Establishes the Financial Reporting Standards Board Act. Includes in definition of "agencies" all departments, officers, commissions, boards, authorities, institutions, universities, foundations, and bodies politic and corporate of the state required to submit financial reporting information to the office of the auditor general, the office of the comptroller, or the federal government. Creates the Financial Reporting Standards Board to assist the state in improving the timeliness, quality, and processing of financial reporting for the state. Includes among the powers of the board (1) the establishment of minimum qualifications, training and continuing education requirements, and best practice guidelines for state agency representatives ("GAAP coordinators") responsible for the submission of required documentation necessary for the Comprehensive Annual Financial Report, as well as providing assistance during the GAAP cycle, (2) consulting with other states and private businesses that have successfully modernized and streamlined their financial reporting systems, and (3) participating in the development of a statewide GAAP-compliant financial reporting system. Directs each state agency to submit an annual audit of its GAAP and financial statement process for the board's review. Establishes responsibilities of the comptroller's division of financial reporting in the GAAP process. The budget bill includes provision for a process of streamlining the work of the Board of Governors for Higher Education and the Board of Regents for Elementary and Secondary Education. Effective January 1, 2013, creates an 11-member Board of Education to help coordinate the state's education systems to ensure that students graduating from high school are fully prepared for college. The Board will be vested with all the powers and duties currently vested in the two existing boards. Membership: 11 appointed by the governor with advice and consent of the senate. The governor will select a chairperson and vice chairperson. The statutory responsibilities of the department of elementary adn secondary education, the commissioner of elementary and secondary education, and the commissioner of higher education remain unchanged. The state board of education will appoint a Commissioner of Elementary and Secondary Education and a Commissioner of Higher Education. Section 16-96-3 establishes an executive committee of education composed of the president of the University of Rhode Island, the commissioner of higher education, and the commissioner of elementary and secondary education. The commissioner of higher education will serve as chairperson. Section 16-96-4 (effective January 1, 2013) requires use of the term "Rhode Island Board of Education" in lieu of any existing reference made to existing boards. 16-96-5 abolishes the board of governors for higher education and the board of regents for elementary and secondary education effective January 1, 2013.

Directs the governor, in making his/her budget report, and budget units in preparing their estimates, to use zero-base budgeting, beginning with the budget report presented to the general assembly in January 2013. Requires the governor's budget report to include zero-base budgeting for the agencies and programs identified by the house and senate budget offices in consultation with the governor's office of planning and budget. Such offices must require each agency to use zero-base budgeting at least once every 10 years and may not require any agency or program to use zero-base budgeting more than once every 8 years. Specifies information that must be included in each budget unit's budget estimate in any year in which zero-base budgeting applies. Specifically provides that the board of regents of the University of Georgia is a budget unit subject to these provisions, and that programs of the board of regents be periodically subject to zero-base budgeting. Requires the department of education's budget as presented in the January 2013 budget report be submitted as a zero-base budget.Automatically repeals these provisions effective June 30, 2020, unless reauthorized by the general assembly.

The secretary serves at the pleasure of the governor. Requires the secretary to have expertise in education management and policy and demonstrated leadership and management abilities. The secretary of education is to assume all the powers, duties, right and responsibilities of the commissioner of education. The agency of education is to assume all the powers, duties, rights, and responsibilities of the department of education. The 10-member state board is to be appointed by the governor with advice and consent of the senate, with priority given to selection of persons with a demonstrated commitment to ensuring quality education and who, to the extent possible, represent geographically diverse areas of the state. The secretary serves on the state board as a nonvoting member. Repeals the board's power to appoint commissioner. Calls for the board to be supported by adequate staff. Requires the board to evaluate education policy proposals, engage local school board members and the broader education community and establish and advance education policy for the state of Vermont. Requires an annual report to the governor and the legislature. Itemizes other duties of the state board such as the establishment of an information clearinghouse and accessible database to help districts share information about education programs and practices that improve student performance; develop sample ballot language for issues that may be decided by Australian ballot; prepare a budget for the agency and submit it to the governor after board review; and annually present the governor's education policy priorities to the state board.

Clarifies that the Chief Education Officer's authority does not include the authority to appoint or remove a person from any of the aforementioned positions. Provides that if there is an insufficient amount in the Personal Property Tax Replacement Fund for payments for regional offices and officials or local officials, the amount of such insufficiency must be carried over to the following month(s). Specifies that salaries plus an amount for other employment-related compensation or benefits for regional superintendents and assistant regional superintendents are payable monthly by the state board of education out of the Personal Property Tax Replacement Fund through a specific appropriation in the state board of education budget for the fiscal year 2012 only, and are payable monthly from the Common School Fund for fiscal year 2013 and beyond through a specific appropriation in the state board of education budget. Specifies that employee contributions required under the Illinois Pension Code for state board employees are subject to appropriation in the state board of education budget for such payments to regional superintendents and assistant regional superintendents. Requires the state board of education, upon becoming aware that a regional superintendent is employing a spouse or relative as an assistant regional superintendent, to report this information to the governor and the comptroller. Prohibits state board under such circumstances from requesting warrants for payment of regional assistant superintendent's other employment-related compensation or benefits (existing provision already prohibits payment of such regional assistant superintendent's salary).

Establishes the Streamlining Illinois' Regional Offices of Education Commission. Directs the commission to explore and examine all duties of the state board of education and all regional offices of education and
intermediate service centers, as well as the boundaries of the educational service regions, to determine which duties and responsibilities should be provided regionally to more appropriately and efficiently deliver services and whether the boundaries of the education service regions can be expanded to streamline the regional offices of education. Requires that the commission ensure that its recommendations include specifics as to the necessary funding to carry out identified responsibilities. Establishes commission membership. Directs the commission to submit a final report of its findings and recommendations to the governor and general assembly by August 2012. CASigned into law 09/2011P-12From bill summary: Eliminates the secretary of education's duties with regard to specified programs, including, among others, the Child Care Facilities Revolving Fund, the Advisory Committee on Before and After School Programs, the Healthy Start Support Services for Children program, the California Longitudinal Teacher Integrated Data Education System, the Quality Education Investment Act of 2006, and the California Longitudinal Pupil Achievement Data System advisory board. Transfers certain of these duties to the president of the state board of education.

Existing law establishes the Education Technology Grant Program to provide one-time grants to school districts and charter schools for purposes of acquiring computers for instructional purposes at public schools and requires the Office of the Secretary for Education to administer the application process for the award of grants. Existing law establishes the Digital High School Education Technology Grant Program with the objective of providing all high school pupils with basic computer skills. The Governor's Office of Child Development and Education is required to provide input on grant application criteria. This bill would transfer to the president of the state board of education the duties of the Governor's Office of Child Development and Education and the Office of the Secretary for Education under these programs.

Requires the task force to consider how to effectively narrow and close the academic achievement gap and foster students' academic success, among other things.

(b) Suggests that the funding allocation for the new program ensure funding stability for districts receiving revenue under the current integration program. Requires revenue under the new program to be used for purposes recommended by the task force and approved by the legislature.

(c) Includes on the task force six members appointed by the education commissioner, three members appointed by the house speaker, and three members appointed by the senate. Directs the commissioner to convene the first task force meeting and to provide assistance upon request. Directs task force members to seek input from experts and to develop recommendations to improve students' academic achievement.

(d) Requires the commissioner to submit a task force report to the legislature by February 15, 2012, recommending how best to allocate funds previously allocated as integration revenue funds in order to achieve improved educational outcomes for students.

(e) Establishes the base appropriation for the new program in fiscal years 2014 and 2015.

(f) For taxes payable in 2013, allows districts to certify a levy in an amount equal to the district's certified levy for taxes payable in 2012.(Article 13, Sec 49)

Establishes the African American Employment Plan Act. Provides that the purposes of the act are to:

(a) improve the delivery of state services to Illinois' African Americans by increasing the number of African American state employees total and the number serving in supervisory, technical, professional and managerial positions;
(b) identify state agencies' staffing needs and qualification requirements;
(c) track hiring practices and promotions of African Americans employed by state agencies;
(d) increase the number of African Americans employed by state agencies;
(e) increase the number of African American state employees who are promoted;
(f) assist state agencies to meet their goals established pursuant to the African American Employment Plan; and
(g) establish the African American Employment Plan

Directs the department of central management services to develop and implement plans (and for each state agency to implement strategies and programs) to increase the number of African Americans employed by state agencies and the number at supervisory, technical, professional and managerial levels. Calls on the department to prepare and annually revise an African American Employment Plan, and to annually report to the general assembly each state agency's activities to implement that plan. Directs each state agency to annually report to the department of central management services and the department of human rights all of the agency's activities in implementing the African American Employment Plan. Sets forth required content of such reports. Directs the department of central management services to assist state agencies that are required to establish preparation and promotion training programs for failure to meet their affirmative action and equal employment opportunity goals.

Establishes the African American Employment Plan Advisory Council to examine: (1) the prevalence and impact of African Americans employed by state government; (2) the barriers faced by African Americans seeking employment or promotions in state government; and (3) possible incentives that could be offered to foster the employment of and promotion of African Americans in state government. Directs the council to issue an annual report of its activities, beginning February 2012.

Amends Sections 16-9-11 and Section 16-12-1. Requires local (county or city) board of education to fill a superintendent position in 120 days. Adds provision requiring notice of a local superintendent vacancy to be posted at each school campus and worksite at least 30 calendar days before the position is to be filled, and to remain posted until the position is filled. Requires notice to include specified information. Prohibits the local board from filling the position during the required posting period. Adds provision that violation of the notice requirements in this section will void any related employment action taken by the board.

Amends Section 16-60-111.9 relating to chief executive officer of any two-year school or college and CEOs of specified specialty schools in the state. Requires vacancy notice for such CEO position to be posted on the Internet. Clarifies that a vacancy in the position of executive officer may be filled by the board within more than 120 days after such vacancy occurs in the case of a financial emergency.

Provides background on 2008 Senate Concurrent Resolution No. 83, S.D. 1, which requested the auditor to conduct a study on the appropriate accountability structure for the Hawaii teacher standards board, and to report the findings and recommendations to the 2009 legislature, which the auditor did in February 2009. Directs the legislative reference bureau to review the findings of the auditor's report and make recommendations, including proposed legislation, regarding whether there is a need for oversight of the Hawaii teacher standards board, and how oversight is provided for similar boards; and how to strengthen and clarify interagency roles, responsibilities and relationships between the board, department of education and teacher education coordinating committee.
Directs the legislative reference bureau to submit its findings and recommendations, including all proposed legislation and budget requests, to the legislature no later than twenty days prior to the convening of the regular session of 2010.

Directs the dean of the University of Hawaii at Manoa college of education to convene a working group to review and make recommendations to address:
     (1)  Licensing rules and their impact on teacher workforce needs in Hawaii
     (2)  Relicensing and tiered licensing options to ensure effective teachers and continuing development of teachers
     (3)  Streamlining processes for reviewing out-of-state and military applicants for licensure
     (4)  Alignment of licensing standards and requirements with the federal No Child Left Behind Act
     (5)  Teacher preparation program alignment with national standards and the role of national accreditation of teacher preparation programs in Hawaii
     (6)  The role of higher education institutions in assisting teachers in achieving National Board certification.
Specifies the membership of the working group. Provides the working group will cease to exist on June 30, 2010. Provides that the Ohio tuition trust authority board must solely perform specified duties and responsibilities. Authorizes the Ohio tuition trust authority board, subject to the advice and consent of the chancellor, to remove the authority's executive director at any time. Directs the authority, by December 31, 2009, to conduct a study of guaranteed tuition program plans and submit a report with recommendations for a new guaranteed tuition plan to the speaker of the house, the senate president and the governor. Authorizes the commission to review and make comments and recommendations on existing or proposed programs, policies, administrative rules and statutes that have an
impact on poverty in Illinois and, in particular, people living in extreme poverty.

Provides for appointments, co-chairs and terms of members. Requires the state superintendent of education to serve on the commission as an ex officio member. Provides for a steering committee. Requires the commission to meet at least annually and the steering committee to meet at least quarterly. Requires the commission to submit an initial report on its activities and recommendations to the constitutional officers and the general assembly by March 1, 2009, and to adopt a strategic plan by January 1, 2010. (e) Enable component school districts and the students who attend schools in those districts to have equitable access to resources; and
(f) Maximize operational and fiscal efficiencies for component school districts.
(2) The services must be provided according to a local service plan developed by the education service district and component school districts. Services goals must include Programs for children with special needs, including but not limited to special education services, services for at-risk students and professional development for employees who provide those services; technology support; school improvement services for component school districts; administrative and support services for component school districts; other services that an education service district is required to provide by state or federal law.
(3) In addition to the services specified, a local service plan may include other services that are designed to meet regional needs.
(4) A local service plan must also contain annual performance measures for the education service district.
(5) A local service plan must: (a) Be adopted by the board of the education service district. (b) After being adopted, be approved on or before March 1 by resolution of two-thirds of the component school districts.
Allows an education service district to provide entrepreneurial services and facilities to public and private entities and to school districts that are not component school districts of the education service district (on contract or under reimbursable conditions) under certain conditions.

Amends new century charter school review panel membership to decrease board of education members and add two new members. Allows board of education to deny charter to school recommended by panel and establishes requirements if the board does not approve the charter.

Allows charter school employees full participation in the state systems for retirement, workers' compensation, unemployment insurance, temporary disability insurance, and health benefits. Requires the department to provide its position listings to the charter school administrative office and any interested local school board of any new century charter school, and to facilitate and encourage the movement of instructional personnel between the department and new century charter schools, including limiting probationary status to one year, within specified parameters.

Allows the new century charter schools to propose to the board of education an alternative weighted student formula.

Repeals existing language on evaluating charter schools. Enacts new language requiring the board to adopt guidelines for multi-year evaluations of charter schools that have been chartered for four or more years, or for special evaluations at any time. Provides parameters and procedures for the board to place a charter school on probation and revoke a charter. Expands definition of "organizational viability" for a charter school.

Adds that if, at any time, the board of directors of the nonprofit organization governing a new century conversion charter school votes to discontinue its relationship with the charter school, the charter school may submit an application to the board to continue as a conversion school without the participation of the nonprofit organization.

Creates the Task Force on Charter School Governance to identify and recommend to the legislature revisions to the existing charter school law and to help create an effective framework for overseeing and supporting new and existing charter schools. Sets forth the areas on which the task force must make recommendations and establishes membership. Requires the charter school administrative office to submit a report to the legislature on the task force's progress, findings, and recommendations no later than twenty days prior to the convening of the regular session of 2006.

Ensures more equitable and stable funding for the basic operations of new century charter schools, including: (1) establishing and providing funding for a per pupil allocation funding mechanism; (2) requiring that funds be requested for fringe benefit costs and collective bargaining increases for charter school employee members of collective bargaining units; (3) allowing additional appropriations for workers' compensation benefits; and (4) providing charter schools with access to all federal education funds received by the state. Ensures charter schools' compliance with federal regulations under the Individuals with Disabilities Education Act. Clarifies administrative hearing procedures relating to the education of handicapped children. Appropriates funds for these various purposes. (CD1)

AZSigned into law 05/2005P-12Establishes the Arizona Performance Based Compensation System Task Force within the state board of education. By Februrary 2006 and annually thereafter, requires the superintendent of public instruction to submit specified school district data to the task force, which must conduct annual evaluation of one quarter of districts' performance based compensation systems based on the submitted data. Requires the annual evaluation to (1) Assess the relationship between components of individual district performance based compensation systems and the improvement in:
(a) Individual student progress and achievement;
(b) Achievement of school district and school site goals;
(c) Teacher professional development;
(d) Teacher job satisfaction;
(e) Parent rating of the quality of education at the school and district levels
and (2) Provide a report to the districts evaluated each year assessing the effectiveness of each district's performance based compensation system, including any recommendations for improvement. Requires the task force to annually submit its findings to the speaker of the house and president of the senate.

On or before June 30, 2010, requires the task force to (1) provide recommendations to the state board on the implementation, operation and monitoring of performance based compensation systems and career ladder programs in the state, and (2) develop written recommendations based on elements of districts' performance based compensation systems.

Requires all local boards in the state to adopt a performance based compensation system, and to vote on a performance based compensation system that includes the following elements:
(1) School district and school performance;
(2) Measures of academic progress toward the state board-adopted academic standards;
(3) Other measures of academic progress;
(4) Dropout or graduation rates;
(5) Attendance rates;
(6) Ratings of school quality by parents;
(7) Ratings of school quality by students;
(8) Imput of teachers and administrators;
(9) Approval of the performance based compensation system by an affirmative vote of at least 70% of the teachers eligible to participate in the performance based compensation system.
(10) An appeals process for teachers who have been denied performance based compensation.
(11) Regular evaluation for effectiveness.

Requires a performance based compensation system to include teacher professional development programs aligned with the elements of the performance based compensation system. Permits a local board to modify the aforementioned 11 elements and consider additional elements when adopting a performance based compensation system. Until December 31, 2009, requires each district to develop an assessment plan for its performance based compensation system and annually submit the plan to the department of education, along with a copy of the district-adopted performance based compensation system.

Creates the state accounting office, to be overseen by the state accounting officer. Creates the position of state accounting officer, to be appointed by and serve at the pleasure of the governor. Requires the state accounting officer to:
(1) Prescribe state-wide accounting policies, procedures, and practices;
(2) Prescribe, develop, operate, and maintain uniform state accounting systems for all state organizations which facilitate financial accounting and reporting in accordance with generally accepted accounting principles and also meet state and federal accounting and financial reporting requirements;
(3) Prescribe the manner in which disbursements shall be made by state organizations;
(4) Prescribe and supervise the installation of any changes in the state accounting information systems necessary to secure and maintain internal control and facilitate the recording of accounting data for the purpose of preparing reliable, timely, and meaningful statements and reports;
(5) Manage the state's accounting, payroll, and human capital systems;
(6) Using generally accepted accounting principles, prepare the state's financial statements and other reports in accordance with legal requirements;
(7) Provide annual financial statements and other reports to the state auditor and other auditors, as appropriate, for review and certification when required by statute or federal regulation;
(8) Develop interim reports on the financial condition and budgetary compliance of the state and various state organizations;
(9) Determine the proper classification for accounting and reporting purposes of all assets, liabilities, revenues, expenditures, fund balances, funds, and accounts in compliance with legal requirements and generally accepted accounting principles and prescribe a uniform classification of accounts and other accounting identifiers which shall be used by all state organizations;
(10) Develop processes and systems to improve accountability and enhanced collection of accounts receivable due to the state. In developing these processes, the state accounting officer may prescribe procedures to allow for the recognition of uncollectible accounts for financial reporting purposes. He or she may also develop guidelines to allow uncollectible debts to be removed from active collection processes. This recognition shall not remove or diminish the state's claim on accounts or debt owed to the state; and
(11) Develop processes and systems to improve accountability and enhance efficiency for disbursement of funds and management of accounts payable.

Clarifies that term "organizations of state government" refers to state boards, departments, commissions, committees, offices, etc. but not to local boards of education or local authorities.

Strikes certain statutory references to the "state auditor" and the Department of Audits and Accounts; inserts references to and transfers some powers to the "state accounting office" and "state accounting officer."

alternate assessments aligned to alternate achievement standards must include a description of benchmarks or short-term objectives. Adds that IEP for all students with disabilities must include a description of how the child's progress toward meeting the annual goals described in the IEP will be measured and when periodic reports will be provided on the progress the child is making toward meeting the annual goals, including the use of quarterly or other periodic reports, concurrent with the issuance of report cards.

Requires the IEP's statement of the special education and related services and supplementary aids and services to be based on peer-reviewed research to the extent practicable.

Changes from 14 to 16 the student age at which a transition plan must be initially developed. Changes language from "a statement of the transitional service needs" to inclusion in IEP of appropriate measurable postsecondary goals based upon age-appropriate transition assessments related to training, education, employment, and where appropriate, independent living skills and the transition services, including courses of study, needed to assist the child in reaching those goals. Deletes provision relating to statement beginning at age sixteen of needed transitional services for the child.

Specifies that the individualized education program team is not required to include information under one component of a child's individualized education program that is already contained under another component of such individualized education program.

(f) Statewide institutes that prepare cadres of mathematics leaders in local school districts, which may include highly skilled retired mathematics teachers, to serve as coaches and mentors in districts and schools;
(g) Cohesive continuing education options for experienced mathematics classroom teachers;
(h) Closing the student achievement gap among various student subpopulations;
(i) Curriculum expectations and assessments of students among the various school levels, prekindergarten, primary, elementary, middle, and high school;
(j) Content standards for adult education centers providing mathematics curricula;
(k) Introductory postsecondary education mathematics courses that are appropriate to the wide array of academic programs and majors;
(l) Research to analyze further the issues of transition from high school or GED programs to postsecondary education mathematics; and
(m) The early mathematics testing program under KRS 158.803.
Other factors may be included in the strategic plan as deemed appropriate by the committee to improve mathematics achievement of Kentucky students.

Requires the committee to (a) Design a statewide professional development program that includes summer mathematics institutes at colleges and universities, follow-up, and school-based support services, beginning no later than June 1, 2006, to prepare teams of teachers as coaches and mentors of mathematics at all school levels to improve student achievement. Specifies areas the design must address. (b) Require schools and districts approved to have participants in the mathematics leader institutes to provide specified assurances to support institute participants and students who need modified instructional and intervention services in math.

Establishes committee membership, terms, chairmanship, attachmetn to Kentucky Department of Education, and responsibilities. Specifies that the committee must:
(a) Present a draft strategic plan addressing the requirements in subsection (1) of this section and other issues that arose during the work of the committee to the Education Assessment and Accountability Review Subcommittee no later than August 2005;
(b) Present the strategic plan for improving mathematics achievement to the Interim Joint Committee on Education by July 15, 2006, which shall include any recommendations that require legislative action; and
(c) Provide a final written report of committee activities to the Interim Joint Committee on Education and the Legislative Research Commission by December 1, 2006.

Also specifies that the committee will have ongoing responsibility for providing advice and guidance to policymakers in the development of statewide policies and in the identification and allocation of resources to improve mathematics achievement. In carrying out this responsibility, the committee must periodically review the strategic plan and make modifications as deemed appropriate and report those to the Interim Joint Committee on Education.
Mandates that the committee collaborate with the Center for Mathematics to ensure that there is ongoing identification of research-based intervention programs for K-12 students who have fallen behind in mathematics, rigorous mathematics curricula that prepare students for the next level of schooling, research-based professional development models that prepare teachers in mathematics and pedagogy, and strategies for closing the gap between high school or GED and postsecondary mathematics preparation.

ILSigned into law 09/2004P-12Under the School Employee Benefit Act, provides the prescription drug benefit program shall be maintained on an ongoing, affordable basis, and the cost to school districts shall not exceed the State's actual program costs.

Makes changes to the provisions concerning the State Board of Education and State Superintendent of Education. Terminates the terms of certain members of the State Board of Education on the effective date of the amendatory Act and provides for new members to be appointed by the Governor, with the advice and consent of the Senate (including a chairperson). Provides that the Governor who takes office on the second Monday of January after his or her election shall be the person who nominates members to fill vacancies whose terms begin after that date and before the term of the next Governor begins. Allows the Governor to remove a member for incompetence, neglect of duty, or malfeasance.

Provides that upon expiration or buyout of the contract of the State Superintendent in office on the effective date of the amendatory Act, a State Superintendent shall be appointed by a State Board that includes the new members who were appointed to fill seats of members whose terms were terminated on the effective date of the amendatory Act. Thereafter, a State Superintendent must, at a minimum, be appointed at the beginning of each term of a Governor after that Governor has made appointments to the State Board. Provides that a contract issued for the employment of a State Superintendent entered into on or after the effective date of the amendatory Act must expire no later than February 1, 2007, and subsequent contracts must expire no later than February 1 each 4 years thereafter. Prohibits a contract from being extended or renewed beyond February 1, 2007 and February 1 each 4 years thereafter, but provides that the State Superintendent shall serve until his or her successor is appointed. Provides that each contract entered into on or before January 8, 2007, with a State Superintendent must provide that the State Board may terminate the contract for cause, and the State Board shall not thereafter be liable for further payments under the contract. Restores current law requiring the State Board to set the State Superintendent's compensation.

Restores current law requiring a majority vote of the members appointed, confirmed, and serving to approve any action, except that the new Board members may vote to approve actions when appointed and serving. Provides that upon appointment of the new Board members, the Board shall review all of its current rules in an effort to streamline procedures, improve efficiency, and eliminate unnecessary forms and paperwork.

Requires the State Board to create certain divisions within the State Board. Provides that rules of the State Board must be in accordance with the Illinois Administrative Procedure Act. Provides that the State Board may not adopt any rule or policy that alters the intent of the authorizing law or that supersedes federal or State law. Provides that the State Board may not make policies affecting school districts that have the effect of rules without following the procedures of the Illinois Administrative Procedure Act.

Requires the State Board to develop and maintain a continuing 5-year strategic plan for elementary and secondary education, to be issued to the Governor and General Assembly. Lists topic areas that the plan must include.

Removes the provision allowing the State Board to create shared service centers. Provides instead that the State Board is granted the power to provide certain regional services, either through a regional administrative technology center or otherwise.

Requires a school district's calendar for the school term and any changes to be submitted to and approved by the regional superintendent of schools (the State Board of Education in Chicago) before the calendar or any changes may take effect.

Gives the regional superintendent of schools the duty to assist and support school districts with the preparation and submission of grant applications and the duty to accept and review all transcripts for new initial certificate applications and ensure that each applicant has met all of the criteria established by the State Board of Education in consultation with the State Teacher Certification Board.

(1)(a) prepare each student for the student's choice of higher education or gainful employment, focusing on the core academic skills of reading, writing, science, and mathematics, balanced with exposure to the arts and applied technology which will enable students to: (i) communicate effectively, both verbally and through written communication; (ii) apply mathematics; and (iii) access, analyze, and apply information; and (b) train students in the key attributes required for successful living.
(2) In accordance with the findings described under Subsection (1), the State Board of Education shall study and make recommendations for: (a) aligning responsibility, authority, accountability, and funding for the State Board of Education, state superintendent, and local school districts; (b) an improved environment of academic achievement; (c) implementing competency-based progress and measurement systems that allow each student to continually progress within and between course levels at an individual optimal rate; (d) assuring that each high school senior is progressing in challenging courses; (e) developing, with employers, trades, professions, and the State Board of Regents competency standards for progress or graduation; (f) improving methods of motivating school districts to increase academic discipline, including reduced cutting of classes by students and utilizing means such as closed campuses; (g) implementing a progress-based assessment system that continually tracks individual student progress each year in each of the core academic areas by: (i) tracking student progress from year to year on a longitudinal basis, rather than aggregate levels of performance; (ii) utilizing national norm-referenced tests as benchmarks, so that the progress of Utah students can be compared to the progress of students in other states and the nation; (iii) providing progress assessment data that follow each student wherever that student attends schools in the state; and (iv) making the assessment data available to parents to permit them to make fully informed decisions regarding the districts, schools, and teachers they wish to involve in the educational process for their children; (h) developing methods to increase school choice among public schools, including intradistrict and interdistrict transfers, and expansion of alternative schools such as charter schools and New Century schools; (i) aligning the current funding mechanisms with the priorities of the strategy focusing on core academics, to include financial incentives and consequences; (j) developing a new incremental state funding mechanism for public education that: (i) motivates school districts to focus on achieving value-added progress in core academics; (ii) is tied to the progress-based assessment system described under Subsection (2)(g); (iii) provides funding details, including adjustments for mobility; and (iv) provides school districts, parents, students, and educators an economic incentive for developing economic efficiencies in the delivery of instruction; (k) remediating schools and districts that do not meet appropriate standards based on the progress-based assessment described above, including possible transfer of control to the State Board of Education; (l) developing ways to meet a variety of learning styles; (m) developing savings through building utilization and per square foot cost limitation in building construction programs; and (n) implementing other best demonstrated practices of other states and their school districts that are achieving significant improvement in core academic progress.
(3) (a) By August 15, 2003, the state board must submit an initial report to the governor's office for use at the State Education Summit Meeting. (b) The State Board of Education shall make at least three annual reports on the issues
described under Subsection (2) to the Education Interim Committee. (c) A final report, including any proposed legislation, shall be presented to the Education Interim Committee prior to November 30, 2003, 2004, and 2005.

One new member will be an adult, appointed for a six-year term. Two students shall be appointed by the Governor for a transition year after an open application process. The first constitutional amendment proposes to change the Board of Education from elected to appointed. The board members would be appointed by the Governor, seven members from a list of nominees submitted by each school advisory council and eight members comprised of one parent, one teacher/instructional staff, one school administrator, one support staff, one community member, and one at large member, and one student member to be appointed by the state student council. The second constitutional amendment proposes to limit the role of the Board of Education to formulation of statewide educational policy and provides that the Superintendent of Education is chief executive officer of the public school system. This change will clearly delineate the Board as a policy making body responsible for setting statewide educational policy and student performance standards and assessment models, monitoring school success, and appointing the superintendent as chief executive officer of public school system. Conforming statutory amendments clarify the role of the superintendent as having jurisdiction over the internal organization, operation, and management of the public school system, as provided by law. Further statutory amendments clearly define the responsibilities of the principal to include, but not be limited to, overseeing the day to day management of the school, the primary function of which is to deliver instructional services.
