CASigned into law 09/2012Postsec.From bill summary: Requires students who are victims of trafficking, domestic violence, and other serious crimes who have been granted a specified status under federal law, to be exempt from paying nonresident tuition at the California State University and the California Community Colleges, and to be eligible to apply for, and participate in, all student financial aid programs and scholarships administered by a public postsecondary educational institution or the State of California, to the same extent as individuals who are admitted to the U.S. as refugees under specified federal law. Requests the University of California to adopt policies that are consistent with these provisions. Requires community college districts to waive the fees of those students to the same extent as individuals who are admitted to the U.S. as refugees under specified federal law. CASigned into law 09/2012Postsec.From bill summary: Establishes the Working Families Student Fee Transparency and Accountability Act as a part of the Donahoe Higher Education Act, and establishes various policies relating to student fees and student financial aid at the University of California and the California State University. Requires the regents and the trustees to comply with prescribed public notice and student consultation procedures prior to adopting an increase in mandatory systemwide fees, and prohibits them from adopting a mandatory systemwide fee increase before specified dates. Requires the regents and the trustees, by April 2, 2013, to develop a list of factors required to be taken into consideration when developing recommendations to adjust mandatory systemwide fees.

Commencing with the 2012–13 academic year, requires the trustees and the regents to provide annual reports on expenditures and financial aid to the legislature, and requires the Legislative Analyst's Office to annually review and report to the legislature its findings, conclusions, or recommendations regarding the implementation of policies implemented pursuant to the bill.

NJSigned into law 05/2012Postsec.Revises the NJ STARS II Program such that the program covers only tuition (no fees) in the amount of $1,250 per semester (previously up to $3,500 per semester) to four-year public or independent institutions (previously only public). Changes the percentage of the scholarship paid by the state to 100% from 50% (50% previously paid by the public institution of higher education).

Deletes the requirement that the amount of the scholarship awarded for the third academic year of study be based on the student's cumulative grade point average upon graduation from the county college. Deletes the requirement that the amount of the scholarship awarded for the fourth academic year of study be based on the student's grade point average during the third academic year of study.

OKSigned into law 05/2012Postsec.Requires that a student will be eligible for in-state tuition regardless of residency if the student is a dependent of a military or reserve service member on active duty and whose home of record is Oklahoma. The student will retain in-state status after the military person has been discharged or released for reasons other than dishonorable as long as the student stays continuously enrolled in a program at an institution in the Oklahoma State System of Higher Education. Home of record is defined as the place where a person was living when he or she enlisted or was commissioned into the military or reenlisted in the military.

Transparency and Efficiency
Requires each public institution of higher learning to maintain a transaction register that includes a complete record of all funds expended, from whatever source for whatever purpose. Provides that the register must be prominently posted on the institution's Internet website and made available for public viewing and downloading. Grants the State Board for Technical and Comprehensive Education the authority to employ and administer certain administrative efficiency provisions.

Comprehensive Human Resources System
Directs the State Budget and Control Board's State Office of Human Resources to participate with five representatives selected by the respective presidents of the public institutions of higher learning and technical colleges to represent all of the public institutions of higher learning and technical colleges to study, develop, and recommend a separate, comprehensive human resources system for the public institutions of higher learning and technical colleges. Provides that the recommendation must include, but not be limited to, prescription of a methodology to establish a uniform compensation and classification plan among the public institutions of higher learning and technical colleges.

Facility and Procurement
Defines "permanent improvement project" for institutions of higher learning and revises the procurement statutory provisions.

Provides a $200,000 limit on the amount of state funds that may be paid for salaries of college and university presidents and administrative employees. Increases the Florida Medallion Scholarship test scores in 2013-2014, from 1050 to 1170 for SAT, including the applicable home school test scores. Increases or establishes required community service hours for Bright Futures applicants. Requires applicants for Bright Futures, and certain other programs to submit the Free Application for Federal Student Aid prior to disbursement of funds. Prioritizes state student financial aid to the neediest (Pell eligible) students for the Florida Work Experience Program and the First Generation in College Program.

Northwest Regional Data Center
Designates the Northwest Regional Data Center as a primary data center.

Student Enrollment Pilot Program
Authorizes a spring and summer term student enrollment pilot program at the University of Florida for the purpose of aligning student enrollment and the availability of instructional facilities. Authorizes Bright Futures scholarships in the summer for these students.

Transient Student Admission
Authorizes the implementation of a transient student admission application process through the Florida Academic Counseling Tracking for Students system to include admissions, readmissions, financial aid, and transfer of credit functions. Authorizes a fee of $5 to support the system.

Tuition
Provides an exemption from the 30 percent need-based expenditure requirement from the tuition differential fee if the university has covered the entire tuition and fee costs of all resident students who are eligible for need-based aid. Authorizes alternative documentation for tuition fee waivers for Purple Heart veterans. Increases the tuition surcharge for excess hours to 100 percent in excess of 115 percent of the credit hours required for a degree. Section 38: Authorizes a district or charter school to charge a fee to a student who enrolls in a state virtual school network course during the summer. Students in a four-year institution are required to have 120 credit hours in order to receive their degree. Currently, there is a "30-hour rule" that allows students to take up to 30 extra hours before graduating without being penalized with out-of-state tuition rates. This rule exempts students who have previously earned a baccalaureate degree, allowing them to complete a second degree with possibly more than 150 hours on their transcript. The rule does not, however, exempt students who have previously earned an associate degree, about 66 hours of transferrable coursework.

In Texas, there are 29 Early College high schools and many programs around the state that allow high school students to graduate with an associate degree along with their high school diploma. When these students transfer to a four-year institution, their 66 associate degree hours transfer either toward their baccalaureate degree or as elective hours, depending on the university. Normally, about half of the hours are counted as elective hours, putting students over the 30-extra hours they are allowed to take before being penalized with higher tuition rates by the time they reach junior or senior status.

The purpose of this bill is to add students with associate degrees to the list of exemptions in order for them to be able to continue to four-year institutions without worrying about higher tuition rates toward the end of their college careers.

S.B. 1343 relates to the formula funding for public institutions of higher education for certain credit hours that do not count toward a degree.

Provides that in order to qualify as a resident for community college and state university tuition purposes, a person/parent or guardian must have maintained legal residence in the state for at least 12 consecutive months immediately prior to his or her initial enrollment in an institution of higher education.

To encourage each undergraduate student who enrolls in a state university to complete the student's respective baccalaureate degree program in the most efficient way possible while providing for access to additional college coursework, state universities shall require a student to pay an excess hour surcharge equal to 50 % of the tuition rate for each credit hour in excess.

Permits the Legislature to provide an annual appropriation to support Florida private colleges and universities. Such appropriations may be used to provide access to Florida residents
seeking a postsecondary education, to fulfill the state's need for graduates in specific disciplines, and to support medical research.

It is the goal of the state to increase funding at state colleges and universities, using state funds plus tuition combined, to at least the 60th percentile of comparable institutions in the Global Challenge States within ten years. The Office of Financial Management (OFM) reports on the progress made toward the state goal. In defining the 60th percentile goal, OFM controls for differences among the comparison institutions in cost-of-living, program and enrollment mix, and reporting and accounting practices. Decreasing student enrollment below 2007 budgeted levels is not allowed as a method of increasing per-student funding. On billing statements to students, each institution must report the full cost of instruction, the amount collected from student tuition and fees, and the difference between the amounts for the full cost of instruction and student tuition and fees.

The surcharge will be an amount calculated to equal 100% of the average cost of the student's education at the relevant institution less tuition and mandatory educational and general fee charges assessed to a student meeting Virginia domiciliary status who has not exceeded 125 % of such credit hours. Certain courses and credit hours are excluded from the calculation of the 125% of the credit hours needed to satisfy the degree requirements for the "credit hour threshold," e.g., remedial courses and credits obtained through advanced placement or international baccalaureate programs or dual enrollment while in high school.  A waiver of the surcharge may be granted by the relevant institution, in accordance with the guidelines and criteria established by the State Council of Higher Education for Virginia (SCHEV).  Waiver criteria may include, but need not be limited to, illness or disability or active service in the armed forces of the United States. A second enactment clause requires SCHEV to revise its guidelines for determining in-state tuition charges, which are not subject to the Administrative Process Act, to include these requirements by July 1, 2006, including, but not limited to, notice to students who may be or may become subject to the surcharge and determinations of extenuating circumstances.

Requires each institution of higher education to affirmatively determine that an applicant who has been granted admission to that institution as a Florida resident meets the residency requirements at the time of initial enrollment. An individual who is classified as a nonresident for tuition purposes may become eligible for reclassification as a resident for tuition purposes only if that individual, or his or her parent if that individual is a dependent child, supports permanent residency by presenting documentation of permanent, full-time employment in the state and domicile in this state for 12 consecutive months while not enrolled full-time at an institution of higher education. States that undergraduate tuition and fees for state university resident students are established within proviso in the General Appropriations Act or law. Requires each board of trustees to set university tuition and fees for graduate, graduate professional and nonresident students, although these may not exceed the average full-time tuition and fees for corresponding programs at member schools of the Association of American Universities. Bars the annual percentage increase in tuition and fees set by each board of trustees for students enrolled prior to the fall of 2005 from exceeding the legislature's annual percentage increase for resident undergraduate students. Requires at least 20 percent of the amount raised by tuition increases to be allocated by each university to need-based financial aid for students. Allows tuition and fees for for graduate, graduate professional, or nonresident students to exceed a cap set for undergraduate resident students.

Requires an undergraduate student to pay 75% over the in-state tuition rate for any credit hours exceeding 120 percent of the number of credit hours required to complete the student's degree program. Provides that a community college student who has earned the associate degree need not pay the full cost for a maximum of 24 hours taken while enrolled at a community college which apply to the student's baccalaureate degree. Provides that an undergraduate student at a state university or in a baccalaurate program at a community college must pay the higher rate for exceeding the aforementioned credit hour limit, regardless of whether those hours were taken while enrolled at a community college, a state university or any private postsecondary institution if the student received state funds while enrolled at the private postsecondary institution.

States that credit hours earned under the following circumstances are not calculated as hours required to earn a degree:
(a) College credits earned through an accelerated mechanism identified in s. 1007.27;
(b) Credit hours earned through internship programs;
(c) Credit hours required for certification, recertification, or certificate degrees;
(d) Credit hours in courses from which a student must withdraw due to reasons of medical or personal hardship;
(e) Credit hours taken by active-duty military personnel;
(f) Credit hours required to achieve a dual major undertaken while pursuing a degree;
(g) Remedial and English as a Second Language credit hours; and
(h) Credit hours earned in military science courses (R.O.T.C).

Requires postsecondary institutions to implement a process for notifying students regarding these requirements, which notice must be provided upon the student's initial enrollment in the institution and again upon the student's having earned the credit hours required to complete the degree program in which he or she is enrolled. Requires the notice to include a recommendation that each student who intends to earn credit hours at the institution beyond those required for his or her enrolled degree program meet with his or her academic advisor.

In a special session called to address higher education issues, the general assembly passed legislation restructuring the governance of higher education and amended the second year of the 1997-1998 biennial budget for colleges and universities. Legislation sets goals for postsecondary education and creates the Council on Postsecondary Education to replace the existing Council on Higher Education. The new council is to provide direction and oversight to all higher education institutions. Duties include: developing a strategic plan with advice from the new Strategic Committee on Postsecondary Education(SCOPE); revising and approving college and university missions; preparing budget requests; developing and accountability system; ensuring coordination among institutions; and changing or eliminating academic programs. The members, appointed by the governor, are to include one faculty member, a student, the commissioner of education and 13 citizens that must be confirmed by the legislature. The legislation also creates the Kentucky Community and Technical College Systems (KCTCS) headed by a board of regents. The new systemn will be composed of two branches: the current University of Kentucky Community College System (with the exception of Lexington Community College, which will remain a part of UK) and the postsecondary technical schools that have been part of the Cabinet for Workforce Development. The 14 members of the new board of regents will include a faculty member; a non-teahcing personnel representative; two student members (one form the community colleges and one from the technical instititutions); and eight additional members appointed by the governor, four from a list of nominations from the UK turstees and four from recommendations submitted by the governor's postsecondary education nominating committee. The nominating committee is composed of seven members (one from each Supreme Court district) appointed by the governor with the consent of the legislature. The legislature amended the second year of the biennium by adding $40 million to the $797.5 million in the original 1997-98 budget for higher education, an increase of 5 percent. The newly-adopted budget is 8.6 percent higher than funding for 1996-97. College and university budgets will reach $791.4 million, 7.8 percent above prior year funding levels, including $99.2 million for community colleges (up 20.1 percent) and $692.2 million for four-year institutions, an increase of 6.3 percent. Faculty pay raises will be determined by institutional boards. Tuition increases will remain as originally adopted: In-state undergraduates will pay 2.6 percent more at doctoral institutions, 3.4 percent more at master's colleges and 2 percent more at community colleges.
Included in the higher education budget is initial funding for 4 of 7 new investments and incentive trust funds to advance the goals of postsecondary education: adult education and literacy ($2 million), regional university excellence ($6 million), research challenge ($6 million) and postsecondary workforce development ($3 million). The new Council on Postsecondary Education will establish the criteria for the allocation of these funds. The remaining three funds created are the technology initiative trust, physical facilities trust and the student financial aid trust.
The 1997-98 budget for elementary and secondary schools remains as originally adopted and total general funds will reach $2.5 billion, an increase of 3.1 percent. Funding for the SEEK formula will increase 2.7 percent to more than $2 billion. No funds were earmarked for teacher pay increases but language in the budget bill encourages districts to give raises of about $900. Other programs receiving increases include family resource and youth services centers ($39.6 million total, up 2.9 percent) and preschool services ($39.3 million, up 3.1 percent). Funding will continue at current levels for school rewards ($10 million), student assessment ($8.1 million), extended school services (34 million), professional development ($14.5 million) and educational technology ($20 million).

If a school district does not provide educational services to an entire grade level, the students in that grade level may attend school at a public school of their choice, outside their district of residence without going through the procedures outlined in section 15-40.2-05. The school district of residence shall pay tuition to the admitting school district. The student may exercise the provisions whether the school district of residence ceased to provide required grade level before or after the effective date of this Act. The public schools must be equally free, open and accessible at all times to all children who have reached the age of six by midnight August thirty first for school districts that do not provide kindergarten or the age of five for schools districts that provide kindergarten and have not reached the age of twenty one. The school board of a pubic school district may, upon approval by a majority vote of the electors of the school district at any regular or special election, dedicate a tax levy for purposes of this section (long-distance learning and educational technology levy) not to exceed five mills on the dollar of taxable valuation of property within the district. All revenue accruing under this levy must be used only for purposes of establishing and maintaining long-distance learning and purchasing and maintaining educational technology. Educational technology includes computer software, computers and computer networks and other computerized equipment which must be for student instruction.

VTActive 06/1994Postsec.Vermont has an unusual system of higher education. It differs from those of most other states in the way it is financed, the way it is organized and coordinated, the sources of its students, its importance to the state's economy and in other ways. Vermont's financing of higher education represents a "high tuition/high student aid" approach as compared to most other states. That is, the state supports its public institutions at a level far below that provided by most states for similar colleges and universities. This results in very high tuition rates - the highest or near the highest in the country. However, the state provides high quality student financial aid programs for its students through the Vermont Student Assistance Corporation, supplementing national and other sources of assistance. These programs help Vermonters needing assistance to attend colleges, universities or other postsecondary schools, either in Vermont or elsewhere. This "high tuition/high student aid" approach to the financing of higher education may be the single most important characteristic of Vermont's higher education system that sets it apart from those of most other states. The system has other important characteristics, some resulting from Vermont's unusual financing approach and others that are not directly related: Vermont's state-assisted institutions and agencies are autonomous entities established as separate corporations and governed by independent boards; while they are not organized as integral parts of state government, they are responsive to its interests and concerns through the Governor's and General Assembly's selection of board memebers and through continuing open discussion, reports, audits and other communications. Vermont's higher education system includes a large and diverse group of both independent and state-assisted colleges and universities which serve thousands of Vermont students and offer a wide range of education programs. Vermont's colleges and universities, both state-assisted and independent, enroll large numbers of students from other states. Vermont is one of the leaders in the country in percentage of its total enrollment coming from out -of-state. A greater percentage of Vermont's young people leave the state to go to college or other postsecondary schools than is the case in most states. A greater percentage of Vermont high school students graduate from high school than in most other states, and the percentage of these graduates who continued their education on a full- or part-time basis within six months after graduation increased from 43.9% in 1978 to 62.3% in 1992. Higher education, considered as an industry, is a more important part of the economy in Vermont than in most states. Almost half of its students and/over half of its income are from sources outside the state. It can be considered one of Vermont's major industries. Only a few states appropriate smaller amounts of tax funds per capita of state population to support higher education - both institutional support and student assistance. Only one state uses a smaller percentage of total personal income than Vermont to support higher education. Vermont has a large proportion of out-of-state students paying high non-resident tuition nearly equal to the costs; thus educaiton appropriations primarily support the resident enrollment.
