Establishes legislative intent that textbooks, instructional materials, and supplemental instructional materials be deemed to be aligned with the content standards and be deemed consistent with the content and cycles of the curriculum framework adopted by the state board if they are aligned to the content standards adopted pursuant to specified provisions.

Adds additional requirements for the review and adoption of K-8 instructional materials, including, but not limited to, changing the submission cycles to 8 years for all subject areas (previously 6- and 8-year submission cycles) and requiring the department of education to assess a reasonable fee on a publisher or manufacturer if it submits instructional materials for review after the applicable timeframe. Requires that the state board criteria for reviewing and adopting instructional materials be approved by resolution at the time the resolution adopting the framework for the current adoption is approved, or at least 12 months before
the date that the materials are to be approved for adoption. Deletes a provision that requires the state board to authorize a district governing board, under specified circumstances, to use its instructional materials allowances to purchase materials as specified by the state board, in accordance with state board standards and procedures.

Requires the department, before conducting an adoption of basic instructional materials for mathematics, to provide notice to all publishers or manufacturers that they are required to pay a fee to offset the cost of conducting the adoption process. Authorizes an LEA to use instructional materials aligned with academic content standards, including basic instructional materials that have not been adopted by the state board, and requires a majority of the participants of any review process conducted by the LEA to be classroom teachers assigned to the subject area or grade level of the materials.

Existing law requires the state board to give the Instructional Quality Commission a public hearing before making any adoption of elementary-level instructional materials. This bill requires the state board to hold a public hearing before adopting instructional materials for use in elementary schools. Also authorizes the superintendent of public instruction, upon review of the commission's recommendations for instructional materials, to make alternative recommendations for instructional materials, and requires the state board to consider the superintendent of public instruction's recommendations, and comments from other advisory bodies and the public, before making its decision to adopt instructional materials.

Extends deadline for state board to adopt a revised math curriculum framework to no later than November 30, 2013 (former deadline was May 30, 2013; bill maintains pre-existing May 30, 2014 deadline for revised English language arts curriculum frameworks and evaluation criteria aligned to the content standards). Authorizes the state board to adopt K-8 instructional materials aligned to math content standards no later than March 30, 2014. Authorizes the state board to adopt evaluation criteria for mathematics no later than March 31, 2013. Requires the instructional materials adopted pursuant to these provisions to remain adopted until the next statewide adoption of instructional materials for mathematics.

Repeals the provisions relating to the Instructional Materials Funding Realignment Program, which was statutorily established to provide districts with funding for instructional materials on the basis of an equal amount per pupil enrolled in public K-12 schools.

ARAdopted 02/2012P-12Authorizes the State Board to select a statewide textbook selection committee to recommend a list of instructional materials consistent with course content standards and curriculum frameworks. Empowers the State Board to require require reports from school districts on the use and distrubution of instructional materials. Specifies that the Department of Education include funding for instructional materials in the foundation funding amount provided to each school district, and that the state of Arkansas must guarantee a set price for materials to all schools for the life of a state adoption cycle.

Requires school districts to establish a textbook selection committee, comprised of a majority of licensed personnel, including teachers. Requires districts to provide instructional materials, including equipment needed to access digital resources, for all K-12 public school students free of charge. Provides that school districts may select their own instructional materials or select from the recommended state-approved list. Requires any materials purchased with state funds be consistent with course content and curriculum frameworks. Requires that the Department of Education monitor compliance with the regulations regarding instructional materials, and report to the House and Senate Education Committees.

Sets forth conditions for offering textbooks for adoption, sale or exchange by any person, company or corporation. Provides that the State Board make and execute contracts for all instructional materials that have been recommended by the Department of Education, and outlines rules regarding contracts, exchange provisions, and assessment of damages. Outlines illegal acts for members of the selecting committe, employees of the Department of Education or member of a school board of directors including: accepting gifts from any agent offering instructional materials for sale, having an interest in the in the proceeds of instructional materials, being promised or offered any valuable thing with the intent of influencing decisions or opinions of instructional materials.

Provides that the textbooks authorized to be purchased are limited without exception to textbooks that have been preapproved and designated by the state board of education for use in any public school and that are secular, non-religious, and non-sectarian. Requires the state board of education to annually publish a list of the textbooks authorized to be purchased. Specifies that this does not require the district to purchase two sets of materials.

Amends provisions in 105 ILCS 5/18-17 (requiring the loaning of textbooks free of charge to K-12 students and students at nonpublic schools) so that all provisions also apply to the loaning of electronic textbooks and equipment needed to access and use such textbooks. Provides that one of the purposes of funds from (1) state board grants to charter schools and (2) Charter Schools Revolving Loan Fund is start-up costs of acquiring electronic textbooks and the technological equipment necessary to access and use electronic textbooks.

Sections 2-4: Eliminates the requirement to administer criterion-referenced tests to students in grade 2. Directs the state board, before the October 2010 Education Interim Committee meeting, to present its plan for a pilot program for the 2010-11 and 2011-12 school years to (1) replace the 10th-grade basic skills competency test with computer adaptive testing of basic skills, and (2) administer the ACT exam to high school students. Directs the state board to implement such a pilot program during the 2010-11 and 2011-12 school years. Exempts districts and charter schools from administering the 10th-grade basic skills competency test during the the 2010-11 and 2011-12 school years. Directs the state board to re-direct the money saved by not administering the 10th-grade basic skills competency test to fund implementation of the pilot program during the 2010-11 and 2011-12 fiscal years. Exempts a student from the 10th-grade basic skills competency test requirement if the student was in 10th grade in the 2008-09 or 2009-10 school years and did not pass the competency test (10th-grade basic skills competency test functions as exit exam unless certain waivers apply).

Section 5: Exempts local boards from the requirement to develop and administer activity disclosure statements for high school-level extracurricular activities (as called for in Section 53A-3-420) until the 2012-13 school year.

Section 6: Exempts the state board, until the 2012-13 school year, from the requirements called for in Section 53A-3-602.5 to annually (1) develop a school performance report for schools, districts and charter schools, and (2) collect and electronically report specified performance data for schools, districts and charter schools.

Section 7: Exempts a school district from certain requirements related to the disposal of textbooks until the 2012-13 school year.

Section 8: Until the 2012-13 school year, releases districts from the requirement in Section 53A-13-107 that an annual presentation on adoption be given to students in grades 7-12.

Section 9: Until the 2012-13 school year, releases districts from the requirement in Section 53A-14-107 regarding alignment of primary instructional materials aligned with the core curriculum adopted under Section 53A-1-402.

Repeals reference to appointment of "academic experts" (teachers and university professors) to textbook adoption review panels. Adds provision barring hardware or software providers (or those holding a professional relationship with hardware or software providers) from making or accepting nominations to state textbook review panels.

§ 66.102: As authorized in Section 31.103(e) of the Education Code, establishes a list of equipment or devices that a district or charter school may purchase using textbook credits, including from the purchase of open-source textbooks (textbook credit = difference between the price paid for a textbook and the cost limit established in Section 31.025(a) of the Education Code for that textbook, multiplied by the number of copies purchased by the district or charter school). Authorizes a district or charter school to receive a textbook credit only in the first year of implementation. Requires the district or charter school to notify the Texas Education Agency (TEA) for the use of funds generated by textbook credits, and submit an itemized expenditure report to the TEA.

§ 66.104: Amends provisions related to selection of instructional materials by school districts. Requires a district or charter school that selects electronic textbooks or instructional materials from the commissioner's list as specified in the TEC, §31.0231, to purchase a classroom set of textbooks adopted by the SBOE under the TEC, §31.023 or §31.035, for each subject and grade level in the foundation and enrichment curriculum. Defines "classroom set" for these purposes. Adds language to clearly establish that the classroom set requirement begins with Proclamation 2010 and is not retroactive.

§ 66.121: Specifies that a requisition for special instructional materials must be based on actual student enrollment to meet individual student need. Requires districts and charter schools to annually conduct an inventory of all currently adopted instructional materials that have been requisitioned by, and delivered to, the district, and for the results of the inventory to be recorded in the district's files. Requires reimbursement for and/or replacement of all braille and large type instructional materials determined to be lost.

Provides that one criterion for adoption is that, for a textbook for a senior-level course, a student who successfully completes a course based on the textbook will be prepared, without remediation, for entry into the eligible institution's freshman-level course in that subject, and that, for a textbook for a junior-level and senior-level course, a student who successfully completes the junior-level course based on the textbook will be prepared for entry into the senior-level course.

Adds new section 31.0261 allowing the state board to execute a contract for the printing of an open-source textbook listed on the state textbook adoption list. Establishes provisions for the purchase of open-source textbooks by the commissioner of education. Requires that a state-developed open-source textbook be irrevocably owned by or licensed to the state. Authorizes the commissioner of education to issue a request for proposals for a state-developed open-source textbook. Establishes prerequisites for the approval of an open-source textbook, and establishes provisions for the revision of open-source textbooks. Requires the commissioner to provide for special and bilingual state-developed open-source textbooks in the same manner as non-open-source textbooks for these populations. Provides for costs and distribution of open-source textbooks. Directs the commissioner to develop a schedule for the adoption of state-developed open-source textbooks. Requires a district or charter school that selects an open-source textbook to requisition a sufficient number of printed copies for use by students unable to access the textbook electronically, unless the district prints copies or provides electronic access to the textbook at no cost to the student. Permits printed copies of open-source textbooks that a district does not intend to use for another student to become the property of the student. Amends Section 31.152 to clarify that it is an offense if a school trustee, administrator or teacher (1) receives any commission or rebate on electronic textbooks, instructional materials or technological equipment used in the schools with which that person is associated in a professional capacity, or (2) accepts a gift, favor or service that might influence him/her in the selection of a textbook, electronic textbook, instructional material or technological equipment.

• that faculty textbook adoptions are made with sufficient lead time to university- or contract-managed bookstores so as to confirm availability of the requested materials and, where possible, ensure maximum availability of used textbooks;
• that in the textbook adoption process, the intent to use all items ordered, particularly each individual item sold as part of a bundled package, is affirmatively confirmed by the faculty member before the adoption is finalized. If the faculty member does not intend to use each item in the bundled package, he shall notify the bookstore, and the bookstore shall order the individualized items when their procurement is cost effective for both institutions and students and such items are made available by the publisher;
• that faculty members affirmatively acknowledge the bookstore's quoted retail price of textbooks selected for use in each course;
• that faculty members are encouraged to limit their use of new edition textbooks when previous editions do not significantly differ in a substantive way as determined by the appropriate faculty member; and
• that the establishment of policies shall include provisions for the availability of required textbooks to students otherwise unable to afford the cost.
The measure further provides that no funds for financial aid from university bookstore
revenue may be counted in the calculation for state appropriations for student financial aid.

Practical problems in obtaining these texts in alternative formats include the wide variety of texts used in postsecondary courses of study, a lack of bargaining power with publishers of postsecondary textbooks in comparison with publishers of textbooks for elementary and secondary education, and hesitation among postsecondary institutions to share alternative formats because of concern about copyright law. Practical problems in producing such materials in alternative formats include the labor intensive and technical nature of the work, the frequent need for expertise in the subject matter of the texts, and the expense and time required for production. The General Assembly further finds that students with disabilities, colleges, universities, and publishers would benefit from cooperative development of a system for sharing those texts produced in alternative formats while adequately protecting the intellectual property rights of publishers.
