Defines "information" for these purposes to include the pupil's actual test scores or grades, the percentile or range into which those test scores or grades fall, or any symbol, color, logo, or other device or emblem used to represent or convey any information about those test scores or grades. ILSigned into law 08/2012P-12Clarifies individuals and circumstances by which information surrounding a child's detainment under the Juvenile Court Act of 1987 may be used. Specifies such information may be used solely by school principal or officials determined to have a legitimate educational or safety interest. Also requires that for a school official to have access to a minor under 17's law enforcement records, the agency or officer must believe there is an imminent threat of physical harm to students, school personnel, or others present in the school or on school grounds. Extends violations under which law enforcement records are to be shared with the school district to include violations of (1) the Hazing Act and (2) the Harassing and Obscene Communications Act, among others. Provides that such law enforcement records must be separate from other school records and are not to become part of the student's official school record or public record. Permits a student to be referred to in-school or community based social services if available and determined in the child's best interest. Identifies approaches that may be applied as "rehabilitation services." Requires that information about a minor who is the subject of a current police investigation directly related to school safety be oral information only (not law enforcement records), and to be used only for safety and for the child's rehabilitation. DESigned into law 07/2012Postsec.Makes it unlawful for a public or nonpublic academic institution to mandate that a student or applicant disclose password or account information granting the academic institution access to the student's or applicant's social networking profile or account. Prohibits academic institutions from requesting that a student or applicant log onto their respective social networking site to provide the academic institution direct access to the student's or applicant's social networking site profile or account. Acknowledges that new technological advances in internet use and social networking require new approaches to protecting reasonable expectations of privacy in personal information.

COSigned into law 06/2012P-12Current law prohibits an employee of a school or school district from requiring a student to participate in a survey, analysis, or evaluation that addresses or requests certain information unless the student's parent provides written consent for the student's participation. This bill adds assessments to the documents for which parental consent is required. In addition to the existing list of information, the employee must obtain parental consent if the document requests a social security number or information concerning the student's or parent's religious beliefs or practices. For a parent's consent to be valid, the employee must make a written copy of the document available for inspection at convenient locations and times.

INSigned into law 03/2012P-12Requires an accredited nonpublic school to provide sufficient verbal information to permit a requesting school to which a child transfers to make an appropriate placement decision when the parent of the child is in breach of a contract that conditions release of student records on the payment of outstanding tuition and other fees.

Requires the state board of education to conduct a second count of students enrolled in school corporations and charter schools in February of each school year, with the first count being in September. Expires the school funding formula on July 1, 2013.

Transfers the appropriation and funding for charter school start-up grants to the appropriation for state tuition support. Increases the amount of the charter school start-up grant for charter schools that begin operation in calendar year 2012 and provides that the grant is to be paid in six installments with one installment in each of the last six months of calendar year 2012.

Specifies that the amount distributed as special grants to school corporations to reflect the savings resulting from the education of students under a choice scholarship rather than in a school corporation are limited only by the state fiscal year appropriation and not the calendar year cap that limits the amount of state tuition support payable in a calendar year. http://www.in.gov/legislative/bills/2012/HE/HE1189.1.html

MTSigned into law 03/2011P-12By November 1 and March 1 of each school fiscal year, districts are required to prepare a report for the director of the Montana youth challenge program containing the name, last-known address, and dates of attendance of a student who:
(i) is at least 16 years of age but less than 19 years of age;
(ii) was enrolled but is no longer enrolled in a school in the district;
(iii) has not provided school transfer or graduation information to a school in the district; and
(iv) has not received a high school diploma or general educational development certificate.
After preparing the report the local education agency is required to provide written notice to the parent or guardian or to the student if the student is at least 18 or is under 18 and emancipated that the agency intends to provide the report to the director
of the Montana youth challenge program. The parent or guardian or the student must be given the opportunity
to object to the planned disclosure of the information. If no objection is received, the report is supposed to be submitted.
(c) The report provided by the local educational agency may not include a student who:
(i) is receiving medical care or treatment that prohibits school attendance;
(ii) is enrolled in a foreign exchange program;(iii) is enrolled in an early admissions college program;
(iv) is participating in a job corps program, an adult basic education program, or an accredited
apprenticeship program; or (v) is excused from school for a reason determined acceptable by the local educational agency.
(d) The official to whom the information in subsection (8)(a) is provided shall certify in writing to the local
educational agency that is providing the information that the information will not be disclosed to any other party
except as necessary to recruit and retain students.

Authorizes the Illinois Mathematics and Science Academy to develop additional campuses throughout the state, but specifies that any additional campus does not need to serve as a residential institution. Abolishes the board of trustees of the Illinois Summer School for the Arts on the effective date of this legislation. Repeals 105 ILCS 420, the Council on Vocational Education Act and 105 ILCS 423, the Occupational Skill Standards Act. Eliminates provision requiring the state board of education's annual report on vocational education to include recommendations on programs and policies to overcome sex bias and sex stereotyping in vocational education programming and an assessment of the state's progress in achieving such goals prepared by the state vocational education sex equity coordinator pursuant to the Federal Vocational Education Law.

Requires a school enrolling a student to make a copy of the student's certified birth certificate and return the original to the person enrolling the child. Provides that once a school has received a certified copy of the child's birth certificate, the school need not request another such certified copy with respect to that child for any
other year in which the child is enrolled in that school.

KYSigned into law 04/2008P-12Requires any school or local board employee who knows or has cause to believe that a student has been the victim of a violation of any felony offense committed by another student on school premises, on school-sponsored transportation, or at a school-sponsored event to immediately cause an oral or written report to be made to the principal of the victim's school. Requires the principal to notify the parents when the student is involved in a reported incident. Specifies information the principal must file with the local school board and the local law enforcement agency or the Department of Kentucky State Police or the county attorney within 48 hours of the original report, and requires the agency receiving the report to investigate the matter referred to it. Provides immunity for reports made in good faith.

Requires districts to report and the statewide data collection system to include all incidents in which a student has been disciplined by the school for a serious incident, including the nature of the discipline, or charged criminally for specified offenses on school premises, on school-sponsored transportation or at school functions. Requires all data to be subject to the confidentiality provisions of the the state and federal Family Education Rights and Privacy Act (FERPA). Provides that parents must have the right to inspect or challenge personally identifiable student records as permitted under FERPA. Requires all data collected per these requirements on an individual student committing a reportable incident to be placed in the student's disciplinary record.

Requires the department of education to provide the office of education accountability and the education assessment and accountability review subcommittee with an annual statistical report of the number and types of incidents of: (1) Violence and assault against school employees and students; (2) Possession of guns or other deadly weapons on school property or at school functions; (3) Possession or use of alcohol, prescription drugs, or controlled substances on school property or at school functions; and (4) All incidents in which a student has been disciplined by the school for a serious incident, including the nature of the discipline, or charged criminally for specified violations on school grounds, on school-sponsored transportation, or at school functions. Requires that the report include all monthly data and cumulative data for each reporting year. Prohibits the report from containing information personally identifying any student.

Requires the department of education to distribute to all districts in every even-numbered year, beginning in 2008: (1) Statewide student discipline guidelines to ensure safe schools, including the definition of a serious incident for reporting purposes; (2) Recommendations designed to improve the learning environment and school climate, parental and community involvement in the schools, and student achievement; and (3) A model policy to implement reporting of student incidents, data collection, and harassment and intimidation provisions as required in this legislation. Requires each local board's code of acceptable student behavior and discipline to be updated at least every two years, with the first update being completed by November 30, 2008. Provides that each code must include:
1. Procedures for identifying, documenting, and reporting incidents of violations of the code and felony violations by any student against another student while on school premises, on school-sponsored transportation, or at a school-sponsored event
2. Procedures for investigating and responding to a complaint or a report of a violation of the code or of a felony incident on school grounds or at a school-sponsored event, including reporting incidents to the parents of the students involved
3. A strategy or method of protecting from retaliation a complainant or person reporting a violation of the code or a felony incident on school grounds or at a school-sponsored event
4. A process for informing students, parents, and school employees of the requirements of the code and enumerated other provisions, including training for school employees
5. Information regarding the consequences of violating the code specified reportable violations.

Provides that a student is guilty of harassment when the student, with intent to intimidate, harass, annoy or alarm another person, and while on school premises, on school-sponsored transportation, or at a school-sponsored event:
1. Damages or commits a theft of the property of another student
2. Substantially disrupts the operation of the school
3. Creates a hostile environment by means of any gestures, written communications, oral statements, or physical acts that a reasonable person under the circumstances should know would cause another student to suffer fear of physical harm, intimidation, humiliation or embarrassment.

Also provides that a student is guilty of "harassing communications" when, with intent to intimidate, harass, annoy, or alarm another person he or she communicates with or about another school student, anonymously or otherwise, by telephone, the Internet, telegraph, mail, or any other form of electronic or written communication in a manner which a reasonable person under the circumstances should know would cause the other student to suffer fear of physical harm, intimidation, humiliation or embarrassment, and which serves no purpose of legitimate communication.

Requires a preschool educational program, child care facility, or day care home or group day care home in which a missing person was enrolled to flag the person's record such that whenever a copy of or information regarding the record is requested, the entity is alerted to the fact that the record is that of a missing person. Directs the entity to immediately report to the department any request concerning flagged records or knowledge as to the whereabouts of any missing person. Upon notification by the department that the missing person has been recovered, directs the school or other entity to remove the flag from the person's record.

Amends the Social Security Number Protection Task Force Act. Places the task force within the office of the attorney general, and makes the attorney general responsible for administering the activities of the task force.

Requires the task force to explore the technical and procedural changes needed to implement a unique identification number system to replace the use of social security numbers. Directs the task force to identify other states and local governments that have implemented a unique identification number system, and to make recommendations and devise procedures for creating a statewide unique identification number program. Directs the task force to report its findings and recommendations to the governor, the attorney general, the secretary of state, and the general assembly by December 31, 2007.

Increases membership of the task force to include, among others, a member appointed by the executive director of the board of higher education, and a member representing school administrators, appointed by the state superintendent of education.

Provides that collegiate student editors of campus media are responsible for determining the news, opinions, feature content, and advertising content of

suppress protected free expression rights of collegiate student journalists and of collegiate student editors.

TNSigned into law 06/1994P-12This bill lowers the standard to conduct searches on school property from "probable cause" and "reasonable cause" to "reasonable suspicion". Such searches include lockers, cars in school parking lots - belonging to students and visitors, containers brought on school property by students and visitors, and the person of students and visitors. Search methods include metal detectors and drug dogs. Items to be sought in search include drugs, drug paraphernalia, weapons and explosives. (Legislative Summaries 1994)

UTSigned into law 06/1994P-12(Effective: 05/02/94) Requires school personnel to comply with protections provided for family and student privacy in the Family Educational Rights and Privacy Act enacted by the United States Congress while administering and operating all public school programs. The legislation requires each school district to enact policies which will protect family and student privacy. Protection policies include parental consent before administering psychological tests, and prohibition regarding inquiry or disclosure of that information.
