LAAdopted 12/2012P-12Repeals §1401, §1403, §1405, which related to levels to, entry and movement in academic assistance. Amends §1601, "Entry into Academically Unacceptable School Status" and §1603, "Requirements for Academically Unacceptable Schools." Adds §1607, which requires a school identified as entering subgroup component failure to enter school improvement level 1, and for the school improvement level to be updated each year to reflect the number of years of subgroup failure. Prohibits schools identified as SI1+ from qualifying for "reward school" status. Repeals §1609, "Order of Priority for Remedies."

Under Chapter 19, "School Improvement, Academically Unacceptable Schools and Subgroup Component Failure: District and State Level Tasks," repeals §1901, "District Level Tasks" and §1903, "District Support at Each Level." Also repeals Chapter 20, "Differentiated Accountability Pilot." Amends §2101, "State Support at Each Level," under Chapter 21, "State-Level School Improvement, Academically Unacceptable Schools and Subgroup Component Failure Tasks." Amends §2301, "Schools Requiring Reconstitution/Alternate Governance Plans." Amends various provisions under Chapter 25, "School Choice" for academically unacceptable schools. NYAdopted 12/2009P-12Amends rule to implement the No Child Left Behind differentiated accountability pilot program. One of the key components of this rule is the repeal of the current paragraph 100.2(p)(6), "School Requiring Academic Progress", and its replacement with a new paragraph 100.2(p)(6), "Differentiated Accountability for Schools," beginning with the 2009-10 school year. The new paragraph will:
(1) Integrate federal and state accountability systems
(2) Reduce the number of school accountability categories by eliminating dual Title I and non-Title I streams of improvement
(3) Collapse identifications for improvement into three simplified accountability phases--Improvement, Corrective Action and Restructuring--based on the number of years a school failed to make adequate yearly progress (AYP) on an accountability performance criterion and/or accountability indicator
(4) Further differentiate each phase into three categories of intervention: Basic, Focused and Comprehensive, based upon the number of accountability groups that failed to make AYP in an accountability performance criterion and/or accountability indicator for which a school has been identified
(5) Determine a school's accountability designation for the 2009-2010 school year based upon the school's accountability status for the 2008-09 school year and the school's AYP for the 2007-08 and 2008-09 school years
(6) Provide schools with diagnostic tools, planning strategies, and supports and interventions specific to that phase in the improvement process and the school's category of need
(7) Allow for differentiation in the accountability process, permitting schools and districts to prepare and implement two-year school improvement/corrective action/restructuring plans that best match a school's designation
(8) Better align the School Under Registration Review (SURR) and NCLB processes and ensure that schools with systemic and persistent failure fundamentally restructure or close
(9) Maximize the state education department's limited resources and utilize the resources of the University of the State of New York (USNY) to assign School Quality Review Teams, Joint Intervention Teams, and Distinguished Educators to schools in improvement; strengthen the capacity of districts to assist schools to improve
(10) Empower parents by increasing combined participation in Public School Choice (PSC) and Supplemental Educational Services (SES) by providing for SES in the first year of a school's identification for improvement and PSC only after an identified school has failed to make AYP.

In addition, Section 100.2p(10) is amended to set forth the action that is to be taken when a school has been designated as Improvement, Corrective Action or Restructuring and has been placed on registration review. More specifically, under the amended regulations, requires a school designated as Improvement (year 1) or Corrective Action (year 1) to modify its plan to meet the requirements of a restructuring plan for implementation no later than the beginning of the school year following the year identified for registration review. The amended regulations also provide that a school designated as Restructuring (advanced) may be warned of revocation of registration unless an acceptable plan for closure or phase out has been submitted. Also allows a school identified for registration review to be identified for phase out or closure if progress has not been demonstrated after two full academic years of implementing a restructuring plan.

LAAdopted 12/2007P-12Amends rules concerning Bulletin 111 - The Louisiana School, District, and State Accountability System. Sets the target graduation rate for schools at 65%. Separates the current School Improvement set of labels and remedies into two separate sets: (1) the "Academically Unacceptable Schools (AUS)" set, which is time-bound, and (2) the "Subgroup Component Failure (SCF)" set, which is in line with requirements of the No Child Left Behind Act. Accordingly, criteria for schools entering, moving within, and exiting these various levels of AUS and SCF are detailed, as are the related remedies.

OHSigned into law 12/2006P-12Sets a number of 14,000 scholarships and amends priorities for distribution, particularly for when the applications exceed the number of available scholarships. Amendments focus on eligibility of students in low-performing schools. See full text for details (attached). From fiscal notes: Am. Sub. H.B. 66 of the 126th General Assembly established the new Educational Choice Scholarship Pilot Program and authorized the award of up to 14,000 scholarships in FY 2007, which can be used to attend participating nonpublic schools.  The bill establishes 14,000 as the maximum number of scholarships for future years as well as FY 2007.  Under current law, first time scholarships are generally available to students who attend or who would otherwise be entitled to attend a school that has been in academic emergency or academic watch for three or more consecutive years.  The bill modifies this eligibility criteria so that first time scholarships are generally available to students who attend or who would otherwise be entitled to attend a school that has been in academic emergency or academic watch for two of the last three years, thus expanding the number of eligible students.  The bill makes other more minor changes in the eligibility criteria, which may also expand the number of students eligible for and choosing to receive scholarships. According to ODE, approximately 3,100 students were awarded scholarships for FY 2007.
 
The amount awarded for each scholarship is the lesser of the actual tuition charges of the school or the maximum scholarship award.  H.B. 66 set the maximum scholarship award at $4,250 for grades K-8 and at $5,000 for grades 9-12 in FY 2007.  In subsequent years, these amounts are to increase by the same percentage as the increase in the base cost formula amount for school districts.  Scholarship students are counted in the resident district's average daily membership (ADM) in order to calculate base cost funding, so that the districts generally will be credited with $5,403 per student in FY 2007.  Kindergarten students are counted in ADM as one-half student, reflecting the traditional half-day kindergarten program.  As a result, a kindergarten student generates about $2,702 in state base cost funding in FY 2007.  An amount equal to $5,200 will be deducted from the resident district's state aid for each scholarship student in grades first through twelfth and $2,700 for each scholarship student in kindergarten.  Therefore, a district generally will be credited with more state aid than is deducted for each scholarship student.  The bill requires that ODE adjust the ADM of the district if a scholarship is awarded to a student that, for whatever reason, was not included in the district's original ADM.  This provision ensures that the district is credited with the appropriate amount of state aid.  To the extent that the bill increases the number of scholarships awarded, school districts and community schools will experience decreases in state aid.  Although school districts and community schools with scholarship students have fewer students to educate, they may not be able to decrease their expenditures to match their state aid loss ($5,200 for students in grades 1-12 and $2,700 for students in kindergarten), especially in the short run.

GASigned into law 12/2005P-12Makes the department responsible for the implementation of a single statewide system of accountability. Adds school systems to the system of review and accountability. Strikes subparagraph (D) of paragraph (6) of subsection (a) of Code Section 20-14-41, relating to appropriate levels of intervention for failing schools, and inserts in lieu thereof the following: (D) Mandate that the parents have the option to relocate the student to other public schools in the local school system to be chosen by the parents of the student with transportation costs borne by the system from a list of available options provided by the local school system. The local school system is to provide transportation for students in Title I schools in accordance with the requirements of federal law. The local school system may provide transportation for students in non-Title I schools. In any year in which the General Assembly does not appropriate funds for the provision of transportation to non-Title I students, the parents assume responsibility for the transportation.

MDRule Adoption 06/2003P-12A. Each local school system shall allow a student attending a public elementary or secondary school to attend a safe public elementary or secondary school within the school system if the student:
(1) Attends a persistently dangerous public elementary or secondary school; or
(2) Is a victim of a violent criminal offense as defined in Criminal Law Article, §14-101, Annotated Code of Maryland:
(a) During the regular school day; or
(b) While attending a school sponsored event in or on the grounds of a public elementary or secondary school that the student attends.
B. The local school system shall effectuate a transfer pursuant to §A of this regulation in a timely manner following either the:
(1) Designation of a school as persistently dangerous; or
(2) Conviction of or adjudication of delinquency of the perpetrator of a violent criminal offense.
C. To the extent possible, the local school system shall allow a student to transfer to a school that is making adequate yearly progress and has not been identified as being in school improvement, corrective action, or restructuring.
D. Each local superintendent of schools shall certify annually in writing to the State Superintendent of Schools that Regulations .18-.20 of this chapter are implemented.
E. The State Department of Education shall:
(1) Maintain a list of schools determined to be persistently dangerous; and
(2) Revise the list annually.

PARule Adoption 06/2003P-12Establishes rules pertaining to compliance with the No Child Left Behind Act of 2001. PENNSYLVANIA REG 3807 (SN) Defines violent criminal offense as any of the following offenses that are set forth in 18 Pa.C.S. (relating to Crimes Code): (i)  Kidnapping. (ii)  Robbery. (iii)  Aggravated assault (on the student). (iv)  Rape. (v)  Involuntary deviate sexual intercourse. (vi)  Sexual assault. (vii)  Aggravated indecent assault. (viii)  Indecent assault. (ix)  Attempt to commit any of the following: homicide, murder or voluntary manslaughter. Except as provided as follows, a student who becomes a victim of a violent criminal offense while in or on the grounds of the public elementary or secondary school that the student attends, shall be offered the opportunity to transfer to a safe public school within the LEA, including a charter school.
For a student victim to be entitled to transfer to another school under this chapter, the violent criminal offense first must be reported to law enforcement authorities by the student, the student's parent or guardian, or school officials. A student victim (or the student's parent or guardian) may apply to the LEA to transfer to another school within 30 calendar days after the incident is reported to school authorities. Except as provided as follows, a student who attends a persistently dangerous school must be offered the opportunity to transfer to a safe public school within the LEA, including a charter school. A student who attends a persistently dangerous school may apply to transfer at any time while the school maintains that designation. Responsibilities of LEAs toward victims of violent criminal offenses: Within 10 calendar days of receiving notice of the violent criminal offense, the LEA shall notify the student victim that the student has the right to transfer to a safe public elementary or secondary school within the LEA, including a public charter school. The notification and offer to transfer shall state that no student is required to transfer to another school. COSigned into law 04/2003P-12Establishes the "Colorado Opportunity Contract Pilot Program" beginning in the '04-'05 school year, which requires school districts with eight or more low or unsatisfactory schools to allow eligible students to attend a participating nonpublic school under the terms of an opportunity contract between the child's parent and the school. NDSigned into law 04/2003P-12A student's parent may apply to a contiguous school district for admission of the student at any time during the school year if: a. The student was a victim of violence occurring within the school in which the student was enrolled and the violence was documented; b. The superintendent of public instruction has declared the school in which the student was enrolled to be an unsafe school; or c. The superintendent of public instruction has identified the school in which the student was enrolled as one that requires program improvement for six consecutive years.
2. The school district receiving an application under subsection 1 shall review the application to ensure compliance with the provisions of subsection 1 and shall notify the student's parent and the student's school district of residence of the arrangements for the student's transfer within five days from the date the application was received. 3. The student's school district of residence shall consider the student transferred as of the date of enrollment by the admitting district. 4. Upon transfer of a student under this section, the board of the admitting district and the
board of the student's school district of residence shall enter into a tuition agreement. The student's school district of residence shall reimburse the admitting district for all costs incurred by the admitting district in providing education for the student. OHSigned into law 11/2001P-12Requires the state board to establish a standard unit of improvement for buildings and requires districts that are not excellent or effective to develop district-wide continuous improvement plans and to develop continuous improvement plans for buildings within the district that are not excellent or effective. Requires an academic emergency district to implement at least one of the following options: (1) replace the building's principal, (2) redesign the building to address the factors impeding student achievement, (3) institute a new schoolwide curriculum or educational model, (4) contract with a college or university education department, an educational service center, or the state department to operate the building, (5) grant priority under the district's open enrollment policy to students who want to transfer from the building, (6) close the building, or (7) develop an alternative comprehensive plan approved by the department. Requires the department to identify research on the effective use of instructional time and on successful intervention strategies for students from different ethnic and socioeconomic backgrounds and to disseminate such studies through the Ohio SchoolNet Commission.
