NDSigned into law 05/2011P-12Provides that a teacher must notify the school principal if the teacher knows or has reason to believe that a student is using, is in possession of, or is delivering alcohol or a controlled substance while on school property, while involved in a school-related activity, or while in attendance at a school-sponsored event. However, the bill exempts teachers or administrators who participate in a juvenile drug court program and receive confidential information regarding a student as a result of that participation.

VASigned into law 02/2011P-12Requires the Department of Health to develop and administer a random survey of students in public middle and high schools to facilitate planning and implementation of effective programs for substance abuse prevention through collection of information identifying trends in alcohol, tobacco, and other drug use and the assessment of risk and protective factors among youth of the Commonwealth. The bill provides that a student shall not be required to participate if his parents refuse consent in writing prior to administration of the survey, and requires local school boards to develop policies for the notification of parents of students selected for participation in the survey.

MOSigned into law 06/2010P-12Requires regulations to be issued requiring contractors and subcontractors working on public works construction projects at public schools to establish and implement a random drug and alcohol testing program. The tests must be administered by a certified laboratory and must require notification to the employer and employee of the results of any positive drug and alcohol test. The school district must be notified of the action taken to protect the safety of the students as a result of a positive test. Cost of the program must be covered by the employer on the public works project.

WVSigned into law 03/2010P-12Implements the High School Graduation Improvement Act, which includes: (1) the continued exploration of diverse instructional delivery strategies to accommodate various learning styles that will focus on a statewide dropout intervention and prevention program to provide support for students having academic difficulties; (2) implementation of a statewide general credit recovery program; (3) improving the way career-technical education is offered; (4) creation of up to five additional juvenile drug courts; (5) investment of additional state funds and other resources in strategies and programs that engage disconnected and discouraged students in a positive learning environment, and; (6) development of plans by the various county boards that demonstrate how they will use available funds to implement the intent of the Act. ILSigned into law 08/2009P-12Repeals provision effective July 2011. Requires the Illinois High School Association to prohibit a student from participating in an association-sponsored or -sanctioned athletic competition unless:
(1) The student agrees not to use any performance-enhancing substances on the association's list and, if the student is in high school, submit to random drug testing
(2) The association receives a statement signed by the student's parent acknowledging specified language, including that a violation of state law concerning performance-enhancing substances is a criminal offense
punishable by confinement in jail or imprisonment.

Requires all coaches for high school extracurricular athletic activities sponsored or sanctioned by the association to complete an educational program on preventing the abuse of performance-enhancing substances, and to complete an exam on the topic. Directs the department of public health to provide oversight of the association's annual administration of a performance-enhancing substance testing program. Requires at least 1,000 high school athletes to be randomly tested each year, and for a trained observer of the appropriate sex to witness the student provide the test sample. Requires a period of ineligibility for any student whose test result is positive or who refuses to submit to random testing. Provides for the confidentiality of test results. Extends to public middle and high schools a requirement that under existing law applies to public elementary schools, which requires a school nurse, teacher, counselor, school psychologist or administrator to complete four hours of in-service training in the prevention of child abuse, violence and substance abuse, and in the promotion of positive youth development. Establishes a deadline of two years after the effective date of this amendment for the specified middle and high school employees to take the required four hours of in-service training. Allows districts and schools to adapt or adopt the curriculum developed by state department of education for the in-service training, as an alternative to the existing law requirement that each district or school develop its own curriculum. Directs districts and schools to incorporate training in school safety and violence prevention into their in-service training in the prevention of child abuse, violence and substance abuse, and the promotion of positive youth development.

UTSigned into law 03/2008P-12Amends the Human Services Code to requires a local substance abuse authority to ensure that all substance abuse treatment programs that receive public funds provide priority for admission to a pregnant minor. Requires a local substance abuse authority to provide a comprehensive referral for interim services to a pregnant minor who cannot be admitted for substance abuse treatment within 24 hours of the request for admission. Provides that, if a substance abuse treatment program is not able to accept and admit a pregnant minor within 48 hours of the time that request for admission is made, the local substance abuse authority must contact the Division of Substance Abuse and Mental Health, which must assist in providing services to the pregnant minor.

IDSigned into law 03/2007P-12Defines "teens at risk" as public school students in grades 7-12 who have been identified as expressing or exhibiting indications of depression, suicidal inclination, emotional trauma, substance abuse or other behaviors or symptoms that indicate the existence of, or that may lead to, the development of mental illness or substance abuse. Authorizes the department of health and welfare, the state department of education, the department of juvenile corrections, counties, courts and local school districts to collaborate in planning and developing mental health counseling, substance abuse treatment and recovery support services and individual service plans for teens at risk.

Creates new section creating a 3-year pilot teen early intervention mental health and substance abuse specialist program. Provides that teen early intervention specialists are to work with individual at-risk teens to offer group counseling, recovery support, suicide prevention and other mental health and substance abuse counseling services to teens as needed, regardless of mental health diagnosis. Provides that districts wishing to have a teen early intervention mental health and substance abuse specialist placed in the district may apply may apply to the department of health and welfare for such placement.

For 3-year period beginning at the start of the 2008 school year, directs the department of health and welfare to work with districts where teen early intervention specialists have been placed to gather data on the effectiveness of this program. Session Law Chapter 309

Requires the certified substance abuse counselor to be employed by a hospital or nonhospital facility providing substance abuse services. Requires the substance abuse assessment to evaluate the suitability for substance abuse treatment and placement in an appropriate treatment setting.

Provides that a teacher whose certificate has been suspended or revoked by the Education Professional Standards Board for illegal use of controlled substances must, as a condition of reinstatement or reissuance of the certificate, submit to drug testing in accordance with Education Professional Standards Board regulations.
