of state assessments, the school systems where the provider will operate, the proposed courses offered, and the alignment of the courses with any approved Louisiana diploma. Provides for an initial authorization period of three years and provides for reauthorization for additional periods of three to five years. Provides for monitoring and evaluation of course providers by the board. Requires the board to create a common course numbering process and course catalogue for all courses and a reciprocal teacher certification process for certain teachers residing in other states who are employed by course providers. Section 1: Directs the state board, by December 31, 2010, to review mandates provided for in administrative rule, to determine whether some could be waived to remove funding pressures on public schools temporarily.

Sections 2-4: Eliminates the requirement to administer criterion-referenced tests to students in grade 2. Directs the state board, before the October 2010 Education Interim Committee meeting, to present its plan for a pilot program for the 2010-11 and 2011-12 school years to (1) replace the 10th-grade basic skills competency test with computer adaptive testing of basic skills, and (2) administer the ACT exam to high school students. Directs the state board to implement such a pilot program during the 2010-11 and 2011-12 school years. Exempts districts and charter schools from administering the 10th-grade basic skills competency test during the the 2010-11 and 2011-12 school years. Directs the state board to re-direct the money saved by not administering the 10th-grade basic skills competency test to fund implementation of the pilot program during the 2010-11 and 2011-12 fiscal years. Exempts a student from the 10th-grade basic skills competency test requirement if the student was in 10th grade in the 2008-09 or 2009-10 school years and did not pass the competency test (10th-grade basic skills competency test functions as exit exam unless certain waivers apply).

Section 5: Exempts local boards from the requirement to develop and administer activity disclosure statements for high school-level extracurricular activities (as called for in Section 53A-3-420) until the 2012-13 school year.

Section 6: Exempts the state board, until the 2012-13 school year, from the requirements called for in Section 53A-3-602.5 to annually (1) develop a school performance report for schools, districts and charter schools, and (2) collect and electronically report specified performance data for schools, districts and charter schools.

Section 7: Exempts a school district from certain requirements related to the disposal of textbooks until the 2012-13 school year.

Section 8: Until the 2012-13 school year, releases districts from the requirement in Section 53A-13-107 that an annual presentation on adoption be given to students in grades 7-12.

Section 9: Until the 2012-13 school year, releases districts from the requirement in Section 53A-14-107 regarding alignment of primary instructional materials aligned with the core curriculum adopted under Section 53A-1-402.

WISigned into law 02/2010P-12The purpose of the statute on instruction in human growth and development instruction is to encourage all school boards to ensure that pupils in their districts are provided ageappropriate instruction in human growth and development. The Act provides that the instruction should
support and enhance communication between pupils and their parents and provide pupils with the knowledge, skills, and support necessary to make healthy decisions now and throughout their lifetimes and to make responsible decisions about sexual behavior. The Act defines "age-appropriate" as suitable to a particular age group of pupils based on the developing cognitive and emotional capacity of and behaviors typical for the age group. a school board that elects not to provide an instructional program in human growth and development must, by September 30 of each school year, send home to the parent or guardian of each pupil enrolled in the school district a notice that includes all of the following:
-- A statement that the school board is encouraged by state statute to provide instruction in human growth and development in grades kindergarten to 12.
-- The subjects of instruction required if the school board were to provide instruction in human
growth and development.
-- A statement that the school board is not providing any instruction in human growth and
development to pupils enrolled in the school district.
Eliminates the prohibition on volunteer health care providers providing instruction on human sexuality, reproduction, family planning, HIV and AIDS, prenatal development, childbirth, adoption, available prenatal and postnatal support, and male and female responsibility in a school.

Identify and develop policies and procedures to implement and evaluate the farm-to-school program; 2. Assist food producers, distributors and food brokers to market state grown food to schools; 3. Assist schools in connecting with local producers; 4. Identify and recommend mechanisms that will increase the predictability of sales for producers; 5. Identify and make available existing curricula, programs and publications for educational purposes; 6. Support efforts to advance other farm-to-school connections; and, 7. Seek additional funds. In cooperation with OSPI, the department of agriculture must collect data on the activities conducted under the act and report biennially to the legislature.

The bill also creates the Washington grown fresh fruit and vegetable grant program within OSPI to facilitate consumption of state grown food by school children. The grant program is to be modeled after the fderal fresh fruit and vegetable program (42 USC Sec. 1769(g)); however, schools receiving grants under this federal program are not eligible for state grants. OSPI must solicit applications, conduct a competitive process and make one to two-year grants to urban and rural schools. The superintendent must follow certain factors and criteria when evaluating applications and selecting grantees. Priority is to be given to applicant schhols with grades K-8 that participate in the national school lunch program and have 50% or more of their students eligible for free or reduced price meals. In coordination with the department of agriculture, OSPI is directed to track outcome measures of the grant program.

School districts are authorized to operate school gardens or farms for the purpose of growing fruits and vegetables to be used for educational purposes and to be offered to students through district meal and snack programs. Student organizations (such as 4-H) must be given the opportunity to be involved in the operation of the garden or farm. When the gardens/farms are used for educational purposes, students must be afforded the opportunity to learn about conventional and organic growing methods.

TXBecame law without governor's signature 05/2007P-12To address an increase in births to unmarried parents in Texas from 1995 to 2002, the office of the Attorney General created the Parenting and Paternity Awareness (P.A.P.A.) program. The program involves engaging students in discussions regarding marriage, committed relationships, and the importance of a father to a child's well-being. Many teachers across Texas have received the curriculum training with positive response from both teachers and students. However, the Texas Education Code does not require school districts to provide an educational program or support services for students who are parents, or to female students who are pregnant. Requiring this type of program in schools may result in students who are better informed about the duties and responsibilities of parenting, relationship skills, and money management. Additionally, such a program may decrease the number of pregnancies and improve parenting relationships and financial skills of those who are parents and of those who are soon to become parents. H.B. 2176 requires a school district to incorporate a parenting and paternity awareness program, developed by the state board in conjunction with the Office of the Attorney General, into the high school health curriculum.

Era. Requires the state board, by February 2007, to adopt a curriculum for each course, including objectives, reading materials, and lesson plans. Specifies that the Old and New Testament shall be the basic text for each respective course. Effective July 2007, students may earn .5 Carnegie units of elective credit for completing each course.

Requires the courses to:
(A) Be taught in an objective and nondevotional manner with no attempt made to indoctrinate students as to either the truth or falsity of the biblical materials or texts
from other religious or cultural traditions;
(B) Not include teaching of religious doctrine or sectarian interpretation of the Bible or of texts from other religious or cultural traditions; and
(C) Not disparage or encourage a commitment to a set of religious beliefs.

Specifies that no person shall be assigned to teach such courses based in whole or in part on any religious test, profession of faith or lack thereof, prior or present religious affiliation or lack of affiliation, or criteria involving particular beliefs or lack thereof about the Bible. Adds that the qualifications and training of teachers shall be determined by local boards.

Authorizes a local board to monitor the content and teaching of the courses as it deems appropriate.

Clarifies that these provisions do not limit the authority of a local board to offer courses regarding the Old Testament or the New Testament that are not in compliance with these provisions; provided, however, that no state funds shall be expended in connection with such a course that does not meet the requirements of these provisions. Also clarifies that local boards are not barred from offering elective courses based upon the books of other religions or societies. In determining whether to offer such courses, the local board may consider various factors including student and parent demand for such courses and the impact such books have had upon history and culture.

Establishes the Committee for Mathematics Achievement to develop a multi-faceted strategic plan to improve student achievement in mathematics at all levels of schooling, prekindergarten through postsecondary and adult. Specifies that at a minimum, the plan must address:

(a) Challenging curriculum that is aligned prekindergarten through postsecondary, including consensus among high school teachers and postsecondary education faculty about expectations, curriculum, and assessment;
(b) Attitudes and beliefs of teachers about mathematics;
(c) Teachers' knowledge of mathematics;
(d) Diagnostic assessment, intervention services, and instructional strategies;
(e) Shortages of teachers of mathematics, including incentives to attract strong candidates to mathematics teaching;
(f) Statewide institutes that prepare cadres of mathematics leaders in local school districts, which may include highly skilled retired mathematics teachers, to serve as coaches and mentors in districts and schools;
(g) Cohesive continuing education options for experienced mathematics classroom teachers;
(h) Closing the student achievement gap among various student subpopulations;
(i) Curriculum expectations and assessments of students among the various school levels, prekindergarten, primary, elementary, middle, and high school;
(j) Content standards for adult education centers providing mathematics curricula;
(k) Introductory postsecondary education mathematics courses that are appropriate to the wide array of academic programs and majors;
(l) Research to analyze further the issues of transition from high school or GED programs to postsecondary education mathematics; and
(m) The early mathematics testing program under KRS 158.803.
Other factors may be included in the strategic plan as deemed appropriate by the committee to improve mathematics achievement of Kentucky students.

Requires the committee to (a) Design a statewide professional development program that includes summer mathematics institutes at colleges and universities, follow-up, and school-based support services, beginning no later than June 1, 2006, to prepare teams of teachers as coaches and mentors of mathematics at all school levels to improve student achievement. Specifies areas the design must address. (b) Require schools and districts approved to have participants in the mathematics leader institutes to provide specified assurances to support institute participants and students who need modified instructional and intervention services in math.

Establishes committee membership, terms, chairmanship, attachmetn to Kentucky Department of Education, and responsibilities. Specifies that the committee must:
(a) Present a draft strategic plan addressing the requirements in subsection (1) of this section and other issues that arose during the work of the committee to the Education Assessment and Accountability Review Subcommittee no later than August 2005;
(b) Present the strategic plan for improving mathematics achievement to the Interim Joint Committee on Education by July 15, 2006, which shall include any recommendations that require legislative action; and
(c) Provide a final written report of committee activities to the Interim Joint Committee on Education and the Legislative Research Commission by December 1, 2006.

Also specifies that the committee will have ongoing responsibility for providing advice and guidance to policymakers in the development of statewide policies and in the identification and allocation of resources to improve mathematics achievement. In carrying out this responsibility, the committee must periodically review the strategic plan and make modifications as deemed appropriate and report those to the Interim Joint Committee on Education.
Mandates that the committee collaborate with the Center for Mathematics to ensure that there is ongoing identification of research-based intervention programs for K-12 students who have fallen behind in mathematics, rigorous mathematics curricula that prepare students for the next level of schooling, research-based professional development models that prepare teachers in mathematics and pedagogy, and strategies for closing the gap between high school or GED and postsecondary mathematics preparation.

KYSigned into law 03/2005P-12Beginning with the 2006-2007 school year, requires each school to limit access to no more than one day each week to retail fast foods in the cafeteria, whether sold by contract, commercial vendor, or otherwise.

Requires every district to appoint a food service director who is responsible for the management and oversight of the food service program in the district; allows two or more contiguous districts to form a "school food service area," in which a school food service director must be jointly selected by the participating superintendents to oversee the school food service area. Each school food service director must be certified as a "school food service and nutrition specialist" or certified by a Level 2 certificate issued by the American School Food Service Association within three years after this bill goes into effect. Requires school cafeteria managers to annually receive at least two hours of continuing education in applied nutrition and healthy meal planning and preparation.

Defines "competitive food," "school day" and school-day-approved beverage." Defines "school-day-approved beverage" as water, 100% fruit juice, lowfat milk, and any beverage that contains no more than 10 grams of sugar per serving. Requires the state board to specify the minimum nutritional standards for all foods and beverages sold outside the National School Breakfast and National School Lunch programs in vending machines, school stores, canteens, and a la carte cafeteria sales. Requires minimum nutritional standards to be based on the most recent edition of the United States Department of Agriculture's Dietary Guidelines for Americans. Requires the state board rule to address serving size, sugar, and fat content of the foods and beverages. Permits school districts to impose more stringent standards than the state board standards. Requires all schools to follow the state board minimum standards unless the school has obtained a waiver from the state board. Requires any waiver approved by the state board to be reviewed on an annual basis.

Bars schools from selling competitive foods or beverages from the time of the arrival of the first student at the school building until 30 minutes after the last lunch period. Allows only school-day-approved beverages to be sold in elementary schools during the school day in vending machines, school stores, canteens, or fundraisers that sell beverages by students, teachers, or groups on school grounds.

Establishes fines and other sanctions for any public school that violates the school food nutrition requirements in section 4 of this bill.

Requires each school food service director to annually assess school nutrition in the district and issue a written report to parents, the local school board, and school-based decision making councils. The report must include:
(a) An evaluation of compliance with the National School Breakfast and National School Lunch programs;
(b) An evaluation of the availability of contracted fast foods or foods sold through commercial vendors;
(c) A review of access to foods and beverages sold outside the National School Breakfast and National School Lunch programs, including vending machines, school stores, canteens, and a la carte cafeteria sales;
(d) A list of foods and beverages that are available to students, including the nutritional value of those foods and beverages; and
(e) Recommendations for improving the school nutrition environment.

Requires the state board to develop an assessment tool that each school district may use to evaluate its physical activity environment. Requires the evaluation to be completed annually and released to the public at the same time as the school food service director's annual nutrition report. Requires every local board to discuss the findings of the nutrition report and physical activity report, seek public comments during a public meeting of the board, and annually hold an advertised public forum to present a plan to improve school nutrition and physical activities in the school district.

Requires each school council of an elementary school to develop and implement a wellness policy that includes moderate to vigorous physical activity each day and encourages healthy choices among students. The policy may permit physical activity to be considered part of the instructional day, up to 30 minutes per day, or 150 minutes per week. Each school council must adopt an assessment tool or utilize an existing assessment program to annually determine each child's level of physical activity. Requires the department to make available a list of available resources to carry out the provisions of this subsection, and to report annually to the Legislative Research Commission on how the schools are providing physical activity under these requirements, and on the types of physical activity being provided. The policy developed by the school council must comply with provisions required by federal law, state law, or local board policy.

Deletes existing provision that, beginning with the 2004-05 school year, schools serving children in grades K-6 provide at least thirty minutes of quality physical activity for students each school day. Replaces with provision that in 2004-05 school year, schools serving children in such grades provide at least thirty minutes of "quality moderate to vigorous" physical activity for students every school day. Requires every public elementary school to annually report to its local board on compliance with this provision. Also requires every local board to annually report to the state board on compliance with this provision. Requires suitably adapted physical activity to be included as part of the individual education plans for students with chronic health problems, other disabling conditions or other special needs that preclude participation in regular physical activity.

Encourages secondary school students not enrolled in a physical education course to participate in moderate to vigorous physical activity commensurate with student ability for at least 30 minutes a day.

Requires various state agents, including the department of education and the department of health and hospitals, as well as the American Heart Association, to collaborate to develop an outreach and communication plan consisting of current information and research on health, nutrition and physical education and fitness issues. This plan must be disseminated to every local public school board and made available to parents and students.

Beginning with the 2004-05 school year, requires a public elementary or secondary school selected from each regional education service center region in the state to be annually identified for an outstanding program of physical activity implemented at the school. As funds are available, requires monetary awards to be given these outstanding schools.

Allows any public school serving students in grades 7, 8, 9 or 10 to apply to participate in a three-year pilot program to begin in the 2005-06 school year. Requires the state board to choose up to eight schools from each of the eight regional service districts to participate in the program, striving to achieve equal geographic distribution. Identifies areas of study: (1) An annual assessment that measures aspects of health-related fitness, rather than skill or agility, of the students in participating schools; (2) An assessment of the changes in weight status of the students who are enrolled in participating schools and who are receiving combined nutritional and physical activity intervention versus a nutritional intervention or physical activity intervention alone; and (3) The collection of individual baseline and longitudinal data to measure the improvement of each individual student. No assessment shall compare any student to another. Idenfities state entities required to collaborate to develop the elements of the pilot program and the recommendations for its implementation. Requires every school selected to participate in the program to provide a comprehensive report to the state board at the end of each school year on the effectiveness of the pilot program in accomplishing the pilot program objectives.

States that the pilot program established in this bill must in no way interfere with or replace any effort, purpose, assessment or program implemented by the Governor's Council on Physical Fitness and Sports.

Requires the state board to submit to the governor and the general assembly a report on the condition and needs of public education in the commonwealth and shall identify any school divisions and the specific schools therein that have failed to establish and maintain schools meeting the existing prescribed standards of quality.

Requires the commissioner to submit proposed science and social studies standards to the legislature by February 1, 2004. Requires the commissioner to consider recommendations from specified stakeholders when developing state academic standards in language arts, math, science, social studies and the arts. Specifies that standards must: (1) be clear, concise, objective, measurable, and grade-level appropriate; (2) not require a specific teaching methodology or curriculum; and (3) be consistent with the constitutions of the United States and the state of Minnesota. Requires the commissioner to adopt rules for implementing statewide rigorous core academic standards in language arts, math and the arts. Specifies that after the rules are initially adopted, the commissioner may not amend or repeal these rules nor adopt new rules on the same topic without specific legislative authorization. Requires these academic standards to be implemented for all students beginning in the 2003-2004 school year. Additionally requires the commissioner to supplement the required state academic standards with grade-level benchmarks, although high school benchmarks may cover more than one grade. Establishes other requirements regarding benchmarks.

Requires every district to establish its own standards in the elective subject areas of health and physical education, vocational and technical education, and world languages. Requires every district to offer courses in all above elective subject areas, and to use a locally selected assessment to determine whether a student has achieved an elective standard. Additionally requires every district, by the 2007-08 school year, to adopt graduation requirements that meet or exceed state graduation requirements. Must provide students who enter grade 9 in or before the 2003-04 school year the opportunity to earn a diploma based on existing local graduation requirements in effect when student entered ninth grade.

Establishes graduation requirements based on course credits in language arts, math, science, social studies and electives, including the arts, for students entering grade 9 in the 2004-05 school year.

Beginning the 2005-06 school year and later, requires annual statewide testing in language arts and math in grades 3 through 8 and at the high school level. Also requires annual science assessments in one grade in grades 3-5 span, the grades 6-9 span, and the grades 10-12 span for the 2007-08 school year and later. Requires a state-developed test in a subject other than writing, developed after the 2002-03 school year, to include both multiple choice and constructed response questions. Requires state tests to be aligned with state academic standards, and for statewide results to be aggregated at the school and district level. Deletes language excluding test scores of students receiving limited English proficiency instruction from school and district testing results. Permits exemption of limited English proficiency students if the student has been in the United States for fewer than three years. Requires state assessments, by the 2006-07 school year to include a value-added component to measure student achievement growth over time. Requires commissioner to include alternative assessments for the very few students with disabilities for whom statewide assessments are inappropriate and for students with limited English proficiency.

Permits school, district or charter school to use a high school student's performance on a state assessment as a percentage of the student's final grade in a course or to place the student's assessment score on the student's transcript.

Requires the commissioner to develop language arts, math and science assessments aligned with state standards, which districts must use. Specifies that commissioner must not develop state assessments for academic standards in social studies and the arts.

Part II concerns public higher education: Each four-year campus of each state-supported public institution of higher learning must have equal representation on all formal and informal councils, advisory groups, committees, and task forces of the commission. Independent four-year colleges must have representation on all formal and informal committees and commissions dealing with higher education statewide issues. Also addresses instate tuition for certain students. Beginning with school year 2002-2003, the annual amount of a LIFE Scholarship for eligible resident students attending a four-year independent institution must be the cost of attendance up to a maximum of the average annual cost of tuition at the state's four-year public institutions of higher learning in the corresponding academic year. In addition, beginning with school year 2002-2003, eligible resident students attending two-year independent institutions may not receive an annual LIFE scholarship of more than the maximum cost of tuition at two-year regional public institutions for thirty credit hours a year or its equivalent."

The Program will be designed to provide a multidisciplinary method to reinforce, augment, and support the objectives of the relevant Standards of Learning and career and technical education competencies through practical experiences that (i) allow students to apply mathematical concepts, communication and computer technology skills, and knowledge of economic principles; (ii) allow students to develop proficiency in basic life skills pertaining to money management, personal finance, banking, commerce and trade, and investments; (iii) facilitate financial literacy and an understanding of the American economic system, Virginia's economy, the global economic system, and the effect of personal finance decisions on the national and state economic systems; and (iv) permit students to explore entrepreneurships and career options in banking and finance. The Program will be funded solely by gifts, grants, donations, in-kind services, and bequests received by a public school from its licensed partner financial institution. The department is to develop guidelines for these programs in consultation with the State Corporation Commission's Bureau of Financial Institutions, the Virginia Bankers Association, and the Virginia Credit Union League. Parental permission is required for student participation in these programs.
