptroller to adopt standards for a green job skills training program awarded a grant.

NESigned into law 04/2009Community CollegeProvides for vocational training for public assistance recipients; provides that for creating the self-sufficiency contract and meeting the applicant's work activity requirement, an applicant shall be allowed to engage in vocational training that leads to an associate degree, a diploma, or a certificate for a minimum of twenty hours per week for up to thirty-six months. From the fiscal note: This bill would allow the work activity requirements for receiving Aid to Dependent Children assistance to include engaging in vocational training that leads to an associate's degree, a diploma or a certificate for a minimum of 20 hours per week for up to 36 months. This provision terminates on September 30, 2012. Required work activities are outlined in the federal Temporary Assistance for Needy Families Act (TANF). In addition to outlining the scope of work activities, states must meet a work participation rate of 50%. Failure to the meet the work participation rate could result in federal penalties being imposed on the state.

Federal law caps vocational training at 12 months. States may exceed the 12-month federal cap, but the individuals who are in
vocational training longer than 12 months do not count towards meeting the federal work participation rate. Based on current work
participation rates and the sunset date, this provision would not put the state's work participation rates at less than 50%.

Section 11 of this bill (The Adult technical education; workforce education and training; report) requires the commissioner of education to:
(1)  Outline and review the current method or methods by which tuition is paid for students enrolled in secondary schools ("secondary students") to attend regional technical center programs.
(2)  Consider and propose potential solutions to any barriers preventing, discouraging, or failing to encourage secondary students to attend regional technical center programs, including scheduling issues, availability of classes outside the traditional school day and academic year, and financial disincentives.
(3)  Outline and review the current method or methods by which the cost of adults entering programs at a regional technical center is funded, both for adults who have a high school diploma and for those who do not.
(4)  Consider and propose potential solutions to any barriers preventing, discouraging, or failing to encourage adults, with and without a high school diploma, to attend regional technical centers, including scheduling issues, availability of classes outside the traditional school day and academic year, and financial disincentives.
(5)  Consider and propose potential financial and other incentives to encourage regional technical centers to offer technical education programs at times other than the traditional school day and academic year and to otherwise make technical education programs more available to secondary students and to adults with and without high school diplomas.
(6)  Consider the positive and negative aspects of including within the definition of "pupil" for purposes of determining a district's average daily membership all adult students with a high school diploma who are attending programs at a regional technical center and consider and propose other methods of subsidizing tuition for these students.
(b)  On or before January 15, 2009, the commissioner shall submit a written report to the senate committee on economic development, housing and general affairs, the house committee on commerce, and the senate and house committees on education detailing the results of the work performed pursuant to this section and all potential methods of addressing the identified issues.

(f) Statewide institutes that prepare cadres of mathematics leaders in local school districts, which may include highly skilled retired mathematics teachers, to serve as coaches and mentors in districts and schools;
(g) Cohesive continuing education options for experienced mathematics classroom teachers;
(h) Closing the student achievement gap among various student subpopulations;
(i) Curriculum expectations and assessments of students among the various school levels, prekindergarten, primary, elementary, middle, and high school;
(j) Content standards for adult education centers providing mathematics curricula;
(k) Introductory postsecondary education mathematics courses that are appropriate to the wide array of academic programs and majors;
(l) Research to analyze further the issues of transition from high school or GED programs to postsecondary education mathematics; and
(m) The early mathematics testing program under KRS 158.803.
Other factors may be included in the strategic plan as deemed appropriate by the committee to improve mathematics achievement of Kentucky students.

Requires the committee to (a) Design a statewide professional development program that includes summer mathematics institutes at colleges and universities, follow-up, and school-based support services, beginning no later than June 1, 2006, to prepare teams of teachers as coaches and mentors of mathematics at all school levels to improve student achievement. Specifies areas the design must address. (b) Require schools and districts approved to have participants in the mathematics leader institutes to provide specified assurances to support institute participants and students who need modified instructional and intervention services in math.

Establishes committee membership, terms, chairmanship, attachmetn to Kentucky Department of Education, and responsibilities. Specifies that the committee must:
(a) Present a draft strategic plan addressing the requirements in subsection (1) of this section and other issues that arose during the work of the committee to the Education Assessment and Accountability Review Subcommittee no later than August 2005;
(b) Present the strategic plan for improving mathematics achievement to the Interim Joint Committee on Education by July 15, 2006, which shall include any recommendations that require legislative action; and
(c) Provide a final written report of committee activities to the Interim Joint Committee on Education and the Legislative Research Commission by December 1, 2006.

Also specifies that the committee will have ongoing responsibility for providing advice and guidance to policymakers in the development of statewide policies and in the identification and allocation of resources to improve mathematics achievement. In carrying out this responsibility, the committee must periodically review the strategic plan and make modifications as deemed appropriate and report those to the Interim Joint Committee on Education.
Mandates that the committee collaborate with the Center for Mathematics to ensure that there is ongoing identification of research-based intervention programs for K-12 students who have fallen behind in mathematics, rigorous mathematics curricula that prepare students for the next level of schooling, research-based professional development models that prepare teachers in mathematics and pedagogy, and strategies for closing the gap between high school or GED and postsecondary mathematics preparation.

Administrative costs are limited to 8% for community-based or non-profit organizations and 5% for school districts of the total state funds received from the district or consortium. This cannot exceed the actual unreimbursed cost of administering ABE services. To be eligible to deliver ABE services, a non-profit or community-based organization must demonstrate that it: 1) is legally established; 2) can meet the ABE reporting requirements; 3) provides training for instructional staff; and 4) develops a learning plan for each participating adult learner with measurable goals or have prior experience.
Performance Tracking System (Section 15). Requires all ABE programs to develop and implement a performance tracking system by July 1, 2000 to collect data on the following core indicators: 1) improvements in literacy skill levels; 2) participation in post-secondary education, training, subsidized employment or career advancement; and 3) receipt of a secondary school diploma or equivalent.
Bill also establishes a base aid for ABE programs equal to $1.80 times the population of the district or a minimum of $4,000. After the basic population aid is paid in full, the difference between the state total and the basic population aid is allocated among districts/programs as follows:
1) eighty-four percent is distributed based on a program's relative share of contact hours in the prior year; 2) eight percent is distributed based on a district's relative share of the students with limited English proficiency enrolled in the district in the prior year; and 3) eight percent is distributed based on a district's relative share of adults in the district without a high school diploma according to the last federal census.
For FY 2002 and later, also establishes two limits to the state ABE aid distributed to ABE programs. Total aid for a program cannot exceed four times the rate per prior year contact hour. A program's aid distributed on the basis of contact hours cannot grow by more than 17 percent per year or $20,000, whichever is more.
Legislation additionally directs the Board of Teaching to develop a competency-based license for adult learners as an alternative to the current licensing requirements. The Board must develop recommendations for the legislature, in consultation with a task force, and report to the legislature by January 15, 2002.
