Prohibits the state eleemosynary institution or institution or agency of higher education or other state agency from collecting a fee or other reimbursement from the district, school, assistance organization, or department of criminal justice for the surplus or salvage data processing equipment. Provides that if a state agency is abolished, the commission must take custody of all of the agency's property or other assets unless other law or the legislature designates another appropriate governmental entity to take custody of the property or assets.

Specifies that this does not require the district to purchase two sets of materials.
Amends provisions in 105 ILCS 5/18-17 (requiring the loaning of textbooks free of charge to K-12 students and students at nonpublic schools) so that all provisions also apply to the loaning of electronic textbooks and equipment needed to access and use such textbooks. Provides that one of the purposes of funds from (1) state board grants to charter schools and (2) Charter Schools Revolving Loan Fund is start-up costs of acquiring electronic textbooks and the technological equipment necessary to access and use electronic textbooks.
Amends the following to indicate that provisions that apply to traditional textbooks also apply to electronic textbooks and the technological equipment necessary to access and use electronic textbooks:

Requires state board to be given opportunity to review a textbook before it is placed on the list, and requires all textbooks to meet specified criteria, including that the textbook must be reviewed and recommended by experts in the subject area and in education technology. Specifies reimbursement procedures for a district that selects an electronic textbook or instructional material from the state list. Establishes conditions under which a district that selects a subscription-based electronic textbook or instructional material may may cancel the subscription and subscribe to a new electronic textbook or instructional material on the conforming list under Section 31.023 or the list adopted under Section 31.0231 before the end of the state contract period.
Amends Section 31.152 to clarify that it is an offense if a school trustee, administrator or teacher (1) receives any commission or rebate on electronic textbooks, instructional materials or technological equipment used in the schools with which that person is associated in a professional capacity, or (2) accepts a gift, favor or service that might influence him/her in the selection of a textbook, electronic textbook, instructional material or technological equipment.

Amends the school food service programs statute to require each district school board to implement school breakfast programs that make breakfast meals available to all students in each elementary school; by the beginning of the 2010-2011 school year, universal school breakfast programs shall be offered in schools in which 80 % or more of the students are eligible for free or reduced-price meals.
Authorizes, for the 2009-2010 fiscal year, the Department of Education to conduct a pilot program to determine the feasibility of managing the Florida Teachers Lead Program through a centralized electronic system.

A second new section prohibits the northern tier network, part of a national research network infrastructure, from replacing any wide area network services to any city, county, or school district which are provided by the information technology department. Prohibits the North Dakota university system from using the northern tier network infrastructure for traditional internet, voice, video, or other telecommunications services beyond those required for research networks. The North Dakota university system or any entity associated with the university system
may not resell any portion of the northern tier network infrastructure to nonuniversity entities other than research collaborators. Requires the North Dakota university system to provide a comprehensive biennial report of northern tier network activities for the 2007-09 biennium and must submit to a biennial audit of the northern tier network activities beginning with the 2009-11 biennium.

States such aid must be provided pursuant to a district-developed plan that demonstrates that the instructional computer hardware needs of students in the district have been adequately met, and that the district has provided for the loan of instructional computer hardware to students attending nonpublic schools.
Provides formula to determine apportionment amount for which a district is eligible.
Provides no district is required to purchase or otherwise acquire instructional computer hardware or technology equipment for which the cost exceeds the amount of state aid provided.
Section 7-b: Adds new section 754 to education code, on loan of instructional computer hardware. Provides that school authorities have the power and duty to loan instructional computer hardware upon request, to all pupils legally attending nonpublic elementary or secondary schools located in the district. Provides such hardware is to be loaned free to such students, beginning with the 2007-2008 school year.
Provides no district is required to loan instructional computer hardware in excess of the hardware acquired pursuant to section 753. Provides such hardware must be loaned on an equitable basis to children attending nonpublic schools in the district, provided that nothing shall be construed to require a district to loan instructional computer hardware.
Directs school authorities to adopt regulations specifying the date by which requests for instructional computer hardware purchase/loan must be received by the district.
