COSigned into law 04/2012Postsec.The bill authorizes each system of higher education and each campus of each state institution of higher education to employ an unlimited number of non-tenure-track classroom teachers under renewable 5-year employment contracts. The employment contract must include a provision that allows the employing system or campus to terminate the contract without penalty if the system or campus can demonstrate financial exigencies and a provision that renders the contract unenforceable if the employing system or campus ceases to be an enterprise and does not have sufficient financial reserves to satisfy the contract.

(4) the number of faculty members in each of six faculty ranks (from professor to teaching assistant), with a breakdown for each rank of the numbers of faculty members by race, ethnicity and gender; (5) average faculty salaries by rank; (6) the amount of money appropriated by the legislature per full-time equivalent faculty member and full-time equivalent student; (7) the total revenue the institution spent per full-time equivalent faculty member and full-time equivalent student; (8) the amount of federal and private research expenditures per tenured or tenure track full-time equivalent faculty member; (9) the number and percentage of faculty members holding extramural research grants; (10) the number and names of awards to faculty members from nationally recognized entities, including those identified by The Center for Measuring University Performance; and (11) the number of endowed professorships or chairs. NVSigned into law 06/2011Postsec.Existing law requires certain persons who apply for employment or a contract with a private postsecondary educational institution to submit a completed fingerprint card that must be taken by an agency of law enforcement and authorization for the postsecondary institution to conduct an investigation of the background of the applicants. (NRS 394.465) This bill allows the fingerprint card
and authorization to be submitted electronically to the Central Repository for Nevada Records of Criminal History. This bill also exempts an applicant from the background check if: (1) the applicant will provide instruction from a location outside this state through a licensed program of distance education; (2) the applicant previously underwent a background check; and (3) the Administrator of
the Commission on Postsecondary Education determines that an additional background check is not necessary.

Directs the higher Education Coordinating Board, Based on the findings of this review, to develop practices, policies and recommendations for cost-containment among public institutions of higher education and submit these to the governor, legislature and public institutions of higher education by November 1, 2010.

Specifies that total class credit hours of production per quarter per full-time faculty member is expected to meet the standards set forth in the budget data submitted by the chancellor of the board of regents.

Also specifies that the authority of government vested by law in the boards of trustees of state-assisted institutions of higher education must in fact be exercised by those boards. Specifies that administrative decisions about (1) the use of available resources, (2) organizational structure, (3) disciplinary procedure, (4) the operation and staffing of all auxiliary facilities, and (5) adminstrative personnel are the exclusive prerogative of boards of trustees. Requires any delegation of authority in other areas of responsibility to be accompanied by (1) appropriate standards of guidance concerning expected objectives in the exercise of of such delegated authority and (2) periodic review of the exercise of this delegated authority, to the end that public interest, as opposed to any institutional or special interest, is served.

Authorizes the commissioner to order an institution willfully disregarding a coordinating board policy to remit a fine. Requires binding resolution for certain disputes among institutions of higher education. Declares an intent to provide for continuous health care eligibility for part-time academic employees based on averaging workload gained during the preceding academic year. Provides that part-time academic employees who have established eligibility as determined from the payroll records of the employing community or technical college districts, for employer contributions for benefits under this chapter and who have worked an average of half-time or more in an academic year, through employment at one or more community or technical college districts, are eligible for continuation of employer contributions for the subsequent summer quarter period including the break between
summer and fall quarters. Provides that, to be eligible for maintenance of benefits through averaging, part-time academic employees must notify their employers of their potential eligibility. The state board for community and technical colleges shall report back to the legislature by November 15, 2009, on the feasibility of eliminating the self-reporting requirement for employees.

ILAdopted 02/2006Postsec.Establishes the Diversifying Higher Education Faculty in Illinois Program (DFI), which combines two former programs, the Illinois Consortium for Educational Opportunity Program (ICEOP) and the Illinois Minority Graduate Incentive Program (IMGIP). The purpose of the program is to encourage minority students to enroll and complete academic programs at the post-baccalaureate level and to enhance the diversity of faculty and professional staff at Illinois higher education institutions
and agencies.

Requires eligible candidates to meet the following criteria:
--Ilinois resident
--U.S. citizens or lawful resident alien
--Racial minority
--Completed baccalaureate degree from accredited postsecondary institution
--Has been admitted as a student pursuing a doctoral, master's, or post-baccalaureate professional degree and will pursue this degree objective as a full-time student, as defined by the institution, for at least 9 months of the year
--Has signed an agreement to meet the Act's employment conditions if a DFI award is accepted
--Candidate's financial resources are such that in the absence of a DFI grant the individual will be prevented from pursuing a graduate or professional degree at the institution
--Possesses above-average academic ability to pursue a graduate or
professional degree as evidenced by (A) minimum grade point average of C+ (2.75 on a grade scale of 4.00 = A) in the last 60 hours of undergraduate work; and (B) admission to a post-baccalaureate degree program at a qualified institution of higher education.

As a condition for acceptance of the award, requires the recipient to agree to:
(1) Accept a teaching or nonteaching full-time appointment at an Illinois institution of higher education; or
(2) Accept a position as an employee of this State in an administrative, education-related position, such as administrative positions in Illinois elementary/secondary and higher education agencies; or
(3) Make a good faith effort to secure such position for a time period of no less than 5 years. A good faith effort includes actively seeking employment and maintaining contact with the institutional representative and Program Board.

Requires the recipient to accept such positions for a period equal to the number of years that he or she was a participant in the DFI grant program.

Requires the Program Board, in determining the recipients of the awards, to consider only members of traditionally underrepresented minority groups
who are underrepresented in particular fields of study.

Authorizes the alliance to expend funds to establish partnerships with organizations or private vendors to encourage high school students with teaching potential to consider teaching as a career. Establishes and sets responsibilities for the Hawaii teacher cadet program advisory board.

Section 3: Requires the University of Hawaii to review its admission policies for the college of education.

Section 4: Requires the University of Hawaii to review its college of education's admission standards and consider allowing
incoming freshman to declare education as their major and enable them to graduate within four years.

Section 5: Requires the University of Hawaii to increase the full time equivalent teacher education faculty positions by 5 additional full-time equivalent positions each year until fiscal year 2014-2015, to allow the number of participants who complete the program to increase by one hundred per cent over the year 2004 total.

Section 6: Establishes need to eliminate specified barriers to interest in and entry of the teaching profession.

Section 7-8: Mandates that the department establish policies, procedures, technology, and accountability measures to ensure that newly hired employees receive timely and accurate wages. Establishes an alternate option if the department is unable to pay the total wages due a newly hired employee. Requires the department to establish rules by December 31, 2005 to implement these changes.

Section 9: Requires the department to provide each newly hired teacher with the new teacher orientation handbook to serve as a reference guide and provide the new employees with information on:
(1) Professional development and incentive programs;
(2) License requirements; and
(3) Other useful information to assist new teachers with their familiarity of the department's organization and educational system.

Section 10: Requires the department to establish a standardized statewide teacher induction program for every newly hired teacher. Requires the program to ensure that the new teacher to mentor ratio does not exceed 15:1 and that all mentors are specially skilled and trained to work effectively with newly hired teachers as determined by the department.

Section 11: Establishes legislative intent to improve student achievement by adopting policies that promote teacher quality.

Section 12: Requires the state board to adopt policies to:
(1) Develop a plan for licensing more individuals with practical experience for teaching in vocational/technical programs;
(2) Develop a plan to accept teachers from any state as long as they have completed state-approved teacher education programs and pass relevant Hawaii teacher examinations or their equivalent;
(3) Clarify the requirements, on a state-by-state basis, for out-of-state licensed teachers to obtain a license in Hawaii;
(4) Develop a plan to facilitate licensing for those who intend to teach in Hawaii immersion programs, the island of Niihau, or any other extraordinory situation as defined by the superindent or the superintendent's designee; and
(5) Pursue full teacher license reciprocity with the mid-Atlantic states, California, Colorado, Illinois, Michigan, New York, Oregon, and Washington.

Section 13: Requires the Hawaii Teacher Standards Board to submit to the legislature a report of its progress and recommendations regarding its licensing standards and development of its policies before the 2006 regular session.

Section 14: Requires the Hawaii Teacher Standards Board to review alternative licensing requirements to replace the PRAXIS examination requirement. Requires the review of alternative requirements to include to the consideration of requiring a minimum amount of years of teaching experience to replace the PRAXIS examination requirement.

Section 15: Authorizes the conversion of Hawaii teacher standards board's nine temporary positions to nine permanent full-time equivalent positions.
