CAVetoed 09/2012Community CollegeFrom bill summary: Authorize the board of governors of the California Community Colleges, once sufficient funding becomes available, to establish a competitive grant pilot program to evaluate a public-private partnership model designed to accomplish specified objectives relating to business development and job creation. Requires the board of governors to select partnering community college districts and private entities
to participate in the pilot program that best demonstrate the ability to fulfill those objectives and specified agreement requirements that the bill would impose. Upon completion of the pilot program, requires specified entities to prepare and post a written summary on the community college district's website. Provides that the pilot program only would be operative if the legislature appropriates funds expressly, or if sufficient private funding is received, whichever comes first. ILAdopted 04/2012Postsec.This rule guides the reviews of (a) applications for new degree programs at public universities and community colleges and (b) proposals from public universities to establish new research and public service centers. This rule also requires the institutional review of all degree programs within a cycle of eight years and submission to the Board of Higher Education of a summary of each review. The reviews should lead to continuation of strong programs, corrective measures to address problem areas, and suspension or elimination of less effective programs.

From Illinois Register: The proposed amendments are based around 4 themes: (1) tightening requirements prior to approval through use of more specific definitions; (2) increasing transparency and accountability through new specific requirements related to consumer information disclosure and essential data elements; (3) tightening and publicizing the post-approval review process by using automatic triggers for review driven by data, complaints, and public disclosures such as adverse actions of accrediting bodies and federal and state authorities; and (4) administrative procedural changes. Enacts the Community College Aid Act. Specifies distribution of state aid appropriations among the six community college areas for 2013-14 and future fiscal years. Amends provisions relating to maximum property tax levy rates authorized to be levied by community college areas. Assigns certain duties to the Coordinating Commission for Postsecondary Education with respect to the Community College Aid Act and authorizes the Commission to adopt and promulgate related rules and regulations. Also creates the Nebraska Community College Student Performance and Occupational Education Grant Committee and sets membership. Gives this committee more authority in developing guidelines for grants and allows determination of allocation of funds (within certain parameters).

From bill summary: Authorizes the governing board of a community college district to change election systems in accordance with the provisions of this bill and the California Voting Rights Act of 2001, subject to approval by the Board of Governors of the California Community Colleges. Authorizes the governing board of a community college district to establish elections by trustee areas. In establishing trustee areas, the territory of a district must be divided into trustee areas, and one member of the governing board must be elected from each trustee area. A candidate for election as a member of the governing board is required to reside in, and be registered to vote in, the trustee area he/she seeks to represent. The governing board is authorized to set the initial boundaries of each trustee area to reflect the population enumerated in the most recent decennial federal census. Thereafter, the boundaries of trustee areas must be adjusted, abolished or rearranged as specified. Authorizes the governing board of a community college district to determine the number of trustees, and requires the governing board to be composed of 5 to 9 members. Authorizes the board to establish, abolish or adjust trustee areas and terms of office, as specified. Transparency and Efficiency
Requires each public institution of higher learning to maintain a transaction register that includes a complete record of all funds expended, from whatever source for whatever purpose. Provides that the register must be prominently posted on the institution's Internet website and made available for public viewing and downloading. Grants the State Board for Technical and Comprehensive Education the authority to employ and administer certain administrative efficiency provisions.

Comprehensive Human Resources System
Directs the State Budget and Control Board's State Office of Human Resources to participate with five representatives selected by the respective presidents of the public institutions of higher learning and technical colleges to represent all of the public institutions of higher learning and technical colleges to study, develop, and recommend a separate, comprehensive human resources system for the public institutions of higher learning and technical colleges. Provides that the recommendation must include, but not be limited to, prescription of a methodology to establish a uniform compensation and classification plan among the public institutions of higher learning and technical colleges.

Facility and Procurement
Defines "permanent improvement project" for institutions of higher learning and revises the procurement statutory provisions.

Public Vote for Tuition Change

NCSigned into law 06/2011Postsec.Requires the Commission on Workforce Development, acting as the lead agency, with the cooperation of other participating agencies, including but not limited to, the North Carolina Community College System, The University of North Carolina, and the North Carolina Independent Colleges and Universities to initiate the "No Adult Left Behind" Initiative (Initiative) geared toward achievement of major statewide workforce development goals. Provides that the Initiative may also include community-based nonprofit organizations that provide services or assistance in the areas of worker training, workforce development, and transitioning North Carolinians between industries in the current global labor market. Provides that the first goal of the Initiative is to increase dramatically to forty percent (40%) the percentage of North Carolinians who earn associate degrees, other two-year educational credentials, and baccalaureate degrees. Permits specific fields of study may be selected for the most intense efforts. Outlines an alternative process to convert a provisional community college district to an independent community college district. Allows a county to organize an independent community college district if the following requirements are met: (1) The county has operated a provisional community college for at least five years; (2) the provisional community college has an enrollment of at least 900 full-time equivalent student enrollment (FTSE) according to the latest audited student count; (3) the provisional community college holds a public meeting to discuss and hear testimony on the conversion to an independent community college district; (4) the board adopta s resultion to form a community college district; (5) the proposed community college district is seeking accreditation; and (5) the provisional community college district has maintained a regional accreditation and oversight relationship with another community college district until it is converted from a provisional district to an independent district. After the resolution to convert to an independent district is adopted, the board is permitted to call an election on a general election date to seek voter approval to increase the property tax levy. Once the voters approve the proposed tax levy, the board cannot submit another proposal in subsequent years. Requires the new alternatively-formed community college district to maintain a regional accreditation and oversight relationship with another community college district until it has reached the initial candidacy state of the accreditation process. Prohibits the community college districts formed by this resolution from receiving state equalization aid and specifies these districts should not be considered when calculating the base used to determine equalization aid to the other community college districts.

Outlines the distribution of Proposition 301 Workforce Development monies for alternatively formed community college districts as follows:
(1) For a new alternatively-formed district required to contract with another district for the purpose of accreditation, the FTSE of the new district is included in the FTSE of the contracting district. Monies generated from the additional FTSE must be used to provide services to students in the new district as approved by the district's governing board through its annual budget process; (2) foran alternatively-formed district that obtains initial candidacy status in its accreditation process, monies distributed based on FTSE will go directly to the alternatively-formed district. Requires the board to convene an advisory committee for the pilot project and report on specified progress by February 28, 2011. Requires that the report include estimated costs for full implementation of the centralized delivery and warehousing of assessment instruments, as well as the technical feasibility of expanding the pilot project, legislative changes needed, and the best model for providing ongoing funding for the pilot project. Requires the office of the Chancellor of the California Community Colleges, in developing the California Community Colleges Common Assessment, to use the existing test item banks created by the California State University and the K-12 system as part of the state's college readiness assessment. (B) Minimize the time and course work required to complete a baccalaureate degree

According to the higher education coordinating board's assistant commissioner for academic affairs and research, as cited in the August 7, 2009 Texas Register, the "establishment of conditions under which the approval of new academic and career technical/workforce associate degree programs, as well as approval of revision of existing academic and career technical/workforce associate degree programs is automatic, would permit public two-year colleges and the five public universities that are authorized to grant the associate degree to implement new degree programs much more quickly than is possible under the provisions of the current version of Chapter 9.

Amends rules related to associate degree programs. Amendment to Section 9.181 clarifies that rules apply not only to public community colleges, but also Texas State Technical College-Harlingen, and the Lamar State Colleges. Amendment to Section 9.183 adds language to stipulate that each academic associate degree must provide a clearly-articulated curriculum that can be associated with a discipline or field of study leading to a baccalaureate degree, and must be identified as such in the institution's program inventory. Section 9.183 as amended also permits a college to offer a specialized academic associate degree that incorporates a higher education coordinating board-approved statewide articulated transfer curriculum and a portion of the college's approved core curriculum if the coursework for both would total more than 66 SCH.

Expresses legislative intent to refine higher education reporting requirements to provide for more effective, manageable and transparent reporting by the higher education segments.

Requests that the University of California notify each high school's governing board of (1) the number of graduates who enrolled in the university in the previous year and the number of graduates who were required to take the entry level writing requirement and (2) the comparable numbers of all California high school graduates who enrolled in the university. Requests that the university of California report such information to the department of finance and the joint legislative budget committee. Establishes legislative intent that California State University (CSU) assess and report the entry-level proficiency of all first-time freshmen. Requires the CSU system to annually report to the legislature, by campus:
(1) The total number of regularly admitted and specially admitted first-time freshmen
(2) The proportion of regularly admitted and specially admitted first-time freshmen that are exempt from entry-level proficiency exams
(3) The proportion of regularly admitted and specially admitted first-time freshmen that become exempt through each of the approved alternatives
(4) The entry-level proficiency exam pass rates of regularly admitted and specially admitted first-time freshmen.

Directs the California State University to and requests that the University of California report annually to the legislature on specified components of their institutional financial aid programs for undergraduate, graduate and professional degree students, including the typical financial aid package for a typical dependent undergraduate student with a parent income of $20,000, $40,000, $60,000, $80,000 and $100,000.

Amends Section 66057 by establishing legislative intent that the University of California and the California State University accommodate enrollment growth by maximizing the utilization of existing instructional facilities during the summer term before building new classrooms and teaching laboratories. Also establishes legislative intent that the University of California and the California State University make requests for capital outlay funding for space for classrooms and class laboratories justified using legislatively approved utilization standards and a reasonable assumption of summer-term enrollment. Adds provisions related to five-year capital outlay for UC and CSU systems. Requests that the University of California and requires that California State University report annually to the legislature on summer enrollment counts and on efforts undertaken to increase summer enrollment.

Repeals 66352, "Task force on instruction in business ethics." Eliminates provision in 67312(b) that the California State University must and the University of California system may report on its efforts to serve students with disabilities (requirement that California Community Colleges submit such reports remains in place).

Adds Section 67501, which directs the California State University and California Community Colleges, and permits the University of California, to annually submit to the legislature a comprehensive five-year capital outlay plan that includes specifeid components. Requires five-year plans to be updated annually.

Adds Section 67502, which requests that the the Regents of the University of California provide the joint legislative budget committee and the department of finance with a summary of all instructional and research space in the university system. Specifies elements the summary must address. Requires the California State University to provide the joint legislative budget committee and the department of finance with a summary of all instructional and faculty office space in the university system.

Adds Section 67503, which requests that the Regents of the University of California, and requires California Community Colleges and the California State University, to annually report on the utilization of classrooms and teaching laboratories.

Adds Section 67504, which relates to the Long Range Development Plans (LRDPs) that each University of California campus and medical center periodically develops to guide physical development.

Repeals 71020, requiring the California Community Colleges Board of Governors every three years to develop and submit a diversity paper concerning its own membership.

Adds 92611.9, establishing legislative intent that the University of California carefully monitor the use and effects of the contracting of services at newly developed facilities. Requests that the UC system annually report to the fiscal committees of the legislature on specified provisions related to hiring and contracting.

Adds Chapter 10.5. Requires the grant application and award process to be as efficient as possible to encourage collaborative applications and shall include consideration of existing programs and facilities. Requires that the Commissioner of Higher Education study the interplay between the State University System and tribally controlled community colleges. Specifically, requires the commissioner to address ways in which the North Dakota university system as a whole and the individual campuses can better interact with tribally controlled community colleges through improved communication, collaboration, and relationship-building activities. In addition, the commissioner shall focus on ways in which tribally controlled community colleges can encourage American Indians to pursue options in higher education, thereby bringing economic benefit to their families and communities and ways in which the university system and the individual campuses can work with tribally controlled community colleges to provide tutoring, mentoring, and other types of assistance necessary to ensure that the retention rates and

Section 371.20.95(C): Directs the chancellor, in consultation with representatives of state community colleges, to conduct a study on the use of "success points" in allocating appropriations to community colleges in FY 2011. Requires the study to identify "success points" in the academic career of community college students and recommend a method to fund achievement of the success points beginning in FY 2011. Requires that the study be completed by April 15, 2010, and directs the chancellor to use the results of the study to recommend changes in the determination of the distribution of community college allocations beginning in FY 2011. Requires the chancellor to report any such formula changes to the Controlling Board by August 30, 2010.

Section 371.20.80(D)(1): Requires 5% of the FY 2011 appropriation for state-supported community colleges, state community colleges and technical colleges to be allocated to colleges in proportion to their share of college student success factors. Specifies that for this purpose, "student success factors" must include all measurable student outcomes that contribute to student achievement as determined by the chancellor of the board of regents, based on the recommendation of the aforementioned consultation. The bill implements some of the recommendations of the Florida College System Task Force and the State College Pilot Project. In particular, the bill:

1. Renames the Division of Community Colleges within the Department of Education as the Division of Florida College System;
- Defines the colleges' service areas.
- Authorizes a community college to change its name to include "college" or "state college" if it has been authorized to grant baccalaureate
degrees and has been accredited by the Southern Association of Colleges and Schools (SACS) to do so, or, alternatively, with
board-of-trustees and State Board of Education (SBE) approval.
- Requires the college to seek a statutory name change in the next regular legislative session following the college's name change.

2. Revises the primary mission of the community colleges (now "Florida colleges") to include upper level instruction and awarding
baccalaureate degrees as authorized by law.
- Provides that a separate and secondary mission of Florida colleges includes adult basic education, adult general education, adult
secondary education and General Educational Development test instruction.
- Requires colleges to maintain associate degree programs after receiving approval to offer a baccalaureate degree.

3. Requires Florida colleges that offer one or more baccalaureate degree programs to:
- Maintain its primary mission (i.e., responsibility for responding to community needs for postsecondary academic education and career
degree education and providing associate degrees that provide access to a university);
- Maintain an open-door admission policy for associate-level degree programs and workforce education programs;
- Continue to provide outreach to underserved populations;
- Continue to provide remedial education;
- Comply with all provisions of statewide articulation agreements relating to 2-year and 4-year public degree-granting institutions;
- Not award graduate credit; and
- Not participate in intercollegiate athletics beyond the 2-year level.

4. The Legislature intends that the primary responsibility of a Florida college, including a Florida college that offers baccalaureate degree
programs, continues to be the provision fo associate degrees that provide access to a university.

5. Provides initial approval of a baccalaureate degree by the SBE.
- Provides criteria for the evaluation of a baccalaureate degree proposal.
- Provides for exceptions from the requirement for SBE approval of baccalaureate degree programs.

Amends policies relating to review and evaluation of community college programs. Eliminates reference to opportunity for a college to request a review cycle longer than five years. Specifies that colleges must review student services and academic support programs (in addition to instructional programs), and that instructional, student services, and academic support programs must be evaluated at least once every five years.

Adds provision requiring each college to develop a schedule that shows when each program will be reviewed during each five-year cycle. Provides that occupational programs must be scheduled in the year following their inclusion in the ICCB follow-up study unless the college obtains an exception in writing from the Illinois Community College Board (ICCB). Requires the review of general education objectives of the academic programs to be scheduled annually, but allows this review to focus each year on areas specified by the Illinois Board of Higher Education and ICCB. Adds provision that the ICCB may request the college to include special reviews of programs identified as a result of state-level analyses, legislative resolutions, or Illinois Board of Higher Education policy studies. States that undergraduate tuition and fees for state university resident students are established within proviso in the General Appropriations Act or law. Requires each board of trustees to set university tuition and fees for graduate, graduate professional and nonresident students, although these may not exceed the average full-time tuition and fees for corresponding programs at member schools of the Association of American Universities. Bars the annual percentage increase in tuition and fees set by each board of trustees for students enrolled prior to the fall of 2005 from exceeding the legislature's annual percentage increase for resident undergraduate students. Requires at least 20 percent of the amount raised by tuition increases to be allocated by each university to need-based financial aid for students. Allows tuition and fees for for graduate, graduate professional, or nonresident students to exceed a cap set for undergraduate resident students.

Requires an undergraduate student to pay 75% over the in-state tuition rate for any credit hours exceeding 120 percent of the number of credit hours required to complete the student's degree program. Provides that a community college student who has earned the associate degree need not pay the full cost for a maximum of 24 hours taken while enrolled at a community college which apply to the student's baccalaureate degree. Provides that an undergraduate student at a state university or in a baccalaurate program at a community college must pay the higher rate for exceeding the aforementioned credit hour limit, regardless of whether those hours were taken while enrolled at a community college, a state university or any private postsecondary institution if the student received state funds while enrolled at the private postsecondary institution.

States that credit hours earned under the following circumstances are not calculated as hours required to earn a degree:
(a) College credits earned through an accelerated mechanism identified in s. 1007.27;
(b) Credit hours earned through internship programs;
(c) Credit hours required for certification, recertification, or certificate degrees;
(d) Credit hours in courses from which a student must withdraw due to reasons of medical or personal hardship;
(e) Credit hours taken by active-duty military personnel;
(f) Credit hours required to achieve a dual major undertaken while pursuing a degree;
(g) Remedial and English as a Second Language credit hours; and
(h) Credit hours earned in military science courses (R.O.T.C).

Requires postsecondary institutions to implement a process for notifying students regarding these requirements, which notice must be provided upon the student's initial enrollment in the institution and again upon the student's having earned the credit hours required to complete the degree program in which he or she is enrolled. Requires the notice to include a recommendation that each student who intends to earn credit hours at the institution beyond those required for his or her enrolled degree program meet with his or her academic advisor.

Establishes the California Postsecondary Education Commission (CPEC) for the collection of data pertinent to the planning and coordination of the higher education system of the state. Adds the California Postsecondary Education Accountability Act (CPSEA) of 2004 to the Donahoe Higher Education Act. Establishes a statewide CPSEA structure that would annually provide an assessment of the progress made by the state's system of postsecondary education in meeting the educational needs of California. Establishes statewide reporting system and requires annual reports. Requires the Postsecondary Education Commission to administer the postsecondary education accountability structure.

Existing law establishes a higher education accountability program under which the University of California, the California State University, and the California Community Colleges are required to prepare a list of reports on a regular basis to the Legislature and to state agencies. Under the program, commencing on November 15, 1994, and each November 15 thereafter, the CPEC is required to submit a higher education report to the Legislature and the Governor that provides information on significant indicators of the performance of the public colleges and universities.

To be eligible to receive a scholarship in the first year of enrollment at a county college, a student must have graduated in the top 20% of the student's high school class. To be eligible for a scholarship award after the first year of enrollment, a student must have ranked among the top 20% of all full-time students, commencing enrollment at the county college at the same time as the student did, who remained enrolled as full-time students at the completion of the student's initial year of enrollment (i.e., the student's full-time college freshman class cohort). Other eligibility criteria provided for in the bill are (i) being a State resident, (ii) having applied for all other available forms of State and federal need-based grants and merit scholarships, exclusive of loans, (iii) being enrolled in a minimum of 12 credit hours per semester, not including any credit hours in a remedial or developmental curriculum, (iv) having graduated from high school in 2004 or later, and not earlier than the calendar year two years prior to the first calendar year of scholarship payment, and (v) maintaining continuous enrollment in a full-time course of study, except for approved leave for medical reasons or family emergency. (i) ensure that secondary students in the public education system have access to applied
technology education in the regional applied technology college; and
(ii) prepare and submit an annual report to the Utah College of Applied Technology detailing:
(A) how the applied technology education needs of secondary students within the region are
being met; and
(B) what access secondary students within the region have to programs offered at applied
technology colleges.
(2) A regional applied technology college may offer a competency-based high school diploma
equivalent approved by the State Board of Education in accordance with Section 53A-1-402.
(3) A regional applied technology college may not:
(a) offer courses other than applied technology education;
(b) offer a degree other than a competency-based associate of applied technology degree
approved by the State Board of Regents in accordance with Section 53B-1-103;
(c) provide tenure or academic rank for its instructors; and
(d) participate in intercollegiate athletics.
(4) The mission of a regional applied technology college is limited to applied technology
education and may not expand to include credit-based academic programs typically offered by community colleges or other institutions of higher education.

In a special session called to address higher education issues, the general assembly passed legislation restructuring the governance of higher education and amended the second year of the 1997-1998 biennial budget for colleges and universities. Legislation sets goals for postsecondary education and creates the Council on Postsecondary Education to replace the existing Council on Higher Education. The new council is to provide direction and oversight to all higher education institutions. Duties include: developing a strategic plan with advice from the new Strategic Committee on Postsecondary Education(SCOPE); revising and approving college and university missions; preparing budget requests; developing and accountability system; ensuring coordination among institutions; and changing or eliminating academic programs. The members, appointed by the governor, are to include one faculty member, a student, the commissioner of education and 13 citizens that must be confirmed by the legislature. The legislation also creates the Kentucky Community and Technical College Systems (KCTCS) headed by a board of regents. The new systemn will be composed of two branches: the current University of Kentucky Community College System (with the exception of Lexington Community College, which will remain a part of UK) and the postsecondary technical schools that have been part of the Cabinet for Workforce Development. The 14 members of the new board of regents will include a faculty member; a non-teahcing personnel representative; two student members (one form the community colleges and one from the technical instititutions); and eight additional members appointed by the governor, four from a list of nominations from the UK turstees and four from recommendations submitted by the governor's postsecondary education nominating committee. The nominating committee is composed of seven members (one from each Supreme Court district) appointed by the governor with the consent of the legislature. The legislature amended the second year of the biennium by adding $40 million to the $797.5 million in the original 1997-98 budget for higher education, an increase of 5 percent. The newly-adopted budget is 8.6 percent higher than funding for 1996-97. College and university budgets will reach $791.4 million, 7.8 percent above prior year funding levels, including $99.2 million for community colleges (up 20.1 percent) and $692.2 million for four-year institutions, an increase of 6.3 percent. Faculty pay raises will be determined by institutional boards. Tuition increases will remain as originally adopted: In-state undergraduates will pay 2.6 percent more at doctoral institutions, 3.4 percent more at master's colleges and 2 percent more at community colleges.
Included in the higher education budget is initial funding for 4 of 7 new investments and incentive trust funds to advance the goals of postsecondary education: adult education and literacy ($2 million), regional university excellence ($6 million), research challenge ($6 million) and postsecondary workforce development ($3 million). The new Council on Postsecondary Education will establish the criteria for the allocation of these funds. The remaining three funds created are the technology initiative trust, physical facilities trust and the student financial aid trust.
The 1997-98 budget for elementary and secondary schools remains as originally adopted and total general funds will reach $2.5 billion, an increase of 3.1 percent. Funding for the SEEK formula will increase 2.7 percent to more than $2 billion. No funds were earmarked for teacher pay increases but language in the budget bill encourages districts to give raises of about $900. Other programs receiving increases include family resource and youth services centers ($39.6 million total, up 2.9 percent) and preschool services ($39.3 million, up 3.1 percent). Funding will continue at current levels for school rewards ($10 million), student assessment ($8.1 million), extended school services (34 million), professional development ($14.5 million) and educational technology ($20 million).
