Replaces certain references to "year-end balance" with "highest year-end balance" in Section 50-27-13, on lottery shortfall reserve subaccounts. Reduces scholarships for book allowances to $150 a year if the year-end balance of a fiscal year is less than 92% of the highest year-end balance. Eliminates all scholarships for book allowances for non-Pell-eligible students if the year-end balance of any subsequent fiscal year is less than 84% of the highest year-end balance. From fiscal impact statement: This bill does not contain an appropriation; however, enactment of this legislation is likely to have a significant impact on the expenditure of the Lottery Tuition Fund. The lack of clear statutory definitions of "tuition" and "general fees" has contributed to a trend by some institutions of higher education to reclassify an increasing portion of their combined "tuition and fee" charges as "tuition." The impact of this reclassification is to increase the value of Lottery Success Scholarships for eligible recipients, thereby increasing the expenditure rate from the Lottery Tuition Fund. OKSigned into law 06/2003P-12Creates the Oklahoma Education Lottery Act to be submitted to the voters for their approval at the November 2004 General Election. If approved by the voters, the Oklahoma Education Lottery would be governed by the seven member Oklahoma Lottery Commission. At least 45 percent of the gross proceeds from the lottery will be made available as prize money. For the first two years of operation, at least 30 percent of the net proceeds will go to the Oklahoma Education Lottery Trust Fund to be used for specified educational purposes and programs, with the amount increasing to at least 35 percent for the third year and thereafter. The Legislature is required to appropriate the revenue in the fund in the following manner: 45 percent for tuition grants and scholarships, construction of educational facilities, capital outlay projects, technology for education facilities, endowed chairs, compensation and benefits for public school support employees and programs and personnel of the Oklahoma School for the Blind and the Oklahoma School for the Deaf; 45 percent for K-12 education including compensation and benefits for public school teachers and support personnel and early childhood programs; • 5 percent to the School Consolidation and Assistance Fund; and • 5 percent to the Teachers' Retirement System Dedicated Revenue Revolving Fund. The State Board of Equalization is required to
annually examine the appropriations from the fund to determine if these appropriations are used to supplant instead of enhance education funding.

SECTION 1. Tennessee Code Annotated, Title 49, Chapter 4, is amended by adding the following as a new part: § 49-4-901. Net proceeds of the state lottery shall be used exclusively for the purposes set out in Article XI, Section 5 of the Constitution of Tennessee and the provisions of this act. Such net proceeds shall be used to supplement, not supplant, existing resources for educational purposes, projects and programs. It is the intent of the general assembly that if there exist net proceeds of the state lottery in excess of those allocated to provide financial assistance to citizens of this state to enable such citizens to attend postsecondary educational institutions located in Tennessee, then such excess net proceeds shall be allocated first to early learning programs. Any raffle conducted by a qualified organization must be conducted by members of the qualified organization without compensation to any member. The organization may not hire or contract with any person or business association, corporation, partnership, limited partnership or limited liability company to conduct a raffle, to sell raffle tickets or to solicit contributions in connection with a raffle on behalf of the organization. Amendment to the Constitution (Article XI, Section 5) permitting the legislature to authorize a state lottery if the net proceeds of the lottery's revenues are allocated to provide financial assistance to state citizens to attend in-state postsecondary educational institutions. Excess funds from lottery net proceeds after postsecondary financial assistance allocations are made will be appropriated to: (1) Capital outlay projects for K-12 educational facilities; and (2) Early learning programs and after school programs. Lottery net proceeds appropriations used to support improvements and enhancements for educational programs will be used to supplement, not supplant, non-lottery educational resources for education programs and purposes. All other forms of lottery are expressly prohibited unless authorized by a two-thirds vote of all members elected to each house of the General Assembly for an annual event operated for the benefit of a 501(c)(3) organization located in Tennessee. A state lottery means a lottery of the type such as in operation in Georgia, Kentucky and Virginia in 2000, and the amendment does not authorize games of chance associated with casinos, including, but not limited to, slot machines, roulette wheels, and the like. VASigned into law 03/2002P-12Establishes the Lottery Proceeds Fund that is authorized as of July 1, 2001, in Section 7-A of Article X of the Constitution of Virginia. The Fund will consist of the net revenues of any lottery conducted by the Commonwealth and will be appropriated to localities to use for public education purposes. The lottery revenues will be transferred to the Lottery Proceeds Fund in two parts, i.e., on or before June 30, the Comptroller will transfer the State Lottery Fund balances for the fiscal year, based on an estimate determined by the State Lottery Department and no later than 10 days after receipt of the annual audit report on the lottery, the Comptroller will transfer the remaining audited balances of the State Lottery Fund for the fiscal year. If an annual audit discloses that the actual revenue is less than the estimate on which the June 30 transfer was based, the State Comptroller will transfer the difference between the actual revenue and the estimate from the Lottery Proceeds Fund to the State Lottery Fund.
