OKSigned into law 06/2012P-12Those appointed or elected to school board positions must agree to take 12 hours of instruction related to education within 15 months. If a member does not complete the required training and is required to leave his or her seat due to not completing the requirement, he or she cannot be reappointed or run for reelection to the board for three years for three-member boards, four years for seven-member boards and five years for five-member boards. Incumbents are required to take six hours of training upon reelection.

Requires prospective board members to publicly affirm certain principles of educational governance. Specifies the responsibilities of board members. Provides for the implementation of training and continuing education in boardsmanship for all board members. Provides for certain sanctions to be imposed upon board members upon a finding that the action or inaction of a board member constitutes neglect of duty or willful misconduct. Requires the state board of education to adopt a model code of conduct for board members, and for local boards of education to adopt a code of conduct that includes, at a minimum, the model code of conduct adopted by the state board. LASigned into law 04/2012P-12Requires performance contracts for local superintendents in districts that receive a C, D or F grade. The contracts must establish performance targets at the school and district level to include: student achievement and graduation rates. Local superintendents will be removed from office for not meeting targets in performance contracts or for other reasons, such as incompetency. Specifies that local school board policies should prioritize student achievement, financial efficiency, and workforce development on a local, regional and statewide basis. Shifts authority for certain responsibilities from school boards to local superintendents, including the hiring and placement of all school personnel. Indicates that school board policies must require superintendents to: delegate to principals all decisions regarding the hiring of their teachers and personnel, subject to approval of superitendents; and consult with teachers prior to making decisions regarding the hiring of principals at their school. The superintendent and principals will make all employment-related decisions based upon performance, effectiveness and qualifications to each specific position. In no case, shall seniority or tenure be used as the primary criterion for hiring, assignment or dismissal of teachers or other employees.

Provides that a school board plan may be amended to allow for both election and appointment of the members of the school board. Provides for a public question to be placed on the ballot of the 2011 municipal election in Mishawaka asking the voters whether the method of choosing members of the governing body of the Mishawaka school corporation shuld be changed. Establihes, ifthe voters of Mishawaka approve the public question, a governing body of the members, three of whom are elected at large by the voters of the city, one of whom is appointed by the city executive, and one of whom is appointed by the city legislative body. NVSigned into law 06/2011P-12Removes the provisions creating the 10-member elected State Board of Education and provides for the election and appointment of members whose terms will commence on January 8, 2013. Bill provides for the appointment of the superintendent of public instruction by the governor from a list of candidates submitted by the state board. Further provides that the superintendent serves at the pleasure of the governor and is in the executive department of state government. Bill provides that the superintendent of public instruction is responsible for ensuring that the duties and responsibilities of the previously created Commission on Educational Excellence, Advisory Council on Parental Involvement, Commission on Educational Technology, Council to Establish Academic Standards for Public Schools, and the Commission on Professional Standards in Education are successfully carried out by the commissions, councils and programs. The bill further revises the qualifications and duties of the superintendent of public instruction to: (1) possess the knowledge and ability to carry out the duties of the position; (2) provide that the superintendent is the educational leader for the K-12 public education in the state; (3) require the superintendent to enforce the observations of statutes and regulations governing K-12 public education; and (4) request a plan of corrective action if the superintendent determines that a school district or charter school has not complied with those statutes and regulations. Provisions of the bill require the state board, in developing the plan to improve the academic achievement of pupils enrolled in public schools, to establish clearly defined goals and benchmarks for improving the achievement of pupils and prescribes those goals and benchmarks. Requires the Commission on Professional Standards in Education to submit annual reports to the State Board and the Legislative Committee on Education describing the status of the regulations adopted by the Commission and a work plan designating the proposed activities of the Commission during the next year. Provisions assign the three regional training programs for the professional development of teachers and administrators and designates the schools districts which will fall within the jurisdictions of the three programs. The bill requires the governing body of each of the regional training programs to establish an evaluation system for the teachers and other licensed educational personnel who participate in the program and prescribes the requirements of that evaluation system. The bill provides for the funding of the three regional training programs and requires the Department of Education to transfer sums to the appropriate districts for the purchase of professional development for teachers and administrators.

Permits these school districts to remove portions of each political contributor's address to show only the city, state, and zip code, but requires that the removed information remain available on the reports maintained in the school districts' offices. Requires that the campaign finance reports be posted online no later than the 5th business day after the report is filed with the school district. (The Texas Ethics Commission reports that the bill's requirements would impact 16 school districts that meet the criteria.)

WHEREAS, a combined school board may wish to elect a high school additional trustee as its presiding
officer because of that person's valuable knowledge and experience; and
WHEREAS, current state law may not allow high school additional trustees to serve as the presiding
officers of combined school boards because they are not members of the elementary district school board; and
WHEREAS, an elementary school district's integrity of governance on a combined school board can be
protected by restricting a presiding officer who is a high school additional trustee from voting on matters that
pertain only to the elementary school district.
This bill allows a trustee to preside over board deliberations under these conditions.

Bars an individual with an immediate family member (1) on a local board, or (2) serving as a local school superintendent, principal or assistant principal, or system administrative staff in the local school system from serving on the local board of education. Requires (1) every local board member to be a U.S. citizen and registered voter; to have read and understood the code of ethics and conflict of interest provisions applicable to local board members and agreed to abide by them; and have agreed to annually disclose compliance with the state board policy on local board member training, the local board's code of ethics and the conflict of interest provisions applicable to local board members. Authorizes the state board to waive these provisions by request of a local board or an individual seeking to qualify for office on a local board and (2) every candidate for a local board to file an affidavit affirming that he/she meets all the aforementioned qualifications (beginning with "U.S. citizen".) Provides that any person judicially determined mentally incompetent is ineligible for election to a local board of education unless the disability determination has been removed.

Bars any local school board from having more than seven members, unless board exceeds seven members by local constitutional amendment, federal court order or other specified provisions. Amends provisions related to per diem and reimbursement of expenses for local board members. Provides for the fundamental roles of local boards of education and local school superintendents. Adds provision barring local board members or their family members from business activities or from acting in their official capacity in any matter that would constitute a conflict of interest. Adds provision barring local board members to use their position to secure privileges, advantages or employment for him/herself or others. Bars local board members (and their immediate family members and businesses in which board members have an interest) from accepting gifts, political contributions or other things of value given or offered to influence the board member in the discharge of his/her official duties. Adds provisions relating to confidentiality of information to which board members are privy that is not available to the general public.

Directs the state board to adopt a model code of ethics for local board members, including appropriate consequences for a violation of the code of ethics. Within three months of state board adoption of a model code of ethics, requires each local board to adopt a code of ethics that, at a minimum, includes the state board's model code of ethics.

Provides that if a local district or school is placed on the level of accreditation immediately preceding loss of accreditation for school board governance-related reasons, the governor may suspend all eligible members of the local board with pay and, in consultation with the state board, appoint temporary replacement members. Allows suspended board member to petition for reinstatement within 90 days; provides that any suspended member who does not petition for reinstatement within 90 days will be permamently removed, and his/her temporary replacement become a permanent member to finish out the removed member's term. Adds provisions relating to a removed board member's petition for reinstatement--requires hearing to determine whether the member's continued service on the board is more likely than not to improve the school system or school's ability to retain accreditation.

Makes ineligible for service as a local superintendent any individual with an immediate family member (1) on the local board or (2) serving as a principal, assistant principal or system administrative staff member in that school system. Allows the state board to waive this provision on a local board's request.

Repeals existing 20-2-230(b) requiring new members of governing boards to receive at least 12 hours of orientation within a year of assuming office. Directs the state board to adopt a training program for local board members. A school district that is a member of a learning community must also provide the learning community coordinating council with a copy of such report on or before the date the report is due to the commissioner.For each fiscal year, learning communities may levy a maximum levy of one cent on each one hundred dollars of taxable property subject to the levy for elementary learning center employees, for contracts with other entities or individuals who are not employees of the learning community for elementary learning center programs and services, and for pilot projects, except that no more than ten percent of such levy may be used for elementary learning center employees.

Specifies content that must be included in a city board regular public meeting agenda, including contact information for a city district representative knowledgable about the agenda, from whom information may be obtained and written comments submitted regarding agenda items. Requires the city board chairperson to ensure sufficient time for public comment on any agenda item at every regular meeting prior to a city board vote. Requires minutes of all city board regular public meetings to be made publicly available in a timely manner and no later than the subsequent regular city board meeting.

Requires the city board by-laws to include a process to allow any city board member to request that items be placed on the board agenda. Allows such request to be made either at or before a city regular public meeting. (10) Respond at a regular public meeting to the recommendations made in annual reports issued by the city-wide council on special education, the city-wide council on English language learners and the city-wide council on high schools
(11) Conduct an annual survey to allow parents, teachers and school personnel to evaluate the performance of the city board and chancellor as regards city district resources, oversight and curriculum. Requires the results of such survey to be made publicly available, including on the city board Web site.
(12) Provide information, data, estimates and statistics as requested by the director of the city's independent budget office or the city comptroller, in a timely fashion.

Eliminates provision directing the board to approve contracts that would significantly impact the provision of educational services or programming in the district. Replaces with provision directing the board to approve city district or community district contracts that meet any of certain criteria. Requires all items requiring city board approval to be by a public vote at a regular board meeting. Prior to approval of any item listed in 1-6 above, requires the city board to undertake a review process to allow the public to submit comments on the proposed item. Requires notice of the proposed item to be circulated to all community superintendents, community district education councils, community boards and school based management teams at least 45 days before a city board vote. Specifies contents that said notice must contain. Also requires a revised public notice to be provided in the event a proposed item listed in 1-6 above is substantially revised, and specifies elements the revised public notice must include. Provides that a lawyer may not simultaneously be an independent contractor and an employee of a district or board of cooperative educational services (BOCES). Provides that a lawyer who is not an employee of a district or BOCES may not seek to be or be considered an employee for purposes of compensation, health insurance, pension and all other employment-related benefits. Provides that any lawyer who violates these provisions is liable for a civil penalty of up to three times the charges and fees for contracted services or salary the lawyer received from the district or BOCES for legal services, and may be enjoined from continuing such violation. Provides that any lawyer who knowingly (1) seeks to be or is considered an employee for purposes of compensation, health insurance, pension and all other employment-related benefits or (2) falsifies or permits to be falsified retirement system records to obtain retirement benefits, is guilty of a class E felony.

Requires every district and BOCES to annually file with the department, comptroller and attorney general a report specifying all lawyers providing legal services to the district or BOCES, whether the district or BOCES hired such lawyers as employees, and all compensation for legal services.

TXSigned into law 04/2007P-12From the bill analysis: The bill amends the Education Code to authorize the board of trustees of school districts to change the length of the terms of its trustees to either three or four years. The bill requires that trustees must specify the manner in which the transition from the length of the former term to the new modified term is made. The bill requires that the transition must begin with the first regular election for trustees that occurs after January 1, 2008.The 79th Legislature mandated that school districts hold joint elections with a municipality, county, or the state. Approximately 50 to 70 districts must change from May to November elections either because they are not part of a municipality that has a May election or because the district is not located in a city and therefore, must partner with the county or state.

Several years ago, the Legislature provided districts sufficient time to change the length of their terms in response to new legislation. Now that another change has been mandated, it is only fair to open the window again for a short time. This bill gives school districts until the end of 2007 to change to three- or four-year terms, which would enable them to partner with one entity. Another benefit of this bill is that voters will become accustomed to seeing school board races on their ballots during city elections instead of on different types of elections year after year.

Pursuant to this bill, a locality would no longer have the option of providing an additional $1 health insurance credit to retired teachers, and the maximum credit that a teacher could receive is $4.

This bill is identical to SB 1218, which was also passed.
