CASigned into law 09/2012Postsec.From bill summary: Enacts the Student Athlete Bill of Rights, pursuant to which, commencing with the 2013–14 academic year, intercollegiate athletic programs at 4-year institutions of higher education in the state that receive, as an average, $10,000,000 or more in annual revenue derived from media rights for intercollegiate athletics, are required to comply with prescribed requirements. Among other things, requires the institution of higher education to provide an equivalent scholarship to a student athlete if an athletic program does not renew the athletic scholarship of a student athlete who suffers an incapacitating injury or illness resulting from his/her participation in the athletic program, and the institution's medical staff determines that the student athlete is medically ineligible to participate in intercollegiate athletics, or if a student athlete on an athletic scholarship and in good standing exhausts his/her athletic eligibility, except for specified athletic programs.

Also requires that athletic programs that receive, as an average, $10,000,000 or more in annual revenue derived from media rights for intercollegiate athletics be responsible for paying the premiums of each of its student athletes whose household has an income and asset level that does not exceed the level for Cal Grant A recipients for insurance covering claims resulting from their participation in the athletic program, unless the student athlete declines the payment of premiums. Provides that the athletic program is responsible for paying the insurance deductible amount applicable to the claim of any student athlete who suffers an injury resulting from his/her participation in the athletic program and makes a claim relating to that injury. Requires the athletic program to provide, to a student athlete who suffers an injury resulting from participation in the athletic program and requires ongoing medical treatment, either the necessary medical treatment or health insurance that covers the injury and the resulting deductible amounts. Provides these provisions do not apply to preexisting medical conditions that predated the student athlete's participation in the athletic program.

Requires that the institutions of higher education to which these provisions relating to equivalent scholarships and insurance coverage apply rely exclusively on revenue derived from media rights for intercollegiate athletics to defray any costs accrued under these provisions. Requires the council to consult with and solicit input from various persons and groups, review existing state and local programs and policies on afterschool and out-of-school time programs and make recommendations to the departments of early, elementary and secondary and higher education. Requires the council to prepare and submit an annual progress report concerning the council's activities with appropriate recommendations concerning afterschool and out-of-school time programs.

HISigned into law 07/2012P-12Directs the department of education and the Hawaii High School Athletic Association to develop a concussion educational program that includes (1) educating specified stakeholders, including students, parents, and coaches, about the signs and symptoms of a concussion and procedures to follow in a suspected concussion; (2) annual educational sessions on concussions for coaches and athletic trainers; (3) mandatory removal from athletic activity for student demonstrating signs of a concussion; (4) need for licensed health provider to evaluate student and determine whether student may return to an athletic activity; (5) monitoring of student's return to physical activity by school's certified athletic trainer. Establishes guidelines for a high school concussion awareness program to be implemented in every Hawaii High School Athletic Association member high school (public and private). Directs the department of education to submit to the legislature no later than 20 days prior to the convening of the 2013 regular session on the development and

LASigned into law 06/2012P-12Prohibits an otherwise eligible student from being determined ineligible for participation in an extracurricular interscholastic athletic activity at the student's school if the student's transfer was necessitated by military orders issued to the student's parent or legal guardian, provided that all of specified conditions apply, including that the parent/guardian is a member of the uniformed services as defined in statute. MESigned into law 05/2012P-12The bill directs the Commissioner of Education to propose a model policy for public schools and private schools enrolling more than 60% of their students at public expense in this State on the management of concussive and other head injuries in school activities and athletics. The bill also accomplishes the following.1. It directs the commissioner to invite representatives of educational stakeholders and interested parties to participate in a working group that will meet during the spring and summer of 2012 to develop a model policy that addresses the prevention, diagnosis and treatment of concussive and other head injuries in students and student athletes.2. It provides that the model policy must include the following requirements: A. That athletic directors, coaches and other school personnel involved with school activities and athletics must be provided with training in the identification and management of concussive and other head injuries;B. That a student participating in a school athletic activity and the student's parent or legal guardian must review the school's policy on the management of concussive and other head injuries;C. That schools must use protocols and forms in the implementation of the policy on the management of concussive and other head injuries;D. That a student suspected of having sustained a concussive or other head injury in any activity or athletic practice or game must be removed from participation immediately and evaluated for brain injury prior to returning to the activity or practices and games; andE. That a student suspected of having sustained a concussion after an evaluation must be banned from further participation until the student has received written medical clearance from a licensed health care provider trained in concussion management for the student to begin the gradual resumption of participation in the activity or practices and games.3. It establishes that schools are required to adopt a policy on management of head injuries and begin implementation of the policy by January 1, 2013 and further provides that schools must gradually implement the policy during the 2012-2013 and 2013-2014 school years.4. Requires the Department of Health and the Department of Education to post on their websites guidelines and materials to inform and education student athletes, their coaches and others concerning the warning signs of sudden cardiac arrest. A participating student and the student's parent must sign a form acknowledging they have received and reviewed an informational sheet based on these guidelines. A student athlete who exhibits signs or symptoms of sudden cardia arrest must be removed from play and may not return to play until he or she is cleared to do so, in writing, by a licensed physician, certified registered nurse practitioner, or cardiologist.

FLSigned into law 04/2012P-12Requires independent sanctioning authorities for youth athletic teams and the Florida High School Athletic Association (FHSAA) to (1) adopt guidelines to educate coaches, youth athletes and their parents, and other stakeholders on the nature and risk of concussion and head injury, (2) adopt bylaws or policies requiring parents to sign an informed consent on the nature and risk of concussion and head injury, (3) adopt bylaws or policies requiring immediate removal from play of a student suspected of sustaining a concussion or head injury, and (4) prohibiting return to play until the student submits written medical clearance from an appropriate health care practitioner. Directs the FHSAA to adopt bylaws for the establishment and duties of a sports medicine advisory committee with specified membership.

Provides parameters for the forfeiture of contests due to eligibility or recruiting violations. Requires an expedited appeals process on determinations of ineligibility. Sections 2-4: Eliminates the requirement to administer criterion-referenced tests to students in grade 2. Directs the state board, before the October 2010 Education Interim Committee meeting, to present its plan for a pilot program for the 2010-11 and 2011-12 school years to (1) replace the 10th-grade basic skills competency test with computer adaptive testing of basic skills, and (2) administer the ACT exam to high school students. Directs the state board to implement such a pilot program during the 2010-11 and 2011-12 school years. Exempts districts and charter schools from administering the 10th-grade basic skills competency test during the the 2010-11 and 2011-12 school years. Directs the state board to re-direct the money saved by not administering the 10th-grade basic skills competency test to fund implementation of the pilot program during the 2010-11 and 2011-12 fiscal years. Exempts a student from the 10th-grade basic skills competency test requirement if the student was in 10th grade in the 2008-09 or 2009-10 school years and did not pass the competency test (10th-grade basic skills competency test functions as exit exam unless certain waivers apply).

Section 5: Exempts local boards from the requirement to develop and administer activity disclosure statements for high school-level extracurricular activities (as called for in Section 53A-3-420) until the 2012-13 school year.

Section 6: Exempts the state board, until the 2012-13 school year, from the requirements called for in Section 53A-3-602.5 to annually (1) develop a school performance report for schools, districts and charter schools, and (2) collect and electronically report specified performance data for schools, districts and charter schools.

Section 7: Exempts a school district from certain requirements related to the disposal of textbooks until the 2012-13 school year.

Section 8: Until the 2012-13 school year, releases districts from the requirement in Section 53A-13-107 that an annual presentation on adoption be given to students in grades 7-12.

Section 9: Until the 2012-13 school year, releases districts from the requirement in Section 53A-14-107 regarding alignment of primary instructional materials aligned with the core curriculum adopted under Section 53A-1-402.

Any person adjudicated, convicted, the subject of an informal adjustment or court approved juvenile diversion program, or the subject of a suspended imposition of sentence for possession, use, or distribution of controlled drugs or substances or marijuana as defined in chapter 22-42, or for ingesting, inhaling, or otherwise taking into the body any substances as prohibited by § 22-42-15, is ineligible to participate in any extracurricular activity at any secondary school accredited by the Department of Education for one calendar year from the date of adjudication, conviction, diversion, or suspended imposition of sentence. The one-year suspension may be reduced to sixty school days if the person participates in an assessment with a certified chemical dependency counselor or completes an accredited intensive prevention or treatment program. If the assessment indicates the need for a higher level of care, the student is required to complete the prescribed program before becoming eligible to participate in extracurricular activities. Upon a subsequent adjudication, conviction, diversion, or suspended imposition of sentence for possession, use, that person is ineligible to participate in any extracurricular
activity at any secondary school accredited by the Department of Education.
